Annex 1 – Mandatory conditions

1 Sale of Alcohol

1 (1) No supply of alcohol may be made under the premises licence- (a) At a time when there is no designated premises supervisor in respect of the premises licence, or

(b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

2 (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children–

(a) Games or other activities which require or encourage, or are designed to require or encourage, individuals to–

(i) Drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

(ii) Drink as much alcohol as possible (whether within a time limit or otherwise);

(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

(d) Provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on– (i) The outcome of a race, competition or other event or process, or (ii) The likelihood of anything occurring or not occurring;

(e) Selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

3 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

4 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

5 The responsible person shall ensure that–

(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures–

(i) beer or cider: ½ pint; (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) still wine in a glass: 125 ml; and (b) customers are made aware of the availability of these measures.

Films

1 Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.

Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

Where- (a) the film classification body is not specified in the licence, or

(b) The relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question; admission of children must be restricted in accordance with any recommendation made by that licensing authority.

In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

Door supervision

(1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.

(2) But nothing in subsection (1) requires such a condition to be imposed- (a) In respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c.12) (premises with premises licences authorising plays or films), or (b) In respect of premises in relation to- (i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or (ii) Any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

(3) For the purposes of this section- (a) "Security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and

(b) Paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.

Annex 3 – Conditions attached after a hearing by the licensing authority

Conditions added at the Licensing Hearing

1. The conditions will attach to all licensable activities carried on at the premises unless expressly stated otherwise. The use of the premises for one or more licensable activities shall constitute an ‘event’ for the purposes of this licence.

This premises licence cannot run in conjunction with any other premises licence issued for the Hop Farm and for a period of 12 months from the grant of this Premises Licence any other premises licence held in respect of these premises shall be suspended unless otherwise notified in writing to the Licensing Authority and . At the end of the stated 12 month period Premises Licence number 05/00766/PREP shall be surrendered by the Premises Licence Holder.

2. The total numbers of persons attending on site at any one time and the types of events will be limited in accordance with the following categories:

2.1. Category A - 30,001 to 53,000

2.2. Category B - 8,001 to 30,000

2.3. Category C – Less than 8,001 unless to meet exceptional circumstances on any day and to ensure public safety and prevent crime disorder this figure has to be increased to protect against any unexpected influx of additional customers and then only so long as it is reasonably safe to do so. Such an increase will limit the overall numbers on site to 10,000 and will comply with the general conditions below, any such decisions to be made and recorded in writing by the Events Safety Officer and Premises Licence Holder.

3. 3.1. No more than one category A event and five category B (or if the category A event has to be downgraded six category B) events will be held in any calendar year, no more than one event to be held in any calendar month with the exception of two events in July and one event in August (which shall be a music event in 2010 and 2011 with the prior consent of the Licensing Authority) provided that

(a) after a period of 2 years from the grant of this Premises Licence the Premises Licence Holder shall be permitted to provide 2 Category B events in August with the prior consent of the Licensing Authority

(b) for a period of 2 years from the grant of this Premises Licence there shall be a minimum 3 week period between the end of the later of the 2 events in July and the commencement of the Category B event in August

(c) in the event of 2 category B events being permitted in August, only one of these shall be a music event

Details of the nature of the event will be supplied to the police licensing officer and the Licensing Authority. Save as specified above, there must be a minimum of two weeks between any such events. As at 1 January 2012 if an established category C event, being an event that has been held at the premises for a continuous period of 3 years is attracting numbers that would require to be classified as a category B event then no more than two can be added into the event plan and this condition revised to permit a maximum of one category A event and seven category B events without requiring an application to vary this condition.

3.2. For the purposes of this licence a music event is defined as an event where one of the principal licensable activities is the provision of live or recorded music.

3.3. The duration of any Category A or B event shall not exceed 3 days in respect of any music event and 5 days in respect of non-music events (these periods exclude any period for camping and set up or break down periods) provided that

(a) War and Peace may last up to 6 days subject to there being no music played after 15:00 hours on the additional day.

(b) The duration of any Category B event can be extended with the prior approval of the Licensing Authority.

4. If a Category A or Category B has to be downgraded to a Category C event then at least 17 days notice in writing is required to the Licensing Authority and to Kent Police and the Responsible Authorities. If the event is downgraded with less than 17 days notice all requirements associated with the planned Category A or category B event will remain in place.

5. 5.1. For all events the Premises Licence Holder will ensure an appropriate risk assessment is carried out and far as reasonably practicable ensure there is compliance with all aspects of the Events Safety Guide published by the Health & Safety Executive.

5.2. The Premises Licence Holder will attend Safety Advisory Group (SAG) meetings to be held in January and monthly between April and October in any given year;

The Licensing Authority will have regard to the views of the SAG in exercising its functions under this licence

6. The Premises Licence Holder will prepare a Major Incident Plan and lodge with Kent Police and the Licensing Authority for the Hop Farm site and comply with the provisions thereof. This plan will be reviewed annually unless otherwise agreed by the Licensing Authority and Kent Police.

7. For all events identified by the Licensing Authority the Premises Licence Holder will prepare and submit to the Licensing Authority and to Kent Police no later than 8 weeks before the event a Community Impact Assessment (CIA). This shall include the documentation of reasonable action to be taken by the Premises Licence Holder to mitigate the effects of the event on the local community so as to demonstrate how the licensing objectives will be met. The Premises Licence Holder shall comply with the provisions of the CIA (either as submitted to or as modified by the Licensing Authority in consultation with the Premises Licence Holder).

8. The Premises Licence Holder shall identify a competent event safety officer (‘the Event Safety Officer’) for all events and circulate their name to the licensing authority and Kent Police in order to provide a specific point of contact in relation to all matters pertaining to safety, before, during and after events. (This person must have the authorisation and an ability to act unhindered on any issues relating to safety).

9. 9.1. A proposed calendar of events at the site including any events outside the scope of the Licensing Act 2003 will be submitted to Kent Police and the Licensing Authority, annually in January detailing the events planned for the following 12 months. Any additions, amendments, or alterations to the calendar of events shall be notified to Kent Police, the Licensing Authority, in writing (by letter, e-mail or fax) as soon as practicable. There will be a standing agenda item at the monthly SAG meetings advising of forthcoming events that might be additional to the calendar of events. The Environment Agency will be notified of any Category A or Category B events.

9.2. For all events the period of notice to be given shall be three months prior to the proposed event unless the event is booked to take place less than 3 months ahead in which case such additions shall be notified under sub-clause (9.1) above as soon as practicable

Transport

10. The Premises Licence Holder will prepare a Traffic Management Plan for the site, submit it to Kent Police, the Licensing Authority the Highways Authority and the Local Planning Authority and comply with the provisions thereof either as submitted to or as modified by the aforesaid bodies. In consultation with the premises licence holder. This will include the implementation as far as reasonably practicable a permanent signage scheme to be installed in consultation with the Kent Police, Highways Authority and Local Planning Authority, directing traffic to the Hop Farm and away from local villages.

11. No helicopter landings or take offs, other than any required in response to an emergency, shall take place at the site for the duration of any event without consultation and written permission by e-mail, letter or fax from the Environmental Department of Tonbridge & Malling Borough Council and The Licensing Authority. This condition does not apply to the helicopter flights that take place in respect of the War and Peace event.

Security and People Management

12. In Category A and Category B events during an event where tickets or wristbands are to be used at each entrance and exit on the licence site the Premises Licence Holder shall ensure that a means of counting the public entering and leaving the site through any of the entries or exits is in place. The nature of the systems of counting will be agreed with the Kent Police and the Licensing Authority and the Premises Licence Holder shall comply with the agreed system. A proportionate means of complying with this condition will be agreed with the Licensing Authority and Kent Police in respect of Category C events.

13. Figures for pre-event ticket allocation will be provided to Kent Police and/ or the Licensing Authority upon request, information will be supplied within 24 hours of any such request.

14. For any event where tickets may be sold or allocated on the gate the maximum number of tickets that may be sold or allocated prior to the day of the event will be:

Category A – 48,000 Category B – 28,500 Category C - 7,000

15. Stewards will be easily distinguishable from members of the public and other SIA or police personnel and shall wear reflective clothing clearly marked “Steward” or other appropriate word signifying their duties.

16. For all events all Stewards will be trained in their duties prior to allowing members of the public onto the site to ensure they have a full understanding of the infrastructure procedures. All training records will be kept by a responsible person and be available for inspection upon reasonable notice being given.

17. For relevant events identified by Kent Police the Premises Licence Holder will provide suitable receptacles to dispose of glass, drugs, needles and weapons on entry to such an event and such provision must be made at all entrances to the event unless previously agreed with the police that this will not be necessary.

18. Searching as a condition of entry will be mandatory when directed by Police following consultation with the Premises Licence Holder based on audience profile and police intelligence prior to any event

19. The Premises Licence Holder shall ensure authorised officers of Kent Police shall have free access to all parts of the licensed site at all reasonable times for the purposes of supervision and enforcing the observance of the licensing objectives under the Licensing Act 2003.

20. The Premises Licence Holder will make arrangements for maintaining public rights of way on the site or for closure or dealing with the manner in which the members of the public will be escorted through or around the site, such arrangements to be confirmed or notified to the licensing authority.

Lighting

21. No later than 28 days prior to any event the Premises Licence Holder will provide to the Licensing Authority the Local Planning Authority, the Environmental Health Department of Tonbridge and Malling Borough Council and Kent Police a plan detailing suitable and sufficient lighting in respect of all events (‘the Lighting Plan’). Any update to these plans will be notified to and agreed with the aforesaid bodies. Any amenity lighting (not being lighting agreed by the aforesaid bodies to be security or safety lighting) shall be orientated to minimise its impact on the surrounding area.

The Premises Licence Holder shall at all times comply with the provisions of the Lighting Plan (either as submitted to or modified by the aforesaid bodies)

Sales of Alcohol

22. The Premises Licence Holder will prepare and agree with the Licensing Authority and Kent Police an Alcohol Management Plan that will include:

22.1. Details of staff training, recording of such training and arrangements to provide such records to Kent Police and Trading Standards

22.2. The manner in which the stewards will monitor the bars and the personal licence holder will enforce compliance with the Licensing Act 2003

22.3. Proposals to comply with the requirement that no person under the age of 16 will be admitted in any structure utilised for the sale of alcohol unless accompanied by an adult

22.4. Confiscation of alcohol in respect of anyone who appears to be under the age of 18

22.5. In respect of any open air field event or marquee used in conjunction with such an event the sale of liquid refreshments, including alcohol only being made in polycarbonate containers, plastic bottles, plastic or waxed paper cups except any form of liquid refreshment within the campsite for consumption in that area only by campsite users

22.6. A requirement that any glass receptacle found in the possession of any person at any open air event or marquee used in conjunction with such an event will be confiscated

22.7. For any category A or B event that at least four personal Licence holders shall be employed in addition to the designated premises supervisor and each will have responsibility for a designated area specified for the sale of alcohol and the plan will detail how they will manage alcohol sales and arrange storage in a safe and legal manner for the duration of the event.

22.8. For any events deemed appropriate by the Kent Police or Trading Standards no persons under the age of sixteen to be allowed on to the site unless accompanied by a persons of the age of eighteen years or over

The Premises Licence Holder shall at all times comply with the provisions of the Alcohol Management Plan (either as submitted to or modified by the Licensing Authority and Kent Police in consultation with the Premises Licence Holder)

23. 23.1. A challenge 25 proof of age scheme will be operated at any bar or any alcohol outlet and will be adhered to by all staff. There will be sufficient signage to notify all members of the public of the operation of the scheme

23.2. A written refusals book will be maintained at each bar or outlet where alcohol is provided or sold on the licence site. This book will be bound and clearly marked. The following information will be recorded for every refusal:

1. The time of refusal; 2. The item refused; 3. Name or description of person refused the sale; 4. Reason for refusal; 5. Name of staff member making the refusal;

23.3. The supervisor on duty will sign or countersign all entries in the refusal book at the end of each shift

23.4. All refusal books will be made available for inspection to any police officer, local authority, licensing officer or Trading Standards Officer at any reasonable time 23.5. No person under the age of 18 is permitted to sell alcohol, unless involved in a training bar programme working in the Shires Bar and Restaurant or such other area as may be notified to Kent Police

Food registration

24. The Premises Licence Holder will use its best endeavours to ensure that details of food vendors are provided to the Licensing Authority 28 days before any event. The documentation that vendors will be required to provide in advance of the event will be agreed by the Environmental Health Department of Tonbridge and Malling Borough Council. The Premises Licence Holder will cooperate with Officers’ requests to close down or remove from the site any food vendors failing to meet safety critical legal requirements.

Documentation to be submitted in advance of events 25. In respect of all events the generic risk assessment will operate as the Event Management Plan unless the Licensing Authority deems otherwise in which case an event management plan and an event safety management plan shall be submitted to and approved by the Licensing Authority no later than 3 months prior to the event subject to condition 10 where a lesser period of notice maybe given. The requirements of the approved Plans shall be fully implemented during the event. The plan shall deal with the following issues:

25.1. The event profile and overview;

25.2. Event management structure, chain of command, event management responsibilities, emergency liaison team;

25.3. If zones are to be identified –clearly marked within each zone: an arena operation where appropriate facilities and attractions including main stages, sterile areas, ingress conditions including weapons and drug search and crowd control;

25.4. Public and worker safety including security and crowd management within the site;

25.5. Major incident plan including emergency vehicle routes, evacuation procedures and places of safety;

25.6. Site information detailing by zone, including, but not limited to, fire safety, temporary structures, barriers, fencing, sanitary/washing and welfare facilities, lighting and electrical work, fuel storage and use;

25.7. The event specific risk assessments and health and safety policy including pre-during and post-event;

25.8. First aid and medical services plan;

25.9. Cleaning schedule;

Camping Management Plan including:

25.10. Division of the camp sites into zones which will be filled sequentially to a density not exceeding 430 tents per hectare.

25.11. Location of vehicles camper vans and caravans

25.12. Separation distances that will be agreed with the Fire Authority,

25.13. Supervision by stewards.

25.14. Fire observation towers and their staffing

25.15. Communication between the towers and Event Control.

25.16. The distance of tents from a fire lane and provision of additional fire

25.17. Points as agreed with the Fire Authority.

25.18. A generic Plan for the provision of toilet, water and washing facilities for both the camping areas and any arenas

25.19. In respect of open air events a proportionate system to deter unauthorised access to the riverside between the event and any associated facilities and the River Medway (to include such items as signage and hazardous tape).

25.20. Details of special effects (e.g. pyrotechnics) and associated risk assessments for displays, fun fairs and other attractions;

25.21. Where the site is to be zoned, site plans showing agreed zones which will be distributed to the licensing authority and the police by email and any service provider involved in the event. The final site plan will be submitted 28 days prior to the event and site plans will be made available during the event at Forward Control or as directed by Kent Police.

25.22. Secure lockers shall be provided for camp site users attending any event upon prior request by the Licensing Authority or Kent Police.

The Premises Licence Holder shall at all times comply with the provisions of the Camping Management Plan (either as submitted to or modified by the Licensing Authority)

Signage

26. A scheme showing the disposition and content of signage to be displayed at the entrance and exits will be submitted and approved by the Licensing Authority (such consent must not be unreasonably withheld) and reviewed as the event progresses such a scheme would include specific mention of crime prevention messages including reference to the location of any secure property lockers provided on the site if required.

27. The Premises Licence Holder shall prepare a Traffic Management Plan including a public transport plan and a traffic impact assessment and submit to Kent Police, the Licensing Authority and the Highway Authority no later than three months prior to the event or in the event of late bookings as soon as possible.

The Premises Licence Holder shall at all times comply with the provisions of the Traffic Management Plan (either as submitted to or modified by the aforesaid bodies)

28. The Premises Licence Holder shall maintain a register of all drugs found or seized within the Hop Farm site and notify Kent Police of any such items as soon as practicable. Drugs will be kept within a secure storage facility and will only be removed on collection by a Police Officer.

29. A list of Security staff will be submitted to Kent Police no later than one week prior to the event commencing this list may produce a pool of people from which the actual personnel will be drawn.

The Premises Licence Holder shall provide to Kent Police

29.1. a daily list of those personnel actually working on site prior to the event opening to the public

29.2. a list of proposed SIA registered security staff together with badge numbers will be submitted to the licensing authority three days prior to the event at which they are to work is due to take place. Any changes to this list will be notified daily prior to the site opening to the public

29.3. All Security Staff and stewards will receive a written statement of their duties

29.4. Written duties sheets will be agreed with Kent Police and the Licensing Authority prior to any event taking place.

The Premises Licence Holder shall ensure that the minimum number of stewards as recommended in the events safety guide and as determined through the event risk assessment.

Noise Management

30. A generic noise management plan will be drawn up, taking into consideration the range of events held at the Hop Farm. This will be agreed with the Licensing Authority on an annual basis (in October of each year) and will deal with;

30.1. How noise arising from any event shall be effectively controlled so as to prevent public nuisance,

30.2. The control of noise from PA systems or other specific noise sources,

30.3. The control of Noise levels including the notification of and the appointment of relevant personnel as set out in the plan,

30.4. Up to 23:00hrs, limiting music noise levels (LAeq, 15min) so they shall not exceed 15dB(A) above agreed background noise levels (LA90, 15min) and, in the 63Hz and 125Hz octave bands, so they shall not exceed Leq, 15min 70dB in any 15 minute period at any representative noise sensitive premises, on no more than 12 calendar days in each year

30.5. How post 23:00hrs, music noise from any event shall be barely audible outside noise sensitive premises. Other noise as far as reasonably practicable shall be barely audible outside noise sensitive premises,

30.6. The agreed methodology by which sound propagation test(s) shall be undertaken prior to any music events in order to set appropriate control limits at the sound mixer position,

30.7. In respect of one Music event held in any given year the general noise plan will permit a period of no more than 6 hours split over 3 days entertainment to be provided where the target noise level at the mixer desk can be set at 98dBA provided that the music noise level at the agreed monitoring points shall not exceed the noise agreed background levels by more than 18dBA

30.8. In respect of the Category A music event the arrangements by which the noise consultant or competent person will continuously monitor noise level at the sound mixer position for all stages, 5 specified continuous monitoring positions and responsive monitoring positions prompted by complaints or unforeseen circumstances e.g. weather conditions, and advise the sound engineer of any adjustments required to comply with the specified noise limits as defined in the noise management plan.

30.9. In respect of Category B music events the noise monitoring arrangements to be agreed between the Premises Licence Holder and Licensing Authority prior to each event,

30.10. The arrangements for responding to any excess of the specified noise limits,

30.11. In respect of category A and Category B events details of the arrangements to ensure that security staff patrol the site, including the camping areas, at all times throughout the day and night and take appropriate action in respect of excessive noise emissions,

30.12. The appointment by the Premises Licence Holder of a competent person, who shall liaise with the Licensing Authority, Kent Police and the Environmental Health Officer before, during and after events, on all matters relating to noise control within the management plan,

30.13. The plan shall not be altered or varied without the agreement of the Licensing Authority. The plan shall be fully implemented during events.

30.14. Noise measurement data shall be submitted to the Licensing Authority within 28 days after the event. This shall include all permanent and roving data. Where possible this should be provided as 15 minute periods as per the requirements of condition iv,

30.15. The setting up, publicising and staffing of a dedicated telephone number to receive and respond to complaints by members of the public. This shall be staffed for the duration of the music event and all calls received and any response recorded. These records to be provided to the Licensing Authority on completion of the event,

Flood Risk Assessment and evacuation plan

31. The generic risk assessment will cover a method to deal with flood risk and evacuation but only in respect of events identified by the Licensing Authority (following advice from the Environment Agency) will it be necessary to be submitted to and approved by the Licensing Authority not less than three months before any event taking place. Additionally in respect of certain events identified by SAG the plan must be deposited with any forward control for the event, the Environment Agency, Kent Police, Kent County Council Emergency Planning Officer and the Licensing Authority.

32. The Premises Licence Holder will provide suitable, securable forward control facilities at any event where the safety advisory group consider it necessary.

Local Residents A dedicated telephone line shall be set up and staffed by the Premises Licence Holder at all times during any licensable event when reasonably required by the Licensing Authority so that members of the public can contact the organiser with any problems they may have. The number of this telephone line shall be publicised at least two weeks prior to the start of the event to all residents likely to be disturbed by the activities at the event. This number will also be provided to the Clerks of Parish Council, Capel Parish Council, Parish Council, Nettlestead Parish Council and Paddock Wood Town Council.
