Government of India Ministry of Law & Justice Department of Legal Affairs (Branch Secretariat) Mumbai 400 020 ANNUAL REPORT FOR THE YEAR 2014-2015 The Ministry of Law & Justice, Department of Legal Affairs, Branch Secretariat, Mumbai is presently headed by the Senior Govt. Advocate & In- charge. He is assisted by one Additional Legal Adviser, one Additional Govt. Advocate and one Superintendent (Legal) and other officials. A Report to the above effect has been submitted as per the directives of the Central Information Commission for time bund implementation of obligations under Section 4 of the Right to Information Act, 2005. The particulars regarding functioning, duties, organization etc. said therein are wisely narrated in the following report: (i) The particulars of its organization, functions and duties ORGANIZATION: The Ministry of Law & Justice has basically divided into two sets, i.e. the Main Secretariat and its Branch Secretariats at Mumbai, Kolkata, Chennai and Bangalore. As far as the work handled by Mumbai Branch Secretariat is concerned, it includes tendering of legal advice, handling of litigation work pertaining to Bombay High Court, litigation pertaining to other sub-ordinate courts which falls under the entire western region and the administration of the Branch Secretariat. The Joint Secretary & Legal Adviser is the overall In-charge of the Branch Secretariat. Additional Govt. Advocates, Additional Legal Adviser, Assistant Legal Adviser & Superintendent (Legal) are assisting the above Joint Secretary level Officers and handling the advice, litigation and administrative matters of the Branch Secretariat. The Section Officer / Drawing & Disbursement Officer assists the Joint Secretary in the local administrative matters. In addition to the above, the work of the Branch Secretariat is bifurcated in separate sections for its smooth functioning, i.e. Advise Section, Misc. Original Side Litigation Section, Appellate Side Litigation Section, FERA/FEMA, DGFT, SAFEMA, etc. Litigation Section, Suits Arbitrations and Land Acquisition References Section. Each Section is dealt by a senior Officer of this Branch Secretariat. Assistants (Legal), Assistants (CCS), Accountant, PPS, PS, PAs, Court Clerks, UDCs, LDCs are other posts which assist the Officers in discharging their duties. 2 FUNCTIONS & DUTIES: The Ministry of Law & Justice, Department of Legal Affairs, Branch Secretariat, Mumbai renders advice to various Ministries / Departments of Government of India on receipt of the respective references from it on different kinds of legal matters and attends to the litigation work of the Central Government in Bombay High Court, C.A.T., other Tribunals and before all the Sub-ordinate Courts of entire Western Region. The entire work is performed by its Officers under the guidance of the Joint Secretary & Legal Adviser and/or the Senior Govt. Advocate and In-charge of this Branch Secretariat. This Branch Secretariat is always guided by the Hon’ble Secretary. No.F.44(10)/2004-Judl., dated 3rd September, 2004 – Modification of terms and conditions 10 O.M. No.F.36(2)/90-Judl., dated 4th June, 1991- Jurisdiction of Branch Secretariats / Supervision of Central Government Litigation work at different High Courts. (vi) A statement of the categories of documents that are held by it or under its control Ministry of Law & Justice, Department of Legal Affairs, Branch Secretariat, Mumbai is a nodal office coordinating with the Ministries / Departments of Government of India and assisting them in handling their advice as well as litigation matters before the Bombay High Court as well as Tribunals / Sub-ordinate Courts inferior to High Court. Therefore, this Branch Secretariat does not keep any original documents with it. All the documents / references received in this Branch Secretariat are invariably be returned to the litigant departments alongwith the advice or correspondence of litigation. (vii) The particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof The Branch Secretariat, Mumbai is dealing with the matters pertaining to Central Government / Ministries / Departments and hence it does not involve any consultation with the public. (viii) A statement of the Boards, Councils, Committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice and as to whether meetings of those Boards, Councils, Committees and other bodies are open to the public, or the minutes of such meetings are accessible for public As far as this Branch Secretariat is concerned, not applicable.
