SUMMARY OF MAIN PROVISIONS OF DRAFT SCHEME (NOT PART OF THE DRAFT SCHEME) This draft Scheme provides for: • The termination of the group ministry established for the benefice of Haswell and Shotton and the benefice of , Thornley and Wingate with ; and the dissolution of the benefice of Dalton le Dale and New ; • the creation of a new benefice of New Seaham comprising the parish of Christ Church, New Seaham, for the appointment of the first incumbent of the new benefice and his place of residence, and for the future patronage arrangements for the new benefice; • the creation of a new benefice of Dalton le Dale, comprising the parish of Dalton le Dale, and for the future patronage arrangements for the new benefice; • the creation of a new benefice of Hawthorn, comprising the parish of Hawthorn, and for the future patronage arrangements for the new benefice; • the creation of a new benefice of Murton and South Hetton, comprising the parish of Murton and the parish of South Hetton, which parishes shall continue distinct, for the parsonage house of the new benefice and for the future patronage arrangements for the new benefice; • the new benefice of Dalton le Dale and the new benefice of Murton and South Hetton to be held in plurality by one incumbent, the parsonage house of the benefice of Hawthorn and Murton to be the official residence of the incumbent of the benefices so held in plurality and for the future patronage arrangements for the benefices so held in plurality; • the new benefice of Hawthorn and the benefice of Easington and to be held in plurality by one incumbent, for the appointment of the first incumbent of the benefices so held in plurality, the parsonage house of the benefice of Easington and Easington Colliery to be the official residence of the incumbent of the benefices so held in plurality and for the future patronage arrangements for the benefices so held in plurality; • the benefice of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton to be held in plurality by one incumbent;, for the appointment of the first incumbent of the benefices so held in plurality; the parsonage house of the benefice of Haswell and Shotton to be the official residence of the incumbent of the benefices so held in plurality and for the future patronage arrangements for the benefices so held in plurality; • for the establishment of a group ministry for the new benefice of Hawthorn and the benefice of Easington and Easington Colliery so held in plurality; the new benefice of Dalton le Dale and new benefice of Murton and South Hetton so held in plurality; the benefice of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton so held in plurality;

all in the diocese of Durham.

DRAFT PASTORAL SCHEME

This Scheme is made by the Church Commissioners (“the Commissioners”) this day of 20 in pursuance of the Mission and Pastoral Measure 2011 (“the 2011 Measure”), the Right Reverend Paul, Bishop of Durham, having consented thereto. Termination of group ministry and dissolution of the benefice 1. (1) The group ministry established by a Pastoral Scheme made by the Commissioners pursuant to the Pastoral Measure 1983 on the 12th day of October 1999 for the benefice of Haswell, Shotley and Thornley (the name of which was subsequently changed to “The Benefice of Haswell and Shotton”) and the benefice of Wheatley Hill and Wingate with Hutton Henry (the name of which was subsequently changed to the Benefice of Wheatley Hill, Thornley and Wingate with Hutton Henry) in the diocese of Durham shall be terminated. (2) The benefice of Dalton le Dale and New Seaham in the said diocese shall be dissolved.

Creation of new benefice of New Seaham 2. (1) A new benefice which shall be named “The Benefice of New Seaham” shall be created in the said diocese, and the area of the new benefice shall comprise the parish of Christ Church, New Seaham. (2) The new benefice and its constituent parish shall belong to the archdeaconry of Durham and the deanery of Easington. (3) If immediately before this Scheme comes into operation the Reverend Paul Thomas Harrison holds an ecclesiastical office within the area of the benefice of Dalton le Dale and New Seaham he shall be the first incumbent of the new benefice. (4) The parsonage house of the benefice of Dalton le Dale and New Seaham (known as 269, Station Road, Seaham, SR7 0BH) shall without any conveyance or other assurance be vested in the incumbent of the new benefice in his corporate capacity as his official residence. (5) The patronage of the new benefice shall be vested in the Bishop of Durham in his corporate capacity.

Creation of new benefice of Dalton le Dale 3. (1) A new benefice which shall be named “The Benefice of Dalton le Dale” shall be created in the said diocese, and the area of the new benefice shall comprise the parish of Dalton le Dale. (2) The new benefice and its constituent parish shall belong to the archdeaconry of Durham and the deanery of Easington. (3) The patronage of the new benefice shall be vested in the corporate body established for the Cathedral Church of Christ, Blessed Mary the Virgin and Saint Cuthbert of Durham.

Creation of new benefice of Hawthorn 4. (1) A new benefice which shall be named “The Benefice of Hawthorn” shall be created in the said diocese, and the area of the new benefice shall comprise the parish of Hawthorn, being one of the constituent parishes of the benefice of Hawthorn and Murton (2) The new benefice and its constituent parish shall belong to the archdeaconry of Durham and the deanery of Easington. (3) The patronage of the new benefice shall be vested in the Executors of the Will of the late Ian Pemberton, Esquire, of Ruslin Cottage, Butcombe, Bristol, BS40 7XQ.

Creation of new benefice of Murton and South Hetton 5. (1) The benefice of South Hetton and, subject to clause 4(1) hereof, the benefice of Hawthorn and Murton in the said diocese shall be united to create a new benefice which shall be named “The Benefice of Murton and South Hetton” and the area of the new benefice shall comprise the parish of Murton and the parish of South Hetton, which parishes shall continue distinct. (2) The parsonage house of the benefice of Hawthorn and Murton (known as The Vicarage, Church Lane, Murton, Seaham, SR7 9RD) shall be the parsonage house of the new benefice. (3) The patronage of the new benefice shall be vested in the Bishop of Durham in his corporate capacity.

Assistant curates: consequential provision 6. (1) If immediately before this Scheme comes into operation the Reverend Paul Philip Paterson holds the office of assistant curate (however described) in the benefice of Hawthorn and Murton he shall, in consequence of the union of benefices effected by the Scheme hold that office subject to the same terms of service in the new benefice of Murton and South Hetton created pursuant to clause 5(1) hereof. (2) If immediately before this Scheme comes into operation the Reverend David Bond holds the office of assistant curate (however described) in the benefice of South Hetton he shall, in consequence of the union of benefices effected by the Scheme hold that office subject to the same terms of service in the new benefice of Murton and South Hetton created pursuant to clause 5(1) hereof. (3) If immediately before this Scheme comes into operation any other person holds an office of assistant curate (however described) in any benefice dissolved by this Scheme he, she or they shall as consequence of this Scheme hold such office or offices subject to the same terms of service in any of the new benefices created by this Scheme as the Bishop shall direct.

Holding of the benefice of Dalton le Dale and the benefice of Murton and South Hetton in plurality 7. (1) The new benefice of Dalton le Dale created pursuant to clause 3(1) hereof and the new benefice of Murton and South Hetton created pursuant to clause 5(1) hereof shall be held in plurality by one incumbent. (2) The parsonage house of the benefice of Hawthorn and Murton shall be the official residence of the incumbent of the benefices so held in plurality. (3) The right of presentation to the benefices so held in plurality (and for the duration only of the plurality) shall be exercised in a recurring series of three successive turns of which the corporate body established for the Cathedral Church of Christ, Blessed Mary the Virgin and Saint Cuthbert of Durham shall have the first and third turns; and the Bishop of Durham in his corporate capacity shall have the second turn.

Holding of the benefice of Hawthorn and the benefice of Easington and Easington Colliery in plurality 8. (1) The benefice of Hawthorn created pursuant to clause 4(1) hereof and the benefice of Easington and Easington Colliery in the said diocese shall be held in plurality by one incumbent. (2) The incumbent of the benefices so held in plurality shall reside in the parsonage house of the benefice of Easington and Easington Colliery. (3) If immediately before this Scheme comes into operation the Reverend Lucy Margaret Moss holds an ecclesiastical office within the area of the benefice of Easington and Easington Colliery she shall be the first incumbent of the benefices so held in plurality. (4) Subject to clause 8(3) hereof, the right of presentation to the benefices so held in plurality (and for the duration only of the plurality) shall be exercised alternately by the Bishop of Durham in his corporate capacity, who shall have the first turn, and the Executors of the Will of the late Ian Pemberton, Esquire.

Holding of the benefices of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton in plurality and disposal of parsonage house 9. (1) The benefice of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton in the said diocese shall be held in plurality by one incumbent. (2) The incumbent of the benefices so held in plurality shall reside in the parsonage house of the benefice of Haswell and Shotton. (3) If immediately before this Scheme copies into operation the Reverend Canon Jane Frances Grieve holds an ecclesiastical office within the area of either of the benefices referred to in clause 9(1) hereof she shall be the first incumbent of the benefices so held in plurality. (4) The right of presentation to the benefices so held in plurality (and for the duration only of the plurality) shall be exercised by the Bishop of Durham in his corporate capacity.

Creation of group ministry 10. (1) A group ministry to be known as “The Group Ministry of East Durham Villages” shall be established for the new benefice of Hawthorn created pursuant to clause 4(1) hereof and the benefice of Easington and Easington Colliery so held in plurality pursuant to clause 7(1) hereof; the new benefice of Dalton le Dale created pursuant to clause 3(1) hereof and new benefice of Murton and South Hetton created pursuant to clause 5(1) hereof so held in plurality pursuant to clause 6(1) hereof; the benefice of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton so held in plurality pursuant to clause 8(1) hereof. (2) If pursuant to clauses 8(3) and 9(4) hereof the Reverend Lucy Moss and the Reverend Canon Frances Jane Grieve become incumbent(s) of the benefices of Hawthorn and Easington and Easington Colliery so held in plurality and or the benefices of Wheatley Hill, Thornley and Wingate with Hutton Henry and the benefice of Haswell and Shotton so held in plurality respectively, she or they shall be the first person (or persons) to hold those benefices as benefices in the group.

Coming into operation 11. This Scheme shall come into operation upon the first day of the month following the date of it being made by the Church Commissioners.

Notes by the Commissioners’ office (not forming part of the draft Scheme)

The Commissioners have been told by the Bishop on the advice of his Diocesan Mission and Pastoral Committee that the rationale behind the diocesan proposals is as follows:

The pastoral reorganisation for Easington Deanery is a widely consulted and carefully considered plan to enable the people of the deanery to worship together and to encourage missional growth. The plans have been passed by Deanery Synod and Bishop’s Council. Easington Deanery prayerfully believes that through this plan ministry can be shared by all.

Publication of this draft Scheme by the Commissioners does not mean that we have taken a view on the merits of the diocesan case. We have a duty to publish draft Schemes based on diocesan proposals.

If we receive representations against the draft Scheme, we will send all representations, both for and against, to the Bishop whose views will be sought. Individual representors will then receive copies of our correspondence with the Bishop (including copies of all the representations) and they may comment further in writing to us in light of the diocesan response if they so wish.

If there are no representations against the draft Scheme, we will make the Scheme and arrange for it to be brought into effect.

The Reverend Paul Harrison Mr Harrison’s status as holding his benefice as a freehold incumbent who is not on Common Tenure will remain unchanged by the provisions of this Scheme. He will therefore be the freehold incumbent of the proposed new benefice of New Seaham should the proposed Scheme take effect.

Clause 6(2) The above clause has been included to ensure that any person holding an office of assistant curate (however described) shall as consequence of the Scheme hold such office or offices subject to the same terms of service in the new benefice of Murton and South Hetton. Although there is currently no such unnamed office holder in post, this clause is included in case any such office holder is appointed before this Scheme comes into operation.

Sharing of ministry within the group The benefices within the group will retain their separate and distinct existence but each of the incumbents (and any priests-in-charge) will have authority to perform in the area of every benefice in the group all such offices and services as may be performed by the incumbent of that benefice. When acting outside his or her own benefice an incumbent must act in accordance with the directions of the incumbent concerned (and in giving such instructions an incumbent should follow the House of Bishops’ Declaration on the Ministry of Bishops and Priests, made in conjunction with the Bishops and Priests (Consecration and Ordination of Women) Measure 2014, that any directions under Canon C8.2(a) relating to a parish which has passed a resolution under the House of Bishops’ Declaration should not conflict with the nature of the conviction on this issue underlying the PCC’s resolution). The incumbents also have a duty to assist each other so as to make the best possible provision for the cure of souls throughout the area of the group ministry. Group Chapter The incumbents (and any priests-in-charge) must meet together regularly as a chapter for the purpose of discussing and reaching a common mind on all matters of general concern or special interest to the group ministry.

Consultation on appointment of new incumbent

A patron of a group benefice must consult the other incumbents (and any priests-in- charge) in the group before seeking the approval of the parish representatives (as defined in s.11(7) of the Patronage (Benefices) Measure 1986), and of the bishop, to the making to a priest of an offer of appointment.
