21 ILLINOIS COURT SYSTEM Illinois has a streamlined Court system consisting of only three kinds of Courts: (1) Supreme, (2) Appellate, and (3) Circuit. The State eliminated all lower courts in 1964 and expanded the Circuit Courts to hear all lower cases.

22 ILLINOIS CIRCUIT COURT Excluding the County of Cook, which constitutes one judicial circuit, the State of Illinois is divided into twenty-three judicial circuits. The Circuit Court shall have unlimited original jurisdiction of all cases, civil and criminal in law and in equity. Circuit Judges are elected for six year terms and have the power to appoint associate judges for a term of four years. All Circuit and Associate Judges must be citizens, licensed attorneys and residents of the area from which elected or appointed. The Supreme Court has the authority to temporarily assign circuit judges to any court and to assign associate judges to any circuit court. Retirement is mandatory at the age of seventy- five; however, with their consent retired judges may be recalled by the Supreme Court. Retired associate judges may be assigned only as associate judges. The Circuit Courts have no stated terms and are open for the transaction of business at all times, subject only to adjournment from time to time.

KENDALL COUNTY 23rd JUDICIAL CIRCUIT

Hon. Robert P Pilmer Kendall County is a member of the 23rd Judicial Circuit, which (Chief Judge) consists of Kendall and DeKalb Counties. The Chief Judge’s 807 W John St function is primarily that of an administrator. It is his overall task to direct the smooth and orderly flow of cases from their commencement at the Hon. Melissa S Barnhart time of filing in the court system through their successful and timely (Circuit Judge) disposition. He also directs the cooperative efforts of the court system and court related services which include the Adult and Hon. Stephen Krentz Juvenile Probation Departments, Family Division, Youth Home and (Circuit Judge) the Jury Commission. In the effort to accomplish the above, the Judiciary cooperates with the offices of the Circuit Court Clerks, Hon. Jody Gleason State’s Attorneys, Public Defenders and the Sheriffs throughout the (Circuit Judge) judicial circuit. Circuit Judges are nominated at primary elections Hon. John McAdams and elected at general elections on a partisan basis to serve for six (Associate Judge) years.

Hon. Joseph Voiland An elected Judge then stands for retention every six years. The (Associate Judge) Associate Judges of the Circuit Court are appointed by vote of the elected Judges of the Circuit Court to four-year terms and stand for retention at the end of such terms by vote of the elected Judges.

Since December 1, 1980, all elections have been governed under the provisions of the general election law of the State of Illinois, commonly referred to as Election Consolidation.

With the implementation of Election Consolidation, the County Clerk is responsible for the administration of all elections within the County. However, the local election official-such as the township and municipal clerk, school district secretary, etc. is still an integral part of the electoral process. These are the people who work with the County Clerk to certify the names for local elections, to be placed on the ballot.

Voter Registration - Who is Eligible To Vote? To be eligible to register to vote, a person must be a U.S. citizen; be 18 years of age as of the next election and reside in the precinct for 30 days prior to the next election. Naturalized citizens must provide the name of the court where naturalized, state and date of naturalization. Who May Register? Those who may register to vote are the following: Anyone who is not now registered in Kendall County and all persons who have changed their name through marriage or otherwise.

Where To Register: Eligible voters may register to vote at the following locations: City, Village and Township Clerks, Public Libraries, Secretary of State Driver’s License Facility and Republican and Democratic party Representatives. Change Of Address: Voters who have moved within Kendall County since registering should notify the County Clerk by filling out the reverse of their voter registration cards and returning them to the County Clerk. Notice of change of address may also be given by letter listing the old and new addresses and mailed to the County Clerk’s office. A notification for change of address, either by card or letter, must bear the signature of the voter or be mailed to: Debbie Gillette, Kendall County Clerk, 111 W Fox St, Yorkville IL 60560. All changes of address must be received by the County Clerk postmarked not later than midnight 28 days prior to any election conducted by the County Clerk. Physically Disabled Voters: Citizens who are not registered to vote and cannot leave their home, hospital, nursing home or other institution because of a permanent physical disability can arrange for voter registration by contacting the County Clerk’s office. Additionally, persons with a permanent physical disability can arrange for a special voter’s registration card which allows absentee voting without obtaining a physician’s certificate for each election. Contact the Election Department for information at 630- 553-4105. Unregistered Voters: Members of the Armed Forces, who expect to be absent from the county in the course of their duties, need not be registered to cast absentee ballots in all elections. This also applies to their spouses and dependents living with the service person. Contact should be made with the Commanding Officer for the appropriate applications. Voting By Mail: A registered voter may request an official “Application for Vote by Mail Ballot” A request for the official application must include the name and home address of the applicant and the address to which the ballot should be sent. Vote by Mail Ballot Applications may also be obtained from the Kendall County web site – www.co.kendall.il.us The official “Application for Vote by Mail Ballot” may be sent to the County Clerk not more than 90 nor less than five days prior to the election. If the official application is filed within that time and is properly completed, a ballot will be mailed to the applicant.

Early Voting: Voters who wish to vote early may do so through the office of the County Clerk beginning on the 40th day preceding the election through the end of the day before Election Day. Early Voting is conducted in this time period during regular business days with some extension of hours as prescribed by statute. Voters are encouraged to check local news media, the county website or by calling 630-553-4104 for locations, times and dates.

65 MARRIAGE / CIVIL UNION LICENSE INFORMATION Marriage/Civil Union Licenses are issued at the Office of the Kendall County Clerk 111 W Fox St, Yorkville IL 60560. Office hours for licenses 8:00 a.m. to 4:00 p.m. offices are closed on weekends and all legal holidays. It is important to note that a marriage and civil union license is valid only in the County in which it is issued.

Requirements BOTH parties must appear in person.

Age: In order to be married or have a civil union certified in Illinois without parental consent, you must be at least 18 years of age. If you are 16 or 17 years of age, both of the parents must sign a parental consent form in the County Clerk’s office at the time of the application. If it is not possible for parents to sign in this office, it may be done before the County Clerk in the parent’s home County. Contact this office for details. Documents: Valid current photo id must be presented. Copy of final divorce decree or death certificate (if applicable).

Marriage & Civil Union License Fees The Fee set for a marriage and a civil union license is $35.00 payable in cash only.

Procedures Parties must obtain the licenses at least one day before they plan to be married or certified. The license is valid for 60 days. Marriage or a Civil Union in Illinois may be performed by either a Clergy Person or a Judge. If you wish to be married or have your civil union certified by a Judge in the Courthouse, you must make arrangements in advance by calling 630-553-4208.

After the marriage or civil union, the person performing the ceremony must return the completed license to the County Clerk’s office within 10 days to be filed.

If for any reason the license is not used it must be returned to the Clerk’s office to be indexed. Under no circumstances should a license be destroyed after it is issued. VITAL RECORDS / CERTIFIED COPIES Certified copies of Birth, Death and Marriage Records of persons who were born, deceased, or married in Kendall County may be obtained from the Office of the Kendall County Clerk. Request for such copies should include the person’s name at birth or at death, the date of the birth or death, the place (town) where the event occurred and the number of certified copies you would like.

Because of the confidential nature of these records, the Illinois State Statutes provide that certified copies of birth records may be obtained only by the person himself, a parent or other legal representative. Certified copies of marriage and death records may be obtained by a person having a personal or property right interest in the record or by his duly authorized agent.

Information to give when requesting a certificate: Name or names, date of birth , death, marriage, place of birth , death, marriage, mother’s full maiden name, father’s name, and the number of certified copies you are requesting. Make checks payable to Kendall County Clerk. The fee for marriage certificate and birth certificate is $10.00 for the first certified copy and $2.00 for each additional certified copy of the same record should accompany each request. The fee for Death Certificates are $12.00 for the first copy and $6.00 for each additional. Requests can be made in person or through the mail. 66 RECORDER’S DEPARTMENT

Document Preparation is a specialized task which may demand legal knowledge or advice.

Veteran's Record DD-214 with ID - No charge 67 The following information should be considered an informational guideline regarding the property tax cycle. The owners of real estate property on January 1st shall be liable for the taxes of that year.

ASSESSMENTS

The County Clerk prepares the assessment list for all taxable parcels and delivers it to the Chief County Assessing Official. The Chief County Assessing Official then distributes said list to the township assessors. By law, all taxable parcels must be reassessed every four years (quadrennial reassessment), but may be done on an annual basis.

After the township assessor has completed his duties, the assessment list is returned and certified to the Chief County Assessing Official. This list is subject to equalization by the Chief County Assessing Official. The Chief County Assessing Official then publishes the assessment list and sends notices to the property owners. Publication of the complete assessment list occurs in quadrennial years. In all other years, only those properties which have had a change from the township assessor are published. The assessment list is then certified to the Board of Review.

The Board of Review is in session from the first Monday in June until March 15 of the following year. They review and revise assessments and hear complaints of property owners. The Board of Review shall complete its duties and certify the revised assessment list to the County Clerk on or before March 15.

The County clerk abstracts the assessment books and compiles the assessed valuation of the various taxing districts, and forwards the same to the Department of Revenue Office of Local Government Services.

The Department of Revenue Office of Local Government Services may equalize the valuation and assessment of property in any county so that the valuation of property in the county is equalized with all others. This is done by the application of and equalization factor of “Multiplier.” The Department of Revenue Office of Local Government Services also assesses railroad property located within the county and certifies the same to the County Clerk.

The Homestead exemptions of eligible homeowners 65 years of age and older, the Homestead Improvement Exemption, the Veteran’s Exemption and the Owner Occupied Exemption have to be subtracted from the equalize value before the tax rate can be computed.

68 LEVIES

All taxing districts must certify their tax levy with the County Clerk on or before the last Tuesday of December of each year.

RATES AND TAXES

The County Clerk computes the tax rates of the various taxing districts by dividing the total assessed valuation, as equalized by the Department of Revenue Office of Local Government Services, of each district into the various amounts levied by the district. The rates being subjected to the limitations of the General Revenue Act.

The rates thus determined for the various districts, in which the individual property lies, are combined and multiplied by the assessed valuation, as equalized, to determine the individual tax bill.

The County Clerk then prepares the books for the collector, showing the taxpayer's name and address, property description, assessed valuation (as equalized), rate and amount of tax extended. The books are then turned over to the County Collector. The Collector prepares and mails the individual bills.

Real estate taxes are payable in two installments. The first installment generally becomes due in June and the second installment in September. Since the tax cycle takes one full year to complete, taxes paid in any year are for the previous year.

All delinquent and unpaid taxes are, by law, to be offered for sale some time during the month of November of each year, after publication and notification of the same.
