NEW YORK STATE LEGISLATURE July 30, 2019 Carmine Di Sibio Chairman and CEO Ernst & Young- EY Five Times Square New York NY 10036 Dear Chairman Di Sibio, We write to express our disappointment with the efforts by Ernst & Young to deny your former partner, Karen Ward, a reasonable opportunity to have her claims of sexual harassment and gender discrimination heard in a court of law. By limiting her recourse to forced arbitration at a personal cost of hundreds of thousands of dollars, you are effectively silencing her and sending a message to your other employees that their claims will not be given a fair hearing and that they will have to pay exorbitant costs to simply have their claims heard. This case is a particularly egregious example of the abuses that led New York State to pass legislation banning such forced arbitration agreements in cases of harassment and discrimination in the first place. New York State is not alone in rejecting forced arbitration in cases of harassment. The private sector has also recognized that these requirements are vestiges of a past where sexual misconduct in the workplace was tolerated or ignored. Companies such as Microsoft, Uber, Google, Facebook, Lyft, Slack, Airbnb, Skadden, Arps, Slate, Meagher & Flom LLP, Sidley Austin, Kirkland & Ellis, and Orrick, Herrington & Sutcliffe LLP have voluntarily dropped mandatory arbitration requirements. It is disturbing that Ernst & Young is unwilling to recognize the negative impact arbitration requirements have on the ability of workers to get a fair hearing and the chilling effect these agreements can have on reporting. While the problems with forced arbitration are clear, the facts in this case are even more troubling.

Gunther Chair, Assembly Committee on Mental Health Legislative Office Building, Room 826 Albany, NY 12248 Hon. Didi Barrett Chair, Assembly Committee on Veterans’ Affairs Legislative Office Building, Room 841 Albany, NY 12248 Dear Speaker Heastie, Chairwomen Gunther and Barrett: We write to request that the Majority Conference immediately release all available funding for the Joseph P. Dwyer Veterans Peer-to-Peer Support Program. As you are aware, more than $4.5 million was allocated in the 2020-2021 Enacted Budget for this critical initiative. Continuing to delay the distribution of these resources threatens one of the most relied-upon and successful programs serving New York’s veterans. We hope you agree, after all they have given to us, our veteran community deserves all the care, attention and assistance we can provide. The financial impacts of COVID-19 on our state have been devastating. While we appreciate the need for prudent spending during these times, the pandemic has also taken a severe toll on individuals struggling with mental illness or post-traumatic stress. Veterans involved in the Dwyer Peer-to-Peer Program depend greatly on these critical services for their personal health and well- being, employment and housing assistance, and necessary recovery. Last year members of the Assembly Minority Conference toured the state and talked to veterans about looming budget and program cuts, and the impacts such actions would have on critical services. Through collaborative efforts, millions in proposed cuts to the Joseph P.

This report describes the legislative actions and major issues considered by the Committee and sets forth our goals for future legislative sessions. The Committee addressed several important issues this year including a ban on single-use plastic bags, a prohibition on the use of 1,4-dioxane in certain products, a constitutional amendment establishing the right to clean drinking water, clean air and a healthful environment and funding for clean water infrastructure projects. Notably, the Committee’s commitment to addressing climate change culminated in the passage of the historic Climate Leadership and Community Protection Act. In addition, the Committee held hearings on climate change, recycling and the environmental footprint of colleges and universities in New York State. Under your leadership and with your continued support of the Committee's

2017 STATE ENVIRONMENTAL SCORECARD 240TH SESSION OF THE NEW YORK STATE LEGISLATURE NEW YORK LEAGUE OF CONSERVATION VOTERS nylcv.org/scorecard INTRODUCTION Since 1989, the New York League of Conservation Voters has been known for its work “electing for the environment,” lending our seal of approval through our endorsement process. We have also increasingly sought to provide objective, factual information about important environmental legislation and funding priorities. In order to improve continuity between these two aspects of our mission, NYLCV has decided to issue our inaugural State Legislative Environmental Scorecard this year. Every two years, we endorse candidates for the State Legislature after assessing their record on the environment and commitment to our priorities. However, we have found that our endorsement process alone is not adequate for holding legislators accountable during their terms Marcia Bystryn, President in office or for producing an objective, public record NYLCV and NYLCV Education Fund of support for the environment. Since 2003, we have issued an Environmental Scorecard for the this year, there was far more legislation that New York City Council that has been effective in renewed New York’s historical environmental elevating the visibility of our priorities, holding leadership by supporting renewable energy, council members accountable for their votes on protecting our water, preserving our land, cleaning the environment, and encouraging members to our air, and reducing waste. support pro-environment legislation. To take those efforts to the next level, we urge you to capitalize on a historic opportunity to address the root of a long-standing and worsening housing crisis impacting every American – but especially those in your respective constituencies. The current debate over a sweeping infrastructure investment package is the ideal environment to push for transformative housing policies that may have been considered impossible even just several months ago. As you well know, housing is both physical and social infrastructure, benefitting the families who are securely housed, as the communities in which it is built, and the economy through job and revenue creation. We write to encourage you to make bold change and a lasting impact by: 1) Establishing a housing safety net by providing Section 8 Housing Choice Vouchers to all eligible households; 2) Preserving public housing; and 3) Expanding affordable housing supply.

James Skoufis, Chair ■ Carl Heastie, Speaker A Message from the Chair... January 2018 Happy New Year! My name is James Skoufis and I am the new Chair of the Assembly Task Force on People with Disabilities. I was very recently appointed to this position following Assemblymember Didi Barrett’s move to chair the Committee on Libraries. James I’d like to offer my sincere appreciation to Assemblymember Barrett and her staff for all of their hard work on the issues affecting people with disabilities and for making Skoufis this transition seamless. I am extremely honored to have been offered this position – Chairperson it is one that I take very seriously. I have already begun reaching out to and meeting with key disability advocates to learn about the problems affecting New Yorkers with disabilities so that together we can pursue solutions. NYS Assembly Task Force on While new to this chairmanship, I am very quickly learning the priorities of New York’s disability community. Accessible housing, personal care attendant wages, People with employment for people with disabilities and several other issues will be at the Disabilities forefront in the 2018 legislative session. I anxiously await taking on these challenges alongside you. One of the items that I have repeatedly heard is that identifying accessible, Inside: affordable housing remains a challenge for people with disabilities who want to live independently in the community. Unfortunately, Assemblymember Lavine’s bill, Page 2 A.5950-A, was recently vetoed, which would have helped people with disabilities to remain in their own homes and out of nursing and adult homes.
