Pursuant to Article V, Section 26, of the Constitution of the State of Oklahoma, the First Regular Session of the House of Representatives for the Fifty-fifth Legislature assembled in the House Chamber at 12:00 o'clock noon.

Representative-elect Brumbaugh called the House to order.

Prayer was offered by Pastor Emeritus Tom Cooksey, First Baptist Church, Cherokee, Oklahoma. Pastor Cooksey was sponsored by Speaker-elect Hickman.

CERTIFICATION OF HOUSE MEMBERS

Representative-elect Ortega moved that the Communication dated November 14, 2014, to the Speaker of the House of Representatives and furnished to the Chief Clerk of the House of Representatives by the Secretary of the State Election Board listing the persons elected to the House of Representatives for the Fifty-fifth Legislature be accepted as prima facie evidence of membership in the House of Representatives and that said Members-elect be seated in the House Chamber and the above-named Communication be printed in the House Journal, which motion was declared adopted.

Representative Brumbaugh declared Representative Hickman elected Speaker of the House of Representatives for the Fifty-fifth Legislature and appointed Representatives Banz, Dank, Ownbey, Russ, McBride and Caldwell to escort Speaker-elect Hickman to the rostrum where Justice James R. Winchester administered the Oath of Office as Speaker.

The Speaker addressed the House. Upon unanimous consent request of Representative Enns the remarks of Speaker Hickman were ordered printed in full as follows:

“Thank you, Representative Sears and Representative Cox for your kind words. Let me begin by thanking Justice Jim Winchester of the Oklahoma Supreme Court for administering my oath of office. Justice Winchester, you and your wife, Susan, who served as Speaker Pro Tempore have been friends to me since before I was elected to the House and I appreciate you and Susan, and your service to our state. It is an honor to have you with us. Thank you also to Brother Tom Cooksey, pastor emeritus of the First Baptist Church of Cherokee, our chaplain for today. Tom has been part of our lives since Jana and I were children when he and his wife, Claudia, moved to Cherokee, then left and came back for a second tour at Cherokee First Baptist. Tom has been a special part of so much of our lives, including marrying Jana and I years ago. Reverend Cooksey, it is an honor to have you with us again for this special occasion today. Thank you. I am honored to have several family members here today. On the floor is my partner in all that I do, my wife Jana. Seated with Jana is our daughter, Ashley, who is a junior at Fairview High School and a recent FFA National Champion, and our son, Austin, who is missing kindergarten today after starting back after the Christmas break just yesterday. Our oldest daughter, Taylor, had to go back to college this weekend and couldn’t be with us

8 House Journal today, but I am so proud of her and all that she is doing as well. Our spouses make tremendous personal sacrifices for us, our families and the people of our district, so that we may be away from home and serve our state. Those of us with young children at home also realize our families make sacrifices due to our absence. Probably none of us thank our spouses and our families enough for those sacrifices, and Jana, Taylor, Ashley, and Austin, I thank you and I love you. Members, please take time for your families. New members in particular, I know you’re excited to be here. I know it is nice to be asked to speak at every event going on in your district but remember those children grow up fast. Do as much as you can together but be home as much as you can for your family just as they are here for you. In the gallery are two of the most supportive parents any son could have and two of the most spoiling grandparents our three children could have, my Dad, who was also Jana’s basketball coach in grade school, and my Mom, Steve and Cathy Hickman from Cherokee. My father just won his fourth state championship in track this year and is the 2014 Oklahoma Track Coach of the Year. My mother is so supportive of him, as well as my brother and me but I think she most enjoys her title of grandmother and spoiling her five grandchildren. I am so proud of both of you and can’t thank you enough for all you’ve done for me. I love you. I am also so proud to have my brother and his family with us. My brother, Jeremy, is the high school principal in Cherokee, and his wife, Megan, is an attorney in Enid. My nieces Holly and Jade are here today too and I am so proud of all of them and happy to have them all joining us today. I’m also privileged to have my aunt and uncle, Christa and Dean Hughes, from Carmen, with me today. They have always been second parents to me which was a wonderful way to grow up. I also think they knocked on more doors for me than I did when I first ran for office 10 years ago! Thank you both for everything and for being here today. Fellow members and guests; I am humbled. Thank you for the honor you have given me by placing your trust in me to serve you as Speaker for the 55th Oklahoma Legislature. And I must also say thank you to the people of Alfalfa, Woods, Major and Woodward counties in District 58 for giving me the privilege to represent them here the past ten years and for the next two years, as well as my predecessor, Rep. Elmer Maddux, for his advice, counsel and support. I feel truly blessed to be able to serve the part of the state where Jana and I grew up and that gave so much to us. A year ago, I asked you to come together like those in the shining city upon a hill which President Reagan referred to often. You did, and the House led on numerous issues in this building. We were stronger when we unified as a body. As we embark on this next session, I ask you again to come together as we face a most challenging year for Oklahoma…not because our state’s economy is not growing stronger each day, thanks to our state’s hard working citizens, men and women primarily in small businesses in large and small communities across our 77 counties. We face a year in state government that will challenge us, and require us to find solutions to our fiscal future. Oklahoma has one of the strongest economies in our union, yet our past decisions have created a unique crossroads that demands us to fund core government services and keep businesses competitive across all borders. We stand side by side, each as elected members of this body, faced with a choice to work through this challenging budget cycle to meet Oklahoma’s needs or to work against each other and fail those who sent us here to represent them. This will be a year that requires sacrifice from those who utilize the services state government was initially

First Legislative Day, Tuesday, January 6, 2015 9 intended to provide, sacrifice from state employees who provide those services, and sacrifices as we determine what programs are beyond our mission and must be ended because they are luxuries we can no longer afford at the expense of the essential state services of public safety, education, transportation and access to affordable healthcare in all areas of our state. This will also be a year that requires creative solutions from all 101 members of this House. Indeed, this will be the time for all hands on deck. For our 22 new members, gone are the days when you would have been not only able to, but expected to, sit on the back row and keep quiet as the issues were debated here on the House floor. While we do face significant challenges this year, the diversity of experience and the depth of the members of this body give me great confidence that this House of Representatives will not only meet those challenges but will lead in meeting those challenges. Even with our budget challenges, I hope you see the possibilities we have before us this year. We have the opportunity to reform our tax code and the responsibility to minimize government regulation to create an economic environment where Oklahoma businesses can create jobs and be profitable, an environment that will be recognized by entrepreneurs and sought after by companies located across the globe. We have the opportunity as well as the responsibility to improve our public education system to do what’s right for our children and prepare them for their future. We have the opportunity to advance needed reforms in corrections and the responsibility to ensure safe working conditions for our correctional employees. We have the responsibility to protect the investments we’ve finally made under new leadership in the past ten years in our roads and bridges to make Oklahoma a safer place to travel and provide the infrastructure for businesses to grow. We have the opportunity to ensure rural and urban Oklahomans have access to quality, affordable healthcare and the responsibility to stand up to the federal government’s efforts which overreach. We have the responsibility to protect our freedoms and assert our rights as a state under the U.S. Constitution. And we have a responsibility to the taxpayers and to future, current and retired state employees to continue improving our retirement systems. We were elected as individuals…which sometimes presents its own unique challenges with 101 people who were each the most popular in their districts on Election Day! While we were elected as individuals, we now must figure out how to work together - much like a group of people sharing the same umbrella in a rain storm. We must find ways to work together to move our state forward not as 101 individuals but as one body; as the Oklahoma House of Representatives. There will be plenty of negative in this building – people telling us what we CAN’T do. I encourage us to focus on what we can do. I encourage you to encourage each other as the session moves forward and we face challenges. I know as we work to meet the challenges we face, there may be disagreement on how we move forward, and that’s okay. But I ask you during those times, let’s agree to disagree respectfully. We can make decisions as a House without getting mad at each other, and then shift our focus to the next challenge we face. Members, the challenges are great. The days will be long. This democratic process will get noisy. There will be agreement about where we want our state to go, but disagreement about how we get there. It won’t be easy, but our founding fathers didn’t intend for it to be. Through all of this, I pledge to you as your Speaker, to serve with respect for each elected member of the People’s House, to be firm but fair, to ensure the majority can conduct the people’s business but that the rights of the minority are protected,

10 House Journal realizing that majority and minority on many issues before us will not be divided by political party. We have been given a tremendous honor by our constituents to represent them in this beautiful and special place. It’s a privilege I hope you take seriously and an opportunity I hope you enjoy. In President Washington’s first State of the Union speech on January 8, 1790, he challenged the Congress to build upon their prior good work for the American people saying, ‘Still further to realize their expectations, and to secure the blessings which a gracious Providence has placed within our reach, will in the course of the present important session, call for the cool and deliberate exertion of your patriotism, firmness and wisdom.’ We today, in this House, will need the cool and deliberate exertion of the patriotism, firmness and wisdom of our 101 members. We do face challenges but when I look across this House floor today I see a team ready to roll up their sleeves, work hard and find ways to do good things. Remember the words found in Galatians 6:9: ‘Let us not become weary in doing good, for at the proper time we will reap a harvest if we do not give up.’ As I alluded to earlier and as I shared with you almost a year ago, Matthew 5:14 describes the Church by saying, ‘You are the light of the world – like a city on a hilltop that cannot be hidden.’ President Reagan referenced this verse when he spoke often about America being the shining city upon a hill. Those in the city on the hill are working to be seen…positioning themselves to be visible…not for their own benefit but for the benefit of the rest of the world. Today I ask you to join me again. I invite all of us together…101 of us, to come together like those in the city upon a hill for the benefit of all, not for ourselves…to make an impact so when we leave here, we can look back at what we’ve done, at the sacrifices we made, the sacrifices our families made while we were away from home serving in this place, and see that it was worth it, for we made a difference for the Oklahomans we served and generations of Oklahomans to come. I hope you’ll join me in looking at the challenges ahead as opportunities to work together to find a better way for Oklahoma. Together, if we don’t give up, we can chart a course which will set the stage for the next generation to be able to live, work and raise their families here, to secure the blessings which our gracious God has placed within our reach, in this special place we call Oklahoma. May God bless you, may He bless our great state, and may God continue to bless America.”

“Good afternoon and welcome to Organizational Day for the 55th Oklahoma Legislature. I want to extend greetings to our returning members as well as our newly elected colleagues from across the state. This is an exciting time to be a member of the Oklahoma House of Representatives and serve our fellow citizens here in the People’s house. I want to thank Justice Winchester for administering the oath of office. We have considered each other family for quite a long time and having him with us today is very

12 House Journal special. I would also like to thank Representative Billy for her kind words in nominating me to serve as Speaker Pro Tempore and Representative Biggs for his hearty second. To the people of District 33 in Payne and Logan counties, thank you for your continued support and confidence in me to serve as your state representative. It is an honor beyond compare to be elected to serve as a member of this distinguished legislative body. I have with me today my mother, Bette Roberts, whose faith in me has never wavered and my daughter Kate Kupiec who soon will make me a grandmother. Thank you for coming today. I also want to introduce three very special friends, Debbie Cochran, Karen Stewart, and Marilyn Duff who have been supportive of me since I decided to run for office in 2004. Thank you for being here today. Over the past few months I have had the privilege of meeting our new members and I am excited for the fresh perspective each will offer during the course of this session. Each member of the Legislature brings unique life and work experiences that will help guide our decisions as we work to advance the cause of our great state. Our mission is to create an appropriate environment that enables those we serve to secure their version of the American Dream. When we reduce bureaucratic regulation and get government out of the way the result is an atmosphere that rewards efficiency and delivers common sense solutions for our state. For the past ten years my time in the Legislature has taught me to be bold in the pursuit of rightsizing state government, improving education, and making our state a better place to live, work, and raise a family. As legislators our obligation is to champion policies that can make a positive difference in the lives of our constituents. I remain in steadfast agreement with each of you that our solemn duty is to preserve to the latest generation those things that make Oklahoma the greatest state in the Union. Of course the most exciting part of our work is fashioning solutions to those challenges we are elected to address. Our work on behalf of this state is never quite finished. To do our job well, we must have leaders that respect the opinion of each elected member, think critically, and work with groups as diverse as our state all in the effort to move our state forward. As Speaker Pro Tempore, I am excited to bring to the position a style of collaborative leadership that encourages each member to be problem identifiers as well as problem solvers. One of the most important aspects of my work as Speaker Pro Tempore is to serve our Speaker while honoring my commitment to help members understand the process of moving legislation forward. I take seriously my responsibility of supporting Speaker Hickman and to actively participate with members of both parties in the process of legislating for our state. Most importantly, I will be accessible to all members so that our voices are heard and respected. As a parent and a legislator I have come to understand that each person has value and deserves our full attention when they seek our help. We each face unique challenges; it is how we overcome those challenges that make us who we are. Because of this, we must respect the opinions of all members and give each legislator the opportunity to present their concerns in a fair and impartial manner. This is the type of leadership necessary to nurture the legislative process and ensure that it works to the benefit of all people. Being elected by this body to serve as Speaker Pro Tempore imposes an obligation of loyalty to our common cause of moving this state forward with appropriate solutions. As Speaker Pro Tempore, I will engage each of you to be part of the solution, to make our state stronger, and to ensure that we are successful in our desire to improve the lives of Oklahomans. Serving in this way requires each of us to be servant leaders.

MOTION

Representative Ortega moved that the Honorable Senate be notified by message that the House of Representatives is organized and ready to convene in Joint Session.

JOINT SESSION

The First Joint Session of the First Regular Session of the Fifty-fifth Legislature assembled in the House Chamber on Tuesday, January 6, 2015, and was called to order by Lieutenant Governor Todd Lamb.

Senator Schulz moved that the attendance roll call of the Senate be considered the attendance roll call of the Senate in Joint Session, which was the order.

Representative Ortega moved that the attendance roll call of the House be considered the attendance roll call of the House in Joint Session, which was the order.

Lieutenant Governor Lamb declared quorums of the Senate and House present and the Joint Session duly assembled.

Invocation was given by Pastor Emeritus Tom Cooksey, First Baptist Church, Cherokee.

Pursuant to Article VI, Section 5, Oklahoma Constitution, Speaker Hickman announced the canvassing of the returns of the General Election held on November 4, 2014, as certified to the House of Representatives and transmitted to the Speaker of the House of Representatives by Secretary of the State Election Board Paul Ziriax and transmitted to the House of Representatives by Secretary of State .

Senator Schulz moved to dispense with the reading of the election results and ordered same printed in the Journals of the House and Senate respectively, which motion was declared adopted.

OFFICE SUPPLIES AND POSTAGE

Speaker Hickman moved that each House Member be provided $350, paid by the House of Representatives, for purchase of official stationery and communication materials and that a credit be provided through the House Comptroller in the House supply room and post office for each Member in the amount of $2,000 for postage and office supplies, and in the amount of $500 for official, out-of-state travel related to the Member’s duties, as approved by the Speaker, and that the Speaker be authorized to conduct the administrative affairs of the House until formally vested with such authority through adopted House Rules, which motion was declared adopted.

The Speaker announced the following interim appointments:

June 19, 2014 – Representatives McBride, Pruett and Sears appointed as Members of the State Capitol Repair Expenditure Oversight Committee. (73 O.S. § 345) August 12, 2014 – Representatives Watson and Brumbaugh appointed as Members of the Executive Committee of the Energy Council and Representatives Biggs, Dank, Denney, Enns, Fisher, Hardin, Henke, Hickman, Inman, Johnson, Kouplen, McBride, Morrissette, Ortega, Osborn, Ownbey, Roberts (Sean), Rousselot, Russ, Sanders, Sears, Shoemake, Vaughan and Wright appointed as Members of the Energy Council.
