TERMS OF REFERENCE (Individual Contractor Agreement)

Title: Good Governance Expert (On-call) Project: European Partnership with Municipalities Programme – EU PROGRES Duty station: Home-based, with frequent travel to South and South West Contract/Level: LICA 6 Duration: maximum of 100 working days commencing in May 2012 for a 10 months period Supervisor: EU PROGRES Component 1 Manager

I. General Background of Project / Assignment

The European Partnership with Municipalities Programme (EU PROGRES) is a joint action of the European Union, the Government of Switzerland and the Government of Serbia, designed to enhance stability and socio-economic development in the South and South West Serbia. In a holistic manner, EU PROGRES will endeavour to accelerate growth and improve the overall conditions in the Programme Area. The United Nations Office for Project Services (UNOPS) has been granted an initial budget of EUR 18,1 million for the Programme, which should be implemented in a timeframe of three years, starting in mid- 2010.

EU PROGRES activities are divided into four components, and the Programme is expected to deliver eight results, as follows:

Component 1: Good Governance (a cross cutting theme underpinning all components) Result 1: Participatory, accountable and transparent governance, respecting human rights

Component 2: Municipal Management and Development Planning Result 2: Municipal organizational effectiveness and efficiency improved and capacities to deliver services to citizens and business increased Result 3: Capacities for planning municipal and regional sustainable development strengthened and relevant development documents created

Component 3: Physical, Economic and Social infrastructure Result 4: Projects and project documentation prepared for key economic, environmental and social projects Result 5: Project financing facilitated through enabling contacts with ministries, donors and other projects Result 6: Selected projects financed and implemented through EU PROGRES

Component 4: Public Awareness and Branding of Areas Result 7: Awareness of the need for, the logic of, and the effects of changes communicated to a broad public Result 8: A plan to develop the areas’ images and self-images as unique areas of Europe are established and implementation begun. Direct beneficiaries of all activities are the twenty five municipal administrations (including city councils, and assemblies) taking part in the EU PROGRES: • , Nova Varoš, , , , Raška, , and Tutin in the South West • , Žitorađa, Kuršumlija, in the Toplički district • , , , , Medveđa, , , , Vladičin Han, , Preševo, , Trgovište in the South Serbia.

Other beneficiaries include municipality-founded institutions and public utility companies, civil society organisations (CSO) and media in the participating municipalities. However, the ultimate beneficiaries are the inhabitants of the South and South West Serbia.

II. Introduction

One of the inherent characteristic of EU PROGRES is its approach to providing support to local self- governments: rather than focusing only to delivering technical assistance or to providing funds necessary for resolving infrastructural problems at local levels, the Programme uses these as entry points for addressing some more pressing and important issues, such as improvements in quality of public sector and services, both locally and nationally.

This in other words means to initiate introduction of good governance, its concept and principles in everyday work of the said public sector.

The Programme is addressing this through following specific activities which may be described as Good Governance as a Cross-cutting Aspect of the Programme:

1) LINKING SMALL INFRASTRUCTURE PROJECTS WITH GOOD GOVERNANCE: The core idea of this activity is to use a specific infrastructure project as a prelude for analysis of related local regulatory framework and (re)defining the same through hypostatizing identified dominant good governance principle, linked to the project in matter.

2) LINKING LARGE INFRASTRUCTURE PROJECTS WITH GOOD GOVERNANCE: The challenge from the previous is here amplified with introduction of more than one local and/or (inter)national actor. Typically, implementation of these projects involves two or more municipalities and at least one Ministry, and sometimes other donors and IOs as well. The task is similar to the above, with special considerations directed to much more complex structure of project processes and organization.

3) OFFERING SUPPORT FOR PURE GOVERNANCE REFORMS: The Programme will be carrying out activities related to this line in at least one municipality, assessed and deemed as fit for the introduction of “pure good governance reforms”.

4) COLLECTING AND COMMUNICATING INFORMATION RE GG “VERTICAL DIMENSION”: This activity relates to consistent and systematic collection of all information related to governance issues concerning so- called “Vertical dimension”, which means relationship of local governments, local public organisations and institutions and the State. The core idea of this activity is to make a relevant Page 2 of 5

inventory of the said and to communicate found issues to the State, with the intention to support positive change.

III. Purpose and Scope of Assignment

Under the supervision of EU PROGRES Component 1 Manager, and an overall supervision of the Programme’s Deputy Programme Manager, the Good Governance Expert will undertake the following tasks/duties:

• Provide expert support in linking Good Governance, its concept, the principles and best practices to EU PROGRES funded municipal small infrastructure projects, in Serbian context • Provide expert support in linking Good Governance, its concept, the principles and best practices to EU PROGRES funded inter-municipal infrastructure projects, in Serbian context • Provide expert support in linking Good Governance, its concept, the principles and best practices to a governance reform in one municipality in the Programme AoR, in Serbian context • Provide expert support and advices, in accordance to the Programme plans and goals, to local governments’ for improving and streamlining administrative procedures and systems for efficient and effective delivery of public services • Provide expert advices on policy experiences of EU PROGRES supported infrastructure projects, ensuring their usability both horizontally (by other municipalities in the country) and vertically (by policy-makers at the national level) • Conceptualize and write final papers/documents on the processes carried on within the above mentioned activates that will contribute to the clients’ (including the central level) knowledge base on the subject • Communicate the European values and Good Governance concept and its principles to all involved in processes • Contribute to development of public policies, practices and documents that are enhancing good governance and are related to EU PROGRES supported infrastructure projects • Perform other related expertise tasks assigned by the supervisor

IV Methodology

The process will entail a combination of comprehensive desk reviews and document analysis, and frequent field visits, and consultations with key stakeholders, including the government partners. The expert will be expected to provide relevant assistance to the recipients, including written contributions, as per need and the work plan.

The detailed methodology should be elaborated and agreed with EU PROGRES in advance.

The above stated specific duties and responsibilities are to be performed and results completed over the period between May 2012 and March 2013 in accordance with the EU PROGRES Work Plan and timelines set by the Component 1 Manager and DPM. All Final Products must be completed, submitted and endorsed by EU PROGRES Programme Manager before February 28th 2013.

VI Monitoring and EU PROGRES Controls

Services completed within agreed timeframe. Written monthly reports to EU PROGRES structured by the tasks stated in the work plan. Timely submission of specific written papers on the process of introduction of good governance practices in the municipalities, produced during the engagement period.

VII Final Product

Written reports in a booklet quality on linking small and inter-municipal infrastructure projects with Good Governance, the governance reform in an LSG and experiences from analysing links and relations between the LSGs and the central government, containing relevant analysis of the process(es), best practices, conclusions and recommendations for the clients. Preparation and submission of final compendiums according to the work plan and based on the above cited papers, ready for publishing.

VIII Qualifications and Experience

. Master degree (or Bachelor’s degree plus two additional years of work relevant experience) in public administration, law, and/or human rights or related fields • At least 7 years of relevant professional experience in dealing with Good Governance issues and LSGs • Understanding the concept of Good Governance and an ability to communicate the benefits of complying with the processes of governance • Experience in developing and writing concept papers • Understanding the relations between Good Governance and pro- economic growth • Working experience with International Organizations • Experience with EC and an understanding of EC Visibility requirements highly desirable • Computer literacy: MSWord, Excel and Access • Strong drafting skills, excellent presentation and facilitation skills • Ability to work independently and as part of a team

• Effective communication and interpersonal skills • Driving skills and a clean driving licence with the ability to travel independently • Serbian as mother tongue. Fluency of written and spoken English language. IX Key Competencies
