AN ACT [allowing the compulsory purchase of certain land.]

Preamble WHEREAS the COMMISSIONERS OF THE VILLAGE DISTRICT OF ONCHAN (hereinafter called ‘the Commissioners’) presented their Petition to the Court on the 5th day of July, 1946, for authority to put into force the powers of compulsory purchase as provided by the Lands Clauses Act, 1871, for the purpose of acquiring (inter alia): — (a) from LAWRENCE LAVERY CORKILL, of The Hague in the Village District of Onchan, certain plots or parcels of land part of the Hague Estate in the Parish of Onchan, together with the whole of the soil of the public highway called Hague Crescent; (b) from HOWSTRAKE ESTATE (1937) LIMITED, two certain parcels of land part of the Howstrake Estate situate in the Village District of Onchan, TOGETHER with the portion of proposed roads abutting upon one such parcel of land, ALSO the right, title and interest of the said Company to a third parcel of land abutting on Hague Crescent in the said Village District; such lands containing approximately 211/4 acres and to be acquired for the purposes of a Park, reserving certain portions thereof for the erection of houses under the Housing Acts, 1924 to 1927, and certain other portions thereof for sale as good class building plots. AND WHEREAS at a Sitting of Tynwald held on the 9th day of July, 1946, IT WAS RESOLVED that the prayer of the said Petition of the Commissioners be granted and the Commissioners were authorised to put into force the Lands Clauses Act, 1871, for the purpose of purchasing (inter alia) the aforesaid lands. AND WHEREAS the acquisition of the said lands was referred to arbitration in terms of the Public Authorities (Acquisition of Land) Acts, 1923 to 1945.

AND WHEREAS on the 30th day of July, 1947, the Official Arbitrator appointed under the said Acts duly made his Award that the Commissioners do pay — (1) to the said LAWRENCE LAVERY CORKILL the sum of £11,940 for the whole of his interest in the land referred to in (a) above, together with £165 towards his costs and the fees on the said award; (2) to the said HOWSTRAKE ESTATE (1937) LIMITED the sum of £3,620 for the whole of its interest in the land referred to in (b) above, together with £42 towards its costs, and the fees on the said Award. AND WHEREAS the said lands referred to in (a) and (b) above (hereinafter called ‘the Park’) were conveyed unto the Commissioners by Deeds both bearing date the 20th August, 1947, which said Deeds were duly recorded in the Registry of Deeds. AND WHEREAS on the 14th day of December, 1948, the Commissioners presented their Petition to Tynwald for (inter alia) leave to sell, from time to time, plots aggregating 21,730 square yards of land of the Park at various prices, not less than those set forth in the said Petition, AND the Tynwald Court RESOLVED that the prayer of the said Petition of the Commissioners be granted. AND WHEREAS on the 5th day of July, 1949, the Commissioners presented their Petition to Tynwald for approval to the sale to the Trustees of the Roman Catholic Archiepiscopal Diocese of Liverpool of a plot of land containing 760 square yards or thereabouts abutting on the Park and Ridgeway Terrace in the Commissioners’ District for the sum of £380. AND WHEREAS at a Sitting of Tynwald held on the 6th day of July, 1949, IT WAS RESOLVED that the prayer of the said Petition of the Commissioners be granted. AND WHEREAS the Commissioners entered into an Agreement bearing date the 4th day of May, 1949, for the purchase from Maude Mary Quayle and Stephen Alfred Quirk of a parcel of land containing 29 acres 1 rood and 13 perches or thereabouts situate abutting on the East of Whitebridge Road and on the West of School Road in the Village District and Parish of Onchan (hereinafter called ‘the Ballachrink Estate’) for the sum of £24,843 11s. 4d. for the purpose of developing the whole of the said land for housing, partly under the Housing Acts 1924 to 1927, and partly by sale for the erection of houses by private enterprise. AND WHEREAS the Commissioners presented their Petition to Tynwald on the 5th day of July, 1949, for (inter alia) the approval of the said Agreement and leave to sell from time to time and at any time, plots not exceeding a total area of 81,313 square yards for private enterprise housing at prices not less than those set forth in the said Petition. AND WHEREAS at a Sitting of Tynwald held on the 6th day of July, 1949, Tynwald approved (inter alia) the said Agreement and authorised the sale of the said plots as prayed.

AND WHEREAS the Commissioners require to have conferred upon them in respect of all the said lands further powers in addition to those contained in the Local Government Acts, 1916 to 1950. AND WHEREAS the objects aforesaid cannot be attained without the authority of an Act of Tynwald.

1 Short title and construction This Act may be cited as the Onchan Village District Park and Ballachrink Estate Act, 1950, and shall be construed as one with the Local Government Acts, 1916 to 1950, and all such Acts so far as the same are not inconsistent with the provisions of this Act are incorporated with this Act.

2 Commissioners deemed to have power to purchase and sell certain lands In addition to the powers vested in them by the Local Government Acts, 1916 to 1950, the Commissioners shall be deemed to have had power to purchase and shall have power from time to time to sell in such manner and to such persons as the Commissioners may think fit — (1) a part or parts aggregating 21,730 square yards of the Park in terms of the hereinbefore recited Resolution of Tynwald of the 14th day of December, 1948, or as Tynwald may hereafter approve; (2) a plot containing 760 square yards of the Park, in terms of the hereinbefore recited Resolution of Tynwald of the 5th day of July, 1949; at prices not less than those by the said Resolutions approved, and subject to such reservations, conditions, restrictions or provisions, and generally upon such terms and conditions as the Commissioners think fit; (3) a part or parts of Ballachrink Estate aggregating 81,313 square yards, in terms of and at the prices not less than those approved by the hereinbefore recited Resolution of Tynwald of the 6th day of July, 1949, or as Tynwald may hereafter approve, and subject to such reservations, conditions, restrictions or provisions, and generally upon such terms and conditions as the Commissioners think fit.

3 Disposal of proceeds of sale The proceeds of such sales shall be applied towards the cost of the lay-out and development of the Park and Ballachrink Estate. Until any portion of such lands is sold, the Commissioners may let the same at the rent and upon such terms and conditions as the Commissioners think fit.

4 Powers of Commissioners The powers hereby granted are in addition to and not in substitution for any powers vested in the Commissioners in and by the said Local Government Acts c AT 12 of 1950 Page 7

or any Acts incorporated therewith and under or by any other Act or Acts of Tynwald.

5 Commencement of Act This Act shall come into operation when the Royal Assent thereto has been by the Governor announced to Tynwald and a certificate thereof has been signed by the Governor and the Speaker of the .
