But the 19 only deception here is in the Complaint. Fox’s opinion hosts have never described the Coronavirus 20 as a “hoax” or a “conspiracy,” but instead used those terms to comment on efforts to exploit the 21 pandemic for political points. Regardless, the claims here are frivolous because the statements at 22 issue are core political speech on matters of public concern. The First Amendment does not permit 23 censoring this type of speech based on the theory that it is “false” or “outrageous.” Nor does the law 24 of the State of Washington.
