[O.C. 568/2012] 31 october 2012 On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that: (a) the Minister of Environment is authorized to withdraw the land identified below from the “Northern Provincial Forest”; and (b) the Minister of Environment is authorized to sell the provincial land identified below, for continued commercial purposes (restaurant and gas station), to Laurie Thorsen of Christopher Lake, Saskatchewan, for the total sale price of $50,000 and to execute any required agreements related to the sale, on behalf of the Government of Saskatchewan:

The Milk Marketing Plan Regulations – MILK PRODUCTION AND FACILITY STANDARDS Order No. 18/12. The SASKATCHEWAN MILK MARKETING BOARD, pursuant to the provisions of The Milk Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 No person shall supply milk to a licensed processor unless that person holds a milk production facility licence issued pursuant to this Order. 2 A person who desires to be licensed pursuant to this Order shall apply to, and in the form issued by, the Board and shall supply any additional information that the Board may require. 3 When an application has been submitted in compliance with the Plan and this Order, the Board may issue a milk production facility licence to the applicant conditional on producing milk in accordance with section 32 of this Order and meeting all other requirements respecting milk production facilities, equipment, and health and sanitation. 4 milk production facility licenses are to be in the form issued by the Board and signed by the Chairperson or designate. 5 No milk production facility licence is transferable. 6 Every milk production facility licence, unless previously cancelled, expires on December 31 of the year for which it is issued. 7 Every licensee shall comply with the Act, Plan, any Order of the Board, and any other Acts or regulations of Saskatchewan. 8 The Board may refuse an application for a milk production facility licence or the renewal of such licence where the licensed producer has failed to comply with any enactment mentioned in section 7. 9 Every licensee shall ensure that his or her milk production facility licence is displayed at all times in a conspicuous place in the milk house. 10 Where, in the opinion of the Board, a licensee has failed to comply with any provision of this Order, the Board may, after giving the licensee the opportunity to be heard, suspend the milk production facility licence. 11 Notwithstanding section 10, the Board, or a Board designate in the case of clause (b) may, without giving the licensee an opportunity to be heard where the Board or Board designate, as the case may be, is of the opinion that to do so is necessary in the public interest for reasons of public health: (a) suspend a milk production facility licence; and (b) suspend the pick-up of milk from a milk production facility until satisfactory evidence is furnished that the milk of the licensed producer is no longer prohibited pursuant to section 10 or that meets the standards set out in section 32. 12 Where a milk production facility licence has been suspended pursuant to sections 10 or 11: (a) notice of suspension in writing is to be given by prepaid registered mail to the licensee; and (b) in the case of a suspension pursuant to section 11, the licensee is to be given an opportunity to be heard within 15 days of receiving the notice of suspension. 13 A licensee is deemed to have received the notice given pursuant to section 12 on the fifth day after the day of mailing. 2238 THE SASKATCHEWAN GAZETTE, november 9, 2012

14 on receiving a notice of suspension, the licensee shall immediately surrender the milk production facility licence to the Board. 15 The Board may reinstate a suspended milk production facility licence if the licensee, within 30 days of receiving the notice of his or her suspension, furnishes written evidence to the satisfaction of the Board that he or she can comply with the provisions of this Order on account of which the milk production facility licence was suspended. 16 Where a milk production facility licence has been reinstated pursuant to section 15, notice in writing is to be given to the licensee that his or her milk production facility licence has been removed from suspension, together with reinstatement of the milk production facility licence. 17 Where the evidence mentioned in section 15 has not been provided within the 30 days mentioned in that section, the Board may cancel the licence. 18 Where a milk production facility licence has been cancelled pursuant to section 17, notice of the cancellation is to be given to the licensee by prepaid registered mail. 19 A licensee is deemed to have received the notice given pursuant to section 18 on the fifth day after the day of mailing. 20 A licensed producer who wishes to design, construct or renovate a dairy barn or milk house shall first obtain the written approval of the Board. 21 The Board may require a licensed producer mentioned in section 20 to provide the Board with any information that the Board needs in order to decide whether to grant the approval. 22 The design, construction or renovation must meet the standards prescribed in the most recent edition of: (a) The Canadian Farm Building Code issued by the Associate Committee on the National Building Code, National Research Council of Canada; and (b) The Canadian Farm Buildings Handbook published by Agriculture and Agri-Food Canada. 23 A licensed producer shall ensure that the milking and milk handling equipment meets all applicable 3-A sanitary standards for design, fabrication and installation. 24 Unless otherwise approved by the Board, a licensed producer: (a) shall have not more than one farm bulk milk tank; and (b) shall have a capacity sufficient to hold and cool milk produced in three consecutive days at peak production. 25 A licensed producer shall ensure that: (a) the farm bulk milk tank meets all applicable 3-A sanitary standards; (b) the farm bulk milk tank is provided with lugs on which to place a spirit leveling device; and (c) a farm bulk milk tank manufactured after January 1, 1996, has a recording thermometer or means for installing a recording thermometer. 26 A licensed producer shall ensure that: (a) the measuring rod or device and the conversion chart are accurate; (b) the measuring rod and calibration charts bear the same serial number as the serial number on the farm bulk milk tank; and (c) the farm bulk milk tank is calibrated at least once every five years. 27 No person shall: (a) except with the prior written approval of the Board, permit animals other than those of the bovine species to be stabled in a dairy barn; (b) permit animals other than females of the bovine species to enter a milking parlour; or (c) permit animals of any species to enter a milk house or milk room. 28 A licensed producer shall ensure that: (a) the dairy production facility is clean and sanitary and meets with the approval of the Board; (b) the dairy barn is managed in such a way as to keep the fly, insect and pest population at a minimal level; (c) the dairy barn is kept clean, and that its walls and ceiling are painted or white-washed at regular intervals; (d) the milking parlour is kept clean, the walls and ceiling are painted at regular intervals, and the floor is flushed with water after each milking; (e) the milk house and milk room are kept painted, clean and tidy; (f) the water supply used for all dairy purposes is of adequate quantity and potable quality; (g) the equipment used for production and handling of milk is cleaned after each use, sanitized before each milking, stored in a sanitary manner and kept in good condition; (h) milking is done under clean and sanitary conditions and that no milking is done other than in a stanchion barn, tie stall barn or milking parlour; (i) freshly drawn milk is cooled immediately and maintained at a temperature greater than 0° and less than, or equal to, 4° Celsius in accordance with 3-A sanitary standards; and (k) persons who do the milking or who enter the milk house: (i) are clean; (ii) keep their hands clean while engaged in work; (iii) wear clean and washable outer garments; (iv) refrain from any unsanitary practice that may result in contamination of milk or equipment; and (v) are free of any communicable disease that is transmissible through milk and that the licensed producer could reasonably be expected to be aware of. 29 Any licensed producer on whose milk production facility any communicable disease that is transmissible through milk occurs, or who suspects that a dairy worker has contracted a communicable disease of that nature or has become a carrier, shall promptly notify the Board. 30 No person shall sell, supply or offer for sale any milk: (a) that contains antibiotics, insecticides, herbicides, colouring matter, blood, preservatives, added water or anything foreign to milk, or that is of disagreeable odour or taste; (b) that is produced during the period beginning 15 days prior to and ending three days after parturition; or (c) that is obtained from an animal that shows evidence or visible signs of disease transmissible to humans by milk. 2240 THE SASKATCHEWAN GAZETTE, november 9, 2012

31 A licence holder of a milk production facility licence shall permit a dairy inspector, or any person authorized by the Board, to collect samples of milk, and shall provide all reasonable co-operation to a dairy inspector or authorized person. 32 A licensed producer supplying milk to a licensed processor shall ensure that all milk: (a) tests negative for veterinary drug residues and inhibitory substances; (b) has a bacteria count not exceeding: (i) 50,000 colony forming units per millilitre; or (ii) 121,000 individual bacteria per millilitre; (c) has a somatic cell count not exceeding 400,000 cells per millilitre; and (d) has a maximum freezing point value of -0.525° Hortvet. 33 Where the milk of a licensed producer does not meet the standards set out in clause 32(a): (a) an infraction is committed and the licensed producer is subject to the price differential set out in section 34 for the full month in which the infraction occurred for all the milk supplied in that month; and (b) the licensed producer is not permitted to market milk until a subsequent farm bulk milk tank sample tests negative for veterinary drug residues or inhibitory substances. 34 The price differential is: (a) 11% below the blend price for the first infraction incurred within any 12-month period; (b) 15% below the blend price for the second infraction incurred within any 12-month period; (c) 23% below the blend price for the third infraction incurred within any 12-month period; and (d) 31% below the blend price for the fourth or a subsequent infraction incurred within any 12-month period. 35 Where the milk of a licensed producer does not meet the standards set out in clause 32(b) or (d) in two of any three consecutive tests, an infraction is committed and the licensed producer is subject to the price differential set out in section 37 for the full month in which the infraction occurred for all milk supplied in that month. 36 Where the milk of a licensed producer does not meet the standards set out in clause 32(c) in three of any five consecutive tests, an infraction is committed and the licensed producer is subject to the price differential set out in section 37 for the full month in which the infraction occurred for all milk supplied in that month. 37 The price differential is: (a) 2% below the blend price for the first infraction incurred within any 12-month period; (b) 4% below the blend price for the second infraction incurred within any 12-month period; (c) 8% below the blend price for the third infraction incurred within any 12-month period; (d) 10% below the blend price for the fourth infraction incurred within any 12-month period; and (e) 17% below the blend price for the fifth or a subsequent infraction incurred within any 12-month period. 38 When an infraction is committed in accordance with clause 32(b), (c) or (d) as provided for in sections 35, 36 and 37, the next test for these respective clauses constitutes the commencement of a new consecutive series of tests for that factor for the purposes of those sections. 39 Where, in the opinion of the Board, a person who is subject to this Order is in default of any requirement imposed by this Order, the Board may order the person in default to remedy the default within a specified time, and the person to whom the order is made shall comply with that order. 40 No licensed producer shall vary the butterfat content of milk obtained from a milking animal before the milk is delivered pursuant to any applicable Orders of the Board. 41 This Order takes effect January 1, 2013. 42 order No. 07/10 is hereby wholly revoked. 43 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. MILK PRICING Order No. 19/12. The SASKATCHEWAN MILK MARKETING BOARD, pursuant to the provisions of The Milk Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 In this Order, licensed processor utilization of milk, partially skimmed, skim milk, creams, concentrated milk or a mix for milk products are listed in the following classes: (a) “class 1(a)” means milk and milk beverages, partly skimmed or skimmed, whether or not treated for lactose intolerance, whether flavoured or not, with or without vitamins or minerals added, for retail and food service (egg nog, cordials, cultured milk, concentrated milk to be reconstituted as fluid milk), and all types of milk shake mixes for retail sale; (b) “class 1(b)” means all types of cream with a butterfat content not less than 5% for retail and food service; (c) “class 1(b)ii” means fresh cream with a butterfat content of 32% and higher used to make fresh baked goods which are not eligible for a Class 5 permit – any utilization of this class would require a Class 1(b)ii permit issued by the Canadian Dairy Commission; (d) “class 1(c)” means new 1(a) and 1(b) fluid products for retail and food service as approved by the provincial authorities during an introductory period; (e) “class 1(d)” means 1(a) and 1(b) fluid products marketed outside the ten signatory provinces but within Canadian boundaries (e.g. Yukon, NWT, Nunavut and cruise ships); (f) “class 2(a)” means all types of yogurts including yogurt beverages, Kefir and Lassi, excluding frozen yogurts; (g) “class 2(b)” means all types of ice cream, ice cream mix, whether frozen or not, other frozen dairy products including frozen yogurts, all types of sour cream, fudge, puddings, soup mixes, caffeinate and Indian sweets; (h) “class 3(a)” means all cheeses other than those identified in class 3(b) and class 3(c); (i) “class 3(b)” means all types of cheddar cheese, stirred curd, cream cheese, creamy cheese bases (cheese mixes), cheddar and cheddar-type cheeses sold fresh. A cheese of descriptive nomenclature will be recognized as a cheddar-type cheese for the purposes of classification if it is a firm or semi-soft, unripened, unwashed curd cheese, with a minimum milk fat content of 25% and a maximum moisture content of 45%; 2242 THE SASKATCHEWAN GAZETTE, november 9, 2012

(j) “class 3(c)” means all types of mozzarella, including but not limited to part-skim mozzarella, part-skim pizza mozzarella and pizza mozzarella, asiago, brick, Canadian-style munster (muenster), colby, farmer, feta, gouda, havarti, jack, monterey jack, parmesan and swiss; (k) “class 4(a)” means all types of butter and butteroil, all types of powder, concentrated milk as an ingredient in the food industry used to make other milk products, all other products not elsewhere stated; (l) “class 4(a)1” means milk components for the manufacture of rennet casein (dry or curd), milk protein concentrate (dry or liquid) or skim milk (dry or liquid) to be used in the manufacture of non-standardized final products in the processed cheese category; (m) “class 4(b)” means concentrated milk for retail sale whether sweetened or not; (n) “class 4(c)” means new industrial products as approved by provincial authorities for an introductory period; (o) “class 4(d)” means inventories and explained losses (ex: dumps, fluid returns, dead vats, etc.); (p) “class 4(d)i” means interprovincial milk or cream movement; (q) “class 4(m)” means milk components for marginal markets as established from time to time by the Canadian Milk Supply Management Committee (CMSMC); (r) “class 5(a)” means cheese used as ingredients for further processing for the domestic and export markets; (s) “class 5(b)” means all other milk products used as ingredients for further processing for the domestic and export markets; (t) “class 5(c)” means milk products used as ingredients for the confectionary sector destined for domestic and export markets; and (u) “class 5(d)” means planned exports and other exports approved by the CMSMC, the total of which shall not exceed Canada’s WTO commitments. 2 The prices to be paid per hectolitre of milk, per kilogram of butterfat, protein or other solids, by licensed processors to the Board, are those prices set forth in the Board’s published milk prices that the Board may establish from time to time in accordance with: (a) Western Milk Pool Coordinating Committee prices established for classes 1(a), 1(b), 1(d), plus a milk price add-on of $1.52 per hectolitre of milk for each of those classes; (b) Western Milk Pool Innovation Program prices established for class 1(c), plus a milk price add-on of $1.52 per hectolitre; (c) Western Milk Pool Coordinating Committee prices established for classes 2(a), 2(b), 3(a), 3(b), 3(c), 4(a), 4(b), 4(d) and 4(d)i; (d) Western Milk Pool Innovation Program prices established for class 4(c); (e) Canadian Dairy Commission prices established for classes 1(b)ii, 4(m), 5(a), 5(b), 5(c) and 5(d); and (f) Canadian Milk Supply Management Committee – Market Committee prices established for class 4(a)1. 3 The Board’s published milk prices shall be issued in the form of a milk price directive which includes the class prices established in accordance with this Order. 4 The Board shall post the milk price directive mentioned in section 4 on its website within two business days of a price change. All material for publication in The Saskatchewan Gazette must be submitted electronically (MS Word or WordPerfect) accompanied by a signed hard copy to the Office of the Queen’s Printer, Saskatchewan Justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.

Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”. The minimum charge for publication of notices not specified below is $16.00 for each notice, which sum shall accompany the material when forwarded for publication.
