1.0 INTRODUCTION Amec Foster Wheeler Environment & Infrastructure, a division of Amec Foster Wheeler Americas Limited, under subcontract to Macaulay Shiomi Howson (MSH), has been retained by the City of Mississauga and the Region of Peel (Peel) to provide professional and technical services for the Ninth Line Lands Secondary Plan Study to establish a Regional and Municipal planning framework for the Ninth Line Lands for future growth and development. As part of the overall study, and in response to a request for further information from Peel (dated March 16, 2016), the objective of this report is to provide a summary of findings specific to the Agricultural Impact Assessment (AIA) for the Ninth Line Lands. Findings summarized herein include an assessment of soils in the subject lands for Agricultural Capability Classification according to Canada Land Inventory (CLI) and the assessment of livestock facilities located on adjacent agricultural properties to determine minimum separation distances. 2.0 SUBJECT AND ADJACENT LANDS The subject lands border the northwest corner of the City of Mississauga, Region of Peel, in a strip of land approximately 9 km long by about 0.35 km wide with an area of 307 ha (+/-) between Highway 407 and the Ninth Line running roughly northwest to southeast from Highway 401 to Highway 403 (ref. Figure 1). Based on visual observations the subject lands were used for agricultural crop production (possibly including pasture and forage production) in recent years but all agricultural activities appear to have been discontinued and the land is not currently used for any obvious purpose. Based on the Peel Region Official Plan (Region of Peel, 2014): “On January 1, 2010 the lands between Ninth Line and Highway 407 (the Ninth Line Lands) became part of the City of Mississauga and the Region of Peel. These lands are identified in the Region of Halton Official Plan as the Ninth Line Corridor Policy Area. Currently, the policies of the Region of Halton and the Town of Milton Official Plans apply to these lands. The policies of the Region of Peel Official Plan do not apply to these lands and a future amendment will bring these lands into conformity with the Region of Peel Official Plan.” Based on the Mississauga Official Plan (City of Mississauga, 2016) and the Planning Act (Ontario Ministry of Municipal Affairs and Housing, 1990) the Ninth Line Lands are designated a Special Study Area: “Lands west of Ninth Line will be subject to the Town of Milton and Region of Halton Official Plans in effect as of January 1, 2010, until such time as they are incorporated into this [Mississauga Official] Plan”.

Lands adjacent to the subject lands northeast of the Ninth Line within the City of Mississauga are primarily residential made up of a mixture of various housing densities (Figure 1). Exceptions are the lands northwest of the St. Lawrence & Hudson rail tracks and lands southeast of Eglington Ave. West which are designated “Business Employment”, as defined in the Mississauga Official Plan (2016).

Lands adjacent to the subject lands on the southwest side of the Highway 407 corridor are part of the Town of Milton. These lands are primarily mixed use including rural residential, agricultural crop land, and some small scale and hobby livestock facilities. Recently some tracts have been developed for industrial use.

3.0 APPROACH AND ASSUMPTIONS Under the Planning Act (2014), prime agricultural areas are protected for long-term agricultural use. Prime agricultural areas used in the production of specialty crops shall be given the highest priority for protection, followed by Class 1, 2 and 3 soils, in order of priority. In Ontario, specialty crops include (but are not limited to) ethnic vegetables, hops, sweet potatoes, specialty fruits (e.g., edible blue honeysuckle, goji berry, sea buckthorn), culinary and medicinal herbs and plants for industrial uses (e.g. biomass crops, fibre hemp). Prime agricultural soils (Class 1, 2 and 3 soils) are identified as described in the Canada Land Inventory (CLI) documentation (Environment Canada, 1972; Agriculture and Agri-Food Canada, 2009). Planning authorities shall designate prime agricultural areas and specialty crop areas in accordance with the guidelines developed by the Province.

A planning authority may identify a settlement area or allow the expansion of a settlement area boundary only at the time of a comprehensive review and only where it has been demonstrated that in prime agricultural areas:

Ź The lands do not comprise specialty crop areas; Ź There are no reasonable alternatives which avoid prime agricultural areas; and, Ź There are no reasonable alternatives on lower priority agricultural lands in prime agricultural areas; and impacts from new or expanding settlement areas on agricultural operations located adjacent or close to the settlement area are mitigated to the extent feasible. 3.1 Agricultural Capability Classification For the purposes of the this study, the subject lands were assessed for their Agricultural Capability Classification (Environment Canada, 1972; Agriculture and Agri-Food Canada, 2009) according to the Canada Land Inventory (CLI) using available soil survey information from Agriculture and Agri-Food Canada (2009), supplemented with on-site inspections where possible. Agricultural Capability Classification ratings range from Class 1 to Class 7 where Class 1, 2 and 3 lands correspond to prime agricultural lands; Class 4, 5 and 6 are classified as marginal agricultural lands; and Class 7 land is unsuitable for agriculture. 3.2 Minimum Distance Separation The Minimum Distance Separation (MDS) approach is a land use procedural tool intended to minimize nuisance complaints due to odour and thereby reduce potential land use conflicts. The MDS approach does not account for other potential nuisance issues such as noise and dust. This is a two-way approach used for the separation of livestock facilities from non-compatible land uses (e.g., housing) and vice-versa. The Minimum Distance Separation I (MDS I) formula was established to estimate the minimum separation distances between proposed new development and existing livestock facilities and/or permanent manure storages. The Minimum Distance Separation II (MDS II) formula was developed to determine the minimum separation distances between proposed new, enlarged or remodeled livestock facilities and/or permanent manure storages and other existing or approved developments.

For the purposes of this assessment, the MDS I formula was applied according to OMAFRA (2006) guidelines. Site visits and on-site interviews were performed to assess the suitability and current use of livestock facilities located within a 2 km distance from all sides of the subject lands. A 2 km perimeter distance was assumed based on a Type B land use anticipated for the subject lands (i.e., high intensity commercial or settlement areas). Calculations were based on maximum potential livestock housing capacity from estimated areas of the facilities or maximum tillable acreage associated with the facility. For empty facilities, calculations were completed assuming worst case conditions (maximum capacity) using beef cattle as the default livestock.

4.0 RESULTS 4.1 Agricultural Capability Classification Based on the review of available data from Agriculture and Agri-Food Canada (2009) which is taken directly from the soil survey report for the County of Peel (Gillespie, et al., 1967), the subject lands contain soils classified as four soil series: Chinguacousy, Jeddo, Tuscola, and Onida developed on till or water deposited sediments. All lands within the subject area [total 307 ha (+/-) = 759 acres (+/-)] are classified as prime land for agricultural production. The locations for each soil series, as mapped, are provided in Figure 1. According to the CLI rating system (Agriculture and Agri-Food Canada, 2009), the Chinguacousy, Tuscola, and Onida series are Class 1 agricultural lands. The Jeddo series are classified as 3DW limited due to poor drainage. Specialty crops were not observed on any of the subject lands.

The areas and characteristics for each soil series are summarized in Table 1. Most (262 ha or 85%) of the subject lands are classified as Class 1 (prime) agricultural land which is excellent for farming and crop production. The remaining 15% (45 ha) is mapped as Jeddo series and classified as Class 3DW land. Jeddo soils are also considered prime agricultural land, as their limitation (restricted drainage) is typically rectified with the installation of subsurface drains. 4.2 Minimum Distance Separation Calculations Based on a review of satellite imagery from Google EarthTM, and on-site interviews with land owners and tenants, it was determined that a total of 14 viable livestock facilities occur within 2 km of the perimeter of the subject lands (Figure 2). All livestock facilities are located either north of the 401 (Esquesing Township, Town of ); west of Highway 407 (Trafalgar Township, Town of Milton); or south of Highway 403 (Trafalgar Township, Town of Oakville). The facilities included five (5) livestock facilities currently in operation and nine (9) empty facilities. Four of the five operating facilities had permanent solid manure storage facilities. Other buildings and structures identified as possible livestock facilities during the review of the satellite imagery were found during on-site inspections to be either structurally unsound or deemed unsuitable for housing livestock. Facilities found not suitable for housing livestock were assumed to have no future potential as a source of odour and therefore are not addressed further in this report.

Calculated setback distances (Factor F) based on MDS I formulae for each livestock facility located 2 km from the perimeter of the subject lands are summarized in Table 2 and shown graphically in Figure 2. Based on the data collected on-site and/or worse case assumptions for empty facilities, set back distances, as calculated using the MDS I formulae, ranged from 197 to 547 m. All areas within setback distances from the facilities did not infringe on the subject lands.

5.0 CONCLUSIONS AND RECOMMENDATIONS The following are based on the foregoing:

i. All soils in the subject lands are classified as prime agricultural lands with 85% being Class 1 land (Chinguacousy, Tuscola, and Onida series) and 15% being Class 3DW land (Jeddo series) limited for agricultural production by poor drainage. Specialty crops were not observed on any of the subject lands. Development of the subject lands according to the Regional Official Plan will permanently remove all 307 ha (+/-) of prime agricultural land in the subject lands from food production; however, there appears to be no reasonable alternatives to avoid these prime agricultural areas given the continuous orientation of the lands in relationships to the adjacent urban form. ii. Calculated setback distances based on MDS I formulae for livestock facilities within 2 km of the perimeter, south west and north of the subject lands, ranged from 197 to 547 m; however, all areas within setback distances from the facilities did not overlap with the subject lands. Based on the calculated distances, it is anticipated that livestock operations in adjacent areas are not expected to impact on development and expansion in the subject lands. iii. Development and expansion into the subject lands will limit expansion of potential livestock operations on adjacent agricultural lands. The extent of potential expansion of existing or new livestock facilities would have to be based on MDS II formulae under current provincial legislation. Potential effects, if any, on adjacent lands could be reduced by restricting expansion into the subject lands to Type A (low intensity) applications. iv. The existing Highway 407 corridor is expected to act as a buffer between the subject lands and adjacent agricultural areas within the Town of Milton to the southwest. The setback provided by the Highway 407 corridor (at least 100 m) overshadows the need for typical mitigation measures such as buffer mounds or tree barriers. From a strict agricultural perspective such mitigation measures would not be necessary. Recommendations for mitigation measures along the subject lands or the adjacent agricultural areas with respect to any influences by the Highway 407 corridor itself are outside of this scope of work. v. It should be noted that consideration should be given to any potential changes to water quality and quantity as part of storm water management measures to mitigate potential influences on water runoff used for the adjacent agricultural production (i.e., irrigation and farm animal consumption).
