INTRODUCTION

Periodic modifications to the boundaries of electoral constituencies are critical to any democratic election system. Without such intermittent changes, number of citizens/voters in one constituency may vary from others raising questions on adherence to universal principle of equality of vote. Election Commission of (ECP) has notified the preliminary report comprising of proposals for fresh delimitation of national and provincial assemblies to be finalized after disposal of objections by voters. While ECP has upheld the legal delimitation principles of geographical compactness and respect for the existing boundaries of administrative units, the principle of equality of vote is compromised in as many as 81 National Assembly constituencies where the variation in population size exceeds the ordinarily permissible legal limit of 10%. The constitution of Pakistan defines the number of seats for the national and provincial assemblies and makes it incumbent upon the Election Commission of Pakistan (ECP) to demarcate constituencies on the basis of population in accordance with the last preceding census officially published. Subsequently, newly unified Elections Act, 2017 authorizes ECP to delimit constituencies for the national and provincial assemblies and local governments and lays out principles of delimitation that have further been elaborated in Election Rules, 2017. Since the constitution and subsequent legislation both mention delimitation in accordance with the officially published census results, a constitutional amendment in December 2017 mandated ECP to delimit the constituencies on the basis of provisional results. This one-time arrangement was warranted by the lack of time required for the delimitation process to complete between the expected date of publishing of official census results for 6th Census held in 2017 and upcoming general elections in July 2018. The same amendment also provided another exemption of excluding FATA from the current delimitation purview. Resultantly, the current delimitation does not account for the population of FATA agencies to obtain a national average of population per constituency. For the current delimitation, the constitution did not provide for increased number of constituencies for the national and provincial assemblies, ECP had to redistribute the population among the same number of constituencies. Current delimitation taking place after 16 long years has actually has increased the population size of the constituencies along with redistribution of constituencies in line with the census results. Delimitation principles laid out in law include distribution of population in geographically compact areas and respecting physical features, existing boundaries of administrative units, facilities of communication and public convenience and other cognate factors to ensure homogeneity in creation of constituencies. The law further specifies the permissible limit of variation (±10%) in population size between two constituencies for an assembly. In case of exceptional situations where this principle is not practicable to follow, ECP has to record the reasons in writing.

A careful analysis of delimitation proposals by Free and Fair Election Network (FAFEN) reveals that inter and intra provincial allocation of population has resulted into grave deviations from the universal and legal principle of equality of vote. Election Rules, 2017 drafted and approved by ECP appeared to have been strictly adhered to but in that process legal principle of equality of vote is compromised. Rules pertaining to delimitation could not sufficiently operationalize the legal principle of equality of vote among constituencies. Law provides for equality among constituencies but Rules have attempted to follow this principle among provinces and districts. A comparative look at the constituencies reveal lopsided demarcation in the sizes of population of the constituencies. For instance, the average population per constituency in Islamabad Capital Territory is the lowest with 667,193 citizens allocated to one representative in the National Assembly while the average population per constituency in is the highest at 785,135 citizens per National Assembly constituency. FAFEN report presents a comprehensive analysis of the distribution of population to the National Assembly constituencies. The first section offers an analysis of the intra- and inter- regional variations of population in delimitation of constituencies. This report bases upon the provisional census data made public by the Pakistan Bureau of Statistics (PBS), and the recent delimitation proposals notified by the ECP. The other major parameter examined is the number of registered voters obtained from the Electoral Rolls published by the ECP. The two key variables (population and registered voters) are examined to draw inferences from:

a. National average of population per National Assembly constituency and standard deviation range b. Provincial/Regional average of population per National Assembly constituency and standard deviation ranges c. National average of voters per National Assembly constituency and standard deviation range d. Provincial/Regional average of voters per National Assembly constituency and standard deviation ranges

e. Application of ±10% variation limit on national population and voters per constituency

f. Application of ten percent variation limit on provincial/regional populations and voters per constituency Given the demographic complexities, there is a need to revisit the delimitation proposals and exercise to ensure equitable representation for all. For instance, a more nuanced approach guided by a variation limit not exceeding 10% from the overall average population per constituency will help ensure a more equitable delimitation. A detailed view of the delimitation issues discussed in this report advocates the need for a significant and thorough review the distribution and delimitation of National Assembly constituencies before their finalization. Intra- and inter-regional variations can not only have a potential impact on citizens’ political representation but can also potentially lead to political tensions ahead of 2018 General Elections.

1. Delimitation of Constituencies: Variation in Population The Elections Act, 2017 defines the parameter for delimitation of representation as ‘elected officials from their constituencies represent the entire population’. However, the recent delimitation proposals, besides being unevenly distributed in terms of registered voters, also exhibit variations in terms of the number of citizens to be represented in the National Assembly. a. Inter-Province/Region Population Variation in the National Assembly Constituencies

Compared with the national average population per constituency, three constituencies of Islamabad Capital Territory (ICT) are smallest among all regions except FATA. The average population per ICT’s constituency is 14% lower than the national average. Among four provinces, the average population for a National Assembly (NA) constituency in Balochistan is lower than the national average while the average population for an NA constituency in remaining three provinces is slightly higher.

As illustrated in table 2, a total of 76 NA constituencies’ populations have a deviation higher than 10 percent from the national average of population per NA constituency. As many as five constituencies in Balochistan, 16 in Khyber Pakhtunkhwa, 38 in Punjab and 22 in Sindh require adjustments to fit in the legal variation range of ±10%. Overall, 184 constituencies fall within this range.

While the current delimitation of National Assembly constituencies examining the national average raises concerns, the situation is not much different while analyzing the variations in population-to-seat ratio, another visible factor that finds disparities. Inter-regional difference need to be addressed to ensure equal representation to Pakistani citizens. For instance, NA-37 Tank in Khyber Pakhtunkhwa (KP) represents 391,885 people, while a population of around 1.2 million in NA-35 Bannu is also represented by one National Assembly constituency. The power of vote for Bannu people will be less than a half of one to be enjoyed by people living in Tank constituency. Similarly, in Punjab, NA-37 Jhelum-II has been demarcated as a seat with a population of 546,113 citizens, while NA-87 Hafizabad-I has a population of almost 1.2 million- almost double the Jhelum constituency. In Sindh, NA-199 Shikarpur-II has been created with a population of 588,185 citizens, while NA-197 Kashmore represents a population of whopping 1,089,169 individuals. In Balochistan, NA-262 Kachhi-cum-Jhal Magsi has been allocated a population of just 386,255 citizens against NA-268 Mastung-cum-chaghai-cum-kalat-cum-Shaheed Sikandarabad-cum-Nushki that will represent almost thrice of this population i.e. 1,083,497 citizens. Following table shows the intra-region variations in the population-to-seat ratio for each province:

2. Delimitation of Constituencies: Variation in Registered Voters This section analyzes the status of proposed delimitation based on the average number of registered voters per NA constituency calculated by using the 2017 district-wise voter statistics issued by the ECP. The district averages of voter per NA constituency present an uneven distribution of voters across districts in fresh, regions and constituencies in fresh delimitation exercise. In order to assess the distribution of registered voters, FAFEN classified constituencies into the following six categories based on the number of registered voters that may fall in freshly delimited constituencies:

Category I: National Assembly Constituencies with less than 150,000 voters: • Unless changed in final notification, as proposed in ECP report, two NA constituencies – one each in Balochistan and KP – will have less than 150,000 registered voters.

National Assembly Constituencies with more than 150,000 but Category II: less than 250,000 voters: • The number of constituencies with potentially 150,000 to 249,999 voters is highest in Balochistan, where majority of NA constituency- 10 of 16, will fall in this category. Three other constituencies falling in category are from ICT.

National Assembly Constituencies with more 250,000 but less Category III: than 350,000 voters: • As proposed, more than one third of all NA constituencies, 78 to be precise, will fall under this category. Majority of Sindh constituencies (42 of 61) will have this voter population range. As many as 20 constituencies in Punjab and 13 in KP will also join their Sindh counterparts to have voters in this range. National Assembly Constituencies with more 350,000 but less Category IV: than 450,000 voters: • More than half of the overall NA constituencies (138) will have a voting population between 350,000 and 450,000 voters. Overwhelming majority of Punjab constituencies (107 of 141) will fall under this median bracket.

National Assembly Constituencies with more 450,000 but less Category V: than 550,000: • As many as 15 NA constituencies will fall under this outlier category. Majority of these constituencies will come from Punjab (11) along with two constituencies each from KP and Sindh.

National Assembly Constituencies with more than 550,000 Category VI: voters: • This extraordinary category will host four constituencies- three in Punjab and one in KP.

ECP’s data suggests that a total of 93,316,823 voters are registered in 256 NA constituencies with an average of 364,519 voters per constituency. However, the distribution of voters in constituencies vary greatly. For instance, NA-262 Kachhi-cum-Jhal Magsi with 138,530 voters will have the lowest number of registered voters, which is 62% less in comparison to the national average. On the other hand, the seat with the highest voting population – NA-19 (Haripur) with 617,255 voters will host 69% more voters than the national average. At a regional level, nearly three million voters in Balochistan have 16 seats in the National Assembly, while four times more voters in KP - around 13 million - have 38 seats, which are 2.5 times more than Balochistan’s representation. Figure 6 shows the number of constituencies that deviate more than ±10% from the national average of registered voters per NA constituency. As many as 73 constituencies will have lesser voters in comparison to the national average, while 85 will have greater number of registered voters than the national average. Punjab will have the highest number of constituencies that will go above the national average of registered voters, while 14 out of 16 Balochistan constituencies will have lesser number of registered voters in comparison to the national average.

8 b. Intra-Province/Region Registered Voters Variation in National Assembly Constituencies

A district-wise analysis of electoral rolls illustrates that the fresh delimitation proposals have caused considerably higher degree of difference in number of registered voters among districts in a region. Taking an example of KP province, Haripur District has been allotted one seat where a total of 604,383 voters reside while one seat has been demarcated for Tank District with a voting population of just 169,305 voters. In Punjab, there are four NA seats proposed for Gujrat District, where the number of voters exceeds 1.7 million (448,636 voters per constituency). On the other hand, Hafizabad has been allocated one seat NA for nearly 617,255 voters that is way higher than the Gujrat average. Another example is Khanewal that has been allocated four seats for nearly 1.48 million voters (370,344 voters per constituency) and Sahiwal has been given three seats for more than 1.36 million voters (454,077 voters per constituency). Sindh is also no exception. South District has been allocated two constituencies where more than one million voters (504,235 voters per constituency) live. On the other hand, has three seats for 722,866 voters (240,995 voters per constituency) that means every two Karachi South voters will have a power of one voter in Malir district.
