To: Humboldt County Planning Commission Re: GPU - Water Resources Element 11

Dear Planning Commissioners,

I am requesting that your body incorporate the Federal and State Wild & Scenic Acts language and protections into the Water Resources Element of the GPU.

In 2004, California’s Wild and Scenic Rivers Act was amended to include a provision requiring all state agencies and local governments to do all in their power to protect these rivers’ free flowing state and to protect the extraordinary values for which they were designated wild and scenic (Cal. Public Resources Code §5093.61).

Humboldt County is blessed to have more miles of State and Federal listed Wild & Scenic Rivers, than any other County in California. All of us need to protect our Water Resources, including our listed Wild & Scenic Rivers for all species, not just human development.

The Legislature enacted California’s Wild and Scenic Rivers Act (Public Resources Code §§5093.54, et seq. ) to protect free flowing segments of California rivers that embody extraordinary scenic, recreational, fishery, or wildlife values:

“It is the policy of the State of California that certain rivers which possess extraordinary scenic, recreational, fishery, or wildlife values shall be preserved in their free-flowing state, together with their immediate environments, for the benefit and enjoyment of the people of the state. The Legislature declares that such use of these rivers is the highest and most beneficial use and is a reasonable and beneficial use of water within the meaning of Section 2 of Article X of the California Constitution”

Please use the laws that already exist to protect and preserve our Scenic Resources, including the Wild & Scenic Rivers Act.
