The ultimate decision maker for the NBA is the Commissioner, Adam Silver, whose job is to represent the interests of the league and more specifically the team owners, while the ultimate decision maker for the players at the bargaining table is the National Basketball Players Association (NBPA), currently led by Michele Roberts. In the current system of negotiations, the NBA and the NBPA meet to negotiate and make changes to their collective bargaining agreement as it comes close to expiration. This paper will examine the 1976 ABA- NBA merger, and the resulting impact that the joining of these two leagues has had. This paper will utilize language from the current collective bargaining agreement, as well as language from previous iterations agreed upon by both the NBA and NBPA, as well information from other professional sports leagues agreements and accounts from relevant parties involved.

Prof. Dr. Owen Miller August 2020 Professional basketball players in the National Basketball Association (NBA) founded the National Basketball Players Association (NBPA) in 1954. The first collective act of professional basketball players under the NBPA was a threat to strike just before the 1964 NBA All-Star Game. Eventually, they had achieved to get the pension plan that they hoped for many years. Larry Fleisher, the general counsel of the NBPA, and Oscar Robertson, the president of the NBPA, were determined to abolish the reserve clause in basketball. The reserve clause restrained the free movement of professional athletes for many years, and NBA players were the ones who established staunch struggle against it, in various ways, including litigation. The NBPA filed a class-action lawsuit, also known as the Oscar Robertson lawsuit, against the merger between two basketball leagues, the NBA, and the ABA (American Basketball Association) in April 1970.

    The San Diego Clippers: A Dream Ends Travis Degheri With the departure of the San Diego Clippers National Basketball Associa- tion (NBA) team, San Diego’s dream of being a part of the NBA abruptly ended. The San Diego Rockets had been sold to Houston in 1971.1 When the ill-fated ABA team—The San Diego Conquistadors—failed in 1975, they were replaced with high hopes by the recently formed NBA expansion team, the Buffalo Braves, soon to become known as the San Diego Clippers.2 San Diego basketball fans once again flocked to buy tickets to see famous NBA players in action. Within six years, local residents saw their dreams end once again, this time with little understanding of what took place to lose the team to Los Angeles. Today’s Clippers originated as the Buffalo Braves in 1970 as one of three expan- sion teams entering the NBA. The others were the Portland Trail Blazers and the Cleveland Cavaliers, leaving the Buffalo Braves with the need to prove themselves on the court and establish their team as a prominent franchise.3 After a disappoint- ing first few seasons, the Buffalo Braves were eventually able to take second place in the Atlantic conference by winning three of their seven playoff games.4 By the end of their 1977-78 season, however, the Buffalo Braves’ luck seemed to be wear- ing out as they finished the season in fourth place with a disappointing record of 27 wins and 55 losses.5 Despite this poor showing on the court, the NBA sent a proposal to the Buffalo Braves owner, John Y.

    SPORTS & ENTERTAINMENT LAW JOURNAL ARIZONA STATE UNIVERSITY VOLUME 10 SPRING 2021 ISSUE 2 SACRIFICE FLY: ADVANCING MLB OWNERSHIP POLICIES INTO THE POST-COVID ERA AT THE EXPENSE OF THE ANTITRUST EXEMPTION CHASE BROWNDORF¥ ABSTRACT In Fall 2019, Major League Baseball (MLB) announced it would begin to allow private equity funds to acquire minority ownership stakes in its franchises. This announcement was met with reserved optimism by proponents of more public ownership opportunities in American sports. In the year since, a once-in-a- century pandemic has upended the United States economy, sparing none, including the sports community. As other segments of the economy have seen publicly-traded special purpose acquisition companies (or SPACs) explode in prevalence, the COVID-19 pandemic has caused SPACs to wade into the waters of professional sports. The SPAC model will undoubtedly be appealing to those seeking to invest in MLB franchises under the league’s new policy but could also have serious repercussions on MLB’s continued exemption under federal antitrust laws. An assault could, in theory, come via a federal courts system already skeptical of the exemption or via Congress. This Note explores implications these changes may have to existing ownership policies.
