President’s Message his is perhaps the most exciting academic year ever on Hofstra’s campus, as we prepare to host the third and final presidential debate of the 2008 Telection season on October 15, and again present Educate ’08, our unprecedented series of lectures, conferences, exhibitions and events focused on the presidency, history, politics and social issues. For the fall Educate ’08 series, we host nationally known figures such as Robert Rubin and Paul O’Neill, George Stephanopoulos, Dee Dee Myers and Ari Fleischer, Mario Cuomo and the Council on Foreign Relations’ Richard Haass, and many other scholars, journalists and policymakers. The Center for Civic Engagement presents its sixth Day of Dialogue, with nearly 50 sessions on critical issues of the day for Democracy in Performance, a live performance featuring actors portraying historic figures. Many of our academic departments and centers, such as the Peter S. Kalikow Center for the Study of the American Presidency, the National Center for Suburban Studies, and Hofstra Entertainment, will also present events with a presidential theme. The Hofstra Cultural Center’s popular Joseph G. Astman International Concert Series features All American Music, while the Hofstra Cultural Center joins the Hofstra University Museum in presenting a reunion of the directors of Hofstra’s series of renowned presidential conferences for On the Record: A Hofstra Presidential Conference Retrospective. In addition to our exciting political series, the Hofstra Cultural Center and the academic departments continue to present a variety of lectures, concerts, dramatic performances and events that will engage and delight the entire Hofstra and surrounding communities. -

POLICY IN SLAM DUNK STYLE George Tenet, with Bill Harlow. At the Center of the Storm: My Years at the CIA. New York: Harper Collins Publishers, 2007, 832 p. Reviewed by Gennady Evstafiev I have in front of me a huge 2007published volume (832 pages with appendices) of recollec tions of George Tenet, exDirector of the CIA. The book contains his memories of seven years that he spent at the head of this notorious department. Strictly speaking, Mr. Tenet served in the agency for nine years – during the first two he was a deputy of notorious John Deutch, whose 18 months of disgrace in the CIA ended in 1997. However, this is a different instructive story. So George Tenet and his directorship of the intelligence occurred during, probably, the most aggressive years of U.S. foreign policy and arrogant selfconfidence of Washington in its unsurpassable global power. Decisions taken in these years by two American administrations shook the stability of the world and continue to have their destructive impact on the prospects of international cooperation and peaceful democratic development of many countries. Reliance on military power, neglect of the opinion of the majority of nations, armstwisting pol icy towards weak countries and U.S. allies, enlightened use of official lies – all this resulted in an unenviable situation, in which the United States finds itself now. George Tenet is a partici pant of this process and an executor of many acts that have nothing to do with international law, the commitment to which is a popular topic of propaganda for the fans of U.S. -

Dione Brunson, B.A. MALS Mentor: Ralph Nurnberger, Ph.D. ABSTRACT The bold U.S. decision to invade Iraq in 2003 was anchored in intelligence justifications that would later challenge U.S. credibility. Policymakers exhibited unusual bureaucratic and public dependencies on intelligence analysis, so much so that efforts were made to create supporting information. To better understand the amplification of intelligence, the use of data to justify invading Iraq will be explored alongside events leading up to the U.S.-led invasion in 2003. This paper will examine the use of intelligence to invade Iraq as well as broader implications for politicization. Thank you to the organizers for inviting me to participate today in this retrospective on the 2003 invasion of Iraq. My role this morning, as I understand it, is to parse the international legal arguments surrounding the invasion and to reconsider them in the fullness of time that has elapsed. It is a role I agreed to take on with hesitation because it is difficult to add much that is new. I suppose I can take comfort in saying what I’ve already said, and saying it again today, because of how I view my obligations as an international lawyer. I believe we lawyers have a duty to stand up and insist that our leaders adhere to the rule of law in international relations and to help ensure that they are held accountable for the failure to do so. As I am sure you are all aware, much remains to be done in terms of accountability, especially in the United States, and it is disappointing that the Obama Administration has so far refused to prosecute what seem to be clear violations of the Torture Convention, including all the way up the chain of command if necessary. Today, however, my talk is confined to the legal arguments about the use of force in Iraq and an analysis of their persuasiveness. -

BUSH BROUGHT PURSUANT TO THE CONVENTION AGAINST TORTURE* * The present document is a modified version of an individual criminal complaint prepared for submission against George W. BUSH in anticipation of his visit to Geneva, Switzerland on 12 February 2011. The individual criminal complaint brought on behalf of an individual plaintiff was not filed, as planned, on 7 February 2011 because of the announcement, on the eve of the filing, that BUSH cancelled his trip. Factual details regarding that visit, as a basis for establishing BUSH’s presence in Switzerland and the inclusion of analysis of Swiss law is reflective of the origins of this document. This document is not intended to serve as a comprehensive presentation of all evidence against BUSH for torture; rather, it presents the fundamental aspects of the case against him, and a preliminary legal analysis of liability for torture, and a response to certain anticipated defenses. This document will be updated and modified as developments warrant. I. FACTUAL BACKGROUND A. George W. BUSH 1. George W. BUSH was born on 6 July 1946, in New Haven, Connecticut, United States. From 20 January 2001- 20 January 2009, BUSH served as president of the United States of America and Commander in Chief of the United States Armed Forces. Pursuant to Article II of the United States Constitution, executive power was vested in BUSH, as president of the United States. Upon assuming office, BUSH took an oath to ―preserve, protect and defend‖ the Constitution of the United States. 2. In his capacity as president of the United States of America and Commander in Chief, BUSH had authority over the agencies of the United States government involved in the torture program, including but not limited to, the Central Intelligence Agency (CIA), the Department of Defense (DOD), the Department of Justice (DOJ), the Department of Homeland Security (DHS), the Department of State (DOS), the Federal Bureau of Investigation (FBI) as well as over the White House and Office of the Vice President. -

Please provide them to [email protected] Chapter 6: US Strategic Competition with Iran: Competition in Iraq 2 Executive Summary "Americans planted a tree in Iraq. They watered that tree, pruned it, and cared for it. Ask your American friends why they're leaving now before the tree bears fruit." --Mahmoud Ahmadinejad.1 Iraq has become a key focus of the strategic competition between the United States and Iran. The history of this competition has been shaped by the Iran-Iraq War (1980-1988), the 1991 Gulf War, and the US invasion of Iraq in 2003. Since the 2003 war, both the US and Iran have competed to shape the structure of Post-Saddam Iraq’s politics, governance, economics, and security. The US has gone to great lengths to counter Iranian influence in Iraq, including using its status as an occupying power and Iraq’s main source of aid, as well as through information operations and more traditional press statements highlighting Iranian meddling. However, containing Iranian influence, while important, is not America’s main goal in Iraq. It is rather to create a stable democratic Iraq that can defeat the remaining extremist and insurgent elements, defend against foreign threats, sustain an able civil society, and emerge as a stable power friendly to the US and its Gulf allies.
