MINUTES OF THE MEETING OF BREEDON PARISH COUNCIL HELD IN THE COMMUNITY CENTRE, BREEDON, ON MONDAY 3RD JULY 2017

1789) Code of Conduct - Councillors’ Declarations of Interest None.

1790) To approve the minutes of the previous meeting of the Council RESOLVED: The minutes of the meeting held on Monday 5th June 2017, having been previously circulated, were signed by the Chairman as a true and correct record of that meeting.

1791) Any matters to be raised with the County Councillor. RESOLVED: Cllr Rushton explained that LCC were keen to support Parish Council’s with War Memorial restoration projects and he said he’d speak to an officer and get him to call the Clerk to arrange a site visit at Breedon.

The Parish Council expressed thanks to Cllr Nick Rushton and Andrew Bridgen for attending the Breedon Summer Sunday event.

1793) Police Matters (a) Police Report Emerging trends / Incidents of note:- We continue to see thefts from vehicles across the area this month we would encourage people to consider where they park, removing valuables from vehicles overnight. The team recently held a number of Free Tool Marking And Crime Prevention Advice event on the beat. It was an opportunity to have power tools, hand tools, and garden equipment marked and personalised helping with their safe return should they be stolen. The security marking is almost impossible to remove. If you missed the chance to have your valuables, please contact a member of the beat team to make an appointment.

Crime Prevention Advice Police takes vehicle crime very seriously and understand the effects of such crime can be distressing and cause a lot of inconvenience for the owner.

The more security you are able put in and around your vehicle, the less attractive it will be to thieves. Consider adopting some of the following security measures in order to try to reduce your likelihood of becoming a victim of future crime. Protect your vehicle. Don’t give thieves an easy ride. • leave it on show expect it to go! Always remove valuables from your vehicle • remove sat nav’s including the support cradle and cables. Wipe away any suction pad marks • don’t leave tools in vans overnight 1 Monday 3rd July 2017. • make sure that doors are locked, windows are closed and keys are removed when you leave the car, even if it’s only for a moment • on icy mornings, never leave your vehicle unattended with the engine running • park your vehicle in a well-lit spot that is visible to others, or covered by CCTV • if you have a garage, use it. Always lock your vehicle and garage • consider fitting a metal cage to your catalytic convertor or have it etched • register any vehicle equipment such as CD players, in-car DVD payers, and sat nav’s, for free with immobilise.com

DOWNLOAD Download 2017 has proved a great success from a policing perspective with early indications suggesting it is another low crime event. More than 100 bands played across the weekend with the headliners being System of a Down, Biffy Clyro and Aerosmith.

It was the first major festival in the country following the terrorist attacks in Manchester and London which prompted a review of security and the decision to put visibly armed officers on patrol throughout the festival. This proved popular with festival goers who thanked officers for keeping them safe and queued up to have their picture taken!

Superintendent Martyn Ball one of the Silver Commanders at Download this year, said: “It’s been another really good year with a great atmosphere and low levels of crime reported to us. The success of our operation lies in our great working relationship with the organisers, Festival Republic. Although it is too soon to give definite crime figures, early indications are that reported crime is very low. Officers worked hard day and night patrolling car parks and campsites and they talked to hundreds of rock fans, swopping hats, giving ‘hi fives’ and having their picture taken. “We had visibly armed officers patrolling for the first time this year following the tragic events of Manchester and London and they were all overwhelmed by the positive response from festival goers who thanked them for keeping them safe. They were happy to have their picture taken many times which was a new experience for the usually camera shy firearms officers! “We used Facebook and Twitter to give out crime prevention advice before and during the event and we’ve had an overwhelmingly positive response from fans on social media posting selfies and thanking us for our friendly policing style. It has been a great success from a police prospective.”

PCSO Bradley asked the Parish Council if it had arranged a date for a future Neighbourhood Watch Meeting. A meeting date was confirmed for Monday 4th September at 8pm, after the Parish Council

1794) Chairman’s Report. Resolved: First of all I would like to thank all the volunteers for their invaluable assistance yesterday. I must admit that as the day approached I was getting very nervous, unnecessarily as it turned out! The volunteer marshalls did a sterling job keeping control. I don't really want to single people out however, I have to congratulate Nigel Page on the success of his grand finale it went down a storm. The winner was Barry Nazer of Main Street who very graciously donated his winnings to the church appeal. It was encouraging to have the support of Cllr Nick Rushton and Andrew Bridgen on the walk. Sadly, Andrew didn't have time to unveil the plaque on the queen’s birthday garden but Andrew Jackson from the Village Voice graciously agreed to take the photo without a celebrity. I would like to thank Breedon Group for putting the plaque in place.

We will shortly be having a shakedown meeting where we will critique this year’s event and start planning for next year. We are hoping for suggestions and would welcome ideas from all parties, the school, the WI and members of the public. Please make your suggestions by email to Sam who will put them on the agenda for the meeting.

I haven't any news on the planning issues, we anxiously await the result of the appeal on the Limes Fields application fingers crossed that our objections are sustained. There hasn't been any more progress on the Cameron Homes application, but good news Limes Farm and barns have been sold at last. A sympathetic restoration will enhance the village scene dramatically.

1795) Administration & Finance (a) Clerk's Report. CLERK’S ADMINISTRATION REPORT – 3rd July 2017

Breedon Fun Day I really enjoyed being part of a fantastic team to create a great community event. I wanted to say a massive thank you to ALL involved especially our volunteers, who took time out of their weekend to help the make the day possible. I thought the day was a great success and I can’t wait to start planning for next year! A special thanks to our ‘duck man’ – great planning, enthusiasm and dedication – I believe this will now be an Annual Race!

Breedon, Tonge and Wilson – Signage Project We are up to £1870.00 in funding – Hope to move this forward this month.

War Memorial Pre-application submitted to the War Memorial Trust and also sent to LCC who apparently like to help restore ancient monuments.

Roundabout Further to the Breedon on the Hill Parish council meeting on the 5th June, Mr Rushton has requested that LCC respond regarding the existing traffic signalled junction on the A453 Walton Hill/ Walton top junction and the suggestion to change to a mini roundabout.

When deciding on what type of junction would be most suited at a particular location we must adhere to the standards as contained in the Design Manual for Roads and Bridges *.

The option of a mini roundabout would not be a suitable form of junction at the A453 Walton Hill/ Hilltop junction in Castle Donington due to the following:

3 Monday 3rd July 2017. • Mini-roundabouts must only be used on roads with a speed limit of 30mph or less and where the 85th percentile dry weather speed of traffic is less than 35mph within a distance of 70 metres from the proposed give way line on all approaches, unless installed in combination with speed reduction measures.

The A453 at this location is subject to the National speed limit, 85%ile approach speeds on the approach to the junction are in the range of 38 - 43mph • Where the existing 85th percentile dry weather speed is 35mph and above and a mini roundabout is installed in combination with speed reduction measures in anticipation of reducing speeds to the required level, post installation vehicle speed monitoring must be undertaken. In the event that vehicle speeds remain at 35mph or above, further speed reducing measures MUST be installed. The introduction of traffic calming features on the approach to the junction would not be desirable.

• Mini-roundabouts must not be used: • at new junctions; • at direct accesses. See TD 41 (DMRB 6.1.7) • on dual carriageways; • at a junction where the forecast traffic flow on any arm is below 500 vehicles per day (2-way AADT).

The A453 is effectively a dual carriageway through the intersection. • The inscribed circle diameter (ICD) of a mini-roundabout is the diameter of the largest circle that can be inscribed within the junction kerbs. The maximum ICD of a mini-roundabout is 28m. Above this dimension, a normal roundabout can accommodate the largest design vehicle and must be used. For further guidance see TD 16 (DMRB 6.2.3). The ICD at the intersection is in excess of 100m, construction of a normal roundabout would require extensive design works, the impact of such a change would need to be carefully assessed to ensure capacity at the junction is not reduced, construction costs would be significant and would need to be assessed against other criteria such as safety benefits (there have been no recorded injury accidents at the site in the five year period to 1st March 2017).

However, on a positive note as the traffic signals have reached their end of life as part of the replacement assessment we look at the functionality and suitability of the existing facilities. As part of this county council is currently finalising proposals to replace the existing traffic signals and having assessed the site the method of operation at the site will be simplified and red / green man pedestrian displays will no longer be provided. This will simplify the operation of the signals and reduce the amount of street furniture reducing the visual impact of the installation whilst still providing positive control for road users. (b) To confirm a date for the de-brief meeting following the Breedon Summer Sunday event; Sunday 2nd July. RESOLVED: Date confirmed Thursday 13th July; the Clerk to invite all parties that were involved on the day. (c) Following the latest Independent Play Area Inspection, undertaken by RoSPA; the Parish Council to discuss the report. - (Reports Fwd to Cllrs) RESOLVED: The Parish Council has reviewed the report, there are no immediate risks, however, the Parish Council plans to replace all equipment and surfacing in the very near future and is due to have a meeting with the school governors to discuss this project.

4 Monday 3rd July 2017. (d) To discuss and confirm the risk assessment put together to minimise and manage the risk to Parish Council assets. RESOLVED: The Parish Council confirmed it was happy with the risk assessment and has adopted the document. The Clerk to email the document through to the Insurance company to make sure it’s happy with the information. (e) To discuss and consider the Parish Council applying for a Heritage Action Zone status. RESOLVED: Cllr Morris had seen the Heritage Action Zone Status and thought it would be a good idea for Breedon Parish Council to look into this, however, after reading all the details it seemed much more complicated than originally thought. Cllr Morris is going to look into this further and report back to Council at a later date. (f) The Clerk to update the Parish Council with the information received on the Berry Ave PROW Application. RESOLVED: Information received from LCC read out:

‘I thought it would assist to provide information on the wider issues and likely timings. As you are very much aware this matter has been dragging on for some time. Looking through the case notes the application came to the authority in August last year. It had also been the subject of discussions prior to that.

We receive a number of claims and often they are linked to routes that have either been closed off or are in imminent danger of being stopped up. As you will appreciate these get priority as the claimed route is under dispute and the public are not able to use them. The route from Berry Avenue is still open and I am unaware of any threat to close it.

In the light of the complexity and resources required to do these types of order we always initially attempt to resolve the matter by agreement with the landowner. On this occasion, this has been made far more complex by the main holding having 4 different parties. Despite this, for a period of time, this looked as though it was likely to be successful but we have had to conclude that since it requires a positive act on all the other parties this is unlikely to resolve the matter. Accordingly, we are now taking the matter forward as a formal claim and a report is being compiled to take the matter to our legal services team. Should an order be made it will be advertised on site, on line and in a local paper. Any party can object, including the wider public. If any objections are received the matter will be passed to the Planning Inspectorate for determination. This is usually through a public inquiry where the evidence is subject to scrutiny and the associated costs of representation.

I hope this will not get to that stage. This is in part why efforts are made to engage with interested parties to both save time and monies, including legal representation. I will ask the officer dealing with the case to keep you up to date with developments but if this goes all the way to a public inquiry be prepared for the long haul. I would not expect this stage to be reached until well into 2018. I should also say that whilst the order process is formally progressing contact is continuing with the other landowners to come to an agreement. If successful this would be far quicker and I hope suit all parties.’

1798) Representatives’ Reports (a) Cllr J Morrison to provide an update on the fly tipping at the Tonge sewage works. RESOLVED: Severn Trent reported to the site manager and established that the current case of fly tipping is actually on STW owned land. This wasn’t clear to the Ops team because the area is outside the STW compound.

Severn Trent will now arrange for the rubbish to be removed. The site manager would prefer not to have a gate further up the track because this can bring its own problems regarding access. (a) Cllr R Morris to update the Parish Council on the information received regarding the recent meeting with LCC Highways to discuss the speed limit on Tonge Lane/Breedon Lane. RESOLVED: Key points: - A traffic survey has been completed and scanned the results have been received. - There used to be a 30 mile an hour limit up until 1979 when for some unknown reason, it was de- restricted. The traffic reports indicate that a speed limit of 30 mph would not attract support from the police in particular because of the enforcement difficulties and the best we are likely to get is 40 mph. 6 Monday 3rd July 2017. - There are currently derestriction repeater signs located in Tonge Lane and it may be possible to legally remove these in any event, given that they merely encourage people to drive faster. - Berry Avenue, although not signposted as such, is subject to a 30 mph limit by virtue of its residential status. - If it were to go ahead. The process is likely to cost in the region of £3500 being the administration element in the main. The county has no fund to meet this and neither does the highways Department. There is a slight chance of a minor element of funding being found, but the cost would, in the main have to be borne by the parish. - The Highways Officer will go ahead and issue a report which is unlikely to appear until September time at which point we can as a parish consider its recommendations and findings and decide whether any commitment should be entered into.
