Ltd. - CRZClearance - Reg.

Sir, This has reference to your letter no. Nil dated 03.01.2014 and subsequent letter dated 15.04.2014 seeking prior CRZ Clearance on the above-mentioned subject.

2. The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of CRZ Clearance for Construction of Beach Resort at Sy. no. 25/9 to 14, Rushikonda Village, Bheemlili Beach Road, Division no. 06, Zone-I, GVMC, Vishakhapatnam, Andhra Pradesh by M/ s Ananthakoti Raju Developers Pvt. Ltd. The proposal st was considered by the EAC in its meetings held on 21st - 22nd March, 2014, 21 _ 22nd April, 2014; and reconsidered in EAC meeting held on 30th June, 2014 - 2ndJuly, 2014. The proponent has informed that:

1. The proposal involves construction of beach resort at Survey no. 25/9 tc 14, Rushikonda Village, Bheemlili Beach Road, Division No. 06, Zone-I, GVMC,Vishakhapatnam. 11. Location: The geographical location of the site is 17°47'14.11"N latitude: and 83°23'4.20" E Longitude on the road connecting Visakhapatnam tc . 111. Area:The total plot area is 4152.05 sq.mts and the total built up area [Stil: +G + First floor) will be of 2289.05 Sq mts. IV. Three no. of blocks namely Main building, Function Hall & Meditation Hal which comprises a Stilt, G + First Floor are proposed to be constructed The stilt area has been totally allocated for parking only. v. The water requirement is projected as 3.75 KLDfor drinking and 8 KLDfo other functions. Total fresh water will be met from GVMC on chargeabh basis. VI. The sewage will be treated in STP which comprises of Screen Chamber Collection Tank, Equalization Tank, Aeration Tank, Secondary clarifier ani Page 1 of CRZ_Ananthakoti_Raju_Beach Resort db· • Territory system like Sand filter and activated carbon filter. The treated waste water will be used for lawn development, green belt area usage and Toilet flushing. Total land allocated for green belt development will be of 2084.34 sq.mts. The solid waste generated is 20 kg/day will be sent to GVMC- dumping site. vn. Power: The power requirement is 50 KVAand will be sourced by APSEB. V111. Parking: The parking space provided for 4 buses, 47 cars and 54 two wheelers. IX. Cost: The estimated cost is Rs. 1.15 crores and out of which 0.30 lakhs will be spent for Environmental Management. x. Approvals: The HTL demarcation was done by IRS, Anna University. An area of 3771.94 Sq.mt fall in 200-500 m from HTL of CRZ-III and 380.11 sqm is falling within No Development Zone i.e. in 0-200 m from HTLas per the approved Coastal Zone management Plan of the area. The Andhra Pradesh Coastal Zone Management Authority has recommended the project vide letter no.7566/ENV /CZMA/2013 dated 01.03.2014. Xl. Wildlife issues: There are no national Parks, wildlife sanctuary, biosphere reserves found in the 10 km buffer zone. xu. There is no court cases/violation pending with the project proponent

3. The proposal was considered by EAC in its meetings held on 21st - 22nd March, 2014 & 21st - 22nd April, 2014 and sought additional information viz. details of parking requirement along with proposed parking and traffic circulation plan etc at peak utilization time considering parking of buses etc, details on emergency evacuation in case of disasters/ natural disasters, details of green belt on the layout and details of energy savings along with the estimation, etc. The proponent submitted detailed drawings showing the parking during peak utilization accommodating 4 buses and 47 cars and 54 two wheelers. Traffic Circulation plan with directions for free flow of vehicles in the project layout has also been submitted along with Emergency Evacuation Plan. Green belt density has been increased and detailed drawing has been submitted. An Appendix has been added to the Energy Savings report showing the break-up of energy savings at individual item level. The proposal was considered by the Expert Appraisal Committee (EAC)and recommended in its meeting held on 30th June, 2014 - 2nd July, 2014 for granting CRZ Clearance. The Ministry of Environment, Forests & Climate Change hereby accords CRZ Clearance for the above-mentioned Construction of Beach Resort at Sy. no. 25/9 to 14, Rushikonda Village, Bheemli1i Beach Road, Division no. 06, Zone-I, GVMC,Vishakhapatnam, Andhra Pradesh by M/s Ananthakoti Raju Developers Pvt. Ltd. under the provisions of the CRZ Notification, 2011 and amendments thereto and Circulars issued thereon and subject to the compliance of the following specific conditions, in addition to the general conditions mentioned below: A. SPECIFICCONDITIONS:

(i) "Consent for Establishment" shall be obtained from State Pollution Control Board under Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974.

~ CRZ_Ananthakoti_Raju Page 2 of6 • (ii) Maintain mmirnum set back of 7.5 mts towards south of the administrative block. (iii) As committed, the width of the roads and the corners of the internal road should be increased so that emergency fire fighting vehicle can pass easily all around the peripheral driveway.

(iv) All the conditions/recommendations stipulated by the Andhra Pradesh State Coastal Zone Management Authority vide letter No. 7566/ENV /CZMA/2013 dated 01.03.2014, shall be strictly complied with. (v) There shall be no ground water drawl in No Development Zone of CRZ area. Between 200-500m from HTL,the water can be tapped with the approval of the State Ground Water Authority.

(vi) There shall be no discharge of sewage waste even after treatment. The Project Proponent, ensure 100% recycling of sewage/liquid waste by application in gardening and/ or flushing through duel piping system.

(vii) The quality of treated effluents, solid wastes, emissions and noise levels and the like, from the project area must conform to the standards laid down by the competent authorities including the Central or State Pollution Control Board and under the Environmen (Protection) Act, 1986. (viii) The total covered area on all floors shall not exceed 33 percent of th plot size i.e., the Floor Space Index shall not exceed 0.33 and th open area shall be suitably landscaped with appropriate vegets cover; (ix) The overall height of construction up to the highest ridge of the roo shall not exceed 9 metres and the construction shall not be moi than two floors (ground floor plus one upper floor); (x) Live fencing and barbed wire fencing with vegetative cover may b provided around private properties subject to the condition that SU(l_ fencing shall in no way hamper public access to the beach; to allc public access to the beach, at least a gap of 20metres width shall e provided if the width of the plot is more than 500 metres. (xi) There shall be no extraction of sand, levelling or digging of sariv stretches except for structural foundation of building, swimmig pool; no flattening of sand dunes shall be carried out. (xii) The construction shall be consistent with the surrounding landscae and local architectural style.

(xiii) There shall be no development within 0-200 m from HTL- 0 Development Zone area.

(xiv) There shall be no disposal of waste into the coastal area. All the sed .waste shall be handl~ as per the Solid waste Management Rules ..

CRZ_AnanthakoD_Raju ~ Page 3 6 • (xv) No construction work other than those permitted m Coastal Regulation Zone Notification shall be carried out m Coastal Regulation Zone area.

(xvi) Construction activity shall be carried out strictly as per the provisions of CRZ Notification, 2011. No construction work other than those permitted in Coastal Regulation Zone Notification shall be carried out in Coastal Regulation Zone area.

(xvii) The solid waste generated shall be properly collected, segregated and disposed in accordance with the provision of Solid Waste (Management and Handling) Rules, 2000.

(xviii)The project proponent shall set up separate environmental management cell for effective implementation of the stipulated environmental safeguards under the supervision of a Senior Executive.

B. GENERAL CONDITIONS:

(i) Adequate provision for infrastructure facilities including water supply fuel and sanitation must be ensured for construction workers during the construction phase of the project to avoid any damage to the environment.

(ii) Full support shall be extended to the officers of this MinistryjRegional Office at Chennai by the project proponent during inspection of the project for monitoring purposes by furnishing full details and action plan including action taken reports in respect of mitigation measures and other environmental protection activities.

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to the Regional Office of this Ministry at Chennai regarding the implementation of the stipulated conditions.

(iv) Ministry of Environment, Forests & Climate Change or any other competent authority may stipulate any additional conditions or modify the existing ones, if necessary in the interest of environment and the same shall be complied with.

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulated are not complied with the satisfaction of the Ministry.

(vi) In the event of a change in project profile or change in the implementation agency, a fresh reference shall be made to the Ministry of Environment, Forests & Climate Change.

(vii) The project proponents shall inform the Regional Office as well as the Ministry, the datec£___of financial closure and final approval of the CRZ_Ananthakoti_Raju Page 4 of6 • project by the concerned authorities and the date of start of land development work.

(viii) A copy of the clearance letter shall be marked to concerned Panchayat /Iocal NGO, if any, from whom any suggestion/ representation has been made received while processing the proposal.

(ix) A copy of the environmental clearance letter shall also be displayed on the website of the concerned State Pollution Control Board. The EC letter shall also be displayed at the Regional Office, District Industries centre and Collector's Office/ Tehsildar's office for 30 days.

(x) The funds earmarked for environmental protection measures shall be kept in separate account and shall not be diverted for other purpose. Year-wise expenditure shall be reported to this Ministry and its concerned Regional Office.

5. These stipulations would be enforced among others under the provisions of Water (Prevention and Control of Pollution) Act 1974, the Air (Prevention and Control of Pollution) Act 1981, the Environment (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification 1994, including the amendments and rules made thereafter.

6. All other statutory clearances such as the approvals for storage of diese from Chief Controller of Explosives, Fire Department, Civil Aviation Department Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponents from the respective competen authorities.

7. The project proponent shall advertise in at least two local Newspaper widely circulated in the region, one of which shall be in the vernacular languag informing that the project has been accorded CRZ Clearance and copies c clearance letters are available with the State Pollution Control Board and may als be seen on the website of the Ministry of Environment, Forests & Climate Chang at http://www.envfor.nic.in. The advertisement should be made within 10 day from the date of receipt of the Clearance letter and a copy of the same should b forwarded to the Regional office of this Ministry at Chennai.

8. This Clearance is subject to final order of the Hon'ble Supreme Court c India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civi No.460 of 2004 as may be applicable to this project.

9. Any appeal against this clearance shall lie with the National Greer Tribunal, if preferred, within a period of 30 days as prescribed under Section H of the National Green Tribunal Act, 2010.

10. Status of compliance to the various stipulated environmental conditior and environmental safeguards will be uploaded by the project proponent in i1 website.

Panchayat, Zilla Parisad z Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the company by the proponent.

12. The proponent shall upload the status of compliance of the stipulated Clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF&CC,the respective Zonal Office of CPCB and the SPCB.

13. The environmental statement for each financial year ending 31st March in Form-Vas is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of Clearance conditions and shall also be sent to the respective Regional Offices of MoEF&CC by e-mail. ~s ~
