Many women don’t get equal pay for equal work. High-quality affordable child care remains beyond the reach of millions of families. Title IX’s promise of educational opportunity has not been realized for every girl and woman. Reproductive health care is at great risk. And women of all ages are more likely than men to be poor. The Center is committed to taking on the toughest challenges ahead, to secure past gains and to advance equality and opportunity for women and their families. Davies† Confidence in the competence of the Court has not been won by the presence of an occasional man of genius. Felix Frankfurter & James Landis1 Once in a great while a member of the Supreme Court of the United States tries to get the last word. “Last word,” that is, in an official sense – a late-breaking opinion issued by a Justice acting as a Justice. Not in- formal last words such as anonymous stabs at colleagues via the press,2 or extemporaneous ejaculations from the bench,3 or post-retirement disclosure of changes of heart.4 Official, juridical attempts to get the last word come in two forms: (1) the surprise opinion, meaning a separate opinion (a concurrence or dissent) issued by a Justice without reasonable notice to the other Justices, after they have publicly committed themselves to a disposition of the case that does not, of course, account for the late-breaking opinion, and (2) the surprise revision, meaning a Justice’s significant alteration of an opinion after other Justices have publicly committed themselves, presumably at least in part in reliance on the original version. Last year’s death of the iconic liberal champion Stephen Reinhardt and the late 2017 departure of libertarian former Chief Judge Alex Kozinski—who both assumed pivotal circuit leadership roles over numerous years—and a few of their colleagues’ decision to leave active court service thereafter, mean the tribunal presently confronts four judicial emergencies and resolves most slowly the largest number of appeals. The 2016 and 2018 federal election cycles—which render uncertain the party that will capture the presidency and the Senate at the polls in 2020—show that more posts could open when additional jurists determine that they will change status across the Trump Administration. Nevertheless, striking partisanship will frustrate the effort to appoint Ninth Circuit judges.

    Michelle T. Friedland Nominee to the United States Court of Appeals for the Ninth Circuit On August 1, 2013, President Obama nominated Michelle T. Friedland to serve on the United States Court of Appeals for the Ninth Circuit. As a litigation partner in the San Francisco office of Munger, Tolles & Olson LLP and former U.S. Supreme Court clerk, she has extensive trial and appellate experience at both the state and federal levels. In nominating Ms. Friedland, President Obama lauded her remarkable legal career as “a [testament] to the kind of thoughtful and diligent [judge]” she will be on the Ninth Circuit.1 Biography Michelle Friedland was born in Berkeley, California in 1972. In 1995, she earned her undergraduate degree with honors in ecology and population biology from Stanford University, where she was elected to Phi Beta Kappa. She then studied political theory for a year at Oxford University on a Fulbright Scholarship. In 2000, she earned her law degree from Stanford Law School, where she was inducted into the Order of the Coif, received the Urban A. Sontheimer Award for graduating second in her class, and won the award for best student note.2 After graduating from law school, Ms. Friedland clerked for Judge David Tatel on the United States Court of Appeals for the D.C. Circuit. The following year, she clerked for United States Supreme Court Justice Sandra Day O’Connor. After completing these two distinguished clerkships, Ms. Friedland returned to Stanford Law School as a lecturer on Federal Jurisdiction and Environmental Law. In 2004, Ms. Friedland joined the firm of Munger, Tolles & Olson as an associate, and she was made partner in 2010.
