53. *Mrs. Shagufta Sadiq:

Will the Minister for Interior be pleased to state:

(a) whether it is a fact that the smuggling of different items is increasing at the entering points of the country; if so, the names of institutions/forces working alongside the borders of the country to control the said smuggling at present;

(b) the steps taken to control the smuggling since March, 2008 till date; and

(c) the achievements gained therefrom so far?

2. *Ms. Khalida Mansoor:

Will the Minister for National Disaster Management be pleased to state whether the process of rehabilitation and settlement of the people affected by floods and rains has been completed; if so, the details thereof? 2 Minister for National Disaster Management: Comments/Action Taken: 1. The entire response to the disaster has been categorized into three phases as under;

a. Rescue and emergency relief. b. Early Recovery. c. Rehabilitation and Reconstruction.

2. As part of the relief NDMA provided relief items including shelter, food and non food items to flood affectees through provincial and District authorities to address the immediate needs of affectees. In addition to the provision of relief by Government agencies, the relief efforts of UN agencies, donors and civil society organization was also coordinated, facilitated and assisted by NDMA to make the entire national response more effective. Details of major relief items provided is attached at Annexure-A.

3. In order to facilitate smooth transition from emergency to rehabilitation, reconstruction and long term development, an Early Recovery Framework/Plan is being prepared for implementation from January, 2011. The Early Recovery Framework will include projects related to the following sectors;

a. Housing. b. Agriculture & Food Security. c. Health & Nutrition d. Education e. Water & Sanitation f. Governance g. Non Frame Livelihood h. Community infrastructure.

4. For need based and all comprehensive construction & rehabilitation, the Government of Pakistan upon the request of Province of has engaged, the World Bank and Asian Development Bank to carry out detailed Damages and Need Assessment (DNA) in the affected areas. DNA exercise is under way and is reported to be completed soon. Construction and Rehabilitation is primarily the responsibility of Provincial Government. Therefore, reconstruction and rehabilitation 3 plan in different sectors based on the results of the DNA will be prepared by them. However, the Federal Government and NDMA will assist the Provincial Government with technical assistance & resource mobilization to fill the gaps if any. 4 3. *Mrs. Shagufta Sadiq:

Will the Minister for National Disaster Management be pleased to state the steps being taken to improve and make effective the role of NDMA?

Minister for National Diaster Management: The National Disaster Management Authority, established in the year 2007, has been actively engaged in managing the complete spectrum of disasters including preparedness, mitigation, relief, response, rehabilitation reconstruction. It has been striving to put in place a robust DRM system in the country through the following initiatives;

– Formulation of National Disaster Risk Reduction Policy.

– Institutional strengthening and capacity Building.

– Hazard, Vulnerability and Capacity Assessment.

– Training, Research, Awareness and Linkages.

– Community Based Disaster Risk Management.

– Mainstreaming DRR into Development.

– Preparedness and Mitigation Initiatives.

– Enhancing Early Warning capacities.

– Implementation of national DRM plans with the assistance from donors and UN agencies.

The NDMA has meager financial resources available to it for undertaking such a daunting challenge, while climate change related issues have further complicated the situation, particularly in tackling hydro-metrological disasters. It would need allocation of dedicated financial and material resources, to further improve its role in effective disaster management, including preparedness, undertaking disaster risk reduction initiatives, and effective response to any disaster situation.

The NDMA has been performing its functions and managed at least four mega disasters since its establishment in 2007, despite human resource constraints as it is manned with only 110 regular staff members. 5 In terms of financial resources during the recent monsoon disaster of 2011, the NDMA had only Rs.300 million seed money available in its fund for undertaking its functions in different areas of interventions. However, it actually required over Rs. 5 billion for immediate provision of life saving relief to affectees of unprecedented rains/floods in Sindh this year, where reportedly over 9.1 million people were affected. Despite such a challenge it managed to provide immediate relief primarily by procuring and supplying relief goods on credit basis and establishing a massive and effective supply chain system.

It has been the biggest ever relief operation managed by the government out of its own resources; notwithstanding the international humanitarian assistance which remained too little and too late.

Similarly, keeping in view the impact of climate change and hazards threatening Pakistan in future, there is an urgent need to focus on preparedness including strategic stock piling of relief items and training the vulnerable communities to be able to meet the adverse affects of disasters. Pakistan being developing country cannot afford to lose its development infrastructure due to recurrence of multiple disasters. Therefore, it has to invest on preparedness, mitigation, and disaster risk reduction rather than putting resources on emergency relief every time.

The Government is considering to augment financial and human resource capacity of NDMA to ensure preparedness measures, stock-pile important relief inventory and effectively implement national policies and programs related to disaster management.

4. *Mrs. Nisar Tanveer:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) whether it is fact that FBR had misreported the revenue collection at the end of financial year 2010-11; if so, whether any inquiry conducted thereof;

(b) whether it is also a fact that major corporate clients of the FBR have asked to grant advances to help the FBR for meeting the revenue targets; if so, the justification thereof; 6 (c) the details of dubious sale tax refunds in inland revenue, misdeclaration and fabricated valuation reported alongwith action taken thereupon during the last three fiscal years; and (d) the steps being taken to reform and make the postings/transfers in the FBR in transparent manners?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Sheikh): (a) In the month of June, 2011 FBR, contrary to the practice of relying on Monthly Performance Reports regarding revenue collection, adopted the practice of getting provisional collection figures on daily basis through fax. The collection figures were obtained from field formations, compiled and reported to the higher authorities along with the copies of faxes. A few LTUs and RTOs reported gross collection in respect of Sales Tax instead of net collection, which resulted in reporting of over collection.

(b) This is not a fact. There were no such advances made during the Financial year 2010-11.

(c) Field Formations have reported that 414 cases of dubious sales tax refunds were detected involving revenue of Rs. 9,389 Million as per attached Annexure. The proceedings for recovery have already been initiated besides penal action against the persons found involved in it.

(d) FBR has drawn guidelines for mobility and posting/transfer policy for all the officers from their initial appointment into service till senior level positions. (i) Rotation Plan for the first twelve years of service (BS-17/18).

(ii) Specialization for Mid Career Management and Senior Level Position (BS-18 and above).

(iii) All officers will be required to serve on field assignments for the first five years after completion of their Common Training & Specialized Training Programs. During these five years each officer will be rotated in all the functional domains of the field formations.

(iv) During the next five years all officers will be rotated for posting in FBR (HQ)/Training Institutions and other support functions.

(v) After completion of twelve years service, the officers will undergo a specialization plan in order to specialize in a specific area of interest relevant to their technical known how, organizational needs and professional interest. 7 8 9 8. *Mr. Mohammad Pervaiz Malik:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) the Consumer Price Index (CPI) and Sensitive Price Indicator (SPI) with regard to determine the rate of inflation as on March 15th, 2008 and November 25th, 2011 respectively in the country;

(b) whether it is a fact that the percentage of Consumer Price Index (CPI) and Sensitive Price Indicator have increased; if so, the reasons thereof; and

(c) the steps being taken to control the said increase?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) Consumer Price Index (CPI) is a statistical measure of the average change in the prices of a predetermined basket of goods and services customarily purchased/consumed by inhabitants of country belonging to specified income groups in the selected geographical areas over a fixed period of time. It covers 76 markets in 40 cities/urban centers of the country. Prices of 487 consumer items are taken for computation of this index on monthly basis. CPI is used to measure inflation.

Sensitive Price Indicator (SPI). It is computed on weekly basis to assess the price movements of essential commodities at shorter interval of time so as to review the price situation in the country. The SPI is being presented in the Economic Coordination Committee of the Cabinet (ECC). SPI comprises of 53 essential items the prices for which are being collected from 53 markets in 17 cities of the country.

Base year of price indices was changed during 2007-08. Therefore, the indices from 2008-09 are calculated by using new base 2007-08.

(b) Percentage change of Consumer Price Index has decreased to 11.10% during 2011-12(Jul-Nov) as compared to 12.00% during 2007-08 and 17.03% during 2008-09. Similarly percentage change of Sensitive Price Indicator (SPI) has decreased to 8.36% during 2011-12(Jul-Nov) as compared to 16.81% during 2007-08 and 21.14% during 2008-09. Generally speaking there is a decreasing trend in CPI and SPI changes.

(c) Does not relate to FBS.

@11. *Ms. Kishwar Zehra:

Will the Minister for Economic Affairs and Statistics be pleased to state: (a) whether it is a fact that Japan has been providing financial assistance for investment in various projects during the last three years till date; if so, the details of such assistance; and

(b) whether it is also a fact that said financial assistance has not been utilized so far; if so, the reasons thereof?

Minister for Economic Affairs and Statistics (Dr. Abdul Hafeez Shaikh): (a) Yes: During last three years Government of Japan extended financial –––––––––––––––––––––––––––––––––––––––––––––––––––––––––––– @Transferred from Prime Minister’s Secretariat. 11 assistance of US $ 681.078 million to the Government of Pakistan as per following details.

Loan Assistance: US $ 556.9 million Grant: US $ 124.43 million.

(b) Not Correct. An amount of US$ 160.698 million has already been disbursed. The remaining amount will also be disbursed as planned during agreed period.

14. *Sheikh Salahuddin:

Will the Minister for National Harmony be pleased to state the subject assigned to the Ministry and its attached departments alongwith the achievements gained since the establishment of the said Ministry?

Minister for National Harmony: Subjects assigned to Ministry of “National Harmony are as under:

Ministry of National Harmony, Islamabad has been constituted vide Notification No. 4-10-2011 -Min-I dated 29-07-2011 with the fallowing official business:—

i. Policy and legislation with regard to interfaith harmony.

ii. International agreements and commitments in respect of all religious communities and implementation thereof.

iii. Representation of Pakistan at UN Sub cornmission on Prevention of Discrimination to Minorities.

iv. Minorities Welfare Fund.

v. National Commission for Minorities.

vi. Evacuee Trust Property Board. 12

Achievements gained since the establishment of Ministry of National Harmony.

i. Revival of Minorities Welfare Fund has been taken up with M/o finance. On restoration of fund, cases of Financial Assistance, Scholarships, Small Development Schemes will be considered.

ii. Revised Accounting Procedures to operate the Minorities Welfare Fund have been taken up with M/o Finance and Auditor General of Pakistan for approval.

iii. Summary for the reconstitution of National Commission for Minorities has been sent to Prime Minister’s Secretariat for requisite approval.

iv. Dewali, a Hindu religious function was celebrated on 17-10-2011 at official level.

v. This Ministry celebrated the Minorities Day-2011 on 11-08-2011 at official level and a mega event was arranged at Aiwan-e-Sadar, Islamabad.

vi. A cheque of Rs. of Ten (10) Million is being extended for the rebuilding of St. Deny’s School Murree.

vii. A cheque of Rs.333,700 is being granted for special repair of Caloary Church, Jameelabad, Multan.

viii. Allocation of funds of Rs. two Million to each Minority MNA (total of twenty Million) for the distribution of Financial Assistance among the poor and needy Minorities people of Pakistan, has been approved by the Prime Minister and the funds are being obtained from Finance Division through Supplementary Grant.

ix. Allocation of funds of Rs. two Million each for Advisor to PM and MOS for distribution of Financial Assistance among the poor and needy minorities people of Pakistan, has been approved by the Prime Minister and the funds are being obtained from Finance Division through Supplementary Grant. 13 The reply of Evacuee Trust Property Board (ETPB) is Annexed.

15. *Ms. Tasneem Siddiqui:

Will the Minister for National Disaster Management be pleased to state the year-wise total amount of funds received by the government from foreign countries/NGO/Charity/Organization as aid for flood affectees during the last three years till date alongwith the country- wise break-up thereof?

Will the Minister for Interior be pleased to state whether there is any proposal under consideration to improve the performance of Rangers and Police to control the Law and Order situation in the country; if so, the province-wise steps being taken in this regard?

Minister for Interior (Mr. A. Rehman Malik): (a) Performance of Islamabad Police control the prevailing law and order situation is as under:—

In order to control the prevailing law & order situation foolproof security programme chalked out and 62 points were identified for the establishment of check posts to check the suspicious vehicles, motorcycles and persons. Keeping in view the prevailing situation, these check points are being rotated from one place to another. The backup of these points is as under:—

City Zone...... 24 Saddar Zone...... 20 I-Area Zone...... 14 Rural Zone...... 04

Furthermore, the ICT Police has taken following steps to control the Law & Order situation and improve its performance: 14 1. Halting Points :

Within ICT, 55 Halting Points have been established from 2359 Hrs to 0600 Hrs with breakup of 17 in City Zone, 21 in Saddar Zone, 17 in I-Area Zone. At these halting points, 55 vehicles have been deployed.

Whereas, from 0900 Hrs to 2359 Hrs total number of 19 Brovo Points on 19 vehicle and 10 Tigers with breakup of 07 in City Zone, 06 in Saddar Zone, 06 in I-Area Zone. At these halting points, 29 Bravo vehicles have been deployed.

2. Patrolling :

The Patrolling System within ICT have been revamped and 15 Falcons and alongwith 06 Commandos vehicles have been deployed which is working in three shifts for surveillance and to combat crime / criminals.

3. Survey of Rented Houses / Places / Kachi Abadies:

Besides this, time to time survey of houses / places given on rent are being conducted at Police Station level to ascertain the types of people living there and also to keep an eye over their activities as well as to control over the crime. Numbers of Survey have been carried out within ICT to ascertain the population deviling in the Kachi Abadies to further improve the law & order situation in the Federal Capital.

4. Survey of Mosques / Deeni Madaris:

In order to curb the crime/criminals, a detailed survey of Mosques situated within ICT have been carried out. There are 827 Mosques within ICT. Out of which 460 from Brailvi, 285 Deobandi, 36 Ahle Tashee, 34 Ahle Hadis & 12 Miscellaneous sects.

The detailed survey of Deeni Madaris revealed that there are 280 Madaris situated within ICT. Out of which 118 from Brailvi, 147 Deobandi, 05 Ahle Tashee, 08 Ahle Hadis & 02 Miscellaneous Sects. 15 5. Establishment of Nakas:

Total 60 Nakabadi points i.e. City Zone 24, Saddar 18, Industrial Area 14, Rural 04 have been established on various key points of ICT which are functioning round the clock. Proper Nakabandi of all exit and entry points of Islamabad are also being held randomly alongwith other places at different venues and times.

6. Re-Introduction of Beat System:

The Federal Capital has been divided in 44 beats and experienced officers have been deputed in each beat to watch the activities of suspects. There is one Falcon (Vehicle) patrolling in each beat.

7. Establishment of Citizen Security and Vigilance Committee:

Citizen and Vigilance Committees have been established at Police Station level and a probationer ASI has also been deputed with each Committee as liaison Officer.

8. Display of Arms:

In this regard, Arms ordinance, 1965 is fully operative. The violators are being dealt with in accordance with the law, irrespective of their status.

Furthermore, to deface the criminals involved in trafficking of illicit arms and ammunition, general hold ups at outgoing / incoming roads are being conducted.

9. Establishment of Community Policing Centre:

To redress the grievances of general public and to involve the local police in community policing, 46 Community Police Centre (CPC) have been established within ICT. An officer of the rank of Sub-Inspector has been deployed at each CP Centre to receive the complaints by the general public and to initiate an immediate action to save the general public from inconvenience.

10. Surveillance of Previous Convicts:

Besides, the previous convicts are also being checked frequently by the ICT Police through physical checking as well as through informers. The attention of public is also invited to co-operate with police by disclosing the names of 16 suspicious persons to police. Leaflets and pamphlets are distributed for educating the inhabitants of the Capital City. Besides, a contingency Plan has been chalked out and the ICT Police Officers are being specially trained to Counter Terrorism. Exchange of secret information and intelligence is being ensured to prevent and combat the crime/criminals.

(b) Steps being taken by the Provincial Police and Rangers to Control the law and order situation are at (Annex-A).

Will the Minister for Interior be pleased to state:

(a) whether it is a fact that livestocks being smuggled to Afghanistan and Iran;

(b) if so, the steps being taken to control it?

90. *Mrs. Nisar Tanveer:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) whether it is a fact that Planning Commission of Pakistan is working on a plan namely “New Development Approach” (NDA) to make the national entities profitable; if so, the salient feature thereof; and

(b) the time by which it will be implemented alongwith the present status thereof?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) Planning Commission of Pakistan has formulated Framework for Economic Growth (FEG) of Pakistan. National Economic Council (NEC) has approved the framework and directed Planning Commission to devise implementation plan for FEG. 17 Restructuring of Public Sector Enterprises (PSEs) is one of the proposed reforms of Framework for Economic Growth (FEG).

According to Framework for Economic Growth (FEG), the loss making Public Sector Enterprises (PSEs) will be classified according to three possible remedial measures that have to be driven firmly.

• First, the utilities (such as electricity and gas) need better management and improved regulation. In case of each utility two key issues of pricing and business process re-engineering must be addressed. The top tier must be market-trained professionals who can keep the corporate culture entrenched. The top most priority of these professionals should be to make this entity efficient to a maximum extent so that it becomes attractive for privatisation at a later stage.

• Second, the category of Public Sector Enterprises (PSEs) which are directly privatisable. These must be privatised.

• Finally there are Public Sector Enterprises (PSEs) that have outlived their purpose and must be considered for closing down.

(b) An institutional framework for appointment of Chief Executive Officers in Public Sector Enterprises (PSEs) has been approved by the Cabinet Committee on Restructuring (CCOR). Status of restructuring is as follows:

• Board of Directors of Pakistan Steel and Railways has been reconstituted. Operational restructuring plan has been presented in the Cabinet Committee on Restructuring (CCOR) and it is under implementation.

• Operational restructuring plan of Utility Stores Corporation (USC) has been presented to Cabinet Committee on Restructuring (CCOR) and it is being finalized.

• State Bank of Pakistan (SBP), Planning Commission and Finance Division are finalizing a restructuring plan for Trading Corporation of Pakistan (TCP).

• Operational restructuring plan of Pakistan Agriculture Storage and Services Corporation (PASSCO) was presented to Cabinet 18 Committee on Restructuring (CCOR) and various options are being considered.

• Public power sector entities are being restructured.

• Pakistan International Airline (PIA) has presented an initial restructuring plan. National Highway Authority is in the process of preparing an operational restructuring plan.

91. *Mrs. Nisar Tanveer:

Will the Minister In-charge of the Prime Minister’s Secretariat be pleased to state steps being taken to bring/attract foreign investment in the country?

Minister Incharge of the Prime Minister’s Secretariat: • Government is already offering competitive incentives through its Investment Policy, the salient features of which are at Annex-I. The steps being taken to bring / attract foreign direct investment in the country are at Annex-II.

Annex-I Board of Investment Islamabad

1. Salient features. of Pakistan’s Investrnent Policy are as under:

• Equal treatment to local and foreign investors.

• All economic sectors are open to FDI except, a few specified industries like arms and ammunition, explosives, radio-active substances, security printing currency and mint.

• Foreign equity up-to 100% allowed for manufacturing, services, infrastructure & social sectors.

• Minimum Foreign equity requirement in non-manufacturing sector (agriculture and infrastructure/social) is USD 0.3 million. In services sector (including telecom and IT) it is USD 0.15 million. Manufacturing sector has no minimum foreign investment amount requirement. 19 • Remittance of royalty, technical and franchise fee, dividends, capital and profits allowed.

• Import of raw material for export manufacturing is zero-rated.

• Attractive tax and tariff incentives package:

— 5 % customs duty on import of plant, machinery and equipment for manufacturing, infrastructure and social sectors.

— 0 - 5 % customs duty for services sector (including IT and Telecom).

— 0% customs duty for agriculture sector.

— No sales tax on import of machinery.

• Foreign Investment is fully procted by following Acts:

i. Foreign Private Investment (Promotion & Protection) Act, 1976.

ii. Protection of Economic Reforms Act, 1992.

Annex-II

Board of Investment Islamabad

Following major steps are being taken to enhance domestic investment in the country: • The Special Economic Zones (SEZs) Bill was cleared by the Council of Common Interest (CCI) in its meeting held on 27-08-2011. (SEZs) Bill has been placed before the Senate Standing Committee on Law, Justice, Human Rights & Parliamentary Affairs for their consideration and approval.

• The incentives of (SEZs) Bill are 5 & 10 years income tax exemption for investors and zone developers respectively with duty free import of plant and machinery. 20 • Recently, Public Private Sector dialogue has been launched for policy consultation with private sector. In this regard, three Sector Advisory Boards (SABs have been constituted on Energy, Agriculture- Livestock-Dairy-Fisheries and Infrastructure-Communication. These SABs, approved by the BOI Board is headed by the Prime Minister of Pakistan and comprises of relevant Federal Ministries, Provincial Governments, Private Sector and Sector Specialist.

• Investment Policy, 1997 is updated and Investment Strategy, 2011-16 has been prepared. They are being taken to the Cabinet for final approval.

• At present, online work visa facilitation and Branch / Liaison Office services have been started.

• 47 Bilateral Investment Treaties (BIT’s) have been signed with different countries. BOI has ratified BIT with Germany, Bosnia & Herzegovina, Kazakhstan and, Tajikistan. BIT’s with USA, Canada, Mexico, Vietnam, Bahrain. Negotiations on BIT have been initiated with Bulgaria and Austria for promotion of investment.

• Overseas and domestic investment conferences / exhibitions are being coordinated/organized by BOI to market investment opportunities in Pakistan and to explore the possible joint ventures.

• Close interaction with Business Chambers, Honorary Investment Counselors and Foreign Missions are being further strengthened.

• Facilitations are made to redress investors’ grievances.

• BOI is also extending facilitation services to local / foreign delegations and individual investors.

92. *Dr. Abdul Wahid Soomro:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state whether it is a fact that the government has initiated several austerity measures during the last three years till date to reduce the government expenditures; if so, the total amount saved therefrom? Reply not received. 21 93. *Dr. Nahid Shahid Ali:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) whether there is any proposal under consideration to increase the number of branches of ZTBL; if so, when it will be implemented; and

(b) whether there is also any proposal under consideration to provide free of cost seeds to the farmers by the said branches; if so, when it will be implemented?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) Yes. A proposal for opening of 34 new branches of ZTBL is under process in State Bank of Pakistan. The branches will be opened as soon as the Central Bank concurs the proposal.

(b) No such proposal is under consideration. The Bank provides finances at market based markup rates to ensure operational and financial sustainability of the Bank.

94. *Mr. Wasim Akhter Sheikh:

Will the Minister for Interior be pleased to refer to Starred Question No.10 replied on 21-7-2011 and to state:

(a) whether it is a fact that Ministry is the line Ministry and the focal point is FIA for International Convention on Protection of Migrant Workers;

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) The incidents of dacoities/armed robberies increased in banks during 2nd and 3rd quarters of 2011.

(b) Some of the reasons are as follows:—

i. Poor law & order situation in the country.

ii. Hiring of Private security agency guards by banks who are sometimes not well trained and equipped to handle such incidents.

iii. Sometimes security agencies may not verify properly the antecedents of the recruited guards and they become accomplice in burglary.

iv. Pay structure may not be sufficiently incentivized for these guards to enable them to efficiently perform their duty.

Eighteen (18) banks affected during the period Jan-Nov 2011 included UBL, HBL, MCB, NBP, Dubai Islamic Bank, Bank Al-Habib, Faysal Bank, Habib Metropolitan Bank, Allied Bank, Meezan Bank, Bank Alfalah, Albaraka Bank, KASB Bank, Askari Bank, Bank of Punjab, Bank Islami, Summit Bank and NIB Bank. 26 (c) SBP has issued various instructions on security arrangements in banks from time to time including BPD Circular No. 27 of 2004, BPD Circular Letter No. 48 of 2004 and BPRD Circular No. 05 of 2007 on security standerd for enhancement of recurity. Board of Investment Islamabad

Following major steps are being taken to enhance domestic investment in the country:

• The Special Economic Zones (SEZs) Bill was cleared by the Council of Common Interest (CCI) in its meeting held on 27-08-2011. SEZs Bill has been placed before the Senate Standing Committee on Law, Justice, Human Rights & Parliamentary Affairs for their consideration and approval. • The incentives of SEZs Bill are 5 & 10 years income tax exemption for investors and zone developers respectively with duty free import of plant and machinery.

• Recently, Public. Private Sector Dialogue has been launched for policy consultation with private sector. In this regard, three Sector Advisory Boards (SABs) have been constituted on Energy, Agriculture- livestock-Dairy-Fisheries and Infrastructure-Communication. These SABs, approved by the BOI Board is headed by the Prime Minister of Pakistan and comprises of relevant Federal Ministries, Provincial Governments, Private Sector and Sector Specialist.

• Investment Policy, 1997 is updated and Investment Strategy, 2011-16 has been prepared. They are being taken to the Cabinet for final approval.

• At present, online work visa facilitation and Branch / Liaison Office services have been started.

• 47 Bilateral Investment Treaties. (BITs) have been signed with different countries. BOI has ratified BIT with Germany, Bosnia & Herzegovina, Kazakhstan and Tajikistan. BIT’s with USA, Canada, Mexico, Vietnam, Bahrain. Negotiations on BIT has been initiated with Bulgaria and Austria for. promotion of investment.

• Overseas and domestic investment conferences / exhibitions are being coordinated / organized by BOI to market investment opportunities in Pakistan and to explore the possible joint ventures. 29 • Close interaction with Business chambers, Honorary Investment Counselors and Foreign Missions are being further strengthened.

• Facilitations are made to redress investors’ grievances.

• BOI is also extending facilitation services to local / foreign delegations and individual investors.

102. *Mr. Muhammad Riaz Malik:

Will the Minister for Finance, Revenue and Planning and Development Division be pleased to state: (a) the total available amount of the account holders in the National Saving Centres, at present; and

(b) whether there is any proposal to increase profit rate on said amount; if so, the ratio thereof?

Minister for Finance Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) The total amount of investments by the account holders in the National Savings Centres as on 31st October, 2011 is Rs.1666 billion.

(b) As per policy of the Government, the rate of profit on National Savings Schemes are reviewed quarterly. As such next revision in profit rates, will be processed in the last week of December, 2011 for the quarter January- March, 2012.

103. *Mr. Salahuddin:

Will the Minister for Interior be pleased to state the steps taken since March, 2008 till date to control corruption from all the Federal Government Institutions/Departments?

Minister for Interior (Mr. A. Rehman Malik): • In March 2008, there was only NAB, which was dealing with Anti-Corruption cases at Federal level. • Federal Government considered it appropriate that in addition to NAB, FIA should also be re-activated for eradication of corruption from Federal Government departments. 30

• The Prevention of Corruption Act, 1947 and other related offences pertaining to corruption punishable under Pakistan Panel Code (PPC) has been placed on the schedule of FIA Act, 1974 vide Interior Division’s notification dated 24-10-2008.

• Anti-Corruption Wing and Economic Crime Wing of FIA were re- established.

• During the period under reference, large number of cases and enquiries has been registered against public servants including major cases of corruption pertaining to Pakistan Steel Mills, NICL, Hajj Scam, Khanani & Kalia, Zarco Exchange etc.

• In order to strengthen prosecution of these cases, FIA has been provided Special Public Prosecutors from the private sector to strengthen the prosecution.

• Amendment in FIA (Inquiries & Investigation) Rules, 2002 is being considered to give more powers to DG/FIA for initiating action against senior public servant found involved in corruption.

• Inspection and monitoring of operational work of FIA especially against officer of BS-17-22 has been started on regular basis to improve the quality of work on one hand and to take action against those Investigating Officers found involved in corrupt practices.

104. *Mr. Salahuddin:

Will the Minister for National Disaster Management be pleased to state:

(a) the criteria and procedure adopted to distribute foreign and domestic aids/items among the flood affected people; and

(b) the steps taken to distribute the said aids/items in transparent manners? 31 Minister for National Disaster Management:

Comments/Action Taken

(a) The foreign assistance for flood / monsoon 2011 was received directly by Provincial Disaster Management Authority, Sindh on the direction of National Disaster Management Authority for onwards distribution to rain affected districts. Moreover, relief provided by Federal Government was handed over to Provincial Disaster Management Authority, Sindh and District Disaster Management Authorities as indicated by Provincial Disaster Management Authority/Sindh Government for further distribution to rain affected districts. National Disaster Management Authority did not involve in the distribution of relief goods. However, the details of foreign flights alongwith relief items received so far is attached as annexure A, whereas relief assistance provided by Federal Government is attached as annexure B.

(b) The distribution of relief items was undertaken by District authorities directly.

• Any amount paid on termination of employment whether paid voluntarily or through an agreement.

(b) Yes, honoraria, diet charges, overtime payment and house rent allowance are included in taxable Income of an employee. The justification is that the tax rate on salary has been reduced and all amounts given to employees as allowances are now included in the taxable Income.

(c) The process of e-filling is not at all complicated and is user friendly. E-filling of returns and statements has helped in taxpayer’s facilitation and reduction of cumbersome procedures as well as the requirements to visit the tax offices for manual filing of returns. 33 106. *Ms. Tasneem Siddiqui:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state the total foreign exchange reserves of the country at present?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): The total foreign exchange reserves of the country as on 14th December, 2011 stood at $16.644 billion.

107. *Dr. Araish Kumar:

Will the Minister for Finance, Revenue and Planning and Development Division be pleased to state the steps being taken to make Competition Commission of Pakistan (CCP) more effective/efficient to curb the activities of different cartels in the country?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): To curb the activities of different cartels in the country the Government of Pakistan has taken the following steps:—

i. The Competition Commission of Pakistan was established in 2007 through Ordinance and thereafter through enactment of the Competition Act, 2010 in October, 2010.

ii. Under the law, the Commission has been given adequate powers to detect and curb cartels and other anti-competitive activities in the country.

iii. The Government has extended full support to the Commission and the Commission is working independently without facing any interference from any quarter of the Government.

iv. The Government has timely appointed Chairperson and the Members of the CCP and Chairman of the Competition Appellate Tribunal whereas the appointment of the other technical members of the Tribunal is underway.

v. For smooth functioning of the CCP the Government is providing the funds through budgetary allocation. 34 vi. The CCP has been efficiently performing its functions and making efforts to curb the exploitation of general public by business men through cartels.

vii. The CCP has introduced the scheme of reward payment to informant, under which a reward can be paid to an informant giving information and evidence related to cartel activity.

viii. CCP has developed detailed enforcement regulations for conducting investigation under the law.

ix. The CCP is closely examining the role of trade associations in promoting cartelisation.

108. *Mr. Mohammad Pervaiz Malik:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) whether it is a fact that the recommendations of the World Bank Mission on Tax Administration and Task Force on Tax Administration have not been implemented so far in order to strengthen the FBR; if so, the reasons thereof;

(b) the steps being taken to implement the aforesaid reports at an earliest; and

(c) whether it is also fact that collection of FBR is neither monitored nor in independent third parity audit of such collection is carried out; if so, the steps being taken in this regard?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) All recommendations of the World Bank Mission on TARP have been thoroughly considered from time to time. Actions where required, in agreement with FBR and Ministry of Finance, have either been completed or are currently under process.

(b) Various steps have been taken to implement the aforesaid report which include. 35

1. Improvement in service to Taxpayer.

A significant setup for tax payer assistance and creation of facilitation centres have been established which are gradually changing the image of FBR in society. 17 new tax facilitation centres have been established.

2. Infrastructure and IT Development.

Office environment and IT infrastructure has been improved considerably with the provision of requisite IT equipments .This facility has been extended to Customs Department also for Data warehouse, and e-portal etc.

3. Introduction of efficient refund mechanism.

Expeditious Refund System (ERS) has been introduced for manufacturers cum exporters where claims are processed within 48 hours. A centralized cheque issuance office has been established by sales tax. This has resulted in reducing sales tax refund pendency by 48% and increasing refunds by 92% (Rs. 52 billion in Finance Year 2011 compared to Rs.27 billion in Finance Year 2010.)

4. Implementation of a new functionally integrated organization.

Though it is an ongoing process, yet FBR has introduced a fully functional organizational setup as envisaged and supported by TARP.

5. Human Resource Development

Training of Staff/Officials is being imparted to acquaint employees with all modern techniques. Job description for all positions of field formations has been prepared by the FBR.

(c) Collection of revenue by FBR is regularly audited by the office of the Auditor General of Pakistan which is an independent authority under article-168 of the Constitution of Islamic Republic of Pakistan.

As per section-12 (Audit of receipts of Federation or of Provinces or of districts) Functions, Powers and Terms and Conditions of Service Ordinance, 2001, of the Auditor General “The Auditor-General shall audit all receipts which are payable into the Consolidated Fund or Public Account of the Federal Government and of each Province and in the accounts of each 36 district and to satisfy himself that all such receipts which are payable into the Consolidated Fund, Public Account or any district account have been properly and correctly deposited and rules and procedures relating to which receipts are being fully observed and the systems are in place to ensure proper assessment and collection of government receipts”.

Annual Audit Reports by Auditor General of Pakistan are examined and discussed by the Public Accounts Committee of the National Assembly of Pakistan for monitoring the compliance.

109. *Rana Mahmood -ul- Hassan:

Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

(a) whether it is a fact that the Securities and Exchange Commission of Pakistan (SECP) is a statutory body;

(b) whether it is also fact that SECP has failed to exercise its powers in letter and spirit during the recent years in order to oversee fraudulent investment made in the insurance sector;

(c) if the answers to parts (a) and (b) above be in the affirmative, whether any inquiry conducted to probe the fraudulent investment; if so, the action taken against the responsibles?

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Shaikh): (a) The Securities and Exchange Commission of Pakistan (SECP) is a statutory body set up in pursuance of the Securities and Exchange Commission of Pakistan Act, 1997.

(b) SECP has been exercising its powers according to the applicable laws. SECP is responsible for the supervision of the business of insurance industry in accordance with the insurance laws of the country. SECP has been enforcing these laws by conducting offsite monitoring and onsite inspections of insurance companies. Over the years, SECP has also taken various actions against the insurance/ takaful companies who were non-compliant with regulatory requirements.

As an insurance regulator, the primary responsibility of SECP is to protect the interests of the policy holders for which it ensures that the prescribed solvency requirements are adequately met. For calculating solvency, investments are allowed 37 in admissible assets upto the specified limits while the actual investment decision rests with the Board of Directors of listed companies. The board of directors of a public limited company including insurance companies is fully empowered under Section 196 of the Companies Ordinance 1984, to invest the funds of the company through the resolution passed in their meetings. The directors on the Board are appointed by the shareholders.

(c) The answer to part, (a) is in affirmative whereas for part (b) it is negative. SECP has conducted various inquiries in last two years to ensure compliance with the applicable insurance laws. These inquiries covered the companies on overall basis rather than any specific area, and a number of observations/violations were identified. SECP has taken appropriate actions to rectify the observed issues including the issuing show-cause notices and imposing penalties for non-compliances of the applicable laws. In addition, SECP has identified the control weaknesses and asked the insurance companies to address those weaknesses in order to strengthen the internal control system.

Minister for Interior (Mr. A. Rehman Malik): (a) Only 04 bus stands are operating in Islamabad without permission of the Islamabad Transport Authority. All these bus stands are operating at Faiz Abad. Names of these bus stands are given below:—

(i) Al-Makkah Coach, Faizabad. (ii) New Bilal Travels, Main Pir Wadahi Road, Faizabad. (iii) New Blue Lines, Pir Wadahi Road, Faizabad. 4 (iv) Frontier Punjab Flying Coach Air Bus Service, Pir Wadahi Road, Faizabad.

The Secretary, Islamabad Transport Authority has granted permission for establishment of 04 bus stands in Islamabad. Names of these bus stands are as under:—

(i) Z. A. Khan, G-9-Markaz, Islamabad. (ii) Raja Travels, Faizabad. (iii) Skyways, Faizabad. (iv) Islamabad Bus Terminal, Near Motorway Chowk, Islamabad.

(b) The operators/owners of the illegal bus tands have filed Writ Petitions in the Lahore High Court, Rawalpindi Bench against the action of CDA and Islamabad Transport Authority regarding removal of these illegal bus stands. The Hon’ble Court directed the Capital Development Authority to provide suitable alternate land/space to the said illegal bus stands so that these could be removed from the present places. Minister for Interior (Mr. A. Rehman Malik): (a) Arms licences were being issued concurrently by the Federal Government and Provincial Governments under Arms Ordinance, 1965, till 30th June, 2011. (b) After passing the 18th amendment the powers for issuance of arms licences have been devolved to provinces and no arms licence has been issued after 30th June, 2011 by the Ministry of Interior, Policy is being formulated for 5 issuance of arms licences to residents of areas that do not form part of any province. NADRA has been assigned the task to issue Computerized Arms Licenses/ revalidation of licences issued by the Ministry of Interior.

Will the Minister for Interior be pleased to state whether there is any proposal under consideration to impose ban on black glass being used in vehicles; if so, the time by which it will be implemented?

Minister for Interior (Mr. A. Rehman Malik): As per Sl. No.17 of twelfth Schedule ( Part-I), under section 116-A of Motor Vehicle Ordinance, 1985, driving with tinted or covered glasses, obstructing visibility from within the vehicles, is a moving violations and Police Officers are empowered to impose fine up on the vehicles driven with the above mentioned glasses. The Assistant Commissioners /Magistrates and Secretary, Islamabad Transport Authority, are implementing the above said law in the Islamabad Capital Territory and fine is being imposed accordingly.

Since a law is available in Islamabad Capital Territory, therefore, no any such proposal, as indicated by the Hon’ble Member of National Assernbly, in the Question, is under consideration of this Administration.

Minister for Interior (Mr. A. Rehman Malik): (a) Two Mobile Scanners were imported from China and installed near Golra Toll Plaza, and Rawat Toll Plaza, sites, Islamabad respectively. However, one Mobile scanner installed at Golra Toll Plaza Site has been shifted / handed over to Pakistan Rangers, Sindh Karachi on 14th October, 2011 for the installation near Hub check post, Karachi due to critical law and order situation in Karachi. The installation of the same is under way under the supervision of DG Rangers, Sindh, Karachi. The second one is under the use of ICT Police near Rawat Toll Plaza Site as stated above.

(b) Yes, both the two scanners are in working condition.

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Sheikh) : (a) Since becoming a member of International Monetary Fund (IMF) in 1950, Pakistan has been availing different financing facilities of IMF to address economic imbalances. Evaluation of the recently ended programme has been carried out as a continuous process during the implementation of the program, in consultation with stakeholders including State Bank of Pakistan, Federal Board of Revenue etc. The last Stand By Arrangement (SBA) that ended on September 30, 2011, resulted in improving the current account balance, stable exchange rate and Foreign Exchange Reserves were recorded at the historically highest level with stable inflow of foreign remittances. Inflation was reduced from 19 the high of 25% in 2008 to 14% in September 2011. The reform process initiated because of the Program is still being pursued actively.

(b) The reforms initiated by the IMF Program are continuing. Also, fiscal discipline is being maintained in a manner as during the currency of the program.

(a) the institution/department-wise cases of anomalies submitted to the Anomaly Committee of the Ministry till date;

Minister for Finance, Revenue and Planning and Development (Dr. Abdul Hafeez Sheikh) : (a) After the announcement of new pay scales 2011, three thousand (3000) cases regarding removal of anomaly in pay fixation have been received for consideration by the Anomaly Committee from different Ministries/Divisions/Departments and Government employees. Ministries/ Divisions/ Departments were asked to send anomaly cases by 30th September, 2011.

(b) The criteria for removal of anomalies in pay fixation has been issued by the Finance Division vide O. M. No. F.1(11) Imp/2011 dated 22-9-2011 (Annexed).

(c) A preliminary meeting was held in which cases pertaining to Military Finance were considered but not finalized.

(d) All the cases are being placed before the Anomaly Committee which meeting is scheduled to be held shortly. , (Annexure has been placed in the National Assembly Library.) 20

Minister for Interior (Mr. A. Rehman Malik): The Department of Immigration & Passports is observing delivery schedule of Passports to the applicants. Ordinary and Urgent Passports are delivered on 12th and 5th working day respectively.

It is further stated that in order to facilitate the Passport seekers, Government of Pakistan has established 33 new Regional Passport Offices within the country raising the total number of Regional Passport Offices in Pakistan to 63 offices (List of offices enclosed at Annex- “A”). 21

Reduction in disbursements is due to hold in Programme Lending for which the Government is taking necessary measures.

(c) Cumulatively, net Capital inflow during the last five years has maintained a positive ratio.

(i) Portfolio Review by the Finance Minister and Secretary EAD with implementing Agencies on regular basis periodically.

(ii) Improving macroeconomic outlook for recommencing program lending.

5. Finance Division (Main): Fifteen officials are working on contract basis. One of them is in MP Scale, nine are employed on fixed pay package. Remaining five, appointed under Prime Minister’s Assistance Package for the families of employees who die in service, do not fall under the criterion conveyed by the Establishment Division for consideration by the Cabinet Sub Committee (Annexure-A).

Auditor General of Pakistan: Sixty six Audit Officers are working on contract in the Department. The case is subjudice in Islamabad High Court as four writ petitions for regularization of services have been filed. Case for regularization would be taken up in the light of directions of the Hon’ble Court.

Controller General of Accounts: 168 officials are working on contract, contingent and daily wages basis. Fifteen of them do not meet the criteria for the regularization – cases of remaining employees are under process in the department.

Pakistan Mint: Six employees are working in the department under PM’s Assistance Package.

Directorate General of National Savings: Six employees are working on contract basis under Prime Minister’s Assistance Package; however, none of them has completed the prescribed length of service for consideration by the Cabinet Sub Committee.

Pakistan Security Printing Corporation: Fourteen Security Guards (Ex-service men) are working on contract basis. Case for their regularization is under process.

6. Economic Affairs Division: Seven contract employees are working in the Division. Cases of two of them have been sent to Establishment Division for placement before the Cabinet Sub Committee, whereas remaining five employees have yet not completed the prescribed length of service. 30 7. Planning & Development Division: Cases of twenty four employees of Planning & Development Division and its attached departments were considered for regularization by the Cabinet Sub Committee in its meeting held on 24-11-2011. Process to regularize them will be initiated in the light of minutes/decisions of the meeting which are awaited.

8. Statistics Division: Cases of 281 contract employees of Federal Bureau of Statistics were referred to Cabinet Sub Committee for consideration. Two of them had not completed required length of service, hence they were not considered for regularization.

Cabinet Sub-Committee had recommended regularization of 279 employees of Pakistan Social and Living Standard Measurement Project. One of them has left the service and case for regularization of remaining 278 employees is under process. (Annexure has been placed in the National Assembly Library.)

Will the Minister Incharge of the Prime Minister’s Secretariat be pleased to state:

(a) whether it is a fact that funds of ERRA have been transferred to a Private Bank; if so, the amount alongwith the date of transfer of fund to that bank;

(b) whether there is any proposal under consideration to transfer a portion or whole of said funds to government owned bank; if so, when it will be transferred?

Minister Incharge of the Prime Minister’s Secretariat: (a) No funds of ERRA have been transferred to a private bank.

(b) According to ERRA’s financial Manual, funds can be placed with the National Bank of Pakistan only. Therefore there is no proposal to transfer any fund in any other bank. 34 104. Ch. :

Will the Minister for Interior be pleased to state whether there is any proposal under consideration to regularize the services of the contractual employees of NADRA; if so, when it will be implemented?

Minister for Interior (Mr. A. Rehman Malik): Yes, work on the proposal is in progress and will be presented before the NADRA Authority Board for consideration in due course of time.

Will the Minister for Interior be pleased to state:

(a) the year-wise total number of employees of FIA terminated from services during the last five years alongwith the reasons and period of termination thereof;

(b) whether it is a fact that some employees have been re-instated; if so, the detail thereof alongwith the total amount paid to those employees; and

(c) the authority who granted approval for the re-instatement of those employees?
