resources; to provide for the acquisition of land; to provide for

the development of public recreation facilities; to provide for

the powers and duties of certain state agencies and officials;

and to provide for the expenditure of appropriations. THE PEOPLE OF THE STATE OF ENACT: 1 Sec. 1. There is appropriated for the department of natural 2 resources to supplement former appropriations for the fiscal year 3 ending September 30, 1992, the sum of $15,501,900.00 for land 4 acquisition and grants and $5,167,300.00 for public recreation

5 facility development and grants as provided in section 35 of

6 article IX of the state constitution of 1963 and the Michigan

7 natural resources trust fund act, Act No. 101 of the Public Acts

8 of 1985, being sections 318.501 to 318.516 of the Michigan

9 Compiled Laws, from the following funds:

20 Community Park, Oakland County 21 Sec. 3. The department of natural resources shall enter

22 into agreements with local units of government for the purpose of

23 administering the grants identified in section 1. Among other

24 provisions, the agreements shall require that grant recipients

25 agree to dedicate to public recreation uses in perpetuity the

26 lands acquired; to replace lands converted or lost to other than

27 public recreation use; and to convey to the state any mineral

05565'92 26 1 interests acquired by the grant recipient with an exception

2 allowed for a share of the mineral interests acquired, which

3 share is based on the portion of the fair market value of the

4 property that was provided by the local cash contribution of the

5 grant recipient. The agreements shall also provide that full

6 payments of grants be made only after proof of acquisition is

7 submitted by the grant recipient and all costs are verified by

8 the department of natural resources.

9 Sec. 4. The department of natural resources shall take 10 steps necessary to make available federal or other funds that may

11 become available for the purpose for which appropriations are

12 made in section 1, and to use any or all of the appropriations to

13 meet matching requirements which are determined to be in the best

14 interest of the state.

15 Sec. 5. Any unobligated balance in any appropriation made 16 under section 1 shall not revert to the fund from which appropri-

17 ated at the close of the fiscal year, but shall continue until 18 the purpose for which it was appropriated is completed. The 19 unexpended balance of any appropriation made in section 1 remain- 20 ing after the purpose for whidh, it was appropriated is completed

21 shall revert to the Michigan natural resources trust fund and be

22 made available for appropriation.

23 Sec. 6. If a person or organization has acquired an option

24 on a parcel of property prior to final determination by the

25 department of natural resources and the Michigan natural

26 resources trust fund board, the property shall not be considered

27 for acquisition unless the department and board can demonstrate

05565*92 27 1 that a clear recreational advantage exists in obtaining the 2 parcel of property for the people of the state at a reasonable

3 fair market value. 4 Sec. 7. As required by section 4(3) of the Michigan natural

5 resources trust fund act, Act No. 101 of the Public Acts of 1985,

6 being section 318.504 of the Michigan Compiled Laws, the

7 grants-in-aid to local units of government shall be awarded pur-

8 suant to this act. 9 Sec. 8. The appropriation in section 1 (Priority No. 41)

10 for various water access sites land acquisition (#91-001) shall

11 not be expended for land acquisition on a lake not specifically

12 identified.
