This paper attempts to understand this change of direction from the central state’s perspective. By examining the dynamics of the basketball and soccer markets, it discovers that while the deregulation of basketball is a result of persistent bottom-up effort from the private sector, the recentralization of soccer is a state-led policy change. Notwithstanding the different nature and routes between these reforms, in both sectors, the state’s aim is to restore and strengthen its legitimacy within the society. Amidst China’s economic stagnation, the regime hopes to identify sectors that can drive sustainable growth, and to make adjustments to its bureaucracy as a way to respond to the society’s mounting demand for political modernization.

How Non- Traditional Trademarks Promote Standardization and May Negatively Impact Creativity and Innovation Irene Calboli I. Introduction In this chapter, I continue the critique that I have started in a recent editorial vis-a- vis to non- traditional trademarks (NTTMs) and focus on three specific examples of NTTMs used and registered by fashion designers, notably: Louboutin, Gucci, and Bottega Veneta.1 In my view, these examples best exemplify the problems de- riving from the protection of NTTMs. First of all, as several of the chapters that are published in this volume have pointed out, these examples demonstrate the negative impact that the protection of NTTMs has on market competition.2 In particular, granting exclusive rights on NTTMs frequently results in preventing competitors from copying similar styles and product features, as NTTMs generally protect product design and aesthetic product features (such as colors, patterns, and shapes). Moreover, when these marks are considered famous—and Louboutin, Gucci, and Bottega Veneta’s marks certainly qualify as famous—their legal protection extends beyond confusing signs and includes anti- dilution protection.3 Accordingly, granting exclusive rights to NTTMs equates to foreclosing competitors and third parties from using any identical and similar product design and product features when this use could “blur” or “tarnish” the protected marks.

In his youth, the Chinese basketball player Yao Ming was once described as a "crane towering among a flock of chickens," Lee Chyen Yee wrote for Reuters (September 7, 2000). The only child of two retired professional basketball stars who played in the 1970s, Yao has towered over most of the adults in his life since elementary school. His adult height of seven feet five inches, coupled with his natural athleticism, has made him the best basketball player in his native China. Li Yaomin, the manager of Yao's Chinese team, the Shanghai Sharks, compared him to America's basketball icon: "America has Michael Jordan," he told Ching-Ching Ni for the Los Angeles Times (June 13, 2002), "and China has Yao Ming." In Yao's case, extraordinary height is matched with the grace and agility of a much smaller man. An Associated Press article, posted on ESPN.com (May 1, 2002), called Yao a "giant with an air of mystery to him, a player who's been raved about since the 2000 Olympics." Yao, who was eager to play in the United States, was the number-one pick in the 2002 National Basketball Association (NBA) draft; after complex negotiations with the Chinese government and the China Basketball Association (CBA), Yao was signed to the Houston Rockets in October 2002. Yao Ming was born on September 12, 1980 in Shanghai, China. His father, Zhiyuan, is six feet 10 inches and played center for a team in Shanghai, while his mother, Fang Fengdi, was the captain of the Chinese national women's basketball team and was considered by many to have been one of the greatest women's centers of all time.

Clippers and Hawaii Tourism Authority (HTA) have announced that the Clippers will return to Honolulu for Training Camp to tip off the 2019-20 season. The Clippers’ third annual Training Camp trip to Hawaii will include a preseason game against Russell Westbrook, James Harden and the Houston Rockets on Thursday, October 3 at 7:00 p.m. HT and another against the Chinese Basketball Association’s (CBA) Shanghai Sharks, owned and run by retired NBA star Yao Ming, on Sunday, October 6 at 1:00 p.m. HT. Both games will be played at the Stan Sheriff Center on the campus of the University of Hawaii at Manoa. “All of Clipper Nation is excited to return to the Hawaiian Islands this fall,” said Gillian Zucker, Clippers President of Business Operations. “Every year, we hear from our players, fans and staff about how much they look forward to starting the season in Honolulu. While in Hawaii, our players have the opportunity to grow together as a team, our fans are able to enjoy the hospitality of the islands - plus Clippers basketball - and we leave with a lasting spirit of Aloha.” The successful partnership between the Clippers and HTA will positively impact Hawaiian residents through a number of opportunities for local youth, coaches and sports fans. Among the assets it would acquire for $16.2 billion are Tiffany's valuable trademarks. One of these is the color trademark for robin egg blue, used to identify jewelry and many Tiffany's luxury goods and related services. Tiffany's has owned a federal trademark registration for that color since 2000. Color can be a major part of branding and promotion for luxury goods companies. Indeed, color is often used to reinforce branding image it is applied to packaging, sometimes products, and then also used in stores, in advertising, and on Web sites and popups, all to create a connected brand image. Tiffany is certainly not the only company to do so. Cartier has its iconic red box, Louis Vuitton traditionally used chocolate brown packaging and recently shifted to "Safran Imperial," a tan shade; Herms has long used orange bags and boxes. Luxury Daily published a special report about colors in the luxury goods business. It is clearly a powerful branding tool. But how can a brand's color be protected legally? History of trademark protection for colors It was not always clear that a single color could be protected as a trademark. Many courts refused to recognize such rights, worried that such recognition would lead to "color depletion," meaning that all of the colors would be used up as trademarks, stifling competition.
