(i) The Local Planning Authority considers that the exceedingly high density of this scheme is an over- intensification of residential development on this edge of settlement site, that would be out of character with adjoining residential development that is under construction, and would exacerbate existing infrastructure capacity problems in North Cornelly.

(ii) The design of the development would lend itself to crime and anti-social behaviour and would therefore fail to promote a safe and sustainable community.

553 TOWN AND COUNTRY PLANNING ACT 1990 SECTION 106 AGREEMENTS

RESOLVED: (1) That having regard to the following application the applicant enters into a Section 106 Agreement, to

(i) Prior to the occupation of the 15 th dwelling on the site, identify, in conjunction with the Principal Housing Officer 5 properties to be provided as Affordable Housing, to be marketed at 30% below market value and to be retained as affordable housing units in perpetuity.

(ii) Prior to the occupation of the 30 th dwelling provide the 5 properties identified for Affordable Housing, to be marketed at 30% below market value and to be retained as affordable housing units in perpetuity.

Such improvements shall consist of high friction red carriageway surfacing, bilingual ‘Slow’ roadmarkings, associated signing and pedestrian facilities including a refuge on the Classified route A4061.

(3) That having regard to the following application, the applicant enters into a Section 106 Agreement, to

(i) Provide a contribution of £20,000 toward the provision/upgrade of an existing play area within the community of Evanstown.

(ii) Provide Affordable Housing in the form of 2 (two bedroomed properties) and 1 (3 bedroomed property) to be marketed at 30% below market value and to be retained as affordable housing units in perpetuity.

21. No lorries shall enter or leave the site during the periods of half hour either side of the times of school commencing and ending.

Notwithstanding the submitted drawings, no works shall commence on site until full engineering details in respect of the bus gate / bus control facility to be located on Road 3 – 9, near Heol Spencer, comprising layout details, including the 3.65m bus only restriction 10 metres in length, with 20 metre lengths of carriageway to a width of 6.5 metres either end of the restriction, platform details, green tarmac surfacing and associated bus only markings, construction details, bus camera and housing facility, longitudinal and cross sections, street lighting, surface water drainage, markings,

15. No works shall commence on site until such time as a detailed design for the proposed attenuation areas and the storm cell including full engineering details duly certified by a professional Engineer, including the inlet and outlet arrangements and the control device, have been submitted to and agreed in writing by the Local Planning Authority. The hydraulic calculations submitted in support of the design shall qualify that the proposed attentuation surface water storage systems limit the surface water discharge to the flows quoted in condition 4. The surface water storage facilities incorporating the agreed engineering details shall be completed in accordance with a programme that coincides with the remainder of the works that are the subject of this planning permission.

Reason : To ensure safe drainage of the highway together with the site and to guard against flooding.
