Applicant is challenging the transfer order dated 01.10.2020 transferring his from Bhor to Saswad to the post of Medical Superintendent. The Applicant is retiring in May 2021. 3. The learned Counsel submits that Private Respondent No.2 who is bought on the post of the applicant is also retiring in May 2021. The learned Counsel further submits that the post in Saswad where he is transferred is already occupied by one Dr. U.R. Tapase from 10.07.2020. The applicant has joined the present post on 28.05.2019. The applicant is working at Bhor from 2014, but however to the lower rank of Medical Officer. The learned Counsel submits that he has served Respondent No.2. 4. The learned P.O. submits that the applicant is relieved on 06.10.2020. She further submits that the approval of competent authority is obtained. 2 5. The learned P.O. is directed to file affidavit-in-reply on next date. Respondents are directed to give posting to the applicant with immediate effect. 6. Today during hearing on the issue of granting interim relief, the Ld. Advocate for the applicants submits that he has gone through affidavit in reply filed by the respondents. He mainly refers to point regarding discrimination against the applicants while favouring certain other officers of the rank of Police Inspectors and Assistant Police Inspectors. In this he concedes that the officers who have been promoted as per the affidavit in reply have been given exemption or they have passed the Marathi/Hindi Language Examination. However, in case of one Pragati Adsure as per 2 O.A. No.145 of 2021 affidavit in reply the respondents have clarified that her promollon order would be cancelled by their office. As a result the discrimination which has been claimed appears to have been satisfactorily explained by the respondents. 2. On the issue of legal impediment regarding promoting the applicants, Ld. (Vijay Sharma vs. Union of India AIR 2008 Bom. 29) This book is an outcome of UNFPA’s efforts for improving the implementation of the law to address the declining Child Sex Ratio: the Pre-conception and Pre-natal Diagnostic Techniques Act. Between 2009 and 2011, UNFPA in collaboration with the Bombay High Court, State Health Systems Resource Centre, Maharashtra State Legal Services Authority and Public Health Department-Government of Maharashtra, supported the organization of Judicial Colloquia for capacity building of Judicial Officers and Prosecutors on the causes and implications of the declining Child Sex Ratio and the PCPNDT Act for speedy redressal of cases and also integrated the issue as part of all training programmes conducted at the Maharashtra Judicial Academy.

    Prayas Annual Report for the Period from April 2017 to March 2018 Work in Prisons (Maharashtra) Mumbai, Thane and Latur Unit Mumbai Mumbai Central Prison Inputs and Interventions Regular prison visits and visits to NGOs were carried out. Home visits and court visits were made on a regular basis. Psycho-social support in the form of counseling was provided to inmates. Legal guidance and information was provided to inmates. Legal aid was facilitated to individual inmates as required. Support in the form of medical aid, telephone calls to family members and advocates, shelter and repatriation was provided to various inmates. Referrals to aftercare programs were made as appropriate. Two individuals are ready to provide financial support for the bail amount of the inmates. Outputs and outcomes A total of 326 inmates were contacted. 152 prison visits were paid. 175 inmates were counseled. Legal guidance and information was provided to 85 inmates. Legal aid was arranged for 33 inmates. 247 phone calls were made to family members, police stations, advocates etc. 28 inmates were provided with emergency support. Repatriation support was provided to 2 inmates. 5 inmates were referred to the Prayas Rehabilitation Programme (NGO Placement Programme). Follow-up with inmates post-release is being carried out with 26 inmates. Challenges Presently, many inmates are facing problem related to surety bail as their families are unable to arrange for the surety and nor can they arrange the big amount of cash bail. Future plans Issuing of Aadhar Card to the inmates in prison regularly, as it is an important document at the time of bail.
