1. Heard Shri Arvind V. Bandiwadekar, learned Advocate for the Applicant and Ms. S.P. Manchekar, learned Chief Presenting Officer for the Respondents.
2. Applicant is challenging the transfer order dated 01.10.2020 transferring his from Bhor to Saswad to the post of Medical Superintendent. The Applicant is retiring in May 2021.
3. The learned Counsel submits that Private Respondent No.2 who is bought on the post of the applicant is also retiring in May 2021. The learned Counsel further submits that the post in Saswad where he is transferred is already occupied by one Dr. U.R. Tapase from 10.07.2020. The applicant has joined the present post on 28.05.2019. The applicant is working at Bhor from 2014, but however to the lower rank of Medical Officer. The learned Counsel submits that he has served Respondent No.2.
4. The learned P.O. submits that the applicant is relieved on 06.10.2020. She further submits that the approval of competent authority is obtained. 2
5. The learned P.O. is directed to file affidavit-in-reply on next date. Respondents are directed to give posting to the applicant with immediate effect.
6. The inspection of the record / file which is bought by the office of respondent no.1 is allowed to the learned Counsel for the applicant in the presence of learned P.O.
7. Matter is adjourned to 10.12.2020. Matter is kept open for hearing on interim relief on next date.

order passed by this Tribunal on 04.09.2019 is cancelled.
4. As such, the issue remains about the impugned order dated 20.08.2019 which was under challenge in the present
O.A.
5. However, learned P.O. pointed out that the Applicant has sent a letter dated 13.10.2020 to the Government that he
is withdrawing this O.A.
6. Today, the Applicant Shri Gajanan Raut is also present in person. I interrogated him. He stated that he does not
want to prosecute present O.A. and requested for permission
to withdraw the same.
7. Learned P.O. on instructions from Shri S.Andale, Under Secretary, Agriculture, Animal Husbandry, Dairy
Development & Fisheries Dept, Mantralaya, Mumbai also
made statement that the Government will cancelled the
transfer order dated 20.08.2019 within two weeks and O.A.

8. In view of above and particularly on statement made by learned P.O., the grievance of transfer order dated
20.08.2019 could not survive.

Learned counsel submits the applicant in O.A 635/2020 was earlier working in Pune Commissionerate and Applicant in O.A 636/2020 was working in Pune Rural earlier and was transferred to Pimpri Chinchwad CommisSionerate. Both the applicants were transferred after creation of Pimpri Chinchwad Police Commissionerate in 2018 and therefore their service period should be counted from 2018 and they have not completed six years in Pimpri Chinchwad Police Commissionerate.
4. Learned P.O submits that the calculation is incorrect as the applicants were not transferred from Pune Police Commissionerate to Pimpri Chinchwad Police Commisisonerate, but they were given duty. However, their parent Commissionerate remained Pune Police Commisisonerate. Learned P.O further submitted that the office of Director General of Police, M.S, has issued a Circular dated 16.3.2020 wherein the tenure of two Commissionerates are clubbed while counting the period of service at a particular station.
5. Learned P.O submits that the applicants have not challenged the said Circular and seeks time to file.
6. Learned counsel submits that till then the applicants are to be allowed to work at their present place of posting as nobody is posted in their place.
7. Applicants to continue to work at their respective place of posting, if at all no other Police Officer is appointed to their respective posts, till today.
