Additionally, this should not be taken as legal advice but rather our interpretation of the guidance. FEDERAL On March 23, CISA has updated critical manufacturing in their memorandum on identification of essential critical infrastructure workers during the covid-19 response to include “workers needed to maintain the continuity of these manufacturing functions and associated supply chains” On March 28, CISA released it’s 2.0 version of this guidance which includes the following language in their transportation and logistics section: Automotive repair, maintenance, and transportation equipment manufacturing and distribution facilities (including those who repair and maintain electric vehicle charging stations). On April 17, CISA released its 3.0 version of this guidance which includes the following language in their transportation and logistics section: Workers critical to the manufacturing, distribution, sales, rental, leasing, repair, and maintenance of vehicles and other transportation equipment (including electric STATE BY STATE BREAKDOWN OF ShIP/BUSINESS RESTRICTION ORDERS Page 2 of 26 vehicle charging stations) and the supply chains that enable these operations to facilitate continuity of travel-related operations for essential workers. On May 20, CISA released its 3.1 version of this guidance. This update changes minimal language in the transportation section. Executive Order: Individuals will be required to wear a mask or other facial covering when in public and in close contact with other people. This amended order extends until August 31, 2020 at 5:00 p.m. Gov. Health Directive for manufacturers – COVID- 19 safety protocols. Governor Asa Hutchinson (R) issued an order providing all persons in the state and person's employees, agents, and officers immunity from civil liability for damages or injuries caused by or resulting from exposure of an individual to COVID-19 on the premises own or operated by those persons or during any activity managed by those persons. Governor Asa Hutchinson (R) has ordered the Secretary of Health to issue a public health order requiring individuals to wear face coverings in public places, with some exceptions. Critical Manufacturing, Essential Workforce: Workers necessary for the manufacturing of materials and products needed for medical supply chains, transportation, energy, communications, food and agriculture, chemical manufacturing, nuclear facilities, the operation of dams, water and wastewater treatment, emergency services, and the defense industrial base. Additionally, workers needed to maintain the continuity of these manufacturing functions and associated supply chains. Executive Action – Gov. Newsom’s order creates a time-limited rebuttable presumption for accessing worker’s compensation benefits. LOCAL - Denver Executive Order: Extended to May 8 CDPHE Guidance Executive Order: Vulnerable Individuals cannot be compelled to perform in-person work for any business or government function, including a Critical Business or Critical Government Function ENACTED legislation: "Healthy Families and Workplaces Act", which requires employers to provide paid sick leave to employees under various circumstances Governor Jared Polis (D) has signed the "Protect our Neighbors" order, which allows local communities to create reopening plans within state guidelines. It allows for Non-Critical Office-Based Businesses to operate at 50% capacity and all other businesses and activities to operate at 50% capacity, limited to 500 persons. These limits do not apply to critical businesses. Executive Order: Governor Jared Polis (D) has ordered all individuals to wear face coverings in public places. There are some exemptions. Gov. Essential workers who contracted COVID19 on the job with a timely, straightforward opportunity to claim any benefits they are due through the workers’ compensation system. That opportunity will come through a forthcoming executive order. Executive Action: allows for rebuttable presumption that workers who contracted COVID-19 between March 10, 2020 and May 20, 2020, contracted it on the job and are eligible for workers’ compensation benefits.
