Hope for a new federal shield law Surprise passage of a reporters’ shield law by the House of Representatives raised the real possibility that a federal law protecting news people from being forced to reveal sources will be passed this year. And about time that would be. Courts have consistently refused to protect reporters from be- ing ordered to reveal the names of sources in both criminal and civil cases. The journalist then has the choice of going back on a promise – or going to jail for contempt of court. Quite a few have gone to jail over the last 30 years rather than endanger someone who trusted them. So why is this a big deal? Because many important stories might never reach print without judicious use of confidential sources: stories of government cor- ruption, organized crime, shoddy consumer products, you name it. If the subject is touchy, people don’t want to talk about it, at least not for publication, unless their name can be protected. A source’s job, even their life, could be in danger. Government lawyers might put them on the witness stand, even send them to jail. No one particularly likes stories that cite unnamed sources, reporters least of all. Most news organizations reserve them for stories that really count, but those are the ones where the source has the most to lose. Supporters were surprised when the law, attached as an amend- ment to a Justice Department spending bill, passed the House, dominated as it is by conservative Republicans. But this is not a partisan issue. NOTICE OF PUBLIC HEARING AND PUBLIC COMMENT PERIOD CONCERNING NATURAL GAS SERVICE RATE INCREASE REQUEST The Kansas Corporation Commission is holding a public hearing to allow Black Hills customers the opportunity to ask questions and make comments about Black Hills’ rate increase proposal. In its application, Black Hills said the increase was necessary because the company has continued to make investments in its system to provide safe, reliable, and efficient natural gas service to its customers. The Company further stated it has experienced increases in wages, medical expenses, and supplier costs. The requested increase would only affect the portions of a customer’s bill that relate to the delivery of gas by Black Hills to customers, the fixed monthly “Customer Charge,” and the per Therm “Commodity Charge.” The rate case does NOT involve the cost of gas that is collected through the Purchased Gas Adjustment (PGA). The cost to purchase natural gas supplies is not regulated and is subject to market forces such as supply and demand, storage volumes, and weather. Black Hills’ last rate increase of $5.1 million was approved on May 16, 2007.

(2) A rider to gradually increase revenues to cover the cost of five specific safety related projects.

(3) Requested funding and accounting order for the utility’s FutureTrack Work Force Development Program. (4) Pension and Other Post Retirement Employee Benefits Trackers to defer and recover/refund in utility’s next rate case the difference between the utility’s actual costs and costs included in base rates. PUBLIC COMMENT PERIOD The Commission will also accept written comments from Black Hills customers through September 22nd, 2014. EVIDENTIARY HEARING The Commission will conduct an evidentiary hearing on the Black Hills rate increase request November 12th - 17th, 2014, at 9:00 a.m. in the first floor hearing room at its Topeka office. At this hearing Commission Staff, Black Hills representatives, and Citizens’ Utility Ratepayer Board (CURB) will present their case to the Commission. The Commission must issue a decision by January 6th, 2015. ADDITIONAL INFORMATION Black Hills’ corporate office is located in Rapid City, South Dakota. It provides electric and natural gas utility service to 762,000 customers in the Midwest. In Kansas, Black Hills provides natural gas service to approximately 111,000 customers.

The Kansas Corporation Commission regulates public utilities including home telephone, natural gas, electric and water companies, as well as motor carriers, oil and gas pipeline, and oil and gas producers. The Commission’s regulatory oversight of public utilities primarily pertains to rates and terms of service. In order to ensure that customers of regulated utilities are provided sufficient and efficient service at just and reasonable rates, utilities may not change their rates without Commission approval.
