Cox|McLain Environmental Consulting, Inc. (CMEC) is pleased to submit this Letter of Interest in response to the Oklahoma Department of Transportation’s (ODOT) Solicitation of Interest for Pre- Qualification for Environmental Studies Services – Non Federal Projects (Contract Identification No. 2256). CMEC has been providing quality Environmental Studies and Coordination for Non Federally funded County projects statewide in accordance with the latest guidance and regulations available. We pride ourselves on expedient quality service and strive to be readily available to our clients when they need us most. Our Oklahoma offices are dedicated to the needs of the local government officials who we serve and we enjoy working with them on their projects, or just visiting with them at the local CED meeting or the ACCO Conference. We understand that this solicitation will be used to support County Government, Circuit Engineering Districts, or other Local Public Agencies for environmental studies for transportation improvement projects on the County Transportation System, per the Instructions and Guidance for the Regulatory Provisions Checklist for Non-FHWA Funded Projects.

CMEC has been in business since 2007, and since 2015, we have established our Tulsa and Oklahoma City offices staffed with environmental professionals with the express purpose of being able to serve our Oklahoma clients. As shown on our Table of Organization, we have dedicated staff members to manage and execute our assignments from ODOT under this contract, flanked by our most senior leaders and discipline specialists. In our Oklahoma City office, we now have three ecologists, an archeologist, a planner, and our GIS Program Manager. Our Tulsa office houses several archeologists, an architectural historian, and an ecologist. Our Irving, TX office is close by with its multi-disciplinary staff, along with technical expertise as needed from Houston, Austin and others in our growing, virtually-connected professional network. In total, CMEC has 64 full-time and numerous additional dedicated contract employees with a full range of environmental skills. We have added Freese & Nichols specifically for hazardous waste studies because they have specialists who meet Mr. Jeff Pearl’s criteria to perform these specific studies. Our qualifications are shown on the attached CAP 255 forms.

The proposed Contract Manager for this contract is Mr. Will Dillsaver with Mr. Jarrod Powers as Project Manager. Mr. Dillsaver has built relationships across ODOT, Circuit Engineering Districts and CMEC, as well as establishing CMEC’s reputation across Oklahoma as a high-quality environmental service provider. His background in oil and gas has provided unique experience in working with federal agencies such as the BIA and BLM and understanding of Oklahoma geography have made him a strong asset to CMEC and the anchor for the Oklahoma City office. He has grown our local staff including GIS expertise so that we have technical skills available where the projects will take place. Again, as reflected in the Table of Organization, Mr. Dillsaver will be supported by CMEC’s senior leadership and task expertise to

Mr. Dillsaver will be supported by Jarrod Powers from our Oklahoma City office. In addition to supporting Ms. Haley Rush for her numerous ODOT responsibilities, Mr. Jarrod Powers has been working directly with Ms. Courtney Filer (Contract Manager for CMEC’s EC 1766F and EC 2016E NEPA Services contracts) on the detailed responsibilities of Contract Management for ODOT, including the focus on detailed communications. Throughout 2019 and 2020, Mr. Powers has supported Ms. Filer on Task Order requests, preparation of scopes and budgets, pre-approval through ODOT discipline specialists, detailed monthly status reports, and the careful coordination required to fulfill this important role. Mr. Powers is devoted to managing the contract responsibilities for CMEC while continuing to provide support for our other managers as they continue fulfilling their existing responsibilities for current ODOT contracts.

CMEC has learned many lessons about how to work successfully with ODOT over the past several years:

• Our administration department works closely with ODOT’s invoicing staff utilizing TOPS; • We have worked on tribal coordination with Ms. Rhonda Fair and we know how to handle property owner notification tasks; • We understand that CMEC need not undertake agency coordination unless specifically requested; • We have developed internal ODOT contract management training materials and checklists to help us monitor the many moving parts of project development; • We have created project tracking programs using Trello (see snapshot provided later in our proposal) to ensure staff members can see which items have been completed and which need to be done for any given project Task Order; • To stay current with your expectations, we have sent our staff to ODOT trainings including for archeology, planning and public involvement for Environmental Justice and Title VI compliance.

We are committed to ODOT which is why we continue to build our staff capabilities in Oklahoma City and Tulsa. To enable our current project and contract managers to continue providing high quality service to ODOT and the counties they serve, we propose the strength of our full professional bench plus these two dedicated, experienced environmental specialists to enhance our professional commitment to ODOT.

CMEC is an Oklahoma-certified DBE firm and will provide all work except for the hazardous waste deliverables that would be provided by FNI if needed. In coordination with ODOT, CMEC • NRCS Coordination conducted a thorough study of the project area footprint, provided property owners notification, conducted an archeology survey and • Floodplain Assessment background research along with Tribal coordination, surveyed for various threatened and endangered species habitat and conducted wetland delineations, reviewed the study area for hazardous waste/hazmat sites, and coordinated with the NRCS. Specialist Studies included an Endangered, Threatened and Candidate Species, Designated Critical Habitat, Bald Eagle and Swallow Assessment, Waters and Wetland Evaluation Report, Cultural Resources Survey Report (including full archeological survey), Hazardous Waste and Phase I Environmental Site Assessment.

These studies provided the supporting documentation for CMEC to draft a Programmatic Categorical Exclusion on ODOT’s behalf.

Cox|McLain Environmental Consulting Inc. (CMEC) is a DBE-certified environmental consulting firm with offices in Tulsa and Oklahoma City, Austin, Houston, and Irving, Texas.  The proposed Client and Contract Manager for this contract is Mr. Will Dillsaver. Mr. Dillsaver is a Senior Ecologist and Oklahoma City Office Manager who has 14 years of experience in the oil and gas/pipeline/ wind/environmental industries. He is skilled in environmental report preparation and GIS processing. A background in wildlife conservation and management contributes to his understanding of a broad range of ecological assessments and surveys, including but not limited to habitat assessments, threatened and endangered species surveys, raptor nesting surveys, Migratory Bird Treaty Act compliance, wetland delineations, and vegetative assessment work. Mr. Dillsaver has built up CMEC resources in the Oklahoma City office to provide multi-disciplinary capabilities that allow CMEC to mobilize quickly across the state of Oklahoma whether the task be for archeological survey, biological surveys, scoping meetings, or plan-in-hand review of engineering documents. Mr. Dillsaver is also an active member of ACCO and regularly attends the Circuit Engineering District Meetings to visit with the commissioners and managers that utlize our services.  Supporting Mr. Dillsaver for this contract is Jarrod Powers. Mr. Powers is a senior ecologist and project manager who has performed environmental evaluations and project management in support of numerous projects for public and private sector clients in Oklahoma, Texas, Kansas, New Mexico, and Arkansas. He has extensive experience in conducting T&E habitat surveys, aquatic species surveys, and Section 404 water and wetland delineations. He has been mentored in the Contract Manager role by Courtney Filer and has completed her detailed internal training regarding ODOT’s processes and requirements from scoping Task Orders in coordination with ODOT’s Specialists; submittal of project schedule tracking reports on the 15th of each month; submittal of documents using the TOPS system; and invoicing requirements and protocols. Mr. Powers works closely with our expanding Tulsa and Oklahoma City based staff members across a variety of technical disciplines.  To optimize our ability to track and manage project schedules, responsibilities, and deliverables, CMEC has utilized the program Trello for particular ODOT contracts and also to manage GIS, planning,history, and archeology requests as well. This tool has enabled us to improve the accuracy, timeliness, and efficienty of tracking Task Orders for our ODOT projects. See attached screenshot in ODOT innovations. In addition, our company-wide GIS team is run by Madeline Cole out of our Oklahoma City office.  CMEC has invested in relevant training (including biological training related to bat surveys and freshwater mussel surveys) and Will Dillsaver brings his permit and experience with the American Burying Beetle to CMEC (and he closely tracks updates on its listing status). We appreciate the additional training opportunities made available by ODOT and our staff have participated in many events: Environmental Justice and NEPA (Ashley McLain), Mapquest Training (Susan Patterson), Public Involvement Training (Courtney Filer), and Cultural Resources Training (OK and Irving archeologists and historians). We have added Brian Cowan, P.G. to CMEC’s team for his geology expertise and hazardous materials specialty.  CMEC has 64 full-time and several dedicated contract employees, including planners, wetlands specialists, biologists, archival researchers, archeologists, architectural historians, and GIS specialists. Our staff members have managed scores of environmental and cultural-resources projects for cities, counties, and other entities throughout Texas, Oklahoma, Louisiana and the western U.S.

 Finally, CMEC has been building our Oklahoma offices and capabilities specifically to better serve ODOT and the County Commissioners they work so closly with. We are genuinely honored to have the opportunity to work throughout Oklahoma, and we hope to continue providing environmental services to ODOT and the CEDs throughout the state.

We have worked closely with client legal representatives to make certain that CERCLA liability protection is maintained when a client must purchase a potentially contaminated site to accomplish project development objectives. When recognized environmental conditions, such as potential contamination, are discovered, we utilize our knowledge of facility operations to help us focus the scope and cost of Phase II ESAs. FNI has worked extensively with the closure of various types of sites with petroleum storage tanks, process equipment, contaminated soils, and investigation-derived waste in the past 20 years. CMEC Tools and Innovations

CMEC utilizes multiple tools and processes for our internal tracking systems and for accurate data collection. CMEC has implemented an innovative management process that ensures we remain on schedule for submittals and effectively accelerates our process. One such tool for tracking projects is software called Trello. We use different boards to track different project types (e.g., ODOT Local Government Projects) and project elements (e.g., project milestones).

The Local Government Board host an identification card that centralizes project information for each TO. The program has a search function which allows us to search by client, discipline, or review status (see snapshot from GIS Trello board). During weekly team meetings, we use Trello to review the status of each project, discuss how to handle challenges, and ensure all steps are being taken to meet ODOT requirements.

CMEC has recently expanded the integration of technology into our historic survey practices. Prior to field survey, CMEC historians complete a desktop review to determine the location of historic-age resources. Points for each resource are added to an online ARCGIS map that historians and GIS analysts can access. Historians use digital maps on tablets in the field to move and edit data points which streamlines production of report graphics.

CMEC ecologists use Trimble Units with sub-meter accuracy for precise data collection during wetland delineations and other select surveys to ensure we are providing accurate information to our clients. CMEC continually works to provide the necessary tools to enable our environmental specialists to continually improve data collection and report products.
