The Central Sector is serviced by the Joint Utilities Board (JUB) Lagoon Systems co-owned by the City of Duncan and the Municipality of North Cowichan, and also provides service to properties within parts of CVRD Electoral Areas D and E and parts of Cowichan Tribes reserve. The Joint Utilities Board (JUB) sewage treatment lagoons are located adjacent to the Cowichan River. The aerated lagoon treatment system produces secondary quality effluent, which is disinfected by chlorination, then dechlorinated. Treated wastewater is discharged into the lower reaches of the Cowichan River and subsequently to the Cowichan Estuary and ocean environment. In recent years, low flows in the Cowichan River have resulted in a situation where there is insufficient dilution of the effluent plume with respect to the river flow. This resulted in the temporary closure of the Cowichan River to recreational activities in August of 2014. It is proposed that the point of discharge be moved from the Cowichan River to the marine environment of Satellite Channel, where significantly more dilution can be achieved and where the likelihood of interaction between the effluent plume and sensitive areas can be reduced. -

January 2005 Citation: KVRI Burbot Committee. 2005. Kootenai River/Kootenay Lake Conservation Strategy. Prepared by the Kootenai Tribe of Idaho with assistance from S. P. Cramer and Associates. 77 pp. plus appendices. Conservation strategies delineate reasonable actions that are believed necessary to protect, rehabilitate, and maintain species and populations that have been recognized as imperiled, but not federally listed as threatened or endangered under the US Endangered Species Act. This Strategy resulted from cooperative efforts of U.S. and Canadian Federal, Provincial, and State agencies, Native American Tribes, First Nations, local Elected Officials, Congressional and Governor’s staff, and other important resource stakeholders, including members of the Kootenai Valley Resource Initiative. This Conservation Strategy does not necessarily represent the views or the official positions or approval of all individuals or agencies involved with its formulation. 20. Aboriginal Rights and Interests Effects
20. ASSESSMENT OF ABORIGINAL AND TREATY RIGHTS AND RELATED INTERESTS 20.1 INTRODUCTION This chapter assesses potential adverse effects on Aboriginal and Treaty rights and related interests which may arise from the Project during construction, operations, decommissioning/reclamation, and post-closure. Underground mining activities have the potential to adversely affect Aboriginal and Treaty rights by interfering with Aboriginal groups’ ability to engage in practices, customs, and traditions that are integral to their distinctive cultures, and/or by interfering with the exercise of rights expressly recognized in a treaty. Interference with Aboriginal and Treaty rights is generally indirect, resulting from changes to environmental conditions that are necessary for the continued exercise of Aboriginal and Treaty rights. The assessment is based on information derived from the Proponent’s engagement with potentially- affected Aboriginal groups, environmental assessments carried out elsewhere in the Application/EIS, and the review of secondary data. Wherever possible, the assessment addresses potential effects on Aboriginal and treaty rights and related interests as understood from the perspective of the Aboriginal groups in question. Baseline reports informing this assessment are appended to the Application/EIS and include: Ethnographic Overview and Traditional Knowledge and Use Desk-Based Research Report (Appendix 17-A) and Saulteau First Nations Knowledge and Use Study for HD Mining Murray River Coal Project (Appendix 17-B). 20.2 REGULATORY AND POLICY FRAMEWORK The Crown has a legal duty to consult with and, where appropriate, accommodate Aboriginal interests when it contemplates a conduct that might adversely impact the potential or established Aboriginal or Treaty right. The Crown delegated procedural aspects of this duty, with respect to the Project, to the Proponent through the Section 11 Order and EIS Guidelines. -

All rights reserved. i West Coast Environmental Law Design Basis for the Living Dike Concept EXECUTIVE SUMMARY Background West Coast Environmental Law (WCEL) is leading an initiative to explore the implementation of a coastal flood protection system that also protects and enhances existing and future coastal and aquatic ecosystems. The purpose of this document is to summarize available experience and provide an initial technical basis to define how this objective might be realized. This “Living Dike” concept is intended as a best practice measure to meet this balanced objective in response to rising sea levels in a changing climate. It is well known that coastal wetlands and marshes provide considerable protection against storm surge and related wave effects when hurricanes or severe storms come ashore. Studies have also shown that salt marshes in front of coastal sea dikes can reduce the nearshore wave heights by as much as 40 percent. This reduction of the sea state in front of a dike reduces the required crest elevation and volumes of material in the dike, potentially lowering the total cost of a suitable dike by approximately 30 percent. In most cases, existing investigations and studies consider the relative merits of wetlands and marshes for a more or less static sea level, which may include an allowance for future sea level rise.
