Re: Williams County Landfill, Williams County Deletion of Permit-to-Install (PTI) Condition

Dear Mr. Carpenter:

The Williams County Landfill (Facility) located in Williams County is currently operating pursuant to PTI No. 03-6551, effective April 5, 1995. Condition 13.f.i. of PTI No. 03-6551 states:

fencing shall be installed to completely surround all sides of the working face. The top of the litter fence surrounding the working face shall always be maintained above the highest elevation of waste placement of the working face.”

On June 18, 2004, The Mannik & Smith Group (MSG), on behalf of Allied Waste Industries, Inc. (Allied Waste), submitted a request to the Ohio Environmental Protection Agency (Ohio EPA), Division of Solid and Infectious (DSIWM), Northwest District Office (NWDO) to remove Condition Number 13.f.i. from PTI No. 03-6551. The request indicated that this condition is no longer necessary because litter control methods, specifically the use of litter fences, are specified in the plan drawings. Ohio EPA has completed a review of the information and hereby approves the request to remove Condition Number 13.f.i. from PTI No. 03-6551. As a part of this approval, Allied Waste is subject to the following conditions:

CONDITIONS

1. Allied Waste shall comply with the litter control methods specified in the permit to install.

2. Issuance of this approval does not constitute expressed or implied agreement that the litter control methods used by the Facility will constitute compliance with applicable Bob Taft, Governor Jennette Bradley, Lieutenant Governor Christopher Jones, Director

state and federal laws, rules, and regulations, nor does issuance of this approval ensure that necessary operating permits or licenses will be granted.

3. Nothing in this letter shall be construed to authorize any waiver from any requirements of applicable state solid waste laws or regulations. This letter shall not be interpreted to release Allied Waste from responsibility under Ohio Revised Code (ORC) Chapters 3704, 3714, 3734, or 6111; under the Federal Clean Water Act, the Resource Conservation and Recovery Act, or the Comprehensive Environmental Response, Compensation, and Liability Act; or from other applicable requirements for remedying conditions resulting from any release of contaminants to the environment.

You are hereby notified that this action of the director of Ohio EPA is final and may be appealed to the Environmental Review Appeals Commission (Commission) pursuant to ORC Section 3745.04. The appeal must be in writing and set forth the action complained of and the grounds upon which the appeal is based. It must be filed with the Commission within thirty (30) days after notice of the director’s action. A copy of the appeal must be served on the director within three (3) days after filing with the Commission. An appeal may be filed with the Commission at the following address:
