TheCounciladopted:

FLOODS

TheCouncilreachedpoliticalagreementonadraftdirectiveontheassessmentandmanagementof floodrisks( 11013/06 ).

Concerningthemainissuesyettoberesolved,theCouncildecided:

• thatthescopeoftheDirectivewouldcoverbothinternationalandnationalriverbasins;

• torequirethatthepreliminaryfloodriskassessmentwouldbecompleteby22December2012 ;

• torequiretherevisionandupdatingofthefloodhazardmapsandofthefloodriskmapsby22 December2019 andrevisionofplansin2021 andeverysixyearsthereafter .

ThetextwillbeadoptedwithoutfurtherdiscussionataforthcomingCouncilmeetingintheformof acommonpositionandsenttotheEuropeanParliamentwithaviewtothesecondreading.

Whenpresentingitsproposal (5540/1/06) ,theCommissiontookintoaccountthat,between1998 and2004,Europesufferedover100majorfloods,includingcatastrophicfloodsalongtherivers DanubeandElbein2002,floodsthatcausedsome700fatalities,thedisplacementofabouthalfa millionpeopleandresultedineconomiclossestotallingatleastEUR25billion,andthatflood eventsduringthesummerof2005,inAustria,,France,GermanyandRomaniaand elsewhere,hadraisedthesefiguresevenfurther.

Assetsatriskfromfloodingincludeprivatehousing,transportandpublicserviceinfrastructure, commercialandindustrialenterprises,andagriculturalland.Inadditiontoeconomicandsocial damage,floodscanhavesevereenvironmentalconsequences,forexamplewhenwastewater treatmentplantsorfactoriesholdinglargequantitiesoftoxicchemicalsareinundated.Floodscan alsodestroywetlandareasandreducebiodiversity.

Theobjectiveoftheproposalis,therefore,toreduceandmanagetheriskswhichfloodsposeto humanhealth,theenvironment,infrastructureandproperty.

Inordertoattainitsobjective,theproposeddirectiveprovidesforpreliminaryfloodrisk assessmentsofeachriverbasindistrict,floodmappinginareaswithasignificantfloodrisk,a coordinationmechanismwithinsharedriverbasins,andfloodriskmanagementplansinvulnerable riverbasinsandcoastalareas.

TheproposalappliestothewholeCommunityterritory,andthereforetofloodriskinbothrivers andcoastalzones.ConsideringthatmostoftheriverbasinsinEuropeareshared,concertedaction atCommunitylevelwouldbringaddedvalueandimprovetheoverallleveloffloodprotection.

TheproposedDirectiveprovidesconsiderableflexibilityforMemberStatestodeterminethelevel ofprotectionrequired,themeasurestobetakenandthetimetablesforimplementingfloodrisk managementplans.AcloselinkwiththewaterframeworkDirective 1isprovidedfor.

Legalbasisproposed:Article175(1)oftheTreaty–qualifiedmajorityrequiredforaCouncil decision,codecisionprocedurewiththeEuropeanParliamentapplicable.TheEuropeanParliament delivereditsopinionatfirstreadingon13June2006.

AIR QUALITY

PendingtheopinionoftheEuropeanParliamentatfirstreading,theCouncilagreedonageneral approachonadraftdirectiveonambientairqualityandcleanerairforEurope.

TheagreementwasbasedonaPresidencycompromisepackage,whichincludesseveralkey elements:

– existinglimitvaluesaremaintainedwithoutanychanges;

– abindinglimitvalueforPM 2.5 in2015willreplaceanonbindingtargetvalueapplicablefrom 2010(25g/m 3forbothtargetvalueandlimitvalue);MemberStateshavetoprepareairquality plansinordertoattaintargetandlimitvalue;

– anexposurereductiontargetforPM 2.5 withtheaimofreducingairpollutioninurban backgroundlocations;areviewtobecarriedoutbytheCommissionuntil2013withaviewto replacingthetargetbyalegallybindingexposurereductionobligation;

– itfollowstheCommission’sproposalsandtakesaccountofMemberStates’currentdifficulties inreachingairqualitytargetsandallowsforatimelimitedextensionofattainmentdatesfor limitvaluesunderclearlydefinedconditions;forlimitvalueswhicharealreadyinforcethe possibilityforpostponementislimitedtoPM 10 untilthreeyearsafterentryintoforceofthis Directive.

AssoonastheopinionoftheEuropeanParliamentisavailable,theCouncilwillbeabletoreach politicalagreementonthisfile.

Itisrecalledthat,despitesignificantimprovementsinEurope'sairqualitydrivenbylegislationand otherfactors,airpollutioncontinuestohaveserioushumanhealthandenvironmentaleffects.

InSeptember2005,theCommissionpresentedathematicstrategyonairpollution( 12735/05 + ADD 1 + ADD 2) andaproposalforanewairqualitydirectiveintheEuropeanUnion( 14335/05) .

Thedraftdirectiveaimstorevisethecurrentambientairqualitylegislation,comprisingtwomain elements:

– themergingoffivelegalinstrumentsintoasingledirective(theframeworkdirective 1,thefirst 2, second 3andthird 4daughterdirectivesandtheexchangeofinformationdecision 5;thefourth daughterdirective 6beingmergedlaterthroughasimplified“codification”process).

– introductionofairqualitystandardsforfineparticulatematter(PM 2.5 )intheair,becauseofthe majorhealthbenefitstobeobtained 7.

Atthesametime,moreflexibilitywillbegiventotheMemberStates.Wheretheycandemonstrate thattheyhavetakenallreasonablemeasurestoimplementthelegislationbutstillneedmoretimeto complywithairqualitystandardsincertainplaces,itisproposedtoallowthemtorequestatime limitedextensiontothecompliancedeadlineintheaffectedzonesundercertainconditions.

Legalbasisproposed:Article175(1)oftheTreaty–qualifiedmajorityrequiredforaCouncil decision,codecisionprocedurewiththeEuropeanParliamentapplicable.

WASTE - Council conclusions

TheCounciladoptedthefollowingconclusions:

"TheCouncil:

1. WELCOMEStheCommission’sCommunicationonaThematicStrategyontheprevention andrecyclingofwastewithitsobjectiveofcontributingtowastepreventionandan efficient,environmentallysoundandsustainablemanagementofwasteandresourceswith aviewtoprotectingresourcesandreducingtheoverallnegativeimpactofresourceuse;

2. HIGHLIGHTSthecloselinkagebetweentheThematicStrategyandotherrelated Strategies,especiallytheThematicStrategyonResources,theStrategyforSustainable Development,andtheIntegratedProductPolicy;

3. CONCURSwiththeCommissionthattheresultsofthereviewoftheStrategyshallfeed intothefinalevaluationoftheSixthEnvironmentActionProgramme;

Objectives of the EU policy on waste

4. STRESSESthesubstantialaimforwastemanagementofachievingahighlevelof protectionoftheenvironmentandhumanhealth;

5. STRESSESthataccountbetakenofallenvironmentalimpactsirrespectiveofwhenor wheretheywilloccur,includingimpactsthatoccuroutsidetheEuropeanUnion, consideringalsosocioeconomicimpacts;

6. UNDERLINEStheimportanceofthegeneralprinciplesofwastemanagement,suchasthe precautionaryprincipleandthepolluterpaysprinciple,theprincipleofwastegenerator’s responsibilityand,forspecificwasteflows,theprincipleofproducerresponsibility,aswell asfurtherprinciplesofwastemanagement,suchastheprinciplesofproximityandself sufficiencywheretheyapply;

WELCOMESlifecyclethinkingasausefulconcepttoevaluatetheenvironmentaland humanhealthimpactsofwasteandoftheuseofnaturalresources,stressesthatthis conceptcanbeusedtominimisetheseimpactsandtodeviatefromthewastehierarchyand CALLSontheCommissiontoprovidegeneralguidanceonlifecyclethinkinginthe contextofwastepolicy;

9. AGREESwiththeCommission’saimtopreventthegenerationofwasteasfaraspossible;

10. SUPPORTStheEU’slongtermvisionofbecominga“Europeanrecyclingsociety”,with positiveeffectsnotonlyforthesustainableuseofnaturalresources,butalsoforthe economyandemploymentandemphasisestheimportanceoftakingspecificmeasuresto increasereuseandrecyclingwhileensuringahighlevelofhumanhealthand environmentalprotectioninallMemberStates;

11 ASKStheCommissiontogiveparticularconsideration,inthecontextofthefinal evaluationoftheSixthEnvironmentActionProgramme,totheneedforrealisticlong, mediumandshorttermtargetsandmeasurestoachievetheoverallvisionoftheEUof becominga"recyclingsociety";

12. RECOGNISEStheobjectiveoftheStrategyofminimizingasfaraspossibletheamountof wastefordisposalanditsenvironmentalimpact,whileacknowledgingthatlandfilling remainsanacceptableoptionforwastestreamsthatcannotberecoveredinasustainable wayandprovidingthatlandfillingisdoneinsuchwaythatnegativeimpactsonthe environmentandhumanhealthareavoided;

13. TAKESintoconsiderationthatahigherdegreeofrecoverymustnotleadtoanincreased diffusedispersionofpollutants;

14. HIGHLIGHTSthatmeasuresandinitiativesbasedonthestrategyonwastemustbe sustainableandmustmakeasubstantialcontributiontoanecoefficientuseofresources;

15. SUPPORTStheimprovementoftheknowledgebaseandthebeneficialuseofdata, especiallyontheimpactsofresourceuse,wastegenerationandwastemanagement,and callsontheCommissiontoconsiderappropriatesimplificationmeasuresinordertoavoid duplicationandoverlappingofreportsandinformationtobesubmitted; a) Legislative measures

16. RECOGNISESthatemphasisshouldbeplacedonthefullimplementationoftheECwaste legislation;

17. SUPPORTStheCommission’sapproachtomodernizingtheexistinglegalframeworkby clarifying,simplifyingandstreamliningtheEUwastelawwiththeaimofbetter regulation,includingthepromotionofsynergieswithexistingEUlaw,andstressesthe importanceofmaintainingahighlevelofprotectionofhumanhealthandtheenvironment;

18 CALLSontheCommissiontoensurethatitsmajorproposalsarefullyassessedintermsof theireconomic,socialandenvironmentalcostsandbenefitsandtheirimpactonlevelsof wasterecyclingandrecoveryactivitiesintheEU;

19. ACKNOWLEDGEStheCommissionproposalfortherevisionofdirective2006/12/ECon wasteandtakesnoteoftheCommission'sintentiontodrawupandpresentproposalsfor theamendmentoftheotherdirectivesandmeasuresinthefieldofwastemanagement basedonthetopicslistedinthestrategy,buthighlightsthefactthatstabilityofrulesis importantforallstakeholders;

20. CALLSONtheCommissiontoclarifyandharmonizecorrespondingdefinitionsinfuture proposalsofwastemanagementlegislationwiththedefinitionscontainedintherevised directiveonwaste,asappropriate,inordertoensurethattheyarepracticableandprovide thegreatercertaintyandclarityessentialforthecompetentauthoritiesandstakeholders;

21. EMPHASISEStheimportanceofusingtheprocedureinwastelegislationonly fordecisionsofatechnicalandscientificnature,concerningnonessentialelementsofa basicinstrument,andstressesthatthisprocedureneedsaclearmandateintheparticular legislation;

22. CONSIDERSthatthenewregulationonshipmentsofwasteimplementslegalobligations fromtheUNBaselConventionandOECDDecisionsandunderlinesthatanobjectiveof regulatingshipmentsofwasteistoenhancethereuseandrecyclingofwasteswithahigh levelofenvironmentalandhumanhealthprotection; b) Prevention

23. CALLSONtheCommissiontocomeforwardwithconcretemeasuresonpreventionof wasteinthefieldsofproductpolicy,chemicalspolicyandecodesigntominimizeboththe generationofwasteandthepresenceofhazardoussubstancesinwaste,andtherebyto fosterthesafeandenvironmentallysoundtreatmentofwaste,andemphasisesthe importanceofpromotingproductsandtechnologiescausinglessharmfulenvironmental effectsandproductsmoresuitableforreuseandrecycling;

24. REQUESTStheCommissiontoworktowardsconsideringreinforcingthewaste preventionaspectsofBREFdocumentsaccordingtotheIPPCDirectiveandtoinclude relevantguidanceinthesedocuments;

25. CALLSONtheCommissiontodevelopguidelinesforwasteprevention,including indicators,takingintoaccountthedifferenteconomicconditionsanddevelopmentsof MemberStates;

26. STRESSEStheroleofeducationandinformationactivitiesinthewastepreventionfield especiallytopromotesustainableproductionandconsumptionaswellastheimportanceof greenpublicprocurement,andcallsontheCommissiontoensurethatanylegislative barrierstogreenpublicprocurementareremoved; c) Recycling

27. UNDERLINEStheimportanceofachievingcommonminimumstandardsforrecoveryand recyclingwherejustifiedatEUlevelwhilstnotingthatindividualMemberStatescan maintainorestablishhigherstandardsforrecyclingwithregardtotheachievementofa highlevelofenvironmentalandhumanhealthprotection;

WELCOMEStheemphasisonincreasedlevelsforrecyclingforcreatingalevelplaying fieldthroughouttheEuropeanUnionformanagingwasteinthemostappropriatewayto increaseenvironmentalandhumanhealthprotectionandhighlightsthattheproductionof highqualitycompost,particularlycompostderivedfromseparatelycollectedbiowaste constitutesanimportantcomponentinthisfieldandacknowledgestheimportanceof measuresonbiowaste;

30. EMPHASISEStheimportanceofpromotingsourceseparationofwasteandtheimportant rolethattherecyclinglegislation,collectionandrecyclingtargetsandproducer responsibilityforspecificwastestreamscontinuetoplayinimprovingwastemanagement intheCommunityandincreasingtherecyclingrateofcertainwastestreams;

TheCounciladoptedthefollowingconclusions:

1. RECALLSthe6thEnvironmentalActionProgrammeanditscommitmentsinparticularto developaThematicStrategyontheUrbanEnvironmentwiththeobjectiveofcontributing toabetterqualityoflifeandtheimprovedwellbeingofcitizensbyencouraging sustainableurbandevelopmentandbyprovidingacleanandhealthyurbanenvironment withhighairquality,lownoise,cleanwater,highuseofrenewableenergyandlow consumptionofspaceandresources.HIGHLIGHTSthatthecontributionsmadebycities andurbanareastocombatingairpollutionandclimatechangeinordertoreduce greenhousegasesisessential;thisconcernsi.a.transportandlanduseplanningaswellas thesustainableconstructionandoperationofbuildings;

GMOs

TheCouncilheldanexchangeofviewson genetically modified organisms (GMOs)wherebyit evaluatedtheactivitieswhichhavebeencarriedoutwithintheEUoverthelastfewmonths,in particularasregardsthemeasuresdecidedbytheCommissiontoimprovetheimplementationofthe EuropeanGMOlegislation.

Inpresentingthesemeasures,CommissionerDIMASpointedoutthattheywereaimedatimproving thescientificconsistencyandtransparencyfordecisionsonGMOsandatdevelopingconsensus betweenallinterestedparties.Theseimprovementsconsistinparticularonstrengtheningtheliaison betweenEFSAandnationalscientificbodiesinordertoresolvepossibledivergingscientific opinionswithMemberStates.Healsoexplainedthattheenvisagedmeasureshaveanimmediate effectanddonotrequireanychangestotheexistingEUlegislationandthattheyprovideformore detailedjustificationofEFSA'sopinionsonindividualapplications.

Thispresentationwasfollowedbyanexchangeofviewswherebythedelegationssupportedthe Commission'smeasures,manydelegationshavingcommentedthatfurtherstepsshouldbetakenin thefuture.Inthiscontextanumberofdelegationsfavouredanenhanceduseoftheprecautionary principleintheproceduresrelatedtoauthorisationsandriskassessmentofGMOsandGMO products.

Somedelegationswished,fortheirpart,andinaccordancewiththeconclusionsadoptedbythe (Agriculture)CouncilinMay2206,thattheCommissioncomeforward,assoonaspossible,with proposalssettingoutCommunitylabellingthresholdsforseeds.

WithaviewtotheadoptionofaprioritisedActionPlanbytheEuropeanCouncilatits2007Spring Session,theCouncilheldanexchangeofviewsonthefollowuptoBiomassandBiofuelsiniatives. Thisexchangeofviewshasshownthatalldelegationsbelievedintheimportantroleofthe EnvironmentCouncilastoensuringthebestsynergybetweenenvironmentalandenergypolicies.

Initsconclusionsof23/24March2006,theEuropeanCouncilcalledfor" an Energy Policy for Europe, aiming at effective Community policy, coherence between Member States and consistency between actions in different policy areas and fulfilling in a balanced way the three objectives of security of supply, competitiveness and environmental sustainability ".Itunderlinedthat," to achieve this consistency (…) energy policy has to satisfy the demands of many policy areas ".It,therefore, calledforan" enhanced coordination between the relevant Council formations ".

TheCounciladopted,byaqualifiedmajority,aregulationamendingRegulation(EC)No 2037/2000asregardsthebaseyearfortheallocationofquotasofhydrochlorofluorocarbons (HCFCs)withrespecttotheMemberStatesthataccededtotheEUon1May2004( PE-CONS 3613/06 ).TheHungariandelegationabstained.

Regulation(EC)No2037/2000onsubstancesthatdepletetheozonelayertakes1999asthebase yearforallocatingquotasofHCFCs.AstheHCFCsmarketinthetennewMemberStateshas changedconsiderablysince1999withthearrivalofnewcompaniesandchangesinmarketshares, averagemarketsharesin2002and2003willbeusedasthebasisforthecompaniesfromthose MemberStates.

Theregulationwillapplyfrom1January2007.

Financial instrument for the environment - LIFE + *

Organised crime - Cooperation between asset recovery offices

PendingtheopinionoftheEuropeanParliament,theCouncilreachedageneralapproachonthe draftCouncildecisiononarrangementsforcooperationbetweentheassetrecoveryofficesofthe MemberStates.

Itshouldbenotedthatthemainmotiveforcrossborderorganisedcrimeisfinancialgain.This financialgainisastimulusforcommittingfurthercrimetoachieveevenmoreprofit.Accordingly lawenforcementservicesshouldhavethenecessaryskillstoinvestigateandanalysefinancialtrails ofcriminalactivity.Inordertocombatorganisedcrimeeffectively,informationthatcanleadtothe tracingandseizureofproceedsfromcrimeandotherpropertybelongingtocriminalshastobe exchangedrapidlybetweentheMemberStatesoftheEU.

Itisthereforenecessarythatclosecooperationtakesplacebetweentherelevantauthoritiesofthe MemberStatesinvolvedinthetracingofillicitproceedsandotherpropertythatmaybecomeliable toconfiscationandthatprovisionbemadefordirectcommunicationbetweenthoseauthorities.

Surrender procedure between the Member States of the EU and Iceland and Norway *

TheCounciladoptedadecisionapprovingthesigningofanagreementonasurrenderprocedure betweentheEUMemberStatesandIcelandandNorway( 9644/1/06, 9676/5/06 ).

Theagreementisaimedatimprovingthesurrenderforthepurposeofprosecutionorexecutionof sentencebetween,ontheonehand,theMemberStatesand,ontheotherhand,NorwayandIceland, bytakingaccountof,asminimumstandards,thetermsoftheConventionof27September1996 relatingtoextraditionbetweentheMemberStatesoftheEU.

1. WelcomesthefourthEurojustAnnualReport(calendaryear2005) 1andnoteswith appreciationthatmostoftheobjectivestobeachievedin2005andassetoutintheAnnual Reportfor2004havebeensuccessfullyattained;

2. Inparticular,drawstheattentionto:

– theprogressmadeintheestablishmentofaconsolidatedinfrastructureandinthe developmentofEurojust'scapacitytoactastherelevantEuropeancounterpartfor judicialcooperationandcoordinationofcrossborderandseriouscrime;

– thesignificantincreaseinthecaseload,namelythefactthat588caseswerehandled, i.e.a54%increaseoverthe2004figuresandthefactthattheseweremainlycomplex cases;

– theimplementationoftheCaseManagementSystem(CMS)inaccordancewiththe internaldataprotectionrulesandtheinstallationofthesecurenetworkforinternal communication;

3. Takesnoteofthefigures,thecaseloadassessmentandthecaseillustrationsoutlinedinthe Report,whichhighlighttheincreasednumberandqualityofthecasesdealtwithby Eurojust.ItrequestsEurojusttocontinuethedevelopmentoftransparent,reliableand detailedstatisticsonthenatureandqualityofcasesandcasework,sothatprogressmaybe adequatelymonitoredinthefuture.Inparticular,byendorsingEurojust'sassessment concerningthecomplexityofcasesregardlessoftheirbilateralnature,neverthelessinvites Eurojusttocontinuefocussingandgivingprioritytocoordinationcasesandtoinvolve,as faraspossible,theEJNforthehandlingofpurelybilateralMLAcases;

4. Welcomesthefactthatin2005EurojusttookactionunderArticle7(a)oftheDecisionin twocasesandencouragestheUnittocontinuewithaproactiveapproachtojudicialco operation.InthisregardtheCouncilendorsesEurojust’sassessmentconcerningthe objectiveofmakingincreaseduseofitspowertoaskthecompetentauthoritiesofthe MemberStatesconcernedtoundertakeinvestigationsorprosecutionsunderArticle7(a)of theDecision.

5. Notesthatdespitethepositivetrendsinthecaseworkandtheincreasinginvolvementofthe countrieswhichaccededtotheEUin2004,significantdifferencesbetweenMemberStates stillexistasregardstheiruseofEurojust.Hence,reiteratestheinvitationtoMemberStates totakeadvantageasmuchaspossibleofthefacilitiesofferedbyEurojustfordealingwith serioustransbordercriminalcases;

TakesnoteoftheassessmentprocedurescarriedoutbyEurojustwithaviewtoevaluating theeffectivenessofthecoordinationmeetings,andunderlinestheimportanceofthe analysisperformedonthelegalproblemsandthebarrierswhichhavearisenincases referredtoEurojust,andalsowithaviewtoidentifyingpossibleshortcomingsand,onthat basis,enableEurojusttomakeproposalsforimprovingjudicialcooperationinaccordance withArticle32oftheEurojustDecision.Suchassessmentshouldbecarriedoutina transparentandrigorousmanner,togetherwiththecompetentauthoritiesconcerned. SuggeststhatanyconclusionsandrecommendationsdrawnbyEurojustfromthe operationalworkshouldbetakenintoconsiderationbynationalandEuropeanauthorities withaviewtoimprovingtheeffectivenessofthefightagainsttransnationalseriouscrime;

7. ExpressessatisfactionwithEurojust’scommitmentinthefightagainstterrorismand welcomestheappointmentofnationalcorrespondentsonterrorismbyallMemberStates. AsksMemberStatestoensurethatinformationonterroristinvestigationsandprosecutions beforwardedtoEurojust.Moreover,callsonMemberStatestoimplementbyJune2006 theCouncilDecision2005/671/JHAof20September2005ontheexchangeofinformation andcooperationconcerningterroristoffencesquicklyandeffectively;

8. UnderlinestheimportanceoftheroleofEurojustasregardsjointinvestigationteamsand theEuropeanArrestWarrant.Withregardtothejointinvestigationteams,theCouncil welcomestheinitiativestakenbyEurojustandEuropoltohostthemeetingsofthe informalnetworkofexpertsonJITsandtoproduceaguideonnationallegislations. EncouragesEurojustandtheMemberStatestotakeallnecessaryinitiativeswithaviewto enhancingtheuseoftheJITs.TheCouncilrecallstheimportanceofthelegalobligationto informEurojustaboutcaseswherethetimelimitsoftheEAWareexceeded,aswellasthe possibilityofseekingitsadviceincertaincasesandasksMemberStatestofulfiltheir obligations.InvitestherelevantCouncilworkingpartiestoexaminethereasonsgivenby MemberStatesfornoncompliancewithtimelimits;andasksthatthisissuebeexamined inthecourseoftheongoing4 th roundofmutualevaluationontheEAW;

9. Underlines,mindfulofitspreviousconclusionsof12.10.2005onintelligenceledpolicing andthedevelopmentoftheOrganisedCrimeThreatAssessment(OCTA),theimportance oftakingintoaccounttheadviceofEurojustonthestrategicprioritiestobeadoptedonthe basisoftheOCTAandexpectsthatEurojust’sroleintheprocesswillbeofsignificantand growingimportance.

10. NoteswithregretthattheeffectivenessoftheroleofEurojustintheimprovementof judicialcooperationseemstobeweakenedbythelackofimplementationofanumberof legislativeEUinstrumentsbyallMemberStates.Inparticular,urgesthosecountriesthat didnotimplementtheEurojustDecisiontodosoandinvitesallMemberStatestotakeall necessarymeasurestocomplywiththeDecisioninordertoprovidetheirnational Memberswiththeappropriatepowersandmeanstoperformtheirtaskseffectively;

11. InvitestheCommissiontoprepareitssecondreportonthelegaltranspositionofthe CouncilDecisionof28.2.2002settingupEurojust,asannouncedintheCounciland CommissionActionPlanimplementingtheHagueProgrammeonstrengtheningfreedom, securityandjusticeintheEuropeanUnion;

12. WelcomestheprogressmadeintherelationshipwithotherEUbodies,namelyEJN,OLAF andEuropol.Whileunderliningtheimportanceofestablishingsynergiesbetweenthe relevantEuropeancounterpartsinthefieldofjudicialandpolicecooperation,theCouncil invitesEurojusttokeepdevelopingsuchrelationshipsandadvisesallthepartiesconcerned toconsideranypossibleinitiativestoallowthestructuralobstaclestocooperationtobe overcome;

13. Takesnoteoftheadvancementoftherelationshipswiththirdcountries,bymeansofthe appointmentofcontactpointsandthenegotiationsofcooperationagreements,and encouragesEurojusttofinalisethenegotiationswiththeprioritycountriesscheduledinthe listprovidedtotheCouncilinSeptember2005 1;

"TheCouncil:

1. ACKNOWLEDGESthatoverrecentyearsprogresshasbeenmadeintheworking methodsofCouncilasregardstheadoptionoftheannualRegulationsfixingTACsand quotas.TheintroductionoffrontloadingandthepresentationoftheBalticSeafishing opportunitiesasaseparateproposalhavecontributedinaconstructivemannertothe legislativeprocess.Theintroductionofmoremultiannualdecisionsandlongtermplans, whichtheCouncilapprovedinDecember2002,hasalsomadeapositivecontributionto reducingadhocannualdecisionmaking.

FollowingtheagreementontheEU'sfinancialframeworkfor20072013,theCouncilreached politicalagreementonadraftdecisioncreatingthe" Youth in action "programmefortheperiod 20072013.ThetextagreedwillbeadoptedasacommonpositionataforthcomingCouncil meetingandsenttotheEuropeanParliamentforasecondreading.

"Youth in action ",successortothecurrent" Youth "programme,isaimedatprovidingyoungpeople inthe31participatingcountrieswithopportunitiesforgroupexchangesandvoluntarywork,aswell assupportingarangeofactivitiesandreinforcingcooperationintheyouthfield.

Themainobjectivesoftheprogrammearethefollowing:

• topromoteyoungpeople’sactivecitizenshipingeneralandtheirEuropeancitizenshipin particular;

• todevelopsolidarityandpromotetolerance amongyoungpeople,inparticularinorderto reinforcesocialcohesionintheEU;

• tofostermutualunderstandingbetweenyoungpeopleindifferentcountries;

• tocontributetodevelopingthequalityofsupportsystemsforyouthactivitiesandthecapabilities ofcivilsocietyorganisationsintheyouthfield;

Lifelong learning programme for 2007-2013

FollowingtheagreementontheEU'sfinancialframeworkfor20072013,theCouncilreached politicalagreementonadraftdecisionestablishinganactionprogrammeinthefieldoflifelong learning,aimedatprovidingfinancialsupportfortheEuropeaneducationsectorfortheperiod 20072013.

ThetextagreedwillbeadoptedasacommonpositionataforthcomingCouncilmeetingandsentto theEuropeanParliamentforasecondreading.

Thenewprogrammewillcomprisefoursubprogrammesalreadyexistingwithinthecurrent Socratesprogramme:Comenius(schooleducation);Erasmus(highereducation);Leonardoda Vinci,(vocationaleducationandtraining);Grundtvig(adulteducation).Itwillalsoincludea “transversal”programmeincorporatingfourkeyactivities(policydevelopment,languagelearning, innovativeapproachesanddisseminationofprojectresults),plusaJeanMonnetprogrammeto supportactionrelatedtoEuropeanintegrationandEuropeaninstitutionsandassociations.Asingle programmeshouldpermitgreatersynergiesbetweenthedifferentfieldsofactionaswellasmore coherent,streamlinedandefficientmodesofaction.

Theaimofthenewprogrammeisbothtocontributethroughlifelonglearningtothedevelopmentof theCommunityasanadvancedknowledgesocietyandtofosterinteraction,cooperationand mobilitybetweeneducationandtrainingsystemswithintheCommunity,withtheaimofbecoming aworldqualityreference.
