The Four Courts of Sir Lyman Duff
THE FOUR COURTS OF SIR LYMAN DUFF RICHARD GOSSE* Vancouver I. Introduction. Sir Lyman Poore Duff is the dominating figure in the Supreme Court of Canada's first hundred years. He sat on the court for more than one-third of those years, in the middle period, from 1906 to 1944, participating in nearly 2,000 judgments-and throughout that tenure he was commonly regarded as the court's most able judge. Appointed at forty-one, Duff has been the youngest person ever to have been elevated to the court. Twice his appointment was extended by special Acts of Parliament beyond the mandatory retirement age of seventy-five, a recogni- tion never accorded to any other Canadian judge. From 1933, he sat as Chief Justice, having twice previously-in 1918 and 1924 - almost succeeded to that post, although on those occasions he was not the senior judge. During World War 1, when Borden considered resigning over the conscription issue and recommending to the Governor General that an impartial national figure be called upon to form a government, the person foremost in his mind was Duff, although Sir Lyman had never been elected to public office. After Borden had found that he had the support to continue himself, Duff was invited to join the Cabinet but declined. Mackenzie King con- sidered recommending Duff for appointment as the first Canadian Governor General. Duff undertook several inquiries of national interest for the federal government, of particular significance being the 1931-32 Royal Commission on Transportation, of which he was chairman, and the 1942 investigation into the sending of Canadian troops to Hong Kong, in which he was the sole commissioner . -

Peter Regenstreif A THREAT TO LEADERSHIP: C.A.Dunning and Mackenzie King BY Now mE STORY of the Progressive revolt and its impact on the Canadian national party system during the 1920's is well documented and known. Various studies, from the pioneering effort of W. L. Morton1 over a decade ago to the second volume of the Mackenzie King official biography2 which has recently appeared, have dealt intensively with the social and economic bases of the movement, the attitudes of its leaders to the institutions and practices of national politics, and the behaviour of its representatives once they arrived in Ottawa. Particularly in biographical analyses, 3 a great deal of attention has also been given to the response of the established leaders and parties to this disrupting influence. It is clearly accepted that the roots of the subsequent multi-party situation in Canada can be traced directly to a specific strain of thought and action underlying the Progressivism of that era. At another level, however, the abatement of the Pro~ gressive tide and the manner of its dispersal by the end of the twenties form the basis for an important piece of Canadian political lore: it is the conventional wisdom that, in his masterful handling of the Progressives, Mackenzie King knew exactly where he was going and that, at all times, matters were under his complete control, much as if the other actors in the play were mere marionettes with King the manipu lator. His official biographers have demonstrated just how illusory this conception is and there is little to be added to their efforts on this score. -

OUR FIRST OLD AGE PENSION 1915-1927 Summary Canada was a changed nation by the end of the First World War (1914-1918). War-time demand led to more industrial production. The urban labour force grew, so that by the 1920s most people lived in the city rather than the country. New factories favoured the young, and jobs that were traditionally done by older people began to disappear. Seniors could look forward to living longer, but many lived in severe poverty. Workers who supported aging parents had a hard time saving for their own old age. Survivor and disability pensions were created for war veterans and their families, but there was still a strong and growing need for a national old age pension system. The Government Annuities plan of 19081 was not the answer since few people could afford them. So in the 1920s, the issue of government assistance for the elderly was back on the political agenda. In 1924, Parliament appointed a special committee to study the question of pensions. Political advocates like James S. Woodsworth and Abraham A. Heaps argued for a national pension scheme. When his government finally won a majority in 1926, Mackenzie King followed up on his promise to Woodsworth and Heaps by introducing legislation that became the Old Age Pensions Act in 1927. In 1927, Canada’s first Old Age Pensions Act was passed: · The maximum pension was $20 per month or $240 per year. · It was available to British subjects aged 70 or over who had lived in Canada for 20 years. 1 Government Annuities: The Canadian Government Annuities Act of 1908 was one of the earliest significant pieces of social legislation in Canada. -

JOURNAL OF NEW BRUNSWICK STUDIES Issue 2 (2011) “Everybody Called Her Frank”1: The Odyssey of an Early Woman Lawyer in New Brunswick Barry Cahill Abstract In February 1934 Frances Fish was called to the bar of New Brunswick and spent the next forty years practising law in her home town of Newcastle (now City of Miramichi) NB. In 1918 she had been both the first woman to graduate LLB from Dalhousie University and the first woman to be called to the bar of Nova Scotia. Though she initially intended to remain in Halifax, she instead left Nova Scotia almost immediately, abandoning the practice of law altogether. She spent the next fifteen years working as a paralegal in Ottawa and Montreal before returning to New Brunswick and resuming the practice of law. This article is a study of Fish’s career in New Brunswick, framed within the experience of the first women lawyers in Canada, of whom she was the seventh.2 Résumé En février 1934, Frances Fish a été reçue au Barreau du Nouveau-Brunswick. Pendant les quarante années qui ont suivi, elle a pratiqué le droit dans sa ville natale, Newcastle (qui fait maintenant partie de la ville de Miramichi), au Nouveau-Brunswick. ONE HUNDRED YEARS OF PEACE: Memory and Rhetoric on the United States/ Canadian Border, 1920-1933 Paul Kuenker, Ph.D. Student, School of Historical, Philosophical and Religious Studies, Arizona State University In the fall of 2010, artists Annie Han and Daniel Mihalyo of the Seattle- based Lead Pencil Studio installed their newest sculpture adjacent to the border crossing station located at Blaine, Washington and Surrey, British Columbia on the U.S./Canadian border. Funded by the U.S. General Services Administration’s Art in Architecture program as part of its renovation of the border crossing station, Han and Mihalyo’s Non-Sign II consists of a large rectangular absence created by an intricate web of stainless steel rods (Figure 1). The sculpture evokes the many billboards that dot the highway near the border, yet this “permanent aperture between nations,” as Mihalyo refers to it, frames only empty space. According to Mihalyo, the sculpture plays on the idea of a billboard in order to “reinforce your attention back to the landscape and the atmosphere, the thing that the two nations share in common.”1 Though it may or may not have been their intention, the artists ofNon- Sign II placed the work in a location where it is easily juxtaposed with a border monument from a different era—a concrete archway situated on the boundary between the United States and Canada. Designed by prominent road-builder and Pacific Highway Association President Samuel Hill, the Peace Arch was formally dedicated at a grand ceremony held on September 6, 1921, to celebrate over one hundred years of peace between the United States, Great Britain and Canada since the 1814 Treaty of Ghent (Figure 2). -
