Community Infrastructure Levy Community Infrastructure Levy Quarterly Report October 2015 1 Note: This report is to serve as an aid and an update on CIL. The information is correct at the time the report was drafted, however it is important to note the following may occur: 1) The Liable Party can challenge the CIL chargeable amount after the Liability Notice and/or the Demand Notice has been issued. In either case, there is a possibility that the chargeable amount can be reduced in some instances. 2) The Council has an instalment policy which provides a payment option in 3 instalments so the CIL payments can be staggered over several months and possibly over two years – please see the Council’s Instalment Policy. 3) An applicant can apply for exemption and relief after a Liability Notice has been issued but before commencement. This may reduce the chargeable amount considerably and in some cases to a nil charge. 2 Contents Page Number 1 Introduction 4 - 5 2 CIL Monitoring Information 6 - 11 3 1 Introduction 1.1 The Tandridge District Council Community Infrastructure Levy (CIL) Charging Schedule was approved by Full Council on the 24th July 2014 and came into effect on the 1st December 2014. Planning applications decided on or after the 1st December 2014 may therefore be subject to CIL. 1.2 The District Council will use CIL to secure Strategic Infrastructure (as shown on the Regulation 123 List of Infrastructure) which will have a district wide impact, while Local Infrastructure will be secured through Planning Obligations in line with the Policies of the Core Strategy and utilising the Planning Obligations and Community Infrastructure Levy Guidance, now published. 1.3 The CIL Regulation 2010 (as amended) do not require a quarterly report, however following a CIL training session with Councillors and Parish Councillors in February 2015, it was felt that a quarterly report will further facilitate the transparency and clarity of the CIL monitoring process. 1.4 As it is still early days with the CIL in Tandridge, the Council has only received two financial payments but financial payments are expected to start trickling through as developments which were granted permission will slowly commence work. The CIL charge is payable once a development has commenced. Other factors that need to be taken into consideration are that some developments may not necessarily get built out in which case there will be no CIL payments. Additionally, where a CIL liable development has commenced, payments can be made in instalments therefore the full payment can take over two years. Consequently, the Council and Parish Council need to take this into account in their plan making. 1.5 The report lists approved CIL planning applications where financial contributions have been agreed, whether that would involve financial gains or zero value due to a planning application being granted approval for relief/exemption. 1.6 Since the first quarterly report was published, four additional columns have now been added to table (2.0 Monitoring) to include commencement date, payment received, date payment received and the Parish Council’s portion. 1.7 At present, each PC in the District is entitled to 15% of the CIL fund within their area until such a time as a Neighbourhood Plan is adopted by a PC, thereby increasing its CIL portion to 25%. 1.8 There are a number of possible reasons why a development may have zero or reduced chargeable amount, as listed below: The development is approved for self-build exemption The development is approved for social housing relief 4 The development is approved for charitable relief 1.9 The financial period to which this document relates to are planning applications that are CIL liable and approved between 1 December 2014 to 30 September 2015. Although this is a quarterly report, it will build upon the last quarterly report to give a full picture and keep all information in one place. The Council has identified sites for more than 1,500 around Smallfield and Burstow, mostly on Green Belt land How will the Plan affect you? The Local Plan sets the policy for future housing development in Tandridge District for the next 20 years. Once it is agreed, all planning applications will be decided in line with it, so it’s important to make your views known now. Although at this time there are no designated sites for major development in Horne listed on the local plan there are a significant amount of sites in the surrounding villages, notably, Smallfield, Lingfield and Felbridge. The Plan claims that 470 houses are needed every year, almost 4 times the current requirement.
