This consolidated monthly report is presented to the Commissioners at your third meeting each month. If you have any questions, please advise the County Administrator at the meeting and he will ask the affected department head(s) to be present at the first meeting of the following month to address those questions. If you have no questions, this item can be received and filed.

Appraiser

October - December 2017

 Real Estate - On-site reviews • Sales of improved properties – 115 • Required 17% Review of Residential, Commercial & Ag parcels Urban: 174 Rural: 85 • Review of new or removed structures Urban: 335 Rural: 106

 Real Estate • Processed 425 transfers of real estate ownership during the 4th quarter 2017. 158 of these transfers included a monetary exchange. • New homes started or completed in 2017: 46 (Compared to 53 in 2016) • New commercial structures started or completed in 2017: 32 (Compared to 35 in 2016)

Page 3 • Began the process of setting 2018 real estate values. • To verify current land use, 467 surveys were mailed to agricultural land owners, with 60% returned.

 Personal Property o Finalized 2017 personal property values

 Oil • Processed Low Production Exemption BOTA orders for tax years 2015-2017, resulting in 94 abatements with a total valuation decrease of $651,446 and a total of $63,592 in tax rebates.

 Miscellaneous • Started the process of scanning 1982-1996 real estate sales documents • Appraiser Lisa Ree was sworn in as the Kansas County Appraiser’s Association President-Elect • Received delivery of 2018 Tahoe • Filled Appraiser I position that was vacated in November

Health Department

See Attachment 3 for table. In addition to the various services listed on the Health Department’s Report for the month of December, the Health Service Administration and staff also completed the following:

Epidemiology: Administration and Nursing Staff investigated 5 cases of reportable diseases as assigned by the Kansas Department of Health and Environment. These cases included: • Hep B 1 case • Hep C 1 case • TB 3 cases

Clinics: Several Community Blood Pressure clinics were held on Dec 6, 7, and 12.

A Community Pneumonia and Prevnar Clinic was conducted Dec 19 at the Hays Good Samaritan Center. 2

Dec 5 Carla Hearld, Chief Health Nurse, attended a leadership team meeting with Phillip Smith-Hanes, County Administrator. Laura Leiker, Administrative Assistant, and Carla Hearld, Chief Health Nurse, attended a WIC Nutrition Action Plan meeting in Stockton, KS. Eunice Dillinger, Public Health Billing Coordinator, attended a meeting with G&J Billing.

Dec 7 Laura Leiker, Administrative Assistant, attended a Healthcare Coalition meeting.

OTHER: Department employees utilized 198 hours ($2,259.33) of benefit time in December.

Throughout December, Bill Ring, Public Works Director met with Phillip Smith-Hanes, County Administrator on Road & Bridge, Environmental, Noxious Weed, and Solid Waste/Landfill divisions activities and projects along with several other short meetings throughout the month.

Bill met with the 4 Divisions supervisors and staff within Public Works to discuss current projects and activities for monthly scheduling departments operations during December.

December 1st – Bill, Curt Hoffman, and Dan Randa interviewed possible candidate for mechanic position.

December 12th – Bill, Dave Hoffman, and Chuck McGinnis attended Bridge 101 class in Salina, KS.

December 12th – Met with Phillip Smith-Hanes for preparation of Resolution to NW Kansas Solid Waste Authority for the Landfill/Solid Waste. Resolution will need approval by the Commission.

December 12th – Met with Rick Rupp to review Union Payroll implementation for accuracy.

December 13th – Bill and Curt Hoffman met with landowner regarding cleaning out a cattle guard on Riverview Road and addressed concerns property owner had regarding right-of- way.

December 13th – Bill attended a Kiwanis luncheon.

SUGGESTED MOTION LANGUAGE: I move that the Commission accept the bid from Nex-Tech in the amount of $33,600 for the installation of Fiber Optic cabling from the Emergency Services building to the new County Health Office located at 2507 Canterbury.

DISCUSSION: When Ellis County began the building and renovation projects a few years ago, the wise decision was made to connect its primary facilities with Fiber Optics. This decision made it possible to provide sustainable, high-speed connectivity to all of its core facilities within the city limits. For obvious financial reasons, the smaller, “ancillary” facilities such as Ellis/Victoria EMS were not included. The County Health office was one of those core facilities and when its functions are moved to the new location, a high-speed connection will be needed there as well.

FINANCIAL IMPACT: Bids were solicited from local providers, Eagle Communications and Nex-Tech. Eagle’s bid was $40,000 with a $250 monthly maintenance fee. Nex-Tech’s bid was $33,600 with no recurring fees. There is $55,712 in the General Fund in 2018 for the construction project. This amount will also need to cover costs for access controls, which are less than $10,000.

DISCUSSION: The attached letter, dated December 20, 2017, was sent to your Commission by the Kansas Legislative Policy Group (KLPG) and requests a contribution of funds toward legal costs.

The KLPG letter references eleven counties that are appealing Small Claims hearing decisions regarding Commercial Salt Water Disposal (SWD) valuations. The Small Claims officer deviated from the method of valuation set forth in the state’s Oil & Gas guide, lowering the lease values. These counties have chosen to appeal the Small Claims decision to the Board of Tax Appeals (BOTA).

The Oil & Gas Guide provides the method to value these type of leases based upon an income value. The taxpayer representative disagrees with this method and believes counties are overvaluing Commercial SWD wells. The representative is pursuing removing these wells from taxation altogether.

Ellis County currently has three 2016 Commercial SWD cases pending with BOTA. The total assessed valuation for these leases is $56,099, generating $4,653 in taxes. The total assessed value for the 56 Commercial SWD leases in Ellis County for 2016 was $348,361. These leases generated tax revenue of $33,566.

The issue relates to commercial saltwater disposal wells and the Department of Revenue's Oil and Gas Appraisal Guide used to Gave determine the classification and value of the wells. The Haskell arguments also reference allowable expenses and inconsistencies within the guide on Hodge man taxation. Procedurally, KLPG is unable to directly intervene in the case because the appeal is under a quick timeframe. Not with standing that, because this is a significant potentially precedent setting case and the decision will likely affect many counties, the KLPG executive committee encourages KLPG member counties to consider making a contribution toward the cost of defending the appeal. According to the oil and gas support policy the minimum contribution is $300. Because an adverse decision in this case could negatively impact your county there is justification in making a donation to offset the costs.

If you are concerned the case may have impact to your community and your commission is willing to assist in this legal effmi please let KLPG know. You should also provide KLPG with the level of financial assistance your county can conm1it.

Page 75 KLPG Oil and Gas Support Policy

The purpose of establishing a KLPG Oil and Gas Committee is to provide KLPG member counties with a process to review and identify oil and gas valuation protest cases, filed for appeal with the Kansas Board of Tax Appeals, in which the issues are not supported by the Oil and Gas Guide and/or existing case law. The Committee will review cases, which contain certain legal issues that could negatively impact KLPG member counties and are suitable for support and submit that recommendation to the KLPG Executive Committee.

Recommendations:

KLPG Oil and Gas Committee would be composed of 5 members: • 1 member of the KLPG Executive Committee • 2 KLPG member delegates or alternate delegates • 2 individuals who serve as an appraiser for a KLPG member county

There may be ex-officio members of the Committee • KLPG executive director • A petroleum engineer • Legal counsel • Others as required

KLPG Oil and Gas Committee will develop and conduct meetings with participating counties to provide their county appraisers and county attorneys with the knowledge of what information is necessary to fully evaluate an appeal.

KLPG will encourage member counties to: (1) have its appraisers submit significant valuation issues to the KLPG Oil and Gas Committee which their appraisers believe are not supported by the Oil and Gas Guide and/or existing case law, (2) submit to the Oil and Gas Committee Small Claims decisions and/or Board of Tax Appeals decisions that are believed not to be supported by the Guide and/or existing case law.

A county submitting an oil and gas valuation case for review would be responsible to pay the legal costs attributable to the Committee review. Cost of review is estimated not to exceed $1,500 per case. An attorney will review each case submitted, gather additional facts as needed, set forth the legal issue(s) related to the appeal and provide the Oil and Gas Committee with an opinion of whether the issue(s) are such that the Oil and Gas Committee should consider recommending involvement in the appeal.

KLPG Oil and Gas Committee will consider and evaluate the cost and benefit of identifying and retaining the services of a petroleum engineer to assist in evaluating oil and gas valuation cases. The petroleum engineer would provide expert testimony as needed at each stage of the appeal process to member Counties.

Page 76 The KLPG Oil and Gas Committee will meet as necessary to review in a timely manner, oil and gas valuation cases and determine if the issue significantly impacts some or all of the members. The KLPG Executive Committee will make the final determination of whether the issue(s) presented are common to all member counties and whether KLPG should provide support during the appeal process, including participating in the appeal by making available an expert and/or participating in the appeal by filing an amicus brief. If the issue presented impacts some but not all the counties, the Executive Committee will determine if the impacted counties desire to proceed with amicus and expert support with costs allocated to those counties.

A special fund to track income and expenditures for the Oil and Gas Support Policy activities will be created. The KLPG Executive Committee recommends that separate assessment be made to KLPG member counties participating in the Oil and Gas Support Policy activity.

The KLPG Executive Committee will annually submit a recommendation to KLPG membership to fund the cost of this project. Assessments to cover the annual costs will be made on a pro-rata basis, determined by county mineral valuation, with minimum assessment of $300 per participating county.

It would not be mandatory for all KLPG member counties to participate in the special fund.

Currently the valuation protests concern oil production, it is anticipated primarily oil producing counties would initially participate, but is not limited to their participation only.

RESOLUTION OF THE BOARD OF ELLIS COUNTY COMMISSIONERS

WHEREAS, Ellis County is required under K.S.A. 75-1120a (a) to utilize accounting and fiscal procedures in preparation of financial statements and financial reports that conform to generally accepted accounting principles as promulgated by the Government Accounting Standards Board (GASB) and the American Institute of Certified Public Accountants (AICPA) and adopted by rules and regulations of the Director of Accounts and Reports, and

WHEREAS, Ellis County is permitted under K.S.A. 75-1120a (c) (1) to request the Director of Accounts and Reports to waive the requirements under K.S.A. 75-1120a (a) and the Director of Accounts and Reports shall grant the waiver to the extent requested by the governing body, and

WHEREAS, the Ellis County Commission has determined that financial statements and financial reports required under K.S.A. 75-1120a (a) are not relevant to the requirements of the cash-basis and budget laws of this state and are of no significant value to the County Commission or the members of the general public of the County, and

WHEREAS, Ellis County does not have any revenue bond ordinances or resolutions or other ordinances of the County that require financial statements and financial reports to be prepared in conformity with K.S.A. 75-1120a (a) for the year ended December 31, 2018,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ELLIS COUNTY, KANSAS, that a request be made to the Director of Accounts and Reports to waive the requirements of K.S.A. 75-1120a (a) as they apply to Ellis County for the year ended December 31, 2018, and

BE IT FURTHER RESOLVED that the Board of Ellis County Commissioners shall cause the financial statements and financial reports of Ellis County to be prepared on the basis of cash receipts and disbursements as adjusted to show compliance with the cash-basis and budget laws of the State.

THIS AGREEMENT, made and entered into this 1st day of January, 2018 by and between the BOARD OF COUNTY COMMISSIONERS OF ELLIS COUNTY, KANSAS, hereinafter called Cmmnissioners, and DEVELOPMENTAL SERVICES OF NORTHWEST KANSAS, INC., HAYS, KANSAS, hereinafter called DSNWK, INC.

WITNESSETH:

WHEREAS, the Commissioners are desirous of providing services for individuals with intellectual/developmental disabilities from Ellis County and have budgeted $240,000 for providing such services, but have determined that it is more practicable to contract with the designated non-profit corporations for such services for individuals with intellectual/developmental disabilities from said county, and

WHEREAS, the non-profit corporation DSNWK, Inc. and its Board of Directors are approved and designated by the Commissioners as the "Cmmnunity Facility for the Mentally Retarded" and the "Cotmnunity Developmental Disability Organization" pursuant to KSA 19-4001 through 19-4015 and the Developmental Disabilities Reform Act of 1995, and

WHEREAS, DSNWK, Inc. is licensed and approved by the Kansas Department for Aging and Disability Services,

NOW THEREFORE, the Commissioners hereby contract with DSNWK, Inc. for services for individuals with intellectual/developmental disabilities fi:om said county, and DSNWK, Inc. agrees to supply said services upon the following terms and conditions, to-wit:

1. Term. The term of this agreement shall be for one (1) year cmmnencing January 1, 2018, and ending December 31,2018.

2. Consideration. The commissioners agree to budget $240,000 for the purpose of providing revenue to pay for services for individuals with intellectual/developmental disabilities from said county. Upon receipt of such tax money, the Commissioners shall pay a designated amount of the mill levy to the Board ofDirectors ofDSNWK, Inc. and the Board of Directors ofDSNWK, Inc. are authorized to receive and expend such moneys to provide services for individuals with intellectual/developmental disabilities from said county.

3. Services. The Cmmnissioners shall evaluate and purchase services from DSNWK, Inc. for adults and for preschool children, over the age of 3, for individuals with intellectual/developmental disabilities from Ellis County, Kansas, at established locations ofDSNWK, Inc., and at such other places as DSNWK, Inc. may hereinafter determine, including all such services which are cmrently being provided by DSNWK, Inc. and such additional services as are made available within the period of this agreement.

Page 80 4. Reports. DSNWK, Inc. shall upon termination of this agreement, provide the Commissioners with an annual report. The Board of Directors ofDSNWK, Inc. shall report to the Kansas Department for Aging and Disability Services in such form as may be required on its activities for individuals with intellectual/developmental disabilities.

5. Charges. DSNWK, Inc. further agrees that it may not deny services to anyone because of inability to pay for services with funds from Ellis County, Kansas, but that DSNWK, Inc. may establish a schedule of charges for services of those who are financially able to pay for such services.

6. Pursuant to DSNWK's contract with the Kansas Department for Aging and Disability Services, in the event of a reduction in State funds, DSNWK may initiate service reduction or eliminate services for individuals who are patiially funded with county funds.

It is agreed and understood by and between the patiies that this agreement is made and entered into pursuant to and in accordance with the provision ofK.S.A. 1974 Supp. 19-4001 et. seq. and the Developmental Disabilities Reform Act of 1995.
