ORDINANCE NUMBER 1006

AN ORDINANCE OF THE OF THE CITY OF PERRIS, OF RIVERSIDE, STATE OF REPEALING ORDINANCE NUMBER 162 AND RE-ESTABLISHING THE PLANNING COMMISSION OF THE CITY OF PERRIS

WHEREAS, the City Council of the City of Perris (the "City Council") adopted Ordinance Number 162 in 1951 to establish the City of Perris Planning Commission (the "Planning Commission"); and

WHEREAS, Ordinance Number 162 defines the duties of the Planning Commission, to advise the City Council on all land use matters, sets forth the number of members as five (5) who are appointed by the with the approval of the City Council, and the terms of those members; and

WHEREAS, the City Council adopted Ordinance Number 1004 to dissolve the Board of Zoning Adjustment, to dissolve the Park and Recreation Commission and to transfer all of the duties of the Board of Zoning Adjustment regarding nuisance abatement and "park planning" duties of the Park and Recreation Commission to the Planning Commission; and

WHEREAS, to accommodate execution of the above-described duties, the City Council desires to re-establish the Planning Commission and to add to the Planning Commission two (2) alternate members.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Perris does ordain as follows:

Section 1. Membership. There is re-established a Planning Commission of the City of Perris consisting of five (5) regular members and two (2) alternate members who shall be appointed, and may be removed, by the Mayor with the approval of the City Council.

Section 2. Members - Terms. Of the initial, regular members of the Planning Commission appointed, three (3) members shall be appointed for four (4) year terms and two (2) members of the Planning Commission shall be appointed for two (2) year terms. The initial, alternate members of the Planning Commission shall be appointed for two (2) year terms. Thereafter, the term of regular members of the Planning Commission shall be four (4) year terms and the term of the alternate members of the Planning Commission shall be two (2) year terms.

Section 3. Duties. The duties of the Planning Commission shall be those set forth in the Conservation and Planning Act, the Government Code and other laws of the State of California, and ordinances of the City regarding zoning, planning, and nuisance abatement under the Municipal Code and related matters, and to advise the City Council, upon request, on questions of nuisance abatement, zoning, planning, implementation of the City Park and Recreation Master Plan, and related matters.

Section 4. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published and posted pursuant to the provisions of law in this regard, and this Ordinance shall take effect thirty (30) days after its passage.
