ARRANGEMENT OF REGULATIONS.

Regulation 1. Citation 2. Designation of bus stops

SCHEDULE

1. These Regulations may be cited as the Transport (Bus Stops) Regulations 2004.

Designation of bus stops.

2.(1) The places specified in the Schedule as demarcated with coloured paint on the ground or by means of traffic signs are designated as bus stops for purposes relating to the principal Act.

(2) It shall be an offence for a person to wait with or park any vehicle at a designated bus stop, other than a bus which is operating a bus service on a specified route in Gibraltar under a licence from the Transport Commission.

(3) A person guilty of an offence contrary to sub-regulation (2) shall be liable on summary conviction to a fine at level 1 on the standard scale.

(4) Where a police officer or traffic warden has reasonable cause to believe that an offence contrary to subregulation (2) has been committed, he may give the person in charge of the vehicle concerned a notice in writing or affix a notice to the vehicle (as the case may be) offering the opportunity of the discharge of any liability to conviction of that offence by payment of a fixed penalty of £100.

(5) Proceedings shall not be commenced against a person for an offence under subregulation (2) if the fixed penalty is paid to the Clerk of the Magistrates’ Court before the expiration of fourteen days following the date of the notice or such longer period (if any) as may be specified therein or before the date on which proceedings are begun whichever event occurs last.

(6) Where a person is given a notice under subregulation (4) in respect of an offence, proceedings shall not be taken against any person for that offence until the end of the fourteen days following the date of the service of the notice or that day after posting such notice or such longer period (if any) as may have been specified therein.
