INTRODUCTION 1. The Commission has before it for consideration: (i) license renewal applications from the above-listed radio stations in Texas; (ii) a timely filed Petition to Deny by the Texas State Conference of Branches of the NAACP and its various local, branches (collectively "NAACP") against the license renewal KGNC-FM©s call sign was changed from KMLT(FM) effective November 2, 1992. 879 applications of the above-listed radio stations; p (iii) oppositions filed by the licensees; and (iv) the licensees© responses to staff letters of inquiry. II. BACKGROUND 2. NAACP alleges that the challenged stations violated our Equal Employment Opportunity (EEO) Rule and policies. Accordingly, it requests that we conduct an investigation of the employment practices of the stations pursuant to Bilingual Bicultural Coalition on Mass Media, Inc. v. FCC. 595 F.2d 621 (B.C. Cir. 1978) (Bilingual) and designate the renewal applications for hearing. The licensees deny NAACP 1 s allegations and request unconditional renewals. III. PLEADINGS 3. Standing. The licensee of Stations KGNC/KGNC-FM argues that the declaration under penalty of perjury filed by NAACP regarding these stations is insufficient to establish standing because the President of the Amarillo Branch does not demonstrate that he is a resident within the service area of the stations.

    2021 TORNADO/SEVERE WEATHER RESPONSE PLAN Tyler / Smith County PURPOSE This plan is designed to serve as a guide and to provide useful information to the public. Users of this plan are encouraged to direct all questions to the appropriate designated agencies. AS ALWAYS, IN AN EMERGENCY SITUATION, PLEASE CALL 911 SCIENCE Tornadoes are a destructive force that in the United States occur an average 1300 times annually, resulting in an average of 80 deaths per year. In Texas alone, tornadoes occur an average of 137 times annually, resulting in an average of 8 deaths per year. A single tornado or an outbreak of tornadoes can kill dozens at one time and can cause widespread damage. A tornado is defined as a violently rotating column of air extending from a thunderstorm to the ground. The most violent tornadoes are capable of tremendous destruction with wind speeds of 300 mph or more. Damage paths can be in excess of one mile wide and 50 miles long. Likely conditions indicating a tornado include a dark, greenish sky, large hail, a wall cloud, and a loud roar similar to a freight train. Tornadoes may appear as a visible funnel extending partially or fully to the ground and may be accompanied by debris. While some tornadoes are clearly visible, they can be nearly transparent until they have picked up dust and debris, or they may be hidden or obscured by rain or low-hanging clouds. Tornadoes can happen during any time of the year and at any time of the day. They may strike quickly and without warning.

The Audio Division has before it a petition for rulemaking filed by Charles Crawford (“Petitioner”), seeking to amend the FM Table of Allotments by allotting Channel 288A to Hall Summit, Louisiana, as that community’s first local FM transmission service. To accommodate this allotment, Petitioner requests that Channel 286A be substituted for vacant Channel 288A at Haynesville, Louisiana. To further accommodate the allotment of Channel 288A to Hall Summit, Petitioner requests the reclassification of Station KYKX(FM) (“KYKX”), Channel 289C, Longview, Texas, to specify operation on Channel 289C0 because that station is operating at below minimum Class C facilities.1 Petitioner has also certified, as required, that no other Class A channel is available for allotment at Hall Summit.2 2. Station KYKX, licensed to Waller Media, LLC, currently operates on Channel 289C with an effective radiated power (“ERP”) of 100 kilowatts (“kW”) at 352 meters height above average terrain (HAAT), which is below the minimum Class C antenna height of 451 meters HAAT. The staff has tentatively concluded that if Station KYKX operates as a Class C0 facility, any short-spacing between Station KYKX and the proposed use of Channel 288A at Hall Summit at the proposed site would be eliminated. For the reasons discussed below, we are issuing this Order to Show Cause directed to Waller Media, LLC, licensee of Station KYKX, Longview, Texas, to show cause why its facilities should not be reclassified.
