The external metal staircase being sited adjacent to both the public highway and residential dwellings has an adverse effect on the character and appearance of the street scene to the significant detriment of visual and residential amenity. Despite correspondence sent to the owner the external staircase and first floor opening remain in situ and unauthorised. The Planning Manager (Enforcement and Trees) authorised the issuing of an Enforcement Notice under delegated powers on 6 November 2020. Report to the District Planning Panel 19/00225/ENFUNA 2 Granby Drive Riddlesden Keighley BD20 5AX Report to the District Planning Panel 24 February 2021 Item Number: B Ward: KEIGHLEY EAST Recommendation: THAT THE REPORT BE NOTED Enforcement Reference: 19/00225/ENFUNA Site Location: 2 Granby Drive Riddlesden Keighley West Yorkshire BD20 5AX Breach of Planning Control: Without planning permission, the installation of a timber boundary fence to the side boundary of the property Circumstances: The Local Planning Authority was made aware of works to erect timber fencing to the side boundary of a dwelling and adjacent to a public highway. The unauthorised fencing by virtue of its of its prominent siting, scale, design and appearance forms an incongruous feature at the property and within the street scene of significant detriment to public amenity. Despite correspondence sent to the owner the fencing remains in situ and unauthorised. The Planning Manager (Enforcement and Trees) authorised the issuing of an Enforcement Notice under delegated powers on 6 November 2020. It was noted that two externally mounted roller shutters had been installed to the front elevation, for which the Council had no record of planning permission having been granted. The owner of the property has been requested to rectify the breach of planning control, however no action has been taken On 6 January 2021 the Planning Manager (Enforcement & Trees) authorised the issue of an Enforcement Notice. It is considered expedient to instigate Enforcement (Legal) Action as the unauthorised externally mounted roller shutters are detrimental to visual amenity by virtue of their design and appearance, contrary to Policies DS1, DS3 and SC9 of the Council's adopted Core Strategy Development Plan Document, the Council's adopted Shopfront Design Guide, the Council's adopted A Shopkeepers Guide to Securing their Premises Supplementary Planning Document and the principles of the National Planning Policy Framework. An inspection showed that a storage container had been sited on the land and further works were carried out to install a roller shutter and attached timber framed structure. The Council has no record of planning permission having been granted. The landowners have been requested to rectify the breach of planning control, however no action has been taken. On 6 January 2021 the Planning Manager (Enforcement & Trees) authorised the issue of an Enforcement Notice. It is considered expedient to instigate Enforcement (Legal) Action as the unauthorised storage container with attached roller shutter and timber framed structure is detrimental to visual amenity by virtue of its design and appearance, contrary to Policies DS1 and DS3 of the Council's adopted Core Strategy Development Plan document and the principles of the National Planning Policy Framework. Report to the District Planning Panel 19/00694/ENFUNA 340 Kensington Street Bradford BD8 9LJ Report to the District Planning Panel 24 February 2021 Item Number: E Ward: TOLLER Recommendation: THAT THE REPORT BE NOTED Enforcement Reference: 19/00694/ENFUNA Site Location: 340 Kensington Street Bradford West Yorkshire BD8 9LJ Breach of Planning Control: Unauthorised single storey extension Circumstances: In August 2019 the Council received an enquiry regarding an extension to the property. An inspection showed that a single storey extension had been constructed, for which the Council had no record of planning permission having been granted. A retrospective planning application for the single storey extension, reference 19/03989/HOU, was refused by the Council in November 2019. No appeal was made against the Council's decision. The owner of the property has been requested to rectify the breach of planning control, however no action has been taken. On 20 January 2021 the Planning Manager (Enforcement & Trees) authorised the issue of an Enforcement Notice. It is considered expedient to instigate Enforcement (Legal) Action as the unauthorised single storey extension is detrimental to visual amenity by virtue of its design, size and appearance, contrary to Policies DS1, DS3 and DS5 of the Council's adopted Core Strategy Development Plan Document, the Council's adopted Householder Supplementary Planning Document and the principles of the National Planning Policy Framework. Report to the District Planning Panel 19/00697/ENFUNA 66 - 68 Lumb Lane Bradford BD8 7QZ Report to the District Planning Panel 24 February 2021 Item Number: F Ward: MANNINGHAM Recommendation: THAT THE REPORT BE NOTED Enforcement Reference: 19/00697/ENFUNA Site Location: 66 - 68 Lumb Lane Bradford West Yorkshire BD8 7QZ Breach of Planning Control: Without planning permission the installation of externally mounted roller shutters, shutter boxes and associated guide rails, black hoarding and a projecting fascia board on the front elevation of the premises. Circumstances: Following an enquiry received in this office in August 2019, a site visit revealed the above breach of planning control. Despite a request from the Local Planning Authority, the owner of the property took no action to rectify the matter. It is considered expedient to issue an Enforcement Notice as the roller shutters, shutter boxes, associated guide rails, hoarding and fascia board obscure the entire frontage of the building when lowered, which combined with the projection of the shutter boxes, hoarding and fascia board results in a significantly dominant and incongruous appearance that is readily apparent in public views. The development has a significantly harmful effect on the appearance of the building and the quality of the street scene and Eldon Place Conservation Area. The Planning Manager (Enforcement and Trees) authorised enforcement action on the 17 December 2020 requiring the removal of the externally mounted roller shutters, shutter boxes, associated guide rails, black hoarding and projecting fascia board.
