FOREWORD

The 13th Finance Commission recommended the State Governments for “Improvement of Statistical Systems at State and District levels” and one of its recommendations was to develop the National Business Register. Business Register is a list of establishments pursuing various economic activities relating to production/distribution of goods and services. It is an important source of information for statistical analysis of the business population and will serve the purpose of a frame for follow up surveys and Business Projects. Business Register has been taken-up as per the guidelines of Central Statistics Office, New Delhi. All establishments registered under the Companies Act, Factories Act, Shops and Commercial Establishments Act, Sikkim Excise Act, Societies Registration Act, Co-op Societies Act, Khadi Village Industries Board and Directorate of Industries have been considered for preparation of Business Register. The preparation of Business Register entailed the study of the Trade License registering system of the State wherein a number of incongruities were observed. Therefore, administrative process re-engineering was undertaken by the Registering Authorities which involved designing of a uniform trade license form, form for renewal, standardized BR number and so on. The State Business Register contains important parameters such as name and address of the establishment, number of workers, major economic activity of the establishment and registration numbers of the establishments with Registration Authorities. However, the information with respect to the total number of workers and establishments registered under Companies Act is under-reported as the digitization of records and the requisite data has not been collected by the Registering Authorities. Further, data on the number of establishments & number of workers could not be obtained from UD&HD(Mangan), UD&HD(Gyalshing) &ChumbungBAC(West district). Introduction The preparation of Business Register (BR) offers us an opportunity to develop a list of entrepreneurial units which will give us real-time information on all aspects of an enterprise/establishment engaged in economic activity. The development of such system will not only strengthen the State statistical system but will also add value to the enterprise registration system of the State.

In accordance with guidelines framed by CSO, MOSPI and taking into consideration the administrative system in the State, appropriate methodologies and strategies have been developed to stream line the existing system of issuing trade license in the State. The objective of revamping this system is to bring about uniformity and to collect and collate information in order to help develop a BR of all the registered enterprises/establishments with details of their location, name, type of activity, ownership, etc. on an annual basis.

Sikkim is a small hilly State in the Eastern Himalayas with formidable physical features. It is bound by the autonomous region of Tibet in the North, Bhutan in the East, Darjeeling district of West Bengal in the south and Nepal forming the western border of the State. The State of Sikkim has a total area of only 7096 sq. km. and is stretched over 112 kms from North to South and 64 kms from East and West.

Teesta and Rangit, which originates from Tsholamu Lake and Rathong Glacier respectively, are the two major rivers of the State. Sikkim has diverse range of flora and fauna. Owing to its altitudinal gradation, the State has a wide variety of plants, from tropical species to temperate, alpine and tundra ones.

As per Census 2011, Sikkim has a population of 6.11 lakh, an increase of 13% from 5.41 lakhs in 2001 census. About 25.15 percent of the total population live in urban areas and 74.85 percent of the population live in rural areas.

According to the 2011 Census, the number of total workers increased from 263,043 in 2001 to 308,138 in 2011-an increase of 17 per cent. 55 per cent of this increase was in the category of marginal workers. Main workers constitute 38 per cent of the total population and marginal workers constitute 13 per cent of the total population.

The number of cultivators in the State has decreased by more than 10 per cent between 2001 -2011. However, there has been more than 50 per cent increase in the agricultural labourers and over 44 per cent increase in „Other Workers‟.

Economy of Sikkim The Gross State Domestic Product at current prices and at constant prices for the year 2015 – 2016 is Rs. 16,63,678 lakhs and Rs. 13,72,154 lakhs, respectively. At current and constant prices, the Per Capita Income (PCI) GSDP of the State for the year 2015 – 2016 is Rs. 2,59,950 and Rs. 2,14,399 respectively. The contribution of primary sector in GSDP at current prices in 2015-2016 is Rs. 1,60,801 lakhs which constitutes 10.02%. Similarly, the contribution of primary sector in GSDP at constant prices is 7.7% in 2015-2016. At current and constant prices, the GSDP on 2015-16 in the secondary sector is Rs. 8,93,877 lakhs and Rs. 7,76,355 lakhs respectively. Similarly, the tertiary sector contributes 34.28% of GSDP at current prices and 33.7% of GSDP at constant prices. The contribution of tertiary sector in GSDP at both current and constant prices has been increasing positively since 2011-2012.

From the above table, it is evident that the economy of the State has shifted from an agrarian sector to the one based on manufacturing and service sectors. The development into these two sectors can be attributed to high demand for more goods and services. Also, the priority of the government to generate adequate employment has led to establishment of large number of manufacturing units. In order to give a fillip to the economy, there has been a rapid growth of industry in Sikkim.

Existing System of registration of enterprises/establishments In Sikkim, there are 58 Registering Authorities (RAs) registering enterprises/establishments under the following acts: a) Sikkim (Repeal & Miscellaneous provisions) Act 1985, for shops and commercial establishments b) Sikkim Excise Act,1956 c) Micro, Small and Medium Enterprises Development Act 2006 d) Sikkim Khadi & Village Industries Board Act, 1996 e) Sikkim Cooperative Societies Act, 1978 f) Sikkim Regulation of Societies, Associations & Other Voluntary Organizations Act, 2008 g) Companies Act, 1956

The Registering Authorities are located in all four districts of the State. East district has the highest number of RAs with 22 followed by South District, West District and North District with 15, 13 and 8 respectively.

Business Register Business Register (BR) is a register of enterprises and establishments engaged in various economic activities of the State. All companies, organisations and establishments that participate in business activities are registered in the Business Register. It provides detailed information about the establishments in the State.

Preparation of State Business Register As per notification no. 1125/DESM&E dated 03/04/2012, the Chief Secretary has been declared as the ex-officio State Business Registrar and Director General, DESM&E as the Deputy State Business Registrar. At the same time, District Collectors and District Statistics Officers have been declared as District Business Registrar and District Deputy Business Registrar. All the Registering Authorities (RAs) have also been declared as the Business Registration Centres (BRC). Sikkim is one of the first State in the country to issue such notification for preparing BR and the notification is an important landmark not only for Sikkim but also for the entire statistical fraternity.

Basically, a BR is prepared by conducting a census covering the entire State. In the census each and every establishment is covered by visiting their premises. However, this is a tedious, time consuming and costly task which cannot be undertaken on an annual basis.

Developing a BR on an annual basis is a challenging task as there are numerous RAs which are not under the purview and control of DESM&E. Considering this, appropriate orders directing the RAs to incorporate the fields required for preparation of BR and to bind the registering authorities to implement methodologies, processes and technology in order to develop an ecosystem which will lead to the development of a dynamic BR was issued.

In Sikkim, all the establishments are required to renew their licenses on an annual basis. The license issued by a RA is valid till 31st March of a year and the same has to be renewed within 15th of May of the same year.

There are 58 RAs of which 31 are in the rural areas. The registration of the establishments under Sikkim (Repeal & Miscellaneous provisions) Act 1985, for shops and commercial establishments is done by 44 RAs. There are 31 Block Administrative Centers in the State which are also the RAs for this Act.

System adopted i. The RAs/BRCs will generate their respective BRs which will be sent through email or in the event of non-availability of the internet, the same will be collected by the officials of DES. The BR of the State and other statistical data will be generated at DESM&E (CMIS). ii. The data for developing the BR will be collected by the RAs in two stages- during the time of registration and during its subsequent renewal. During the time of registering, the RAs prepare the list of all establishments with details like, name of establishment, type of ownership, address, type of activity, PAN/TAN, telephone number, etc. and during the renewal, information such as changes in the location, number of persons usually working, etc. will be captured.

Goals of the BR System a. To develop an integrated system for development of BR, collation and compilation of information relating to the registered establishment. b. Develop a coherent and consistent system of collection, analysis and dissemination of data within the present structure of a decentralized set of responsibilities. c. Build database and provide easy access to statistical data d. To strengthen the coordination mechanism among the RAs/government departments for sustaining the BR system e. Highlightthe usefulness and relevance of BR f. Reducing administrative burden, time and cost through the creation of electronic data processing system

Uses of Business Register  Business Register helps in establishing business profile for a specific area.  Business Register gives real time information on all aspects of enterprise engaged in various economic activities.  The database will strengthen the State statistical system.  The statistical data will help in developing plans for various management purposes.  It improves efficiency in registration system. Thus, reducing administrative burden, time and cost.

Concept and Methodologies developed by DESM&E for preparation of BR of Sikkim

The preparation of Business Register offers us an opportunity to develop Register which will give us real-time information on all aspects of an enterprise engaged in economic activity. The development of such a system will not only strengthen the State statistical system but will also add value to the enterprise registration system. To achieve the envisaged objective, it is essential to bring about a subtle change in the current system of registration of enterprises.

Appropriate methodologies and strategies were developed to stream line the existing system of issuing trade license in the State. The objective of revamping the system is to bring about uniformity and, to collect and collate information in order to help develop a BR of all the registered enterprises/establishments with details such as location, name, whether operational, etc.

Developing a BR is a challenging task as there are numerous Registering Authorities (RAs) which are not under the purview and control of DESM&E. Considering this, it is important to issue appropriate orders directing the RAs to incorporate BRN and to bind the registering authorities to implement methodologies, processes and technology in order to develop an ecosystem which will lead to the development of a dynamic BR. This entails convincing the higher authorities of the importance and usefulness of the scheme.

Process analysis of issuing trade licenses

A system analysis and study of the present registration system and process of issuing license adopted by different RAs was undertaken by DESM&E and after a thorough study, the following were observed: In the State the Registering Authorities were issuing trade license to undertake business under the following acts. (a) Sikkim (Repeal) & Miscellaneous provisions) Act 1985 for shops and commercial establishments. (b) Micro, Small and Medium Enterprises Development Act 2006 (c) Sikkim State Rule Registration of Document 1930 (d) Sikkim Khadi & Village Industries Board Act, 1996 (e) Sikkim Cooperative Societies Act 1978

(f) Sikkim Regulation of Societies, Associations & Other Voluntary Organizations Act 2008 (g) The Sikkim Excise Act, 1956 (h) Companies Act, 1956

The following were observed with respect to the registering system: (i) There is no centralized system wherein information from all the RAs converge. (ii) All the RAs are operating independently and there is ambiguity in their registration system. (iii) Computer software-based registration is being undertaken in only 3 RAs. No digitization of data is being done. (iv) Minimum information required for developing BR is not captured by the RAs (v) No uniform description system or NIC 2008 is used. The description of activity used by the RAs lack clarity and is not codified (vi) The forms and the trade license (TL) issued by various RAs are different. Some RAs issue one-page trade license while others issue TL in the form of a blue booklet. (vii) Forms issued by the RAs for registration is not uniform and information detailed in the form is not sufficient to develop a good BR (viii) There are over 35 RAs which registers enterprises with respect to Shops and Commercial Act. However, there is no uniformity in their processes. (ix) No system of maintaining the records properly

Based on these findings, the following goals and strategies were developed and were pursued: (i) Issue of relevant notification by Government of Sikkim to recognize the importance of BR and making BRN mandatory. The Chief Secretary has been declared as the ex-officio State Business Registrar and Director General, DESM&E as the Deputy State Business Registrar. At the same time, District Collectors and District Statistics Officers have been declared as District Business Registrar and District Deputy Business Registrar. (ii) Consultation workshops/meetings were held with all the stakeholders to better understand the registration system and develop appropriate strategies for development of BR. 9

(iii) As per our concept and design, the RAs will be the point from where the BRN will be assigned and information for developing BR will be captured during the time of registration and subsequent renewal of the license of the enterprise. (iv) A standard system of applying for trade license and subsequent renewal, was developed. A standard form for applying trade license and „office use form‟ were designed. At the same time, a renewal form hitherto not used by the RAs, has also been designed and integrated in the processing system. The objective of the renewal form is to capture the workforce details and operational aspect of the enterprise/establishment. (v) A „Record Register‟ has also been designed which will record and assign BRN and all other details of the enterprise (vi) Process for implementation of National Industrial Classification (NIC) 2008 has been initiated. For the time being, we have mapped description of activity of different RAs with NIC codes for immediate use. (vii) A codified rural and urban directory was developed to identify and locate the enterprise/establishment. The objective of the directory is to give the location particulars of the villages which is mapped with the district, GPU, Municipal Ward, BRC, census village, pin-code, etc. This directory will be helpful in identifying the location particulars of an enterprise and for generating reports. (viii) Identification and establishment of Business Registration Centers (BRC). All RAs will work as BRCs and Trade License Number will be replaced by BRN. (ix) Sensitization programmes and workshops held in all the districts for developing BR (x) Preliminary study had revealed that many of the enterprises were operating without licenses. The list of these enterprises was provided to the RAs for their registration. (xi) Digitization of registering process of all RAs (xii) Administrative and Technical re-engineering of RAs (xiii) 12 digit BRN: In the present system, RAs issue trade license wherein the Trade License Number (TLN) is mentioned. With a view to institutionalize the BRN, bring about uniformity and for computing purposes, the TLN has been replaced by BRN. We have standardized the system of numbering the enterprise with a 12 digit BRN number which will be assigned as under:

Observations and Findings BR 2016-17:  In Sikkim, there are 58 Authorities engaged in registering of the business establishments, known as BRC. There are 31 BRCs in rural areas and 27 BRCs in urban areas.  There are 22 registering authorities in East district, which is the highest. The second highest number of registering authorities is in South district with 15, which is followed by West and North district with 13 and 8 registering authorities each.

 The number of business establishments in East district is 16,178. 55% of the total business establishments, which is the highest, is found in East district, followed by South district, having 23% of the total establishments, i.e. 6626 nos. In West and North district, there are 17% and 5% of business establishments, respectively. North district has the least number of establishments with 1649, only.  The number of establishments in urban areas is found to be more than rural areas. There are 15251 establishments in urban areas and 14111 in rural areas.

 East district has the highest percentage of establishments both in rural and urban areas with 77% of the total establishments in urban area and 32% of the total establishment in rural area are found.  The number of establishments in the urban and rurual areas of East district are 11668 and 4510 respectively.  Unlike in the East District, the number of establishments in the rural areas of North, West and South Districts are more than in the urban areas.  In rural areas of North, West and South district, there are 1020; 4422 and 4159 establishments respectively, whereas the number of establishments in urban areas of North, West and South district are 629;487 and 2467 respectively.  In West district, 90% of the establishments is in rural area and remaining 10% in urban area. The district has the least percent of establishments in the urban areas.  In North district, 62% of the establishment is in the rural areas and 38% in the urban areas. The least percentage of establishments in rural areas is found in East district.

 The highest number of registration of business establishments in the State is in Gangtok Municipal Corporation, East district (9229).  In North district, 584 establishments were registered in Mangan Nagar Panchayat, which is the highest in the district.  In South district and West district, Namchi Nagar Palika and Soreng Block Administrative Centre are the RAs where highest number of establsishments are registered with 1320 and 686 respectively.  The number of establishments registered under Companies Act, Shops and Commercial establishment Act, Societies Registration

Act, Cooperative Societies Act, Khadi and Village Industries Act and Directorate of Industries Act is highest in East district.  In Sikkim, 25841 number of establishments is registered under Shops and Commercial establishment Act (88%), followed by Cooperative Societies Act with 3383 establishments (11%).  14926 number of establishments in East district are registered under Shops and Commercial establishment Act of the State. Similarly, in South and West district, 5648 and 3854 establishments respectively, are registered under this act. The least number of establishments registered under this act is in North Sikkim with 1413.  It is also observed that a number of enterprises are registered under multiple acts. In such cases, priority has been given to Shops and Commercial establishment Act.  Factories Act has not been implemented in Sikkim. The digitization of list of establishments was not completed by Law Department during the prepration of the report. Thus, the number of establishments registered under Companies Act is under reported.

 3 digit NIC 2008 code has been assigned to the economic activities of the State.  30.85% of the establishments (9057) are engaged in the retail sale of tobacco, food and beverages. In the rural areas there are 5688 such establishments and the figure for urban areas of the State is 3369.

 As per the information provided by the RAs, 54275 persons are employed in the establishments. In the rural areas, 28375 are employed and in urban areas, the figure is estimated at 25900.  By type of ownership, 51.73% of the establishment are owned by proprietors (15190), 34.74 % are owned by others (10201) and 11.54% are owned by co-operatives (3388).

 As per BR 2016-17, there are 4,204 establishments registered with RAs, who have reported their activity as Hotels, lodges, homestays, restaurants, tea stalls and fast-food. Out of this, 1,341 are hotels, lodges and homestays and the remaining 2,863 are restaurants, fast-food, tea stalls and the like.  There are 468 registered travel agencies as per BR 2016-17.
