Maybe every court will start holding holographic oral argu- ments. 3 Maybe standards of review will change when courts have the ability to view a crucial event on video, 4 or when counsel can embed an audio snippet of controversial testimony into a brief.5 Maybe the technology gap between the haves and the have-nots will grow so great that courts should not only provide indigent defend- ants with counsel,6 but also provide their counsel with the latest software. Maybe the short attention spans of modern readers will lead to BuzzFeed-style7 Brief-sicles: "Ten Exciting Reasons to Rule in Favor of My Client. You'll Gasp When You Read the Third One!" What I can predict with some certainty is that the future of ap- pellate advocacy will be inextricably tied to the future of reading. In fact, you'll hear a lot about reading if you ask appellate judges about their jobs. In 2015, appellate Judge Kate Toomey described the transition from the trial court to the appellate court by observ- ing that she spends her days "reading hundreds of pages of briefs and cases and draft opinions-far more reading than I did as a Dis- trict Court judge-and devoting a great deal more time to writing 3. Koelling, Appellate Practice: The Next 50 Years, Judges' J., Summer 2014, at 15 (predicting changes "over the next 30 years" such that "[e]ach courthouse will have its own holographic studio so that oral argument will have the appearance of taking place in the actual courtroom from both the judges and the advocates' points of view"). 4. Summer 2016 A Mind at Work 417 and editing."8 Another judge described the same transition, noting that in his rookie year, he "read perhaps a thousand briefs in hun- dreds of cases and wrote nearly 100 decisions."9 Earlier this year, an Associate Justice of the California Court of Appeal noted that he has a "dream job," but that it is not perfect, because "there's enough reading to blind an owl."10 These days, that reading is being completed on a variety of plat- forms: paper, desktops, laptops, and even phones. This technology will have a big impact on the future of appellate advocacy, but judges and lawyers are still in the early days of the digital revolu- tion, and we don't yet know how things are going to shake out. Right now, we are in a time of transition from paper-based docu- ments to digital documents. That transition may never be com- plete-i.e., we may never completely give up paper documents-but we are certainly moving to an information society that is more fo- cused on digital documents than on paper documents. Understanding how that digital world affects legal reading is vi- tal to understanding the future of appellate advocacy. Lawyers need to understand some of the science of how people read and in- teract with the written word; unfortunately, we have been slow to grasp the importance of this science." Understanding reader be- havior is also crucial, both because reading realities are relevant to the application of law to facts, and because the legal community needs to know what features to demand from their research web- sites, from their writing software, and in their court rules. 12 Too much of our current research technology imitates books, without compensating for the transition from hard copy to digital platforms. 8.     38/ Pere Antoni Pons The everydayness of power The West Wing If the effect is the same as what happens with me, after seeing any average-quality chapter of The West Wing (1999-2006) the reader-spectator will think he or she is witnessing an incontrovertible landmark in the latest phase of audiovisual narrative. After viewing one of the more dazzling, memorable episodes, he or she will not hesitate to believe that this is to behold one of the major, most perfect intellectual and artistic events of the early twenty-first century, comparable —not only in creative virtuosity but also in meaning, magnitude and scope— with Michelangelo’s Sistine Chapel, Shakespeare’s tragedies, Balzac’s The Human Comedy, or the complete recordings of Bob Dylan. Over the top? Even with more rotund words, it would be no exaggeration. Nowadays, nobody can ignore the fact that a colossal explosion in quality has happened over the last decade in the universe of American TV series. The old idea according to which the hapless professionals —scriptwriters, actors and directors— the ones who lack the luck or talent to carve out a niche in Hollywood or to triumph in the world of cinema, have to work in television has now been so thoroughly debunked that it even seems to have been turned on its head. He is Catholic, attended Notre Dame, and considered becoming a priest (until he met his wife). He has a Ph.D. from the London School of Economics, wrote an economics textbook, and won a Nobel Prize in Economics. He has a fierce intellect and a fondness for trivia, and he enjoys quizzing his staff. He is a member of the Democratic Party and is up for re-election, but it’s a rocky road. He has been stricken with Multiple Sclerosis (MS), but he’s never revealed it publicly, so the perception that he lied to the American people becomes an obstacle politically.* There was a recent assassination attempt on his life, and one of his staffers, Josh Lyman, was nearly killed. Delores Landingham, the President’s secretary (who is older than he is), was killed in a car accident after she bought her very own first car, and this episode involves her funeral.     "If anyone asks, just tell them that it's all been blown out of proportion," Josh Lyman said with a hint of queasiness in his voice, as he and Donna marched out of McGary's corner office and made a beeline down the hall. "Is that the official stance?" she asked from his left, keeping pace with a frantic staccato rhythm of her hard­soled shoes. "We don't have an official stance yet," he replied with a grimace. "But it's all over the news and these vultures want to tear us apart." "We're not dead yet," offered Donna. "What?" "Scavengers. Vultures are scavengers. They'd only be tearing us apart if we were dead." "Or dying," he agreed. Ahead, Sam Seaborn rounded the corner and nearly ran into them outside the Oval Office. He was holding some papers and looked as if he'd been running all morning. "Josh!" he began as he stopped in his tracks. "Sam, I'm just heading to see your boss. Is Toby in his office?" "He is," Seaborn breathed as he changed directions and fell in step beside Lyman, handing him a piece of White House stationary, "but he sent me to find you. We need an official statement from the president regarding this incident with McGary." "Yeah, you and ninety­seven other people this morning," Lyman moaned as he skimmed the document. "DC police already made a statement, and there's not much else we can say." "People are going to want to know if McGary's getting canned over this," Sam pleaded.
