Special Edition Volume 6, Issue 9 November 2004 2004 ELECTION RETURNS Initiatives Initiative Subject/Description Yes No Proposition 64 Unfair Competition Law: Limits an individual’s right to sue under 58.9% 41.1% the unfair competition laws by requiring that the individual actually PASSED incurred injuries, and suffered financial/property loss because of, the unfair business practice. Proposition 66 Three Strikes: Amends the “Three Strikes” law by requiring that 46.6% 53.4% increased sentences be given only for violent and/or serious felonies. FAILED Additionally, the proposition redefines what constitutes a violent and/or serious felony, and requires increased punishment for specified sex crimes against children. Proposition 69 DNA Samples: Requires the collection of DNA samples from all 61.8% 38.2% felons, adults and juveniles that are arrested for or charged with PASSED specified crimes. The proposition further requires that, in five years, DNA samples be taken from adults arrested for or charged with any felony. Proposition 1A Protection of Local Government Revenues: Protects local funding 83.6% 16.4% for public safety, health, libraries, parks, and other locally delivered PASSED services. Also, prohibits the State from reducing local governments’ property tax proceeds, and stipulates that these provisions may only be suspended if the Governor declares a fiscal necessity and two-thirds of the Legislature approves the suspension. The proposition additionally requires the State to fund legislative mandates imposed on local governments
