पयाϕवरण ,,, वन और जलवायु पƗरवतϕन मंJालय अिधसूचना नई Ƙदली, 7 जून , 2019 काकाका.का ...आआआआ.... 19291929((((अअअअ))))....————Oाďप अिधसूचना भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ अिधसूचना सं. का.आ. 2 143 (अ), तारीख 24 मई, 2018 ůारा भारत के राजपJ, असाधारण मĞ Oकािशत कƙ गई थी िजसमĞ उन सभी ƆिŎयĪ से, िजनको उससे Oभािवत होने कƙ संभावना थी, उस तारीख से, िजसको उŎ अिधसूचना कƙ राजपJ कƙ Oितयां जनता को उपल ध करा दी गई थी, साठ Ƙदन कƙ अविध के भीतर, आϓेप और सुझाव आमंिJत Ƙकए गए थे; और, उŎ OाĐप अिधसूचना कƙ राज पJ कƙ Oितयां जनता को 25 मई, 2018 को उपल ध करा दी गई थĕ ; और, उŎ Oाďप अिधसूचना के Oयुēर मĞ ƆिŎयĪ और पणधाƗरयĪ से OाƁ आϓेपĪ और सुझावĪ पर मंJालय मĞ िवचार Ƙकया गया था ;

िचJांगुडी पϓी अभयारय िजसे अयथा ‘’ िचJांगुडी कमा ई’’ के नाम से जाना जाता है, दिϓणी तिमलनाडु के मुदुकुलाथूर तालुक और रामनाथपुरम िजले मĞ िथत है। यह तिमलनाडु के रामनाथपुरम िजले के िचJांगुडी =ाम का भाग है। िचJांगुडी पϓी अभयारय तिमलनाडु के रामनाथपुरम िजले मĞ अϓांश 09°19’उ और देशांतर 078° 28’ पू के बीच िथत है। अभयारय को अनुमािनत ϓेJ 0.4763 वगϕ Ƙकलोमीटर के साथ वषϕ 1989 मĞ घोिषत Ƙकया गया था। यह िचJांगुडी =ाम के एस .एफ.सं.159 मĞ िथत है;

और, इसे वयजीव संरϓण अिधिनयम , 1972 कƙ धारा 18 (1) के अथϕ और दायरे के अंतगϕत जल - िनकायĪ मĞ रहने वाले जलीय पϓी जीवĪ के संरϓण के उŶेय से पयाϕवरण और वन िवभाग (एफ आर वी) के तारीख 21

िसत बर, 19 89 के शासनादेश सं.684 के ůारा अभयारय के Đप मĞ अिधसूिचत Ƙकया गया है। यहां देश के िविभž भागĪ से आहार के िलए अनेक Ƙकम के Oवासी पϓी आते हġ। Ɔत मौसम के दौरान यहां 43 OजाितयĪ के लगभग 11000 पϓी सूचीबŵ Ƙकये गये हġ और यहां के महĔवपूणϕ पिϓयĪ मĞ वाइट इिबस, लैक इिबस , ओपन- िबलेड Eोक , सफेद बगुला, मैना, टील, बतख, डारटेरस, हेरोन, पेिलथनस आƘद सि मिलत हġ;

और, यह अभयारय िभž -िभž Oकार कƙ वनपित और जीवजंतुĸ का सबसे बड़ा वास है और यहां संकटापž Oजाितयाँ Oचुर संϞया मĞ हġ िजनमĞ पेिलकन , पġटेड Eोक , यूरािसयन पुन िबल , वाइट इिबस, डारटेर, फलेƚमंगो और कॉमन कूट , िपन टेल, =ागने, इगरेटस, कोरमोरĞϧस , लैक ƚवंϟड िटट , Ɯकंग Ƙफशर , कॉमन मैना, बराहƚमंनी काइट, पोŝेड ओवलेट जैसे जल पϓी और 30 से अिधक अिभिलिख त सामाय पϓी सि मिलत हġ;

और, यह अभयारय शीतकालीन Oवासी पिϓयĪ के िलए आदशϕ पयाϕवास ह ġ जहां Oजनन और आहार कƙ दृिƍ से घĪसले बनाने और आहार के िलए Ɔापक दायरा है। दिϓण भारत कƙ ओर Oवास करने वाले औपिनवेिशक पिϓयĪ के पसंदीदा आXय -थलĪ मĞ से एक है। अϝटूबर से फरवरी तक इस अभयारय मĞ महवपूणϕ पϓी आते हġ। इस आLϕभूिम कƙ गहराई अिनयिमत है और सामाय वषाϕ होने कƙ िथत मĞ इसमĞ 3 से 5 महीने तक जल भरा रहता है;

और, यह अभयारय मूल Đप से ƚसंचाई टġक है िजसका उपयोग अϝटूबर से जनवरी तक उēरपूवϕ मानसून ůारा संभƗरत जल का कृिष के िलए भंडारण Ƙकया जाता है। माचϕ से अगत तक यह यह टġक पूरी तरह सूखा रहता है। चूंƘक यह अभयारय मूल Đप से ƚसंचाई टġक है, यहां अभयारय के अंतगϕत कोई Oाकृितक वन नहĕ है। 1980 के दशक के दौरान वन िवभाग के सामािजक वािनकƙ ƚवंग ůारा बबूल (अकैिशया िनलोƗटका ) के पेड़ लगाए गए थे;

और, इस अभयारय कƙ मुϞय वनपित नी रमुली (हायगरोƘफला चुली (हैिमट ) एम.आर. अमेइदा), नायउरीिव (अचयरांथेस असपेरा एल .), पनाइ (बोरासुस फलाबेलीफेर एल .), इĐϝकु (कलोटरोिपस िगगंिथया (एल.) आर.बीआर.), वेϧटुōाया -थाज़हाई (Eीडैϝस परोकु बĞस एल .), मौकिथपौ (पारथेिनउम हायटेरोफोĐस एल .), अवराम, अवाराइ (सेžा अउरीकुलाटा (एल.) रो ϝसब ) पुिलया मारम (तमाƗरनदुस इंिडका एल .), नाई कदुगु, नाई वाइलेइ (ϝलेओमे िवकोसा एल .), नेइवेिलकाटमनाϝकु (लपोमोियया कारिनया जाϝय .), िवसानुकारंदी (इवावालुस अिसनोइदेस (एल.) एल.), वेलाƗरōाइ , कैराōाइ (कुकुिमस टीवुस एल .) आƘद हġ। इस अभयारय के एक ƚसंचाई टġक होने के कारण यहां जीवजंतु Oजाितयां (पϓी जीवĪ को छोड़कर ) बćत कम है ँ िजनमĞ भारतीय =े नेवला (हेरपेटेस इदवारदिस ), भारतीय पाम िगलहरी (फुना बुलुस पमाĐम ), िसयार (कैिनस ऑƗरयस ), लैक - नेपड खरगोश (लेपुस िनगरीकोिलस ) और बġडीकूट रैट (बġडी को टा बĞगालĞिसस ) सि मिलत हġ;

और, इस अभयारय मĞ िसफϕ एक मानव बती है जो इसकƙ दिϓणी सीमा अथाϕत् िचJांगुडी पर िथत है, िजसे िचJांगुडी गांव कहते हġ। इस =ाम मĞ मुϞयत : अगडे समुदाय के लोग रहते है।ँ अिधकांश =ामवासी मारवार जाित से संबंिधत हġ। याधवर और िपलई जाितयĪ मĞ Oयेक 40 सदयĪ के साथ संϞया मĞ बराबर है। सभी =ामवासी ƚहंदू धमϕ को मानते हġ। चार =ाम िचJांगुडी , इराईचीकुलम, एस पी कोŝई और पĪदमपुली िचJांगुडी पϓी अभयारय के िनकट िथत है, जो िचJांगुडी पंचायत कƙ अिधकाƗरता मĞ आतĞ है;

और, =ाम कƙ कुल जनसंϞया मĞ 2350 पुĐष और 2850 िƓयां हġ। अिधकतम जनसंϞया िचJांगुडी =ाम मĞ है और उसके बाद इराईचीकुलम, एसपी कोŝाई और पĪदमपुली =ामĪ मĞ है। सभी =ामĪ मĞ पƗरवारĪ कƙ कुल संϞया ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3

910 है और लगभग 818 पƗरवारĪ के पा स िनजी भूिम है। हालांƘक , कुल पƗरवारĪ मĞ से आधे से अिधक (690) गरीबी रेखा से नीचे हġ। कृिष और स बर Ƙ;याकलाप जैसे Ƙक पशु पालन और कुϝकुट –पालन Oतािवत पाƗरिथितकƙ संवेदी जोन मĞ रहने वाले लोगĪ के िलए अथϕƆवथा का Oमुख Ɠोत है।ँ Ĳट और कोय ला बनाना भी यहां के लो गĪ कƙ आजीिवक़ा का साधन है;

अतः, अब, केLीय सरकार, पयाϕवरण (संरϓण ) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पƗठत पयाϕवरण (संरϓण ) अिधिनयम, 1986 (1986 का 29) (िजसे इसमĞ इसके पƇात् पयाϕवरण अिधिनयम कहा गया है) कƙ धारा 3 कƙ उपधारा (1) तथा उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ůारा Oदē शिŎयĪ का Oयोग करते ćए , तिमलनाडु राϤय मĞ िचJांगुडी पϓी अभयारय कƙ सभी सीमाĸ के चारĪ ओर 0.08 Ƙकलोमीटर से 1.88 Ƙकलोमीटर तक िवताƗरत ϓेJ को िचJांगुडी पϓी अभयारय पाƗरिथितकƙ संवेदी जोन (िजसे इस अिधसूचना मĞ इसके प चात् पाƗरिथितकƙ संवेदी जोन कहा गया है) के Đप मĞ अिधसूिचत करती है, िजसका िववरण िनƄानुसार है, अथाϕत् :--

1.1.1. पाƗरिथितकƙ संवेदी जोन काकाका िवतार औरऔरऔर सीमासीमा....-(1) पाƗरिथितकƙ संवेदी जोन का िवतार िचJांगुडी पϓी अभयारय के चारĪ ओर 0.08 Ƙकलोमीटर से 1.88 Ƙकलोमीटर तक है। पाƗरिथितकƙ संवेदी जोन का ϓेJफल

4.7972 वगϕ Ƙकलोमीटर है।

(2) पाƗरिथितकƙ संवेदी जोन कƙ सीमा का वणϕन उपाबंधउपाबंध----IIII के Đप मĞ संलŐ है।

(3) पाƗरिथितकƙ संवेदी जोन कƙ सीमा का सीमांकन दशाϕने वाले संरिϓत ϓेJ का मानिचJ उपाबंधउपाबंध----IIIIIIII ककक-क---चचचच पर है।

(4) पाƗरिथितकƙ संवेदी जोन और संरिϓत ϓेJ कƙ सीमा के भू-िनदğशांकĪ कƙ सूची ;मश : उपाबंधउपाबंध----IIIIII ((कककक)) और (((ख(खखख)))) मĞ है।

(5) Oमुख -थलĪ पर भू-िनदğशांकĪ के साथ पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले =ामĪ कƙ सूची उपाबंधउपाबंध---- IVIVIV के Đप मĞ संलŐ है।

222.2... पाƗरिथितकƙ संवेदी जोन केकेके िलएिलएिलए आंचिलक महायोजना .–(1) राϤय सरकार, पाƗरिथितकƙ संवेदी जोन के Oयोजन के िलए, राजपJ मĞ अंितम अिधसूचना के Oकाशन कƙ तारीख से दो वषϕ कƙ अविध के भीतर, थानीय ƆिŎयĪ के परामशϕ से और इस अिधसूचना मĞ Ƙदए गए अनुबंधĪ का पालन करत े ćए , राϤय सरकार के सϓम Oािधकारी के अनुमोदनाथϕ, एक आंचिलक महायोजना बनाएगी।

(2) राϤ य सरकार ůारा पाƗरिथितकƙ संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मĞ िविनƠदϕ ट ऐसी रीित से तथा सुसंगत कĞLीय और राϤय िविधयĪ के अनुĐप तथा कĞLीय सरकार ůारा जारी Ƙदशा िनदğशĪ, यƘद कोई हĪ, के अनुसार बनायी जाएगी ।

(3) आंचिलक महायोजना मĞ पाƗरिथितकƙ और पयाϕवरण संबंधी सरोकारĪ को सि मिलत करने के िलए इसे राϤय सरकार के िनƄिलिखत िवभागĪ के परामशϕ से बनाया जाएगा, अथाϕत्: - 4 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(i) पयाϕवरण , (ii) वन और वयजीव , (iii) कृिष, (iv) राज व , (v) शहरी िवकास, (vi) पयϕटन , (vii) =ामीण िवकास, (viii) ƚसंचाई और बाढ़ िनयंJण , (ix) नगरपािलका, (x) पंचायती राज, (xi) लोक िनमाϕण िव भाग, (xii) राजमागϕ, और (xiii) तिमलनाडु राϤय Oदूषण िनयंJण बोडϕ।

(4) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , आंचिलक महायोजना मĞ वतϕमान मĞ अनुमोƘदत भू-उपयोग, अवसंरचना और Ƙ;याकलापĪ पर कोई Oितबंध नहĕ लगाया जाएगा तथा आचंिलक महायोजना मĞ सभी अवसंरचनाĸ और Ƙ;याकलापĪ मĞ सुधार करके उहे अिधक दϓ और पाƗरिथितकƙ -अनुकूल बनाने कƙ Ɔवथा कƙ जाएगी।

(5) आंचिलक महायोजना मĞ वनरिहत और अव;िमत ϓेJĪ के सुधार, िवźमान जल िनकायĪ के संरϓण , आवाह ϓेJĪ के Oबंधन , जल-संभरĪ के Oबंधन , भू-जल के Oबंधन , मृदा और नमी के संरϓण , थानीय जनता कƙ आवयकताĸ तथा पाƗरिथितकƙ एवं पयाϕवरण के ऐसे अय पहलुĸ कƙ Ɔवथा कƙ जाएगी िजन पर यान Ƙदया जाना आवयक है।

(6) आंचिलक महायोजना मĞ सभी िवźमान पूजा थलĪ, =ामĪ एवं शहरी बितयĪ, वनĪ कƙ XेिणयĪ एवं ƘकमĪ , कृिष ϓेJĪ , ऊपजाऊ भूिम, उźानĪ एवं उźानĪ कƙ तरह के हƗरत ϓेJĪ , बागवानी ϓेJĪ , बगीचĪ , झीलĪ और अय जल िनकायĪ कƙ सीमा का िनधाϕरण Ƙकया जाएगा तथा सहायक मानिचJ भी Ƙदया जाएगा और इस महायोजना मĞ िवźमान और Oतािवत भू- उपयोग कƙ िवशेषताĸ का यौरा देने वाले मानिचJ भी Ƙदए जा एंगे।

(7) आंचिलक महायोजना मĞ पाƗरिथितकƙ संवेदी जोन मĞ होने वाले िवकास का िविनयम न Ƙकया जाएगा और सारणी मĞ यथा सूचीबŵ Oितिषŵ एवं िविनयिमत Ƙ;याकलापĪ का पालन Ƙकया जाएगा और इसमĞ था नीय जनता कƙ आजीिवका कƙ सुरϓा के िलए पाƗरिथितकƙ -अनुकूल िवकास का भी सुिनƇय एवं संवधϕन Ƙकया जाएगा ।

(8) आंचिलक महायोजना, ϓेJीय िवकास योजना कƙ सह -कािलक होगी ।

(9) इस Oकार अनुमोƘदत आंचिलक महायोजना , िनगरानी सिमित के िलए एक संदभϕ दतावेज होगी ताƘक वह इस अिधसूचना के उपबंधĪ के अनुसार िनगरानी के अपने कतϕƆĪ का िनवϕहन कर सके ।

3. राϤय सरकार ůारा ƘकएƘकएƘकए जाने वाले उपायउपाय....---- राϤय सरकार इस अिधसूचना के उपबंधĪ को Oभावी बनाने के िलए िनƄिलिखत उपाय करेगी, अथाϕत्:--

(1) भूभूभू-भू---उपयोग.उपयोग.उपयोग.–––– (क) पाƗरिथितकƙ संवेदी जोन मĞ वनĪ , बागवानी ϓेJĪ , कृिष ϓेJĪ , मनोरंजन के िलए िचिहत उźानĪ और खुले थानĪ का वृहद वािणिϤयक या आवासीय पƗरसरĪ या औźोिगक Ƙ;याकलापĪ के िलए Oयोग या संपƗरवतϕन अनुϔात नहĕ Ƙकया जाएगा :

परंतु पाƗरिथितकƙ संवेदी जोन के भीतर भाग (क) मĞ िविनƠदϕƍ Oयोजन से िभž Oयोजन के िलए कृिष और अय भूिम का संपƗरवतϕन , िनगरानी सिमित कƙ िसफाƗरश पर और सϓम Oािधकारी के पूवϕ अनुमोदन से, ϓेJीय नगर योजना अिधिनयम तथा यथा लागू केLीय या राϤय सरकार के अय िनयमĪ एवं िविनयमĪ के अधीन तथा इस अिधसूचना के उपबंधĪ के अनुसार थानीय िनवािसयĪ कƙ िन Ƅिलिखत आवासीय जĐरतĪ को पूरा करने के िलए अनुϔात Ƙकया जाएगा :-

(i) िवźमान सड़कĪ को चौड़ा करना, उहĞ सुदृढ करना और नई सड़कĪ का संिनमाϕण करना ;

(ii) बुिनयादी ढांचĪ और नागƗरक सुिवधाĸ का संिनमाϕण और नवीकरण ; (iii) Oदूषण उपž न करने वाले लघु उźो ग; (iv) कुटीर उźोग एवं =ाम उźोग ; पाƗरिथितकƙ पयϕटन मĞ सहायक सुिवधा भडार , थानीय सुिवधाएं तथा =ह वास ; और (v) बढ़ावा Ƙदए गए पैरा-4 मĞ उिलिखत Ƙ;याकलाप।

परंतु यह भी Ƙक ϓेJीय शहरी िनयोजन अिधिनयम के अधीन सϓम Oािधकारी के पूवϕ अनुमोदन के िबना तथा राϤय सरकार के अय िनयमĪ एवं िविनयमĪ एवं संिवधान के अनुϢछेद 244 के उपबंधĪ तथा तसमय Oवृē िविध, िजसके अंतगϕत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकारĪ कƙ मायता ) अिधिनयम, 2006 (2007 का 2) भी आता है, का अनुपालन Ƙक ए िबना वािणिϤयक या औźोिगक िवकास Ƙ;याकलापĪ के िलए जनजातीय भूिम का Oयोग अनुϔात नहĕ होगा :

परंतु यह भी Ƙक पाƗरि थितकƙ संवेदी जोन के अंतगϕत आने वाली भूिम के अिभलेखĪ मĞ ćई Ƙकसी JुƗट को, िनगरानी सिमित के िवचार OाƁ करने के पƇात्, राϤय सरकार ůारा Oयेक मामले मĞ एक बार सुधारा जाएगा और उŎ JुƗट को सुधारने कƙ सूचना कĞLीय सरकार के पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय को दी जाएगी:

परंतु यह भी Ƙक उपयुϕŎ JुƗट को सुधारने मĞ, इस उप-पैरा मĞ यथा उपबंिधत के िसवाय, Ƙकसी भी दशा मĞ भू- उपयोग का पƗरवतϕन सि मिलत नहĕ होगा ।

(ख) अनुOयुϝ त या अनु पादक कृिष ϓेJĪ मĞ पुन: वनीकरण तथा पयाϕवासĪ और जैव - िविवधता कƙ बहाली के Oयास Ƙकए जाएंगे ।

(2) Oाकृितक जल Zोत ...- आंचिलक महायोजना मĞ सभी Oाकृितक जल ZोतĪ के आवाह ϓेJĪ कƙ पहचान करके उनके संरϓण और बहाली कƙ योजना सि म िलत कƙ जाएगी और राϤय सरकार ůारा मागϕदशϕक िसŵांत इस रीित से बनाए जा ĵगे Ƙक उसमĞ इन ϓेJĪ या इनके आसपास के ϓेJĪ के िलए हािनकारक िवकास Ƙ;याकलापĪ को Oितिषŵ Ƙकया गया हो । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(3) पयϕटन या पाƗरिथितकƙ पयϕटन. ––– (क) पाƗरिथितकƙ संवेदी जोन मĞ सभी नए पाƗरिथितकƙ पयϕटन Ƙ;याकलाप या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार पाƗरिथितकƙ संवेदी जोन स बंधी पयϕटन महायोजना के अनुसार अनुϔात होगा;

(ख) पाƗरिथितकƙ पयϕटन महायोजना राϤय सरकार के पयाϕवरण और वन िवभागĪ के परामशϕ से पयϕटन िवभाग ůारा बनायी जाएगी;

(ग) पयϕटन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पाƗरिथितकƙ पयϕटन संबंधी Ƙ;याकलाप िन ना नुसार िविनयिमत Ƙकए जाएंगे, अथाϕत् : -

(i) वयजीव अभयारय कƙ सीमा से एक Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, Ƙकसी होटल या Ɨरसोटϕ का नया सिžमाϕण अनुϔात नहĕ Ƙकया जाएगा। परंतु, पाƗरिथितकƙ पयϕटन सुिवधाĸ के िलए वयजीव अभयारय कƙ सीमा से एक Ƙकलोमीटर कƙ दूरी से परे पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक पूवϕ पƗरभािषत और अिभिहत ϓेJĪ मĞ पयϕटन महायोजना के अनुसार, नए होटलĪ और Ɨरसोटϕ कƙ थापना अनुϔात होगी।

(ii) पाƗरिथितक संवेदी जोन के भीतर सभी नए पयϕटन Ƙ;याकलापĪ या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार पाƗरिथितकƙ पयϕटन पर जोर देते ćए कĞLीय सरकार के पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय के मागϕदशϕक िसŵांतĪ के ůारा तथा राEीय या> संरϓण Oािधकरण, ůारा जारी पाƗरिथितक पयϕटन (समय-समय पर यथा संशोिधत) मागϕदशϕक िसŵांतĪ के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन Ƙकए जाने तक पयϕटन के िलए िवकास और िवźमान पयϕटन Ƙ;याकलापĪ के िवतार वातिवक थल िविनƠदϕƍ संवीϓा तथा मानीटरी सिमित कƙ िसफाƗरश पर स बŵ िविनयामक Oािधकारी ůारा अनुϔात Ƙकया जाएगा और Ƙकसी नए होटल , Ɨरसīट या वािणिϤयक थापनĪ के संिनमाϕण कƙ अनुϔा नहĕ दी जाएगी। (4) Oाकृितक िवरासत ...–.––– पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले बćमूय Oाकृितक िवरासत के सभी थलĪ जैसे Ƙक जीन पूल Ɨरजवϕ ϓेJ , शैल संरचना, जल Oपात , झरने, दरğ, उपवन, गुफाएं, थल , वनपथ, रोहण मागϕ, उOपात आƘद कƙ पहचान कƙ जाएगी और उनकƙ सुरϓा एवं संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी।

(5) मानव िनƞमϕत िवरासत थ ल.ल.ल.-ल. --- पाƗरिथितकƙ संवेदी जोन मĞ भवनĪ , संरचनाĸ , कलाकृित-ϓेJĪ तथा ऐितहािसक, थापय संबधी , सĭदयाϕमक और सांकृितक महव के ϓेJĪ कƙ पहचान कƙ जाएगी और उनके संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी। (6) वविन व िन Oदूषण ...- विन Oदूषण (िविनयमन और िनयंJण) िनयम, 2000 मĞ िनयत उपबंधĪ के अनुसरण मĞ पाƗरिथितकƙ संवेदी जोन मĞ विन Oदूषण के िनयंJण के िलए िविनयमĪ और उसके अधीन समय समय पर बनाए गए संशोिधत िनयमĪ को कायाϕिवत करेगा ।

(7) वायु Oदूषण ...- पाƗरिथितकƙ संवेदी जोन मĞ वायु Oदूषण कƙ रोकथाम और िनयंJण , वायु (Oदूषण िनवारण और िनयंJण ) अिधिनयम, 1981 (1981 का 14) के उपबंधĪ और उसके अधीन बनाए गए िनयमĪ और उनमĞ Ƙकए गए संशोधनĪ के अनुसार Ƙकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7

(8) बिहZाव काकाका िनसारण ...- पाƗरिथितकƙ संवेदी जोन मĞ उपचाƗरत बिहZाव का िनसारण , और उसके अधीन बनाए गए िनयमĪ के अतगϕत सि मिलत Ƙकए गए पयाϕवरणीय Oदूषण के िनसारण संबंधी साधारण मानकĪ या राϤय सरकार ůारा िनयत मानकĪ, इनमĞ जो भी अिधक कठोर हĪ , के अनुसार Ƙकया जाएगा ।

(9) ठोसठोसठोस अपिशƍ ...-.--- ठोस अपिशƍ का िनपटान एवं Oबधन िनƄानुसार Ƙकया जाएगा :-

(i) पाƗरिथितकƙ संवेदी जोन मĞ ठोस अपिशƍ का िनपटान और Oबंधन भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अOैल , 2016 के अधीन Oकािशत ठोस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा;

(ii ) पाƗरिथितकƙ संवेदी जोन मĞ माय OौźोिगƘकयĪ (ई एस एम) का Oयोग करते ćए िवźमान िनयमĪ और िविनयमĪ के अनुĐप ठोस अपिश ƍ का सुरिϓत और पयाϕवरण -अनुकूल Oबंधन अनुϔात Ƙकया जाएगा।

(10) जैव िचƘकसा अपिशट ...- जैव िचƘकसा अपिशट का Oबंधन िनƄानुसार Ƙकया जाएगा :-

(i) पाƗरिथितकƙ संवेदी जोन मĞ जैव िचƘकसा अपिशƍ का िनपटान भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय –समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माचϕ, 2016 के तहत Oकािशत जैव िचƘकसा अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा;

(11) लािट लािटकक अपिशƍ का Oबंधन ...-.--- पाƗरिथितकƙ संवेदी जोन मĞ लािटक अपिशƍ का Oबंधन, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माचϕ, 2016 के तहत Oकािशत लािटक अपिशƍ Oबंधन िनयम, 2016 के उपबंधो के अनुसार Ƙकया जाएगा।

(12) िनमाϕण और िववंस अपिशƍ का Oबंधन ...-.--- पाƗरिथितकƙ संवेदी जोन मĞ िनमाϕण और िववंस अपिशƍ का Oबंधन, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 317(अ), तारीख 29 माचϕ, 2016 के तहत Oकािशत संिनमाϕण और िववंस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(13) ईईई–ई–––अपिशƍ. --- पाƗरिथितकƙ संवेदी जोन मĞ ई –अपिशƍ का Oबंध न, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय ůारा Oकािशत तथा समय-समय पर यथा संशोिधत ई–अपिशƍ Oबंध न िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(14) यानीय पƗरवहन. --- वाहन-यातायत का संचलन आवास-अनुकूल तरीके से िविनयिमत Ƙकया जाएगा और इस संबंध मĞ आंचिलक महायोजना मĞ िवशेष उपबंध सि मिलत Ƙकए जाएंगे तथा आंचिलक महायोजना के तैयार होने और राϤय सरकार के सϓम Oािधकारी ůारा अनुमोƘदत Ƙकए जाने तक , िनगरानी सिमित Oासंिगक 8 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

अिधिनयमĪ और उनके तहत बनाए गए िनयमĪ एवं िविनयमĪ के अनुसार वाहनĪ कƙ आवाजाही के अनुपालन कƙ िनगरानी करेगी।

(15) यानयानयान जिनत Oदूषण ...-.--- वाहन जिनत Oदूषण कƙ रोकथाम और िनयंJण लागू िविधयĪ के अनुसार Ƙकया जाएगा और वϢछ तर Ĳधन के Oयोग के Oयास Ƙकए जा एंगे ।

(16) औźोिगक इकाई यांयांयां.यां...---- (i) सरकारी राजपJ मĞ इस अिधसूचना के Oकाशन कƙ तारीख को या उसके पƇात् पाƗरिथितकƙ संवेदी जोन मĞ Ƙकसी नए Oदूषण कारी उźोग कƙ थापना अनुϔात नहĕ होगी।

(ii) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , पाƗरिथितकƙ संवेदी जोन मĞ कĞLीय Oदूषण िनयंJण बोडϕ ůारा फरवरी, 2016 मĞ जारी ƘदशािनदğशĪ मĞ Ƙकए गए उźोगĪ के वगĖकरण के अनुसार केवल गैर- Oदूषणकारी उźोगĪ कƙ थापना अनुϔात होगी। इसके अितƗरŎ , गैर-Oदूषणकारी कुटीर उźोगĪ को बढ़ावा Ƙदया जाएगा।

(17) पहाड़ी ढलानĪ काकाका संरϓण ...-.--- पहाड़ी ढलानĪ का संरϓण िनƄानुसार Ƙकया जाएगा:-

(क) आंचिलक महायोजना मĞ पहाड़ी ढलानĪ के उन ϓेJĪ को दशाϕया जाएगा िज नमĞ Ƙकसी भी संिनमाϕण कƙ अनुϔा नहĕ होगी;

(ख) िजन ढलानĪ या िवźमान खड़ी पहाड़ी ढलानĪ मĞ अयिधक भू-ϓरण होता है उनमĞ Ƙकसी भी संिनमाϕण कƙ अनुϔा नहĕ होगी ।

(18) केLीय सरकार और राϤय सरकार, यƘद यह आवयक समझती है, इस अिधसूचना के उपबंधĪ को Oभावी करने मĞ अय उपाय िविनƠदϕƍ करेगी।

444.4... पाƗरिथितकƙ संवेदी जोन मĞमĞमĞ Oितिषŵ यायाया िविनयिमत Ƙकए जाने वाले Ƙ;याकलापĪ कƙकƙकƙ सूचीसूची....---- पाƗरिथितकƙ संवेदी जोन मĞ सभी Ƙ;याकलाप , पयाϕवरण (संरϓण ) अिधिनयम, और तटीय िविनयमन जोन अिधसूचना, 2011 एवं पयाϕवरणीय Oभाव आकलन (ईआईए) अिधसूचना, 2006 सिहत उसके अधीन बने िनयमĪ और वन (संरϓण ) अिधिनयम, 1980 (1980 का 69), भारतीय वन अिधिनयम, 1927 (1927 का 16), वयजीव (संरϓण ) अिधिनयम, 1972 (1972 का 53) सिहत अय लागू िनयमĪ तथा उनमĞ Ƙकए गए संशोधनĪ के अनुसार शािसत हĪ गे और नीचे दी गई सारणी मĞ िविनƠदϕƍ रीित से िविनयिमत हĪगे, अथाϕत् :-

भारत संघ के मामले मĞ वषϕ 1995 कƙ Ɨरट यािचका (िसिवल) सं 202 मĞ तारीख 4 अगत , 2006 तथा गोवा फाउंडेशन बनाम भारत संघ के मामले मĞ वषϕ 2012 कƙ Ɨरट यािचका(िसिवल) सं. 435 मĞ तारीख 21 अOैल, 2014 के माननीय उŔतम यायालय के आदेश के अनुसार Ƙकए जाएंगे। 2. Oदूषण (जल , वायु, मृदा, विन पाƗरिथितकƙ संवेदी जोन मĞ कोई नया उźोग लगाने और वतϕमान आƘद) उपž करने वाले उźोगĪ Oदूषणकारी उźोगĪ का िवतार करने कƙ अनुϔा नहĕ होगी : कƙ थापना । जब तक Ƙक इस अिधसूचना मĞ िविनƠदϕƍ न हो, पाƗरिथितकƙ संवेदी जोन मĞ फरवरी, 2016 मĞ कĞLीय Oदूषण िनयंJण बोडϕ ůारा जारी ƘदशािनदğशĪ मĞ Ƙकए गए उźोगĪ के वगĖकरण के अनुसार केवल गैर- Oदूषणकारी उźोगĪ कƙ थापना होगी। इसके अितƗरŎ , गैर-Oदूषणकारी कुटीर उźोगĪ को Oोसाहन Ƙदया जाएगा।

3. बड़ी जल िवźुत पƗरयोजनाĸ लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) कƙ थापना । हĪगे। 4. Ƙकसी पƗरसंकटमय पदाथϕ का लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) Oयोग या उपादन या Oसंकरण हĪगे। । 5. Oाकृितक जल िनकायĪ या भूिम लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) ϓेJ मĞ अनुपचाƗरत बिहZावĪ का हĪगे। िनसारण । 6. नई आरा िमलĪ कƙ थापना। पाƗरिथितकƙ संवेदी जोन मĞ नई आरा िमलĪ कƙ थापना और िवźमान आरा िमलĪ का िवतार अनुϔात नहĕ हो गा । 7. Ĳट भŝĪ कƙ थापना । लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे।

खखख.ख...िविनयिमत Ƙ;याकलाप 8. होटलĪ और Ɨरसोटī कƙ पाƗरिथितकƙ पयϕटन Ƙ;याकलापĪ हेतु लघु अथायी संरचनाĸ के वािणिϤयक थापना । िनमाϕण को छोड़कर संरिϓत ϓेJ कƙ सीमा से एक Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, नए वािणिϤयक होटलĪ और Ɨरसोटϕ कƙ थापना अनुϔात नहĕ होगी :

परंतु, संरिϓत ϓेJ कƙ सीमा से एक Ƙकलोमीटर के बाहर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, सभी नए पयϕटन Ƙ;याकलाप करने या िवźमान Ƙ;याकलापĪ का िवतार पयϕटन महायोजना और लागू ƘदशािनदğशĪ के अनुसार अनुϔात होगी । 9. संिनमाϕण Ƙ;याकलाप । (क) संरिϓत ϓेJ कƙ सीमा से 1.0 Ƙकलोमीटर के भीतर या 10 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक , इनमĞ जो भी अिधक िनकट हो, Ƙकसी भी नये वािणिϤयक संिनमाϕण कƙ अनुϔा नहĕ होगी:

परंतु थानीय लोगĪ को अपनी आवास स बधी िनƄ िलिखत आवयकताĸ को पूरा करने के िलए , पैरा 3 के उप पैरा (1) मĞ सूचीबŵ Ƙ;याकलापĪ सिहत अपने O योग के िलए, अपनी भूिम मĞ भवन उप-िविधयĪ के अनुसार , संिनमाϕण करने कƙ अनुϔा होगी :-

(i) िवźमान सड़कĪ को चौड़ा करना, उहĞ सुदृढ करना और नई सड़कĪ का संिनमाϕण करना;

(ii) बुिनयादी ढांचĪ और नागƗरक सुिवधाĸ का संिनमाϕण और नवीकरण करना; (iii) कĞLीय Oदूषण िनयंJण बोडϕ ůारा Ƙकए गए वगĖकरण के अनुसार गैर- Oदूषणकारी लघु उźोगĪ कƙ थापना ; (iv) =ामीण उźोगĪ सिहत कुटीर उźोगĪ , सुिवधा भडारĪ और =ह -वास सिहत पाƗरिथितकƙ पयϕटन मĞ सहायक थानीय सुिवधाĸ कƙ Ɔवथा ; और (v) इस अिधसूचना मĞ सूचीबŵ बढ़ावा Ƙदए गए Ƙ;याकलाप ।

परतु गैर –Oदूषणकारी लघु उźोगĪ से संबंिधत संिनमाϕण Ƙ;याकलाप लागू िनयमĪ और िविनयमĪ, यƘद कोई हĪ , के अनुसार सϓम Oािधकारी कƙ पूवϕ अनुमित से िविनयिमत Ƙकए जाएंगे और वे यूनतम हĪगे । (ख) एक Ƙकलोमीटर से आगे ये आंचिलक महायोजना के अनुसार िविनयिमत हĪगे ।

10. गैर Oदूषण कारी लघु उźोग। फरवरी, 2016 मĞ केLीय Oदूषण िनयंJण बोडϕ ůारा जारी उźोगĪ के वगĖकरण के अनुसार गैर -Oदूषणकारी उźोग तथा अपƗरसंकट मय लघु और सेवा उźोग, कृिष, पुप कृिष, बागबानी या कृिष आधाƗरत उźोग, जो पाƗरिथितकƙ संवेदी जोन से देशी सामि=यĪ से उपाद बनाते हġ, सϓम Oािधकारी ůारा अनुϔात हĪगे।

11. वृϓĪ कƙ कटाई । क. राϤय सरकार के सϓम Oािधकारी कƙ पूवϕ अनुमित के िबना वन भूिम या सरकार भूिम या रा जव भूिम या िनजी भूिम पर वृϓĪ कƙ कटाई कƙ अनुϔा नहĕ होगी । ख. वृϓĪ कƙ कटाई कĞLीय या संबंिधत राϤय के अिधिनयमĪ और उनके अधीन बनाए गए िनयमĪ के उपबंधĪ के अनुसार िविनयिमत होगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11

12. वन उपादĪ और गैर काƏ वन लागू िविधयĪ के अ धीन िविनयिमत होगा । उपादĪ का सं=ह ।

13. िवźुत और संचार टॉवर लगाने, लागू िविधयĪ के अधीन िविनयिमत होगा भूिमगत केबल िबछाने तार-िबछाने तथा अय बुिनयादी को बढ़ावा Ƙदया जाएगा। ढांचे कƙ Ɔवथा । 14. ठोस अपिश ट Oबंधन। लागू िविधयĪ के अधीन िविनयिमत हĪगे । 15. फमĬ , कारपोरेट, कंपिनयĪ ůारा थानीय जनता के Oयोग के िलए लागू िविधयĪ (अय था उपबंिधत बड़े पैमाने पर वािणिϤयक पशुधन के िसवाय) के अधीन अनुϔात होगा । संपदा और कुϝकुट फामĬ कƙ थापना । 16. नागƗरक सुिवधाĸ सिहत यह Ɔवथा लागू िविधयĪ , िनयमĪ , िविनयमĪ और मौ जूदा बुिनयादी ढांचे कƙ Ɔवथा। ƘदशािनदğशĪ के अनुसार उपशमन उपायĪ के साथ कƙ जाएगी। 17. िवźमान सड़कĪ को चौड़ा करना, यह Ɔवथा लागू िविधयĪ , िनयमĪ , िविनयमĪ और मौ जूदा उहĞ सुदृढ बनाना और नई सड़कĪ ƘदशािनदğशĪ के अनुसार उपशमन उपायĪ के साथ कƙ जाएगी। का िनमाϕण करना। 18. पयϕटन से संबंिधत अय लागू िविधयĪ के अधीन िविनयिमत हो गा । Ƙ;याकलाप जैसे Ƙक पाƗरिथितकƙ संवेदी जोन ϓेJ के ऊपर से गमϕ वायु के गु बारे, हेलीका टर , Gोन, माइ;ोलाइϧस उडाना आƘद। 19. पवϕतीय ढलानĪ और नदी तटĪ का लागू िविधयĪ के अधीन िविनयिमत होगा । संरϓण ।

20. रािJ मĞ सड़क यातायात का लागू िविधयĪ के अधीन वािणिϤयक Oयोजन के िलए िविनयिमत संचलन । होगा ।

21. थानीय जनता ůारा अपनायी थानीय जनता के Oयोग के िलए लागू िविधयĪ के अधीन अनुϔात जा रही वतϕमान कृिष और हĪगे। बागवानी पŵितयĪ के साथ डेयƗर यां, दुϟध उपादन , जल कृिष और मय पालन ।

22. Oाकृितक जल िनकायĪ या भू ϓेJ जल िनकायĪ मĞ उपचाƗरत अपिशƍ जल/बिहZाϕव के िनसारण से मĞ उपचाƗरत अपिशƍ बचा जाएगा। उपचाƗरत अपिशƍ जल के पुनचϕ; ण और जल/बिहZाϕव का िनसारण । पुन:उपयोग के Oयास Ƙकए जाएंगे अयथा उपचाƗरत अपिशƍ जल/बिहZाϕव का िनसारण लागू िविधयĪ के अनुसार िविनयिमत Ƙकया जाएगा। 23. सतही और भूजल का वािणिϤयक लागू िविधयĪ के अधीन िविनयिमत होगा । Oयोग एवं िनकषϕण । 24. कृिष या अय उपयोग के िलए लागू िविधयĪ के अधीन िविनयिमत होगा तथा संबंिधत Oािधकारी 12 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

6.6.6. िनदğश ---िनबंधन.-िनबंधन.िनबंधन.---- (1) मानीटरी सिमित इस अिधसूचना के उपबंधĪ के अनुपालन को मानीटरी करेगी।

(2) मानीटरी सिमित का कायϕकाल तीन वषϕ तक या राϤय सरकार ůारा नई सिमित का पुनगϕठन Ƙकए जाने तक होगा और इसके बाद मानीटरी सिमित राϤय सरकार ůारा गƗठत कƙ जाएगी।

It is located in S.F No. 159 of Chitrangudi Village; AND WHEREAS , It is notified as a sanctuary within the meaning and scope of section 18 (1) of Wildlife Protection Act 1972, through the G.O Ms. No 684, Environment and Forest Department (FRV) dated the 21 st September, 1989 for the conservation of avian fauna that inhabit the water body. Many of the different varieties of migratory birds arrive from various parts of countries for feeding purpose. About 11000 birds belonging to 43 species have been listed during the peak season and the important birds include, white ibis, black ibis, open-billed stork, egrets, mynas, teals, ducks, darters, herons, pelicans etc.; AND WHEREAS , the Sanctuary is biggest resident for variety of floral and faunal diversity and has species richness of nearly threatened species such as Pelican, Painted stork, Eurasian Spoon bill, White ibis, Darter, Flamingo and water birds such as common coot, Pin tail, Garganey, Egrets, Cormorants, Black winged stilt, King fisher, Common myna, Brahminy kite, Spotted Owlet and more than 30 common birds are documented; AND WHEREAS , the sanctuary offers ideal habitat for winter migratory birds with considerable diversity in nesting and feeding behaviour for breeding and feeding. It is one of the preferred nesting sites for heronry species and colonial birds migrating to South India. The feathered visitors flock the sanctuary from October to February. The wetland is irregular in depth and retains water for 3 to 5 months, if rain is normal; AND WHEREAS , the sanctuary is basically an irrigation tank that is used for storing water for agriculture recharged by the northeast monsoons from October till January. The tank remains completely dry from March to August. As the sanctuary is basically an irrigation tank, there is no natural forest within the sanctuary. Babul ( Acacia nilotica) plantations were raised by the Social Forestry wing of the Forest Department during 1980s; AND WHEREAS , the major flora in the sanctuary are Neermulli ( Hygrophila schulli (Hamilt.) M.R.Almeida), Nayurivi (Achyranthes aspera L.), Panai (Borassus flabellifer L.), Erukku (Calotropis gigantea (L.) R.Br.), Vettukkaaya- thazhai (Tridax procumbens L.), Mookthipoo (Parthenium hysterophorus L.), Avaram, Avaarai (Senna auriculata (L.) 26 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

Roxb.) Puliya maram (Tamarindus indica L.), Nai kadugu, Nai vaelai (Cleome viscosa L.), Neivelikatamanakku (Ipomoea carnea Jacq.), Vishnukarandi (Evolvulus alsinoides (L.) L.), Vellarikkaai, Keerakkaai (Cucumis sativus L.) etc. The sanctuary being an irrigation tank has very less faunal species (except Avifauna) which include Indian Grey Mongoose (Herpestes edwardsii) , Indian Palm Squirrel (Funambulus palmarum) , Jackal (Canis aureus) , Black -naped Hare (Lepus nigricollis) and Bandicoot Rat (Bandicota bengalensis); AND WHEREAS , the sanctuary has only one settlement that abuts it on the southern border, namely Chitrangudi Village. The village is mainly constituted by forward community population. Majority of the villagers belong to Maravar caste. Yadhavar and Pillai castes are on par in number with 40 members each. All the villagers follow Hindu religion. Four villages, Chitrangudi, Eraichikulam, SP Kottai and Pondampuli are present in the vicinity of the Chitrangudi bird sanctuary under the jurisdiction of Chitrangudi Panchayat; AND WHEREAS , the total population of the village consists of 2350 males and 2850 females. Maximum population is located in Chitrangudi village followed by Eraichikulam, SP Kottai and Pondampuli. Total number of households in all the villages is 910 and nearly 818 households own land; however, more than half of the total households (690) are below poverty line. Agriculture and allied activities such as livestock rearing, poultry are the major sources of economy for the people living in the proposed Eco sensitive zone. Brick making and charcoal making also contribute to their livelihood; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 0.08 kilometres to 1.88 kilometres around the boundary of Chitrangudi Bird Sanctuary in the State of Tamil Nadu as the Chitrangudi Bird Sanctuary Eco- sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from 0.08 kilometres to 1.88 kilometres around the Chitrangudi Bird Sanctuary. The area of the Eco-Sensitive Zone is 4.7972 square kilometres. (2) The boundary description of the Eco Sensitive Zone is appended at Annexure I. (3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-F. (4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure III (A) and (B) respectively. (5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV . 2. Zonal Master Plan for Eco-Sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-Sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment, (ii) Forest and Wildlife, (iii) Agriculture, (iv) Revenue, (v) Urban Development, (vi) Tourism, (vii) Rural Development, (viii) Irrigation and Flood Control, (ix) Municipal, (x) Panchayati Raj, (xi) Public Works Department, (xii) Highways, and (xiii) Tamil Nadu State Pollution Control Board. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for Security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government .- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities; (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone; 28 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan. (d) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometres from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-Sensitive zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents. - Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and management of solid wastes shall be as under:- (i) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone; (ii) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. – Bio-Medical Waste Management shall be as under:- (i) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28 th March, 2016; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29

(ii) safe and Environmentally Sound Management (ESM) of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone. (11) Plastic Waste Management. - The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time . (12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time. (13) E-Waste. - The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic . – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution . - Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units . – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-Sensitive Zone. (iii) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes . - The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. (18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.- All activities in the Eco- Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

unless so specified in this notification and in addition the, non- polluting cottage industries shall be promoted. 3. laws. B. Regulated Activities Commercial establishment of hotels 8. No new commercial hotels and resorts shall be permitted within and resorts. one kilometer of the boundary of the Protected Area or upto the

extent of Eco-sensitive zone, whichever is nearer, except for small

temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities

listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents, such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution as per the classification done by the Central Pollution Control Board; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including homestays; and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 31

(v) promoted activities listed in this notification: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. Small scale non polluting industries. 10. Non polluting industries as per classification of industries issued by

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification .-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 the Central Government hereby constitutes a Monitoring Committee, comprising of the following members namely:-

6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 33

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA

North Starts from the interception point of feeder channel to Chitrangudi Kanmoi on the

Mudukalathur – Kamuthi state highway. Thence the boundary travels in eastern direction along the Mudukalathur – Kamuthi state highway.

North East The boundary along the Mudukalathur – Kamuthi state highway on the northern portion ends at the interception point of Turi village approach road on the Mudukalathur – Kamuthi state highway.

East Along the Turi village approach road, the boundary travels around 500 mts. away in south

eastern direction.

South East The boundary travels along the bund of Pondampuli Kanmoi till it touches the southernmost tip of the Pondampuli Kanmoi on the bund.

West The boundary travels along the Chitrangudi – Sonaipiriyankottai road and inturn along the

Chitrangudi village approach road.
