(1) (2) (3) (i) Particulars of the Function and Duties of the Department :- Organization, The functions and duties performed by this Department as they are functions and duties provided in the Secretariat Manual. as mentioned in 4(1)(b)(i) of the Act So far as the activities of the Department are concerned, they are stated as follows :- 1. All Establishment matters of this Department 2. Pension and other benefits to the officers and staff of the Department and Medical Officers. 3. Public Grievances matters. 4. Financial assistance to Government and Non-Government Institutions. 5. Law matters relating to this Department, 6. Enactment of New Laws. 7. Reply to the Assembly and Parliament Questions. 8. Sanction of Free beds to the Public under BPL. 9. Appointments, Dismissal, resignation etc. in respect of W.B.M.E.S. personnel. 10. All Establishment matters relating to Teaching Institutions under this Department. 11. All matters relating to Public Health Cum Administrative Service Officers and B.D.S. Officers. 12. All matters relating to Non-Medical Technical Personnels of the Directorate and Subordinate Offices. 13. Transfer and postings of Secretaries of Hospitals, Public Health cum Administrative Service and B.D.S. Officers. 14. All matters relating to appointment/transfer of the Nursing Staff. Powers - The Governor of the State West Bengal is the Constitutional head of of its officers and the Government in the State. All functions of the Department are discharged with employees as the pleasure of the Governor. The Minister-in-Charge of the Department is the Supreme Authority of the mentioned in Department. Under the Principal Secretary there is a set of Officers comprising Special Secretaries, Joint Secretaries, Deputy Secretaries, Assistant Secretaries, Registrar, Officers on Special Duty, Protocol Officer, Liaison Officer, Special Officers and Section Officers. All Officers right from the Additional Chief Secretary down to the Officers in the rank of Registrar enjoy the power of disciplinary functions of the department. The Additional Chief Secretary is authorized to punish the offending employee if the charge is substantiated beyond doubt. The Officers from the rank of Additional Chief Secretary down to Assistant Secretary are empowered to issue any executive order with the approval of the Additional Chief Secretary, Special Secretary and Joint Secretary. They may issue any Government order sanctioning and allotting fund subject to the concurrence of the Finance Department, so far as release of the fund is concerned. B. Duties - The duties of the officers and employees of the Department is elaborately stated in the West Bengal Service Rules (Part I), 1987 vide Appendix 6A of West Bengal Services (Duties, Rights and Obligations of the Government Employees) Rules, 1980. Legal Powers Conferred through notifications (under the following Acts and Subsequent Amendments and Rules made thereafter) (i) Secretariat Manual, (ii) W.B.S.R. Pt.I & II, (iii) West Bengal Classification, Control and Appeal Rules, 1971. Financial Powers As delegated by ‘Delegation of Financial Powers Rules, 1977’ (Financial Rule I & II) vide Government of West Bengal Finance Department (Audit Notification No.9757-F, dt.17.11.1977) and its subsequent amendments Circulars and Memorandum issued from time to time. Administrative Powers As delegated in All India Service Rules, West Bengal Service Rules and W.B.S.(Classification, Control and Appeal) Rules, 1971 Circulars and Memorandum issued from time to time.
