ER61/19 Members Attendance and Apologies The Director of Environment and Regeneration completed the roll call. An apology was recorded from Councillor Reilly. Open for Decision 1 Page 1 ER63/19 Deputation – To Receive Mr J Wright (Head of Regulations) and Mr K Wells (Team Manager), North West Regulations Team NIEA to give a Presentation on Anaerobic Digesters The Committee received Mr Wright (Head of Regulations) and Mr Wells (Team Manager) North West Regulations Team, NIEA who gave a power-point presentation on Anaerobic Digesters highlighting the following points: Anaerobic Digestion in Northern Ireland What Is Anaerobic Digestion? The Four Stages of Anaerobic Digestion Types of Anaerobic Digestion (‘on farm’ and ‘industrial) The Regulation of Anaerobic Digestion in Northern Ireland Waste and Contaminated Land (NI) 1997 Order 1. Regulatory Position Statements 2. Waste Exemptions – Paragraph 9 – Agricultural Benefit 3. Waste Management Licence* (Controls impacts beyond site boundary, Financial Provision, Fit and Proper Person – inspection funded by fee, significant penalties). ABP. 4. Waste Permit for large Anaerobic Digesters accepting more than 10t/day of animal waste or 100t/day of any waste type Waste Management Licences How we regulate a Waste Management Licence – - Risk based approach - Site Inspection Report - Sanctions for non-compliance Public Register of waste facilities: Positives 1. £1.2 investment – 25 year lifespan. 2. Renewable Obligation Certificates (ROC’s). OFGEM. 2 Page 2 3. Renewable energy, good use of problematic waste streams, circular economy eg 4. Relatively low risk 5. Production of bio-fertilizer (digestate). Potential Issues: 1. Proximity to sensitive receptors – nuisance and environmental impacts. 2. Nitrogen deposition – sensitive bogs. Habitats Regulation Assessment (HRA). 3. Combustion Emissions – VOC’s, NOX – 4. Perceived risks. 5. Land use – ‘making electricity instead of milk’. 6. Planning permission – infrastructure. 7. Land banks for digestate use. 8. Catastrophic failures…. Hazards of Anaerobic Digesters…!!! Confined Spaces Explosive Atmospheres Toxic Gas and Asphyxiation Pressure Systems (Corrosive environment) Bio risk Drowning Farm animals Electric Shock Noise Burns Slips, trips and falls Vehicles Tank Failure Varying standards of tank designs. Concrete is best, mild steel is not! They all have weaknesses. NIEA Agri Team – sign off. The Chairperson thanked the deputation for their presentation and commended them on its content. Members then raised the following points: 3 Page 3 - In terms of electricity supply queried the accessibility to the grid and the delivery of power from the grid. - Referred to concerns regarding current regulations and possible insufficient inspection of facilities. - Expressed concern regarding the number and location of Anaerobic Digester facilities in this Council area. - Referred to concerns regarding the safe disposal of farm waste. - Acknowledged the process involved in disposing of the waste and the need to be more constructive in terms of recycling. - Queried the extent of nitrates, ammonia and toxins emitting from the process into the River Foyle. - Referred to recent concerns expressed by the Auditor General regarding the process and the potential for investigation into Anaerobic Digester plants given suggested evidence of fraud in relation to the subsidies being applied. - Referred to public concerns that the structure was not sufficiently reliable to prevent fraud. - Expressed concern at the flimsy response received from NIEA regarding the planning process and licensing conditions in respect of Anaerobic Digesters. - Expressed concern that planning approvals and licences were not being monitored sufficiently possibly resulting in the disposal of waste from outside the Council area and possibly the North of Ireland. - Expressed concern at the apparent lack of transparency regarding the process. - Referred to the increasing number of anaerobic digester plants located in the rural area and the lack of clarity regarding the amount of waste required to maintain a facility. - Enquired if enforcement action for non-compliance with the regulations, would impact on the original planning approval. - Queried if NIEA were notified by Councils regarding concerns relating to planning approval or third party involvement. - Pointed out that Renewable Obligation Certificates (ROCs) were ultimately publicly funded. - Enquired if there were different classes of licences granted in respect of varying types of materials. - Queried if a licence would be granted in situations where Council had identified a problem on the site. - In regards to the issue of de-coupling referred to the fact that a number of anaerobic digester plants built originally as a part of a farm were now operating as a private business and were no longer 4 Page 4 spreading digestate on the land. Queried what action would be taken in such circumstances. Expressed concern that this was not monitored sufficiently and queried why approval had been granted given that the concept of the facility had changed. - Expressed concern that facilities were not being reviewed even when the circumstances had changed significantly from when the licence was originally granted. - Expressed concern at the lack of restrictions/constraints placed on a plant following the granting of the original licence. - Enquired if the Department had a limit on the number of plants in any particular area which could not be exceeded or was this dictated by market forces. - Queried the regulations

    For The Glory Of Sport The story of the Commonwealth Games from 1930 to 2014 By Bob Phillips Author€s Note The Commonwealth Games have always been particularly close to my heart in a lifetime of a passionate interest in sport. I saw them for the first time as a teenage fan in Cardiff in 1958 € when they were still known as the British Empire and Commonwealth Games € and was captivated then by the marvellous deeds of the athletes on a cinder track fitted tightly round the hallowed turf of the celebrated Arms Park rugby-football ground. Lithe and lightning-fast sprinters from the Caribbean islands, rugged middle-distance and long-distance runners from Australia and New Zealand, a gloriously fluent quarter-miler from India, jumpers and throwers from what then seemed such exotic far-flung corners of the globe as Fiji, North Borneo and Singapore € it was all intensely exciting and laid the foundations for what would be for me many more such delightful adventures to come as a professional journalist and broadcaster. Even so, there were only 35 countries competing at those Games of more than half-a-century ago. In Glasgow this year there will be twice that number. The Games have grown out of all recognition, but in the process of so doing they have managed to maintain an intimacy € even a coziness, if you like € which so many of the other forms of international sport have long since shunned in the relentless interests of commercialism. This is a favoured theme of mine which you will find recurring throughout this history of the Commonwealth Games € call me old-fashioned, if you wish, but there are inherent qualities of fair play, of sportsmanship, of comradely competition among members of a vastly extended but affectionate family, which have survived over more than 80 years at these Games, though not entirely unscathed, and they are not widely in evidence elsewhere these days.
