Hickory Woods, LLC, a New Hampshire limited liability company having a principal place of business at 15 Dartmouth Drive, Suite 102, Auburn, New Hampshire 03032, for consideration paid grants to ______, as ______, both having a mailing address ______, with WARRANTY COVENANTS:

A certain unit with the Dwelling and other improvements therein, at Hickory Woods Condominium, situated in Londonderry, County of Rockingham, State of New Hampshire, more particularly bounded and described as follows:

Unit No. _____ in Hickory Woods Condominium, as defined, described and identified in the Declaration of Condominium of Hickory Woods Condominium, dated February 17, 2014, 2013, and recorded in the Rockingham County Registry of , Book 5513, Page 2510 (the “Declaration”), and as shown on a certain site plan entitled “Condominium Site Plan, Hickory Woods, Tax Map 2, Lot 27, West Road/NH Route 102, Londonderry, New Hampshire 03053”, Owner of Record/Prepared For: Hickory Woods, LLC, Prepared by: Benchmark Engineering, Inc., consisting of sheet 1 of 6 of Plan #D-38119 in the Rockingham County Registry of Deeds and dated September 18, 2013, and five (5) floors plans being entitled “Condominium Floor Plan, Hickory Woods, Tax Map 2, Lot 27, West Road/NH Route 102, Londonderry, New Hampshire, 03053”, Owner of Record/Prepared For: Hickory Woods, LLC, Prepare by: Benchmark Engineering, Inc., dated September 16, 2013, and being Sheets 2-6 of 6 of Plan #D-38119 in the Rockingham County Registry of Deeds (all plans referenced hereinabove collectively the “Plans”).

Said condominium is established pursuant to N.H. RSA 356-B.

Patios, decks, driveways, parking areas, sidewalks, lamp posts and mailboxes appurtenant to or serving exclusively said Unit as well as the water line serving exclusively the Unit from the edge of the private right-of-way to the Unit building shall be considered part of said Unit and not Common Area and the owner shall be responsible for the maintenance, repair and replacement of the Unit as set forth in the Declaration.

Also conveying an undivided interest in the Common Area (the “Common Area”), and exclusive use of the “Limited Common Area”, as described, defined and identified in the

Declaration and on said Plans. Subject to and with the benefit of the following rights and , which are common to all Units:

1. An exclusive to use the Limited Common Area appurtenant to the Unit conveyed herein, if any, as defined and described in the Declaration and on the Plans.

2. Easement in common with others to use the Common Area, excepting the Limited Common Area, as set forth in the Declaration and Plans.

3. Non-exclusive easement for structural support and encroachments and for repair, and also such other rights and easements as are set forth in the Declaration.

Each Unit Owner shall be responsible for the repair and replacement of the Limited Common Area appurtenant to his or her Unit, including any improvements (e.g. deck, patio, steps, etc). The association will be responsible for maintaining (but not the repair or replacement of) the following in the limited common area: lawn care, snow removal, tree and shrub pruning, sprinkler system spring startup and fall winterization.

Age Restriction. Hickory Woods Condominium is an age-restricted community in accordance with NH RSA 354-A:15 and applicable elderly zoning ordinances of the Town of Londonderry, and the conditions of approval of the site plan for the Condominium. Specifically, this Condominium is intended for persons 55 years of age or older. Each unit must have a minimum of 1 occupant who is age 55 or older. No occupant of any unit may be under age 22. No guest who is under age 22 may stay for a period longer than 60 days. This Unit is subject to certain limitations and restrictions on use and occupancy because it is located in an age restricted community which are set forth in the Declaration.

This conveyance is subject to the following to the extent that the same are still in force and/or applicable:

1. All matters affecting the within conveyed premises, if any, shown on plans recorded in the Rockingham County Registry of Deeds as Plan No. 38140 and No. D-38119 as may be amended.

2. Declaration of Condominium of Hickory Woods Condominium recorded in the Rockingham County Registry of Deeds at Book 5513, Page 2510.

3. Condominium Site Plan and Floor Plan recorded in the Rockingham County Registry of Deeds as Plan No. D-38119 as may be amended.

4. Declaration of Covenants and Restrictions as to Use and Occupancy of Property recorded in the Rockingham County Registry of Deeds at Book 5512, Page 15.

5. Utility Easements of record affecting the Unit and the Common Area of the Condominium.

6. Memorandum of Site Agreement (Notice of Lease pursuant to RSA 477:7-a) between Tai-Deh Hsu, Trustee of H.S.L. Trust and Associated Telecommunications Consultants dated September 2, 1999, and recorded on September 15, 1999, at Book 3423, Page 0842 of the Rockingham County Registry of Deeds.

7. Amendment to Site Agreement between Tai Deh Hsu, Trustee of the HSL Real Estate Trust and SBA Towers, LLC, dated April 13, 2012, and recorded on April 23, 2012, at Book 5308, Page 2192 of the Rockingham County Registry of Deeds.

8. A non-exclusive easement by Grantor for the benefit of Lot 2-27-30 as shown on Plan #D-37811 in the Rockingham County Registry of Deeds for access and the right to maintain telephone and electric utilities connecting with existing utilities over and under any and all private roadways which may be constructed on said Lot 2-27.

9. Cell Tower Fall Zone Easement to benefit of Tai-Deh Hsu, Trustee of HSL Real Estate Trust recorded at Book 5465, Page 2007 of the Rockingham County Registry of Deeds for Cell Tower Fall Zone in the Common Area.

10. Access Easement to the benefit of Tai-Deh Hsu, Trustee of HSL Real Estate Trust recorded at Book 5465, Page 2009 of the Rockingham County Registry of Deeds.

11. Access and Utility Easement to Hickory Enterprises of Londonderry, LLC recorded at Book 5465, Page 2011 of the Rockingham County Registry of Deeds.

12. Roadway Improvement Easement to the Town of Londonderry recorded at Book 5465, Page 2018 of the Rockingham County Registry of Deeds.

Each owner of a Unit shall be responsible for maintenance thereof as set forth in Section 3.4.4 and Section 6.6 of the Declaration including, but not limited to, repair, pumping and replacement of the septic tank servicing said Unit, notwithstanding the location thereof within the Common Area.

The undersigned Grantee(s) acknowledge that they have read the Declaration, including the By-, and the Condominium Rules and Regulations referred to hereinabove and accept the provisions thereof and of this deed.

Without limiting the generality of the foregoing, by acceptance of this deed, the Grantee(s) acknowledges that occupancy within the Unit is limited to not more than two (2) full time occupants, at least one (1) of whom shall be aged fifty-five (55) or older in accordance with Section 3.6 of the Londonderry Zoning Ordinance (Elderly Housing) and Section 3.5.14 of the Declaration (Elderly Housing Covenants), as may be amended.
