This workshop was held to go over the new National Fire Protection Association (N FPA) Code Book to determine which new regulations would be appropriate for the Alabama LPG to incorporate into its training for Liqueed Petroleum operators.

Mr. Jones and Mr. Greg Meadows, Gas Pipeline Safety Investigations Supervisor for North Alabama attended the Alabama Natural Gas Association (ANGA) Annual Meeting in Miramar

There were two incidents reported by the National Response Center in June:

0 A diesel fuel release on Norfolk Southern in Birmingham

0 A vehicle accident that resulted in a passenger being ejected onto the tracks in

Montgomery on CSX (no railroad employees or equipment was involved in the incident)

RWS staff also responded to one complaint concerning a blocked crossing in which the complainant was directed to the FRA blocked crossing complaint form.

RWS staff cited four violations with civil penalties in the month of June. Each of the violations were found to be defects on critical components on outbound trains in rail yards that had been previously inspected by railroad personnel. Track inspection staff are also currently completing their recurrent FRA training via podcast that come out every couple of weeks followed by required assigmnents and/or tests.

MOTOR CARRIER SERVICES

The Motor Carrier Services (MCS) staff accomplished the following matters regarding state authority to operate as a motor carrier in Alabama with proof of insurance coverage:

As of June 30, there were 9,142 Alabama carriers (83%) registered for 2021 UCR with 1,814 that remain unregistered.

In June, the staff responded to four e-mails and one telephone call pertaining to Focused Anomaly Reviews (F ARS) for the 2021 UCR registration year. UTILITY ENFORCEMENT DIVISION AGENDA August 3, 2021 Commission Meeting Page I 3

The staff also assisted motor carriers in making necessary changes to their operating status with the Federal Motor Carrier Safety Administration (FMCSA). There were 13 MCS-150 forms processed indicating that seven motor carriers’ USDOT numbers were deactivated and six forms contained updates to carriers’ USDOT number data.

Here are some of the highlights from the UCR Board of Directors meeting:

The staff received one For Non-Prot (FNP) quarterly report from an FNP carrier for the first quarter of 2021. There was a total of 67 FNP quarterly reports for the second quarter of 2021 sent by mail or e- mail.

Staff received 22 annual reports for 2020 during the month of June.

In June, one passenger supplement tariff for Crown Limousine & Sedan Service, L.L.C. d/b/a Crown Limousine Service (C3652), one household goods supplement for Armstrong Transfer & Storage Co., Inc. d/b/a Armstrong Relocation (C618), and one household goods tariff for Stevens Moving & Storage, Inc. (NEW) were accepted.

The staff completed one compliance audit for the following carrier:

FIELD SERVICES

Staff observed the installation of an automated VIPER switch on the Alabama Power Company distribution system in Montgomery.

The Field Services Section (FSS) staff met with personnel from Kess Environmental, operators of Alabama Wastewater Systems Inc., to review the facilities used to provide Wastewater treatment services for 33 customers in the Seven Pines Subdivision located in Harvest. The system appeared to be functioning as designed with no defects noted at the time of the inspection.

Staff also met with personnel from Community Utilities of Alabama to review the facilities used to provide Wastewater treatment of two systems in Cullman County. Both systems, Waterford Condominiums and Smith Lake RV appearedin excellent operating condition at the time of the inspection.

Staff visited Water Works Inc. to inspect visible portions of the system used to provide potable water for approximately 180 customers in Talladega. A company representative for Water Works Inc. failed to show for the inspection. FSS staff attempted to perform the scheduled inspection to clear a discrepancy from last year's inspection. While an e-mail had been received stating the discrepancy would be corrected by January 31, 2021, the item had not been corrected. During the inspection, other items were identied that were not in compliance with the APSC Water Rules. The company owner and the manager were contacted and given 60 days for all items to be corrected with a follow-up inspection to be conducted on August 31, 2021, at 10:00 am. The Common Equity as of June 30, 2021 (Actual) was adjustedusing net income, payment of Common Stock and Preferred Stock dividends, Capital Contributions, and Other Adjustments from the Company's 2021 budget. The average common equity is a 12-month average using actual and budgeted data. The average retail common equity (RCE) was calculated using the retail separation factor of 95.29%. The retail net income (RNI) for average common equity and the common equity percentage (CEP) were calculated by using actual data for the six months ended June 30, 2021, and then adding six months of budget data for July 2021 through December 2021. The Other Adjustments, if any, are the result of the Company adopting FASB Statement 123 (R), which requires the reporting of stock option expenses. — DOCKET 32382(G) By way of letter dated July 16, 2021, Alabama Power Company (“Alabama Power” or “the Company”) is requesting to extend for an additional six years the Renewable Generation Certicate (RGC) granted by Order of the Alabama Public Service Commission (“APSC” or “the Commission”) dated September 16, 2015, in Docket No. 32382.

The sole purpose of this request is to seek additional time within which the Company may exercise rights under the RGC, without any other change to its operative terms, conditions and requirements. As such, the Company submits that no hearing should be required in connection with this request.

To date, Alabama Power has worked with customers to deploy four solar projects under the RGC comprising a total of approximately 170 MW, leaving unused authority of approximately 330 MW of the originally approved 500 MW. Absent an extension of the RGC, the unexercised capacity amount of 330 MW will expire on September 16, 2021.

If any of the originally authorized 500 MW has not been exercised by the new proposed deadline of September 16, 2027, the certificate authorization for that unexercised capacity will expire.

DOCKET 28101(G) — Spire Gulf, Inc. RSE renewal on July 1, 2021, Spire Gulf, Inc. (Spire Gulf’) and the Ofce of the Attorney General of Alabama (the “AG”) submitted for the Commission’s consideration a proposed settlement agreement regarding all terms and conditions for the extension of Spire Gulf’ s RSE mechanism. The terms of the agreement submitted were as follows.

ROE Range: Adjusting point of 9.95% with a range of 9.70% - 10.30%. Equity Cap: 55.5% RSE Term: 4 years

CCM: The CCM will use FY 2021 actual O&M expenses as its base year, provided the FY 2021 actual O&M expenses land below the FY 2020 actual O&M expenses; otherwise, the base year will be FY 2020 actual O&M expenses. Reversion to original sharing percentages, which are 50/50 for any benet, and 75/25 for any penalty. August CPIU will be used, rather than June. AGA Dues: 50% of AGA dues will remain recoverable under the RSE mechanism. Points-of-test: Three points-of-test in March and September annually.

After receiving the proposed settlement terms, the Commission staff recommends acceptance of the proposed settlement terms with the following adjustments:

CCM: > The FY2021 actual O&M expenses will be used as the base year. > In those rate years when a penalty is assessed, the base year for the succeeding rate year CCM calculations is unaffected. (i.e., The base year will be the CPI-U adjusted, base year O&M expenses). > In those rate years when an incentive is received by the Company, the base year O&M expense is reset to the actual O&M expense for that rate year and becomes the base year O&M expense used in CCM calculations beginning with the succeeding rate year. > In those rate years when an incentive is received by the Company, the amount of the incentive is transferred to a reserve account for economic development. 0 The economic development reserve shall be excluded from calculations of common equity. 0 Any expenditures from the economic development reserve must rst have Commission approval and the amounts thereof shall continue to be excluded from common equity.

Points of Test: Reduced from three proposed in the agreement to two (April 30 and September 30)

All other terms of the proposed agreement are recommended by the staff for approval.

RECOMMEND: Adoption of the settlement agreement submitted by Spire Gulf and the AG on July 1, 2021, as modied by the above discussed staff adjustments which are recommended for approval in their entirety.
