1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Legislative Findings and Intent. I Liheslatura finds that the 3 Department of Parks and Recreation needs assistance in the prevention of vandalism 4 at Guam's park facilities. The mission of the Parks Division of the department is to 5 provide clean, safe and attractive parks for the recreational and aesthetic enjoyment of island residents and visitors. Currently, Department of Parks and Recreation has three (3) Park Rangers to accomplish this mission.

I Liheslatura further finds that three (3) parks identified by the department frequently experience vandalism, including Matapang Beach Park in Tumon, Asan Memorial Beach Park in Asan, and Fort Soledad in Umatac. It is, therefore, the intent of I Liheslatura to reappropriate Twenty-Five Thousand Dollars ($25,000.00) from the budget of the Office of Vice Speaker Joanne M.S. Brown to the Department of Parks and Recreation to purchase, install and repair existing gates at the three (3) identified parks to curb crimes of vandalism.

Section 2. Deappropriation and Reappropriation. The sum of Twenty- Five Thousand Dollars ($25,000.00) is hereby deappropriated from the sums appropriated to I Liheslatura and reappropriated to the Department of Parks and Recreation for the purposes of purchasing, installing and repairing park entry gates leading to the following public parks and to purchase equipment, supplies and repair in the following amounts:

1. Matapang Beach Park Entry Gate and Perimeter Fencing $16,000

2. Asan Memorial Beach Park Entry Gate $ 3,500

3. Repair of the Fort Soledad Entry Gate $ 1,500

4. Equipment, supplies, and repair $ 4,000

TOTAL $25,000

21 Notwithstanding any other law or rule, the Fiscal Officer of I Liheslatura is 22 authorized to reduce the allotment to Vice Speaker Joanne M.S. The mission of the Parks 5 Division of the department is to provide clean, safe and attractive parks for the recreational 6 and aesthetic enjoyment of island residents and visitors. 9 I Lilzeslatura further finds that there are kthree parks identified by the department 10 that experience high volumes of vandalism, including Matapang Beach Park in Tumon, 11 Asan Memorial Beach Park in Asan, -h PA i:: E- and Fort Soledad 12 in Umatac. It is therefore the intent of I Liheslatura to deappropriate Twenty-Five Thousand 13 Dollars ($25,000.00) from the budget allotted to the Office of Vice Speaker Joanne M.S. 14 Brown, for the Department of Parks and Recreation to nurchase, install and repair existing 15 gates at the & three identified parks to curb crimes of vandalism.

COMMITTEE REPORT ON BILL NO. 209 (EC), as amended,

AN ACT TO APPROPRIATE TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) FROM THE FUNDS OF THE OFFICE OF VICE SPEAKER JOANNE M.S. BROWN TO THE DEPARTMENT OF PARKS AND RECREATION FOR THE INSTALLATION AND REPAIR OF ENTRY GATES AND EQUIPMENT AND SUPPLIES FOR T8 PUBLIC PARKS AROUND THE ISLAND. I - I. OVERVIEW The Executive Committee held a public hearing at 2:00 p.m. on January 17,2006 in the Public Hearing Room, I Liheslaturan GGhan. Public notice was given to all media (see facsimile confirmation page) on January 10 and January 16,2006. Notice was placed in the PDN on January 13, 16 and 17,2006.

11. SUMMARY OF TESTIMONY Individuals that appeared before the Committee to present oral and written testimony on the bill were as follows:

Tom Morrison, Director, Department of Parks & Recreation provided oral and written testimony in support of Bill No. 209 (EC). Mr. Morrison testified that the Gated Parks Program, initiated in 2003, has been instrumental in deterring and preventing vandalism of the island's public parks and facilities. He added that the proposed legislation will allow the department of move forward with protecting isolated parks which park rangers cannot secure at night. Concerns/Questions from committee and individuals who presented testimony:

Senator J. Won Pat asked if Asan Memorial Beach Park was under federal jurisdiction. Mr. Morrison clarified that the area adjacent to the memorial park was local property. It will cost about two-thousand dollars ($2,000) to install and construct a gate to prevent vandals from driving vehicles into the area and destroying property, he added.

Senator Won Pat asked the location of Apotguan Beach Park. It was stated that this is the park adjacent to Alupang Beach Towers. Speaker M. Forbes sought clarification on whether structures were recently

demolished in this area. Cynthia Jackson of the Department of Public Works stated restroom facilities were- - tom down because they were in violation of FEMA regulations.

Speaker Forbes said this park is popular with the community, and asked Ms. Jackson if she had any recommendations on how to restore its restroom facilities. Ms. Jackson said the Recovery Coordination Office is best suited to answer this question. Speaker Forbes then asked Mr. Morrison to probe into the Apotguon park's restroom reconstruction. Mr. Morrison said the parks department will monitor whether there is an increase in permit requests. Speaker Forbes said this was beside the point and reiterated the area's importance, and the lack of restroom facilities poses an inconvenience to the community. Senator Won Pat inquired with Mr. Morrison whether the department thought of entering into some form of partnership with the neighboring hotel. Mr. Morrison noted they have sent a letter to Alupang Beach Towers pertaining to this, but have not received a response.

Senator L. Kasperbauer asked if the word "restroom" should be omitted from the bill since there is no longer a facility, therefore, no need for security gates to be constructed. Mr. Morrison concurred, explaining that at the time the bill was written, the former parks administrator did not foresee the demolition of facilities.

Speaker Forbes asked if there were other parks with razed infrastructure, and whether it is a new policy of the parks department to tear down underutilized park facilities to deter vandals. Mr. Morrison responded that these areas do not serve the intended purposes and have become a haven for crime and vandalism, it is a 30- year-old problem due to poor planning. Speaker Forbes asked that the legislature and the community be notified of parks slated for closure. Mr. Morrison responded that this is made already public.

Vice Speaker Brown said if this is an issue for discussion, her committee can dialogue with the Department of Parks & Recreation. She noted that relative to Apotguon Point Park, the figures were provided by the parks department, and she and parks officials can work on necessary amendments to the legislation to address changes. She further inquired about updates specific to arrangements made between the government and the hotel adjacent to Matapang Beach Park in Tumon. Mr. Morrison stated that this is before the Office of the Attorney General and did not want to comment further.

Speaker Forbes said that the institution of barbequing at beaches or public parks - although seemingly insignificant - is important because it holds great social value. He explained that Tumon is catered to tourists, therefore, the island's public parks in other parts of the island are important to the community - this is why the Department of Parks and Recreation exists - to benefit the people and not just the parks.

111. FINDINGS AND RECOMMENDATION The Executive Committee finds that the intent of Bill No. 209 (EC) is to assist the Department of Parks and Recreation in its efforts to protect the island's public parks from acts of vandalism and other crimes.

I Liheslatura further finds that money, which will be provided through funds from the Office of Vice Speaker Joanne M.S. Brown, will assist the Department of Parks and Recreation with its Gated Parks Program to protect the island's public parks and facilities, so that the community may be able to enjoy and benefit from their use during recreational and social gatherings.

Hafa Adai! The Department of Parks and Recreation (DPR) is in fill support of the referenced bill which would provide funding for the repair and installation of entry gates at various park facilities throughout the island. The incorporation of park entry gates into our existing park system continues to be instrumental in the deterrence of vandalism.

The newly expanded Territorial Park Patrol Program, in combination with the gated park system has proved effective in our mission to provide clean, safe, and attractive park and recreational facilities for our island residents and visitors alike. AN ACT TO APPROPRIATE TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) FROM THE FUNDS OF THE OFFICE OF VICE SPEAKER JOANNE M.S. BROWN TO THE DEPARTMENT OF PARKS AND RECREATION FOR THE INSTALLATION AND REPAIR OF ENTRY GATES TO PUBLIC PARKS AROUND THE ISLAND.

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Legislative Findings and Intent. I Liheslatura finds that the 3 Department of Parks and Recreation needs assistance in the prevention of 4 vandalism to Guam's park facilities. The mission of the Parks Division of the 5 department is to provide clean, safe and attractive parks for the recreational 6 and aesthetic enjoyment of island residents and visitors. Currently, 7 Department of Parks and Recreation has three Park Rangers to accomplish 8 this mission.

9 I Liheslatura further finds that there are four parks identified by the 10 department that experience high volumes of vandalism, including Matapang 11 Beach Park in Tumon, Asan Memorial Beach Park in Asan, Apotguan Beach * d) I 8 1 Park in East Agana, and Fort Soledad in Umatac. It is therefore the intent of I 2 Likeslatura to deappropriate Twenty-Five Thousand Dollars ($25,000.00) from 3 the budget of the Office of Vice Speaker Joanne M.S. Brown, for the 4 Department of Parks and Recreation to purchase, install and repair gates at , the four identified parks to curb vandalism.

Section 2. Deappropriation and Reappropriation. The sum of Twenty-Five Thousand Dollars ($25,000.00) is hereby deappropriated from the sums appropriated to 1 Likeslatura and reappropriated to the Department of Parks and Recreation for the sole purpose of purchasing, installing and repairing of entry gates leading to the following public parks in the following amounts:

1. Matapang Beach Entry Gate And Perimeter Fencing: $16,000 2. Asan Memorial Beach Park Entry Gate $3,500 3. Restroom Security Gate for Apotguan Beach Park $4,000 4. Repair of the Fort Soledad Entrv Gate $1,500 TOTAL $25,000

Notwithstanding any other law or rule, the Fiscal Officer of I Likeslatura is authorized to reduce the allotment to Vice Speaker Joanne M.S. Brown by an amount equal to the sum deappropriated by this section.

Section 3. Reporting. The Director of the Department of Parks and Recreation shall submit a written report regarding the expenditure of this appropriation to I Likeslatura after the funds have been expended. No portion of this appropriation shall be used for purposes other than that specifically defined in Section 2 of this act.
