THE PRESIDENT'S LETTER

Dear Members and Subscribers:

The Tennessee Genealogical Society has exciting plans brewing for an active fall season. Mrs. Charles Barham, Vice-President of the Society, reports that there will be a Genealogical Workshop in October under the joint sponsorship of the Memphis Public Library and.Information Center and the Tennessee Genealogical Society. The workshop will consist of five sessions, held on October 1, 8, 15, 22 and 29 from 1:00 p. m. to 3:00 p. m. at the library on Peabody and McLean. There will again be a group of competent lecturers, but the format will be new and different from last year's, with more emphasis on individual genealogical material. There will be no charge for the workshop. We do hope that many of our out-of-town subscribers will be able to come early, visit the library, attend the session and share information and fun with us.

There is still more to come.

Mrs. T. Rivers Young and Mrs. Laurence B. Gardiner are making plans for the Tennessee Genealogical Society's biennial seminar. The area of study is the state of , and we are very fortunate to have as our speaker, leader and instructor, Mr. Robert Young Clay, Assistant Virginia State Archivist. The seminar will be held on October 18th at the Colonial Country Club. It c will start at 10:00 a. m. and end at 3:00 p. m. and will include luncheon. We do hope that you will share these wonderful educational opportunities with us.

The Tennessee State Library and Archives has announced the publication of a revised and expanded GUIDE TO THE MICROFILM HOLDINGS OF THE MANUSCRIPT SECTION. Individual copies, in soft cover, 8-1/4" x 10-1/2", are priced at $2.50 each. The guide includes a description of each of the 500 or so films, as well as a compre­ hensive name and subject index. Among the details given about each film is a notation as to whether or not the collection is available on interlibrary loan. This certainly sounds like a bargain for the price.

We would like to thank Mr. James R. Johnson, Reference Librarian, History De­ partment, Memphis Public Library and Information Center, for his article, Tennessee Public Lands, which appears in this issue. This historical background could provide a clue to the whereabouts of a missing ancester for you.

MAJOR TILMAN DIXON CEMETERY ••••Col. Laurence T. Ayres, 3000 Susquehanna Lane, Austin, Texas, 78723, has written us additional information about the people whose tombstones were copied by Robert Y. Clay and published in Vol. 21, 1974, "An­ searchin" News. We appreciate his sharing this information with us. His script is quoted below. "Mr. John P. Seay and wife, Mrs. Jennie Vaughan Seay, who is a daughter of the late Colonel James Harrison Vaughan," owned the Tilman Dixon home in Dixon Springs, Tennessee, about fifty years after the place "was owned by Dr. Shelby of Nashville and occupied by Mrs. Tunstall and a single daughter as a wayside inn. It was about that time or soon after purchased of Dr. Shelby by Frederick Nance Mitchell, also of Nashville, who moved to it and lived there for a time. Colonel Vaughan, who was then a young man keeping store at Dixon's Springs, married his daughter and after the death of her father bought the place and resided there, making improvements and alterations referred to, till his death which occurred in the year 1879, his wife having died several years before." (Extracted from BOWEN's History of Smith Co. Two of the individuals mentioned above are buried in the Tilman Dixon cemetery near the site of the house which burned in December, 1974. The two resting there are Colonel Vaughan and his wife, Eliza Ann(Mitchell)Vaughan. The "Martha Mitchell" pro­ bably was the wife of Frederick Mitchell and they may be the Frederick Nance Mitchell and Martha "Patsei' Perkins who were married 18 Nov., 1799 in Pittsylvania, Virginia. The "C. P. Mitchell" may be a son of Frederick and Martha Mitchell and a brother of Eliza Mitchell Va~ghan. (One wonders where Frederick Mitchell was buried.) James H. Vaughan, who once owned the Tilman Dixon home, was the son of John S. Vaughan of Halifax County, Va. His mother was Ann(Stanfield)Vaughan, daughter of Marmaduke and Anne Stanfield. John S. Vau9han was the executor of the estate of his father-in-law, Marmaduke Stanfield, the will of the latter having been filed in Hali­ fax Co. In addition to James Harrison Vaughan, John and Ann Vaughan had a least six children, 4 girls and 2 boys, one being Henry Banks and the other being John S., Jr. Mary Frances Vaughan married John Chambers B~idgewater; she was a daughter of James H. and Eliza Ann(Mitchell)Vaughan. Although she is buried in the Tilman Dixon cemetery~ her husband is not; he died before returning home from the Civil War. Other children of James and El iza Vaughan were: Martha "Jennie", wife of John P. Seay; Victoria "Vickie", wife of G. F. Potter; James H. Vaughan, Jr., who~may have married a McClellan; and William S. Vaughan. Susan A. Vaughan may have been a daughter or a daughter-in-law. The John S. We have a letter from MS. Edna Adams, of Newhall, California, who has forwarded to us the original Bible Record pages of the Samuel J. Wishard family. They were the property of Mrs. Georgia Camp, who died in December of 1973. As far as her friends knew, she had no relatives, and Ms. Adams, realizing the value of such records, sent them to us. If any member of this family can be found, we will be happy to pass them on to him or her; if not, the pages will be placed in the files of the Tennessee Genealogical Society Library. This very extensive and thorough compilation of Macy records gives the European background of the family, as well as its beginnings in New England and its trek across New York, the midwestern states, and eventually to the south. The author gives each individual's name, generation, family, children, dates and counties where available. This is a large family with southern branches pre~dating the Civil War.

The purpose of this publication is to list colonial and emigrant ancestors and to place them upon their lands. To this end a compilation of land records and maps with a background of historical information has been made. Selected historical information of Henrico City and County was taken from prime and original sources. Boundaries were marked also, taken from prime and original sources. Abstracts of land patents were transcribed from patent books 1-14 (1632-1732). Also included is the Quit Rent Roll of Va. 1704-1705 which contains the names of the patentees of new lands and their taxable acres. There is a map which shows the present counties of Eastern Va. with dates.of formation and counties from which they were taken. Another map shows the CurIes of the James River as it appears in Colonial times with place names and names of land owners placed on their lands. A tremendous amount of research has been done for this publication, which is a valuable tool for genealogists interested in this area.

This is a very remarkable publication concerning early South Carolina Huguenot settlers. The history is presented in five sections: (1) A historical address on the introduction of cotton planting, which includes the names of a few planters and their families; (2) Reminiscences of "the oldest inhabitant left among us" in St. Stephen's Parish, including 53 plantation na~es, owners, their wives and children, and frequent Revolutionary War stories; (3) Sixty~eight pages on Craven Co. south of the Santee River, including stories of plantation social life and family connections wherever applicable; (4) The French Refugees, their background as a group, and a list of 154 heads of families, frequently giving place of birth, parents, maiden name of wife, and children, stating which were born in Europe and which in Carolina; (5) St. John's Parish memoirs covering a plantation tour with many families out- lined. This book is a genealogical treasure to many whose backgrounds are of early Co s. The Ridenours were from the Rhine Valley of German-Swiss-Palatinate-Alsace-Lorraine origin. The first of the family to settle in America were Nicholas and Susan of Rosenthaal, Alsace. They settled in Elizabethtown (Hagerstown), Maryland with their two sons. Nicholas Reitenour II married Rosina Kershner and took the oath of Allegiance at Philadelphia when 44 years of age. His oldest son, John Adam, married Marie Cassell. Both came to America on the ship Lydia from Rotterdam in 1739. The Ridenours were of the class of Protestants who fled. the religious wars of the 17th century. The Ridenour families of the Shenandoah Valley of Virginia claim relation­ ship with Ridenours from Alsace Lorraine. The first settlement at Powell's Fort listed Adam Ridenour. From these beginnings these sturdy people emigrated fro~ Penn., Maryland and Virginia into Ohio, Indiana, Illinois and up the Shenandoah Valley to the Carolinas, Tenn., and Kentucky.

The information given in this publication intrigues and sickens as one reads of the unfortunates who were reprieved from death sentences and transported to America. From 1615 to 1775 some 30,000 convicts were sent to the New World where they were sold into bondage. The names of the convicts are alphabetically listed. A feature of the book is the list of ships, names of their captains, approximate sailing dates, destinations and source of references of those who were in the business of transporting convicts to America.

William Gambrill, planter, was living in 1684-5, and owned 100 acres of land called "Charles Gift" near the "Horns upon the Clifts" in Charles County, Maryland. He was the first recorded Gambrill listed by the author. After giving many wills, records, cemetery listings and dates, the author carries her family through the years in "a pleasant way. She has included a remarkable collection of family pictures, some dating back to the 18th and 19th century. Genealogically, it is a treasure, but it needs an index.

Clark County is located in east central Kentucky with Winchester as its county seat. The county was erected in 1792 and was taken from Bourbon and Fayette Counties. Nearly 300 old graveyards are located and recorded. An equal number of old cemeteries gave been abandoned and-forgotten. After many years of research, miles and miles of traveling, checking and rechecking the author adds this com­ mendable book to her notable publications concerning Clark County, Ky. The roots of the Odom family are found in Wilkes County, North Carolina where at least three generations of the family lived and prospered. In 1840 William and Sarah (Yount) Odom moved to Union County, Ga. Some 9 or 10 children, three married daughters and their husbands and several grandchildren went along. As other early families did, they increased and spread into adjacent states, and eventually they migrated west into the greater part of the nation. The family is in its tenth generation and scarcely a state exists that does not contain a descendant. The publication is well done and contains much genealogical information.

Two brothers, Michael and Jacob (and perhaps another) and wives came to this country on the ship Harle, Sept. 1, 1736. They landed at Philadelphia. Michael and Jacob both took the oath of allegiance to the Colony of Pennsylvania and took up land. Adam Hufstedler thought to be a son of Michael is found in Federick County, Maryland and Lincoln County, North Carolina. The children of Adam and Louisa are found in York County, So~th Carolina, Blount County, Alabama, Knox County, Ten­ nessee. From these people the Huffstedlers of the Southern States descended. The author has included numerous allied family lines in this prodigious work. This genealogical history traces the or1g1n of the name Murphy in Ireland, gives the beginning of the linage in America, and follows them from Va. to Tenn., Ky. and Ark. It records their extensive wanderings over the nation. George Murphy, Sr. (ca 1745-1831) was a Revolutionary Soldier who settled in Pittsylvania Co., Va. and who later moved to Tenn., where his many descendants were particularly active in Robertson and Carroll Counties. In Carroll, Henderson, Benton, Madison, and Obion Counties, the allied families were: Anderson, Appleby, Barnhill, Beal, Edgin, Franks, Gossett, McCall, Meals, Murphy, Parker and Phillips. In Ky. the allied families were found mostly in Muhlenberg, Webster, Graves, Christian, Hardin and Warren Counties. They were: Elliott, Head, James, Jernigan, Johnson, Lee, Murphy, Murphey, Orr, Putman and Williams. Forty-five pioneer families are listed in this the 4th vol. for Wayne County, Ky. The biographies are gossipy and chock full of information concerning the everyday lives of the people, their work, their loves, their children, etc. The history of photography is unique. Daguerre invented his method of photography (the first photographs) in 1827.

The author has made an encyclopedia of Yates families of the United States(not a genealogy) before 1800. Family groups are given when known. He feels that there is work yet to be done and that data is still missing on the listed Yates Families. The data is condensed and abstracted from correspondence, manuscripts, etc. The author hopes that by exchange of information, he will be able to establish his own line of Isaacs Yates, b. Va. 1790. Included also are names of many Yates research­ ers. From such publications as this one are clues found for further research, among them.

John Crow lived in Orange County, North Carolina from 1760 to 1781. His first wife was Ruth Holland and second was Elizabeth Clark, whom he married in 1773. The families of Crow, Clark, Martin and Burke become interrelated in the 1830-1860 period in Northern Georgia. John Crow left Orange County some time after 1781 and before the census of 1790. He moved through western N. Carolina and settled in the Northwest Corner of S. Carolina. His sons, Thomas, James and Stephen were in Murray County, Ga. in 1850. The author traces the marriages of the sons and daugh­ ters of John Crow with the families of Clark, Martin and Burke. He gives the for­ mation of pertinent counties in N. This genealogy wastes no space. It is chock full of information of value to the genealogist. The author has documented records of the Colonial and Revolutionary periods from the early 1600's through the early 1800's on the Fearn families and their connection~, the Lees, Keenes, Rogers, Therriotts and Worthams. The name Beard is of Anglo-Saxon origin and was found in Hampshire, England in the 11th century. David Beard (1773-1855) the founder of this line in America, was born in N. C., as was his wife Lavina (1783-1865). David, William and Alexander Beard were settlers in Wilson Co., Tenn. (1794-1849) where David is found on the Tax List of 1803. His eight children and their descendants are the subjects of the eight parts of this publication. An appendix includes documentary proof in deeds, wills, marriage records and censi.

This is a well done family genealogy and should be helpful in locating ancestors and descendants of a pioneer family. The progenitor was Robert Peek who was pro­ bably born in Richmond, Va. in 1800. He is thought to have been brought to Overton County as a child by a parent or parents. The name of his first wife is unknown, but she bore ten children. She was born in North Carolina and died in Putnam County, Tenn. about 1845. Robert died about 1881 in Putnam County. His second wife was Celina Harp who was born 1-29-1824 in Tenn. and died Nov. 1889 in Fate, Texas. She, too, was the mother of ten children. The index includes over 300 names and a large slice of Putnam County history.

TENNESSEE PUBLIC LANDS James,R. Johnson

\ For most of Tennessee's history, the people have been farmers. In fact, as perma­ nent settlers first began arriving in the area in the late 1760's from North Caro­ lina, Virginia, and Pennsylvania, practically all were engaged in agricuiture. As was true of the colonists west of the Appalachian mountains, these first Tenne'sseans sought to own the land that they farmed. With the land being by far the largest investment of the pioneers, it was natural that records pertaining to the transfer of the land from the public domain to the private individual were made and main­ tained. These records are a valuable source for today's genealogist. However, due to the changing land policies of the various governments that claimed the area that became Tennessee, the searching of these records is often frustrating.

Although the pre~ence of Indians throughout North America confused the question of land ownership, Americans accepted the notion that the public domain originally belonged to the government which had the power to transfer the land to individual citizens. Moreover, the government normally assumed the responsibility of acquir­ ing the Indians'claim to the land before opening an area for settlement by Ameri­ cans. In many parts of the country the passing of public lands from the government to the individual landowners worked smoothly. However,in Tennessee the land issue was complicated since more than one government claimed the land. During the coio­ nial period, North Carolina, relying on its charter of 1663 from King Charles II, possessed the best claim to the transmontane region. However, due to unsettled boundaries as settlers first began moving into the Holston area of East Tennessee in the years before the Revolutionary War, land patents were obtained from both North Carolina and Virginia. Not until the boundary between Virginia and North Carolina was finalized in 1779 did all the land in the Holston area come under the ( control of the North Carolina government. With the creation of the State of Franklin in East Tennessee from 1784 to 1789, the land question was further com­ plicated since this short-lived government also sold land to settlers. Yet, these were minor problems compared to 'the entangled situation that resulted from the conditions on which North Carolina ceded its Tennessee claims to the national government in 1790. For the next few years, Tennessee's puBlic lands were simul­ taneously claimed by the governments of North Carolina, Tennessee, and the United States.

The dispute over Tennessee public domain between these three governments was in large part due to North Carolina's land policy. In 1777, the North Carolina Assembly passed an act opening up land offices in each county of the state which was authorized to sell land in the newly created county of Washington. In this new county that included most of the Tennessee country, any male citizen could purchase 640 acres for a relatively small sum. An additional one hundred acres could be bought for each member of his family. However, most of the land sold was not transferred directly from the government to the individual farm owner. Most of the million acres that was sold under the authority of this land law was purchased by land speculators. Land speculators purchased large tracts of land on the frontier, and with hopes of making a profit they would subdivide the land for purchase by the settlers.

At the end of the Revolutionary War, the land act of 1777 was replaced by the North Carolina Assembly with a new land law in 1783. Under the terms of the new act the number of acres which could be purchased in one tract was raise~ from the 1777 limit of 640 acres to 5,000 acres. Except for the lands reserved for the ( Cherokee Indians and the veterans of the Revolutionary War, all the western country was opened for settlement. Since depreciated currency was used for purchase, the land sold for less than five dollars per hundred acres. The procedures used to " Ansearch1n." News -60- acquire land under this 1783 act is of interest. The act required that the potential buyer, or his agent, go into the frontier and mark out the boundaries of the tract desired. Such a rude survey was called an entry. The buyer then submitted the entry to an official appointed by the government who made a record of the entry and issued a warrant for the survey to the claimant. Next, an official survey was made by a government official who also drew up a plat of the proposed property purchase. After the survey had been made and the plat drawn, the secretary of state was authorized to issue a grant. With payment for the land made, the title was finally clear after the grant was recorded in the office of the register for the county where the land was situated. As a result of the com­ plications of the legal procedure required to purchase land and the fact that land sold in such large tracts, once again a large amount of the land available went to land speculators. Thus, the individual settlers would often purchase their small holdings from the large landowners rather than from the North Carolina government.

With the exception of conflicting claims by those who purchased the land, the acts of 1777 and 1783 transferred the public domain from the government to the individual without too much difficulty. However, problems and disputes did result from North Carolina's practice of rewarding those who served in the Revolutionary War. Since North Carolina had much more land than money, the Revolutionary government decided to encourage enlistment in the Revolutionary cause by offering land bounty. In 1780 an act was passed which provided that upon completion of three years' enlist­ ment period, soldiers would be given a land grant of 200 acres and a gift of one prime slave. To satisfy these land bounties, a military tract was created in the western country, north of the Tennessee River and west of the Cumberland Gap. The military land bounty law was modified in 1782 when land was given on a graduated scale with a private receiving 640 acres and a brigadier general receiving 12,000 acres. Those who were wounded in the war received their full land bounty, and the heirs of dead soldiers also received equivalent acreage. Those entitled to land ~. were issued land warrants by the North Carolina government. The warrant specified-· the amount of land the veteran should receive. However, the owner of the warrant could fix by entry and survey the land he desired within the military reserve. For a number of reasons many soldiers elected not to migrate to the western country. Therefore,they sold their warrant to other individuals. The military bounty system caused problems because no definite date for claiming the bounty lands by veterans was ever clearly established.

In 1790 North Carolina ceded its western lands to the new Federal government. The North Carolina legislature made this cession on a number of conditions with two of the conditions dealing with the land question. The claims of purchasers under the land acts of the state were to be made good, as were the claims of men who held land warrants for the military reservation. If there was not enough land in this reserve, then the military warrants would be satisfied on other unappropriated lands. North Carolina reserved the right to continue making grants on all military warrants, although the survey had to be completed by 1792. The United States Congress agreed to these terms.

Thus, in 1790, Tennessee became a territory of the United States, but much of her land was still controlled by North Carolina. During the six years that Tennessee was a territory, the United States took no action to surveyor sell the public .lands in the territory. After Tennessee entered the Union in 1796, the Tennesseans de­ clared that Congress had no claim to her vacant lands by the omission of such a reservation in the act of admitting Tennessee to the Union. The Uni.ted States claimed that no such clause was necessary; and the~efore, the public lands of Tennessee still belonged to the federal government. North Carolina complicated the situation by extending the period that surveys should be completed and by con­ tinuing to issue military warrants. Summer, 1975 -61- After a bitter and extended controversy, the dispute was eventually resolved by a compromise, known as the Compact of 1806, enacted by Congress in that year. In the agreement, Tennessee recognized the title of the United States to a section of the state which became known as the Congressional Reservation. In this area Con­ gress reserved for the use of the Federal government all lands lying west of the Tennessee River and a broad adjoining strip extending eastward along the southern boundary of the state. There were practically no settlers in this area at the time, but certain North Carolina claims had been located here under the land act of 1783. Such claims were not invalidated, but no new North Carolina claims were to be set up unless other available land shall prove inadequate to satisfy them. The United States surrendered to Tennessee all claims to land north and east of the Congressional Reservation boundary. However, Tennessee had to agree to a number of conditions. First, Tennessee must satisfy all future North Carolina military bounties. Second, Tennessee was to reserve for the use of public education a section of land in each township. Next, from the Cherokee reservation which was free of claims by North Carolina veterans, Tennessee was to appropriate large tracts of land for higher education. Finally Tennessee agreed to sell its land for not less than two dollars an acre which was the minimum price established for feudal land.

Although this compromise was designed to end the dispute over the administration of public lands by the three governments, the quarrel continued. North Carolina con­ tinued to maintain that the right to perfect titles in the Congressional Reserva­ tion upon claims recognized in the original cession. In a case before the United States Supreme Court, the justice decided that North Carolina had relinquished its power to issue grants in Tennessee. However, the state continued to issue military warrants. Nevertheless, the administration of public lands was now clearly under the control of Tennessee and the United States. For the next few years, Tennessee waged a campaign to have the United States to cede the federal lands to the state. c Under the leadership of James K. Polk, Tennesseans claimed that the state had re­ ceived few benefits from the public lands in the state because of the excessive demands resulting from North Carolina's land policy. Tennesseans wanted the United States to cede the remaining public lands to the state for educational purposes. In 1841, Congress authorized Tennessee to sell waste land in the Congressional Reservation for the federal government's benefit, but granted occupants, often called squatters, pre-emption rights to 200 acres at 12-1/2 cents an acre. In 1846, Congress ceded the remaining lands, together with the revenue obtained since 1841, to Tennessee on condition that the proceeds from the sale of the land be used for public education. Thus, by 1846, Tennessee was sole proprietor of the remaining lands in 'the state.

The complicated history of public land in Tennessee is confusing, but in the land records there is a wealth of information available to the genealogist. The issuance of military bounties establishes without question the fact that an ancestor parti­ cipated in the Revolutionary War. The discovery of land records also places an ancestor in a particular section of the state, and by searching the extant records in the region more information can be obtained. Many early records deal with the ownership of land. It is fortunate for those searching family history that such a large number of early Tennesseans were farmers who own their own farms.

Mrs. Robert Anderson sent us the following deeds which she copied from the deed books in Haywood County, Tennessee:

"Marks Spence deeded to Robert C. Scott, both of HayWood County, Tennessee, a tract of land in the 11th survey District, Range 2, Section 9, containing 350 acres, part of a 500 acre grant made to Mark Spence also being part of Henry Nails' grant of 2,560 acres, number 22490, founded on warrant on number 5008, for the sume of $1,225.00 cash in hand paid by Robert C. Scott•••.beginning at the south corner of an elm on John Rice's land•••• 224 poles to John Stone's corner. (Signed) Mark Spence. Witnesses: Matthew Picket, Abner Spence, and Thomas Durham. Made this November 26, 1831." Haywood County Deeds - C, page 125.

"Abner Spence deeded to Robert C. Scott, a tract of land in Haywood County, 11th Survey District, Range 1, Section 9, 100 acres, for $500 cash in hand paid by Robert C. Her daughter, a relative of the Scott family of Tennessee, sent in the will of Robert C. Scott which is recorded in the Haywood County Will Book - 1, on pp. 447­ 448:

STATE OF TENNESSEE, Haywood County, IN THE NAME OF GOD AMEN: I, Rob't C. Scott of Haywood County, and State of Tennessee, do constitute and make this my last will and testament, hereby revoking all others.

"Article 1st: I give to my son John A. Scott, negro man named Henry and one bed and furniture.

"Article 2nd: I give to my daughter Aim Coleman Rayner, negro woman named Grace and girl Adeline and all their future increase. I also give to her two hundred acres of land, that I purchased of Isham Boyce including all the land that was cleared at the time I purchased it, by her husband's paying the installments that are due and that may hereinafter become' due, and further paying to my estate three hundred and twenty-five dollars, which amount I paid in purchase of the said land.

"Article 3rd: I give to my daughter Harriett HawJdns, Levisa and child Nathaniel and her future increase and one bed and furniture.

"Article 4th: I give to my son Robert Runnells Scott, .•••olle feather bed and fur­ niture, two hundred dollars to school him, and five hundred dollars to support him.

"Article 5th: I give to my son Thomas Miller Scott, boys Isaac and Joe; one feather bed and furniture and two hundred d9llars to school him.

"Article 6th: I give to my daughter Virginia Lafayette negro girl Margaret and little Peggy, one feather bed and furniture and two hundred dollars to school her. I "Article 7th: I give to my six children above named my five shares of Roanoke Stock in Virginia to be equally divided amongst them.

"Article 8th: I give to my son James R. Scott, two hundred acres of land that I purchased of Isham Boyce, by his paying the installments that are now due, and may Summer, 1975 -63- hereafter become due, for said land and further paying to my estate three hundred and twenty-five dollars which amount I paid in 'purchase of said land."

"Article 9th: All the lands that I may own at my death to be sold.•.• "

"Article 10th: All my negroes not heretofore given, with all other moneys to be equally divided amongst aLL my children to wit: Sarah Boyd, Mary R. Porter, James R. Scott, JohnA. Scott, Ann C. Rayner, Harriett M. Scott, Robert R. Scott, Thomas M. Scott, and Virginia L. Scott."

"Article 11: I hereby appoint Charles B. Porter, and Thomas A. Rayner my executors to this my last will and testament given under my hand and seal this 18th day of August 1836." (Signed): RobertC. Scott. Test: F. Greaves, D. J. Allen.

Copied from the files of the old APPEAL now the Commercial Appeal, Memphis, Ten­ nessee: "April 2, 1840, Thomas Rayner and Charles B. Porter, Executors of R. C. Scott, deceased, will sell at the Scott residence in Haywood County, Tennessee, his 700 acre plantation dwelling, cotton gin, and horse mill. The land is located on the road from Brownsville to Durhamville, Ripley and Fulton, Tennessee, about ten miles from Brownsville. Included in the sale of the land will be 200 hogs, five mules, six horses, 500 barrels of corn, 9000 pounds of pork, a carriage, harness, and ten slaves."

Mrs. Anderson sent us a sketch of Robert Scott which was written by a member of the Scott family: "The founder of the Scott family in Haywood County was Robert Scott who came with his wife and ten children from Halifax County, Virginia, in the fall of 1831, and settled on what was then known as his Lagoon Plantation, located on the North side of the road leading from Brownsville, the county seat, to a small village, Durhamville, in the adjoining county of Lauderdale. Robert C. Scott, Sr., was twice married in Halifax County, Virginia, the place of his birth not being known to me. (Proved to be Culpeper, Va. R. A.) His first wife was Mary Marable and they had four children: George, Mary, Sarah and James. His second wife was Miss Mary Alston, their children: John Alston, Ann Harriett, Robert C.; Thomas Miller, and Virginia Scott. The fourth child, Robert C. Scott, ~r., married first Eliza McGowan. Their children were Eliza and Robert H. Scott. Caroline Eliza McGowan Scott d. 14 Jan. 1849. Robert C. Scot~, Jr., -married second Miss Amelia Ann Tyson and they had seven children: Benjamin Tyson Scott, George Coleman Scott, Walter Scott, Ambrose Tyson Scott, Louisa Scott, Stonewall Scott, and Mamie Scott.

Robert Scott, Sr. died in 1838, and his wife died at his Lagoon Plantation in the year 1836. Both are buried on their homeplace."

We are greatly indebted to Mrs. Anderson for this material and she graciously states that she will be glad to correspond with others who have this Scott line.

On April 8, 1812, Captain John Baker pulled out of Bell Buckle, Bedford County, Tennessee with a wagon train of 28 wagons and 90 people, all bound for Texas. Their destination was the Brazos River country northwest of Houston, land which later became Washington on the Brazos. The train included 39 men, 19 WOmen and 42 children, and the wagons were pulled by 116 draft horses and mules. There were also 30 saddle horses on the trip. The 19 or 20 families who left Tennessee had paid $100 each for the trip, and on April 20th two more wagons joined the train. A list was made of all on the wagon train in order to aid friends and relatives in tracing them, if necessary.

Captain Baker led his wagon train to Forth Smith, Arkansas, then headed south to the Red River, east of Spanish Peak. It took 199 days to reach the Big Bend of the Red River, which is now in Bowie County, Texas. In 1812, this was a territory and the point of entry into Texas was made at this bend because of quicksand to the east and to the west. It is about 10 miles north of present day Hooks, Texas. Today all that is left to identify the spot is one lonely white marble tombstone, standing amidst several sunken graves. The inscription on the stone is "Jane, wife of S. Cooper, 1846-1887". There is thought to have been a small settlement here for a while, as graves were dug here very early, and people coming to Texas from Tennessee and Kentucky would cross the river here and camp a while before moving on. This old forgotten cemetery is called Red River Cemetery.

Six graves are definitely known to be here; they were marked by stones in 1922, and as late as 1930 were seen there by my husband, Woodrow Wilburn. Not being c interested in history at that time, he did not copy the data from them. It is fairly certain that the stones have been pushed over by grazing cattle and have sunk into the ground. Also a bulldozer has been used in clearing this land in recent years. The marker for Jane Cooper's grave was purchased in Clarksville, Tennessee, shipped to Ft. Smith, Ark., and taken to her grave sometime in 1888.

Of the six graves, one was that of Jane Cooper's grandmother, name unknown. Jane's maiden name was Bolander, and her husband was Sam C. Cooper, Jr. He died in 1914 and is thought to be buried here. His parents, Sam C. Cooper, St., and wife (name unknown), are buried here.

Captain Baker's first wagon train reached its destination 299 days after leaving Bell Buckle, Tennessee. He made two other such trips, one in 1814 and one in 1816. On the last one, he and his family settled at Spanish Peak. However, the Indians were so bad there, he moved his family across the Sulphur Fork and somewhat to the east about 40 or 50 miles. He was the father of Cullen Baker, notorious Texas outlaw.

RULES OF THE WAGON TRAIN

1. Allow 5 days for each one hundred miles. Bad days, what you can make, or stay in camp if agreed on by all. Real good days, and ground, makes it easy pulling 25 to 30 miles per day, if camp sites come right. 2. Take plenty of guns and ammunition. 3. Recommended - shave your head - Indians have no interest in Bald Heads. 4. Do not drink whiskey or alcohol in freezing weather, or you are liable to freeze to death. 5. Do not fire rifles, only when absolutely necessary. 6. Do not stay up late - get your sleep. Guards are on duty all night. 7. Do not smoke strong pipes and cigars in close places where women and children are. 8. Keep your politics and preaching to yourself. Let the preacher do the preach­ ing. Summer, 1975 -73- 9. In case of a runaway of teams to wagons, get down and try to ride it out. If you jump, you are liable to get killed, or hurt badly. The horse men will pick the team up, maybe not too far off. 10. All people - young, married, or not, stay inside the circle of wagons in Indian country, or you are liable to lose your scalps. 11. The wagon master will try to pick spots so men and women and children can bathe, clean up, and wash clothes, when possible. 12. Be courteous and help others. 13. Do not be noisy, even with your musical instruments; only when it is safe. 14. When can, we will have recreation and dances. 15. Do your part by all means. yor twenty years we have been searching for my husband's grandparents' marriage record in Shelby Co. in 1866, to no avail. We had visited and written the courthouse three times and always received a negative response, but we knew they had married on April 26, 1866 in or near Memphis. Naturally we searched in Mississippi and Arkansas to no avail. Last week we asked the clerk in the Marriage Records at the Administra­ tion Building if we might see the index for marriages. When we looked, it had no record of the marriage of Statira R. Spratt and James Thomas Biggs. The clerk told us the original book was down in the basement, but that we could read the microfilm. copy made from the original book. We found what we had sought for twenty years! A very kind and thoughtful lady made a Xerox copy of the record of our grandparents, which had not been transferred to the recent index book•.•.Book 4, page 477, license issued to J .. T. Biggs and Miss Statira R. Spratt on the 23 April 1866 by John Logue, Clerk, J. Weaver, Dp'ty Clerk, R. A. Waller, Bondsman for $1250. The marriage was solemnized on April 26, 1866, but was unsigned by officiating minister It may be of interest to some to know that marriage licenses were published in the MEMPHIS DAILY APPEAL each Sunday, the first time being Sunday, 29 April 1866. We read these and learned that they were married near Collierville, Tenn. in the home of the groom's uncle, James G. Moore, and that the marriage was solemnized by ( the Rev. R. R. (Richard Riley) Evans, Presbyterian Minister of Germantown, Tennessee. I hope this information will help others who have sought marriage records in vain. Tell them not to give up hope. Salem Church is located in Crockett County, Tennessee, about 2 miles northwest of Gadsden, Tennessee and is now a member of the Obion Presbytery. The following history was copied from an older Session Book into the Session Book of 1884.

Salem Congregation of the Cumberland Presbyterian Church, being a part of Center (Methodist) congregation, was organized into a separate congregation by petitioning the Madison Presbytery of the Cumberland Presbyterian Church in 1854. Petitioners were:

MEMPHIS NEWS AND NOTES:

As the last issue of ANSEARCHIN , NEWS goes to press for 1962, your president is pleased to report that all four local projects, outlined in January, have been completed. The last of these was the microfilming of ELMWOOD CEMETERY RECORDS, 1853-1904. Two rolls of. original records on film were presented to the Memphis Public Library in September.

In January we will present new plans and projects for 1963. We need sugges­ tionsfrom our members. Won't you please continue to offer new ideas, send new material for pr~nt and last, but not least, be with us in 1963?
