1938 CONSTITUTION, PROVINCIAL CHAP. 8 (AMENDMENT). CHAPTER 8. An Act to amend the " Constitution Act." R.S.B.C. me, c.. 1937, c. 12. [Assented to 9th December, 1938.] IS MAJESTY, by and with the advice and consent of the H Legislative Assembly of the Province of British Columbia, enacts as follows:— 1. This Act may be cited as the "Constitution Act Amend- short «tie. ment Act, 1938." 2. Schedule C to the " Constitution Act," being chapter 49 of Ee-enacts sch. c. the " Revised Statutes of British Columbia, 1936," is repealed, and Schedule C as contained in the Schedule to this Act is sub stituted therefor. 3. (1.) For the purpose of the revision of voters' lists under Revision of the " Provincial Elections Act" subsequent to the dissolution of the present Legislative Assembly, Registrars of Voters shall be appointed, and lists of voters shall be revised for the electoral districts as named and described in the Schedule to this Act (in this section referred to as " new electoral districts," as dis tinguished from the existing electoral districts, which are in this section referred to as "old electoral districts"). (2.) For the purpose of preparing the first revised list of voters for a new electoral district the boundaries of which differ from the boundaries of an old electoral district of the same name, the Registrar of Voters of the district shall strike from the last revised list of voters of the old electoral district the names of all voters who reside without the boundaries of the new electoral district; and the list with those names so struck off shall be deemed, for all purposes of the revision, the last 17 2 CHAP. 8 CONSTITUTION, PROVINCIAL 2 GEO. 6 (AMENDMENT) . revised list of voters for that new electoral district. The Reg istrar of Voters shall prepare from the names of voters so struck off a list of the names of those voters who reside in any new electoral district, and shall forthwith transmit the list to the Registrar of Voters for the new electoral district, together with the original affidavits made by the voters whose names appear on the list so transmitted. (3.) Every list of names transmitted under subsection (2) to the Registrar of Voters for a new electoral district shall be deemed, for all purposes of the revision, a part of the last revised list of voters for that district, and the Registrar of Voters to whom it is transmitted shall post up a copy of the list in his office and a copy in a conspicuous place on the outside of the door of his office. (4.) For the purpose of preparing the first revised list of voters for a new electoral district as to which there is no old electoral district of the same name, the Registrar of Voters shall place on a list the names of the voters appearing on the several lists transmitted to him pursuant to subsection (2) ; and the list so prepared by him shall be deemed, for all purposes of the revision, the last revised list of voters for that new electoral district. (5.) For the purpose of preparing the first revised list of voters for a new electoral district the boundaries of which cor respond with the boundaries of an old electoral district of the same name, the last revised list of voters for the old electoral district shall be deemed, for all purposes of the revision, the last revised list of voters for that new electoral district. (6.) The lists of voters as last revised in conformity with this section shall be the lists of voters to be used at all elections held after the dissolution of the present Legislative Assembly until new lists are revised and certified under the " Provincial Elections Act." (7.) This section shall for all purposes be construed as one with the " Provincial Elections Act." commencement. 4. Section 2 shall come into operation on the dissolution of the present Legislative Assembly. SCHEDULE C. (Section 15.) (The Mining Divisions herein mentioned, unless specifically stated to the contrary, are as described in the Gazette of October 19th, 1936.) 18 1938 CONSTITUTION, PROVINCIAL CHAP. 8 (AMENDMENT) . ALBERNI ELECTORAL DISTRICT. (1.) All that portion of the Province of British Columbia which is con tained within the following boundaries:— Clayoquot Mining Division, except that part which drains into Johnstone Strait and the Strait of Georgia; together with Alberni Mining Division, as defined in the Gazette of May 6th, 1937, shall constitute one electoral district, to be designated as " Alberni Electoral District," and return one member. ATLIN ELECTORAL DISTRICT. (2.) All that portion of the Province of British Columbia which is con tained within the following boundaries:— Atlin Mining Division; Stikine Mining Division, except that part which lies to the east of the one hundred and twenty-eighth meridian of west longitude; together with Portland Canal Mining Division, as defined in the Gazette of April 22nd, 1937, shall constitute one electoral district, to be designated as " Atlin Electoral District," and return one member. BURNABY ELECTORAL DISTRICT. (3.) All that portion of the Province of British Columbia which is con tained within the following boundaries :— Commencing at the point of intersection of the north-westerly boundary of the City Municipality of New Westminster with the centre line of North Road; thence south-westerly along said boundary to the most northerly corner of Lot 172, Group 1, New Westminster Land District; thence west erly and northerly along the boundaries of the District Municipality of Burnaby to the north-west corner thereof; thence due north to the middle line of Burrard Inlet; thence easterly along said middle line to the point of intersection of the northerly production of the centre line of North Road; thence southerly to and along said centre line to the point of commencement, shall constitute one electoral district, to be designated as " Burnaby Elec toral District," and return one member. CARIBOO ELECTORAL DISTRICT. (4.) All that portion of the Province of British Columbia which is con tained within the following boundaries:'— Quesnel Mining Division; that portion of Cariboo Mining Division which lies to the south of the following described line: Commencing at that point on the one hundred and twenty-fourth meridian of west longitude as estab lished by survey, which lies due west of the south-west corner of Lot 1263, Cariboo Land District; thence east to said corner; thence easterly along the southerly boundaries of Lots 1263, 1262, 1257, 1256, 1057, 1056, 1051, 1050, 1045, 1044, 1043, 5226, and 5225 to the north-west corner of Lot 5218; thence southerly along the westerly boundary of Lot 5218 to the south-west corner thereof; thence easterly along the southerly boundaries of Lots 5218, 5217, 5216, 5210, 5209, and 5201 to the south-east corner of Lot 5201; thence northerly along the easterly boundaries of Lots 5201 and 974 to the north east corner of Lot 974; thence easterly along the northerly boundaries of Lots 975, 976, 977, 994, 995, 996, 998, 997, and the southerly boundary of Lot 1003 to the south-east corner of Lot 1003; thence due south to the point due west of the north-west corner of Lot 9066; thence east to said corner; thence easterly along the northerly boundary of Lot 9066 to the north-east corner thereof; thence due east to the easterly bank of the Fraser River; thence southerly along said river-bank to the south-west corner of Lot 2913; thence easterly along the southerly boundaries of Lots 2913, 2914, 2917, 19 CHAP. 8 CONSTITUTION, PROVINCIAL 2 GEO. 6 (AMENDMENT) . 4575, and 4574 to the south-east corner of Lot 4574; thence southerly along the easterly boundaries of Lots 4573 and 4572 to that point on the easterly boundary of Lot 4572 which lies due west of the south-west corner of Lot 6945; thence east to said corner; thence easterly along the southerly bound aries of Lots 6945 and 6943 to the south-east corner of Lot 6943; thence due east to the middle line of Bowron River; thence southerly along said middle line to the point thereon which lies due west of the north-west corner of Lot 9518; thence east to said corner; thence easterly along the northerly boundary of Lot 9518 to the north-east corner thereof; thence due east to the westerly boundary of the watershed of Dominion Creek; thence south erly along said boundary to the southerly boundary of the watershed of Haggen Creek; thence north-easterly along said boundary to the westerly boundary of the watershed of the streams flowing easterly into the upper reaches of the Fraser River; thence south-easterly along said boundary to the easterly boundary of the watershed of the streams flowing into Quesnel Lake—all the lots herein above mentioned being in Cariboo Land District; together with Clinton Mining Division, except that part which lies to the south of the following described line: Commencing at that point on the surveyed east boundary of Lillooet Land District which lies due east of the south-east corner of Lot 1844, Lillooet Land District; thence west to said corner; thence westerly along the southerly boundaries of Lots 1844, 1842, 1841, 1840, and 1839 to the south-west corner of Lot 1839; thence westerly in a straight line to the south-east corner of Lot 1494; thence westerly along the southerly boundaries of Lots 1494, 1495, and 5260 to the south west corner of Lot 5260; thence northerly along the westerly boundary of Lot 5260 to the north-west corner thereof; thence due north to the southerly boundary of Lot 1910; thence easterly along said boundary to the south-east corner of Lot 1910; thence northerly along the
