Section) Nirman Bhawan, New D lhi-11 Dated the Ma$5 2018 ORDER Subject: Renewal of Permission for 4th batch of 150 MBBS seats at Pacific Institute of edical Sciences, Udaipur, Rajasthan (PIMS ) for the academic year 2018-19- Disapproval -r g. Whereas the Medical Council of India vide letter dated 31.10.2017 recommended to the Ministry of Health & Family Welfare not to renew the permission for admission of 150 MBB seats in the year 2018-19 (4th batch) at Pacific Institute of Medical Sciences, Udaipur, Rajasthan a d also applied Clause 8(3)(1)(b) of Establishment of Medical College Regulations, 1999 informing as under:- The Executive Committee of the Council considered the assessment report 21st and 22nd August, 2017) and noted the following:- Deficiency of faculty is 43.50 % as detailed in the report. Dr. K.K. Sharma, Dean possesses total teaching experience as Professor + As ociate Professor of 9 years 7 months against requirement of 10 years; hence not qual fled to hold the post. Non-medical faculty in Biochemistry is 80.00 % against maximum permissible imit of 50%. Shortage of Residents is 83.00 % as detailed in the report. Total number of CMOs are inadequate for round the clock duty. Bed Occupancy is 61.2 % at 10 a.m. on day of assessment. OPD attendance data supplied by the Institute are overinflated. Patients names are entered in computer system without availability of patient, particularly in ENT, Ophthalmology. All new & old patients are counted twice in Ophthalmology. There was NIL Normal Delivery & only 1 Caesarean Section on day of assessmen Wards: Psychiatry ward was closed. Pantry & Store rooms are not furnished in all the wards. There is no Demonstration room in 5th floor General medicine ward. There is no Unit-wise bed distribution. General Surgery ward Demonstration room was shown as that for Paediatrics; it was locked & key was not available. ICUs: Registers of ICCU & MICU are not maintained differently. SICU is shown with Neurosurgery ICU. Details of patients admitted in ICCU & ICUs on day of assessment are not provided. Labour room: Eclampsia room is not available. Medical Education Unit: No orientation programme is conducted. No member of MEU has undergone advanced training course. Central photography Section: Although it is claimed that the staff is available, the list of available staff is not provided. Students' Hostels: Recreation rooms are not furnished. Indoor games are not pri ided. Residents' Hostel: Female Residents' Hostel is closed without use. -2- In view of above, the Executive Committee of the Council decided to recommend to the Central govt not to renew the permission for admission of 4th batch of 150 MBBS students at Pacific Institute of Medical Sciences, Umarda, Udaipur, Rajasthan under Sai Tirupati University Udaipur u/s 10 A of 1MC Act, 1956 for the academic year 2018-19 and further decided to apply clause 8(3)(1)(b) of the Establishment of Medical College Regulation (Amendment),2010(Part II), dated 16th April, 2010 and amended on 18th March, 2016 provides as under:- "8(3)(1) (b) Colleges in the stage from III renewal (Le. Admission of fourth batch) till recognition of the institute for award of MBBS degree If it is observed during any inspection of the institute that the deficiency of teaching faculty and/or Residents is more than 20% and/or bed occupancy is <65 %, compliance of rectification of deficiencies from such an institute will not be considered for renewal of permission in that Academic year" Whereas, as per Section 10A (4) of Indian Medical Council (IMC) Act, 1956, the Institute was granted hearing on 29.11.2017 in the Ministry to present the case of the Institute vis-à-vis disapproval letter of the MCI; Whereas representative(s) of the Institute appeared before the Hearing Committee constituted for the purpose in the Ministry and made submissions in the light of recommendation of MCI; Whereas the Hearing Committee, after considering the submissions/ compliance furnished by the Institute, observed as under:- "High order deficiency of faculty (43.5 %) and residents (83 %) has been pointed out It cannot be satisfactorily said that the twin deficiencies have been meted even as on date. The college could also not provide any real time information in respect of admission details of patients. In view of the above, the recommendation of MCI for disapproval may be accepted". A copy of the hearing committee report containing their observation is enclosed. Whereas the Institute has filed a D.B. Civil Writ Petition No. 3800/2018 in Rajasthan High Court, jodhpur and the Hon'ble Court vide order dated 21.03.2018 has directed to conduct compliance inspection for renewal of permission for 4th batch at Pacific Institute of Medical Sciences, Udaipur, Rajasthan (PIMS) for the academic year 2018-19; -3- Whereas Medical Council of India has filed Special Leave Petition (Civil) No. 8756/2018 before the Hon'ble Supreme Court of India against the order dated 21.03.2018 of Hon'ble High Court of Judicature for Rajasthan at Jodhpur. The Supreme Court set aside the order dated 21.03.2018 of High Court of Rajasthan at Jodhpur and asked the High Court to dispose off the matter, v , ot_o_ orbit—) cLi— 1 6 , k 2.0 l e- ; Whereas the Hon'ble High Court of Rajasthan in D.B. Civil Writ Petition No. 3800/2018 gave the following direction on 03.05.2018:- "Renotify for 16th May, 2018 and in the meanwhile it is expected that the Union of India shall take necessary decision. The decision be communicated to the petitioners" Whereas the Ministry vide letter dated 10.05.2018 forwarded a representation Iated 31.01.2018 of the college to MCI with a request to furnish comments/considered opinion i the matter. MCI vide letter dated 11.05.2018 intimated that in view of Regulation (8) (3) (1) (b) of the Establishment of Medical College Regulations 1999, the medical college is ineligible for compfi iance verification assessment and for renewal of permission for the academic year 2018-19. MCI rther explained that they have followed the Regulations in respect of all Private Medical Colleges without any deviation and informed that the college is not eligible for renewal of permission for th year 2018-19; Now therefore, The Central Government, after considering the recommendation dated 31.10.2017 of MCI, recommendation of the Hearing Committee and reply dated 11.05.2018 of MCI, has decided not to renew the permission for admission of 4th batch of 150 MBBS students at Pacific Institute of Medical Sciences, Udaipur, Rajasthan (PIMS) for the academic year 2018-19.
