Maryland Medicaid Tobacco Cessation Coverage
Maryland Medicaid Tobacco Cessation Coverage Why should standard Medicaid cover tobacco cessation? The Medicaid population smokes at a rate almost two and a half times higher than the private insurance population (23.9 percent vs. 10.5 percent)1. This high smoking rate not only leads to disease and premature death, but also costs the Medicaid program approximately $39.6 billion per year. That makes up nearly 15 percent of all annual Medicaid spending2. Investments to reduce smoking among the Medicaid population can lead to reductions in general healthcare costs and short-run Medicaid costs. Tobacco cessation can also save state Medicaid programs money over the long term. Comprehensive Recent research suggests that if just 1 percent of current smokers in Cessation Benefit: Maryland quit smoking, the state would save $53.6 million in Medicaid costs the following year3. Seven Medications: The seven medications and two forms of counseling discussed in the MMWR NRT Gum (OTC*) are proven effective tobacco cessation treatments. Improving access to these NRT Patch (OTC) NRT Lozenge (OTC) treatments can encourage more beneficiaries to quit smoking, which would NRT Inhaler result in substantial savings for the state. The corresponding Board of Health regulation was introduced on October 1, 2019. A public hearing was held on November 5 on this bill, ZTA 19-06, Vape Shops, along with related Bills 29-19 and 32-19 and their companion resolutions adopting each Bill as a Board of Health regulation. Bill 31-19 and the Regulation would prohibit the distribution of any tobacco product, coupon redeemable for a tobacco product, cigarette rolling paper, or electronic cigarette to any individual under 21 except under certain circumstances. It would also prohibit an individual under 21 from using or possessing a tobacco product or electronic cigarette except under certain circumstances. Public Hearing/Correspondence The Council held a public hearing on November 5 on Bill 31-19 and its companion regulation as well as related Bills 29-19 and 32-19 and ZTA 19-06. It was a joint hearing and most written testimony submitted on these bills is attached to the staff report of Bill 29- I 9.

What is the Tobacco Settlement? In the mid 1990s, many states sued cigarette companies like Philip Morris and R.J. Reynolds for deceptive practices in making and marketing cigarettes. Some of these practices included deliberately making cigarettes more addictive and deadly while intentionally misrepresenting the risks. The states sought court orders modifying the companies' marketing practices and money damages to pay for increased medical costs caused by tobacco-related diseases. In 1998, the companies and states entered into a comprehensive settlement of all these claims, requiring the companies to change their marketing practices and pay billions of dollars to the states over time. This settlement is called the Tobacco Master Settlement Agreement. Since 1998, many other tobacco companies have joined the Master Settlement Agreement. They voluntarily agreed to the settlement's marketing restrictions and obligation to make ongoing payments. Some cigarette companies have not joined the settlement, but are obligated to comply with state laws that have some similar provisions. How are the settlement payments calculated? The annual settlement payments are based on the total volume of cigarettes sold in the United States, as determined by the number of cigarettes subject to the federal government's cigarette excise tax. Therefore, if the companies sell fewer cigarettes, their annual settlement payments decrease. The payments may also decrease if the companies that settled lose significant market share to cigarette companies that did not settle. However, the payments are adjusted upward for inflation at a rate not lower than 3% compounded annually. If inflation is over 3%, the inflation adjustment matches the overall inflation rate.

Results: Compared to plain packaging or a brand logo, packages with full branding were considered more ap- pealing and more likely to be youth-oriented (p < 0.001). State and Local Policy Options Electronic Smoking Devices Electronic Smoking Devices (“ESDs”) are battery operated devices designed to heat a liquid nicotine solution to the point of vapor in order to deliver vapor the user for inhalation, mimicking the act of smoking. ESDs first began appearing widely in the United States in about 2006, and use and availability have significantly increased since.1 ESD sales have doubled every year since 2008, and are projected to approach $2 billion in 2013.2 At the same time, the Centers for Disease Control and Prevention (“CDC”) reported that ESD use among students in grades 6-12 more than doubled between 2011 and 2012 – the first years for which data is available – to an estimated 1.8 million students.3 These trends are concerning due to unanswered questions about the health risks arising from ESD use, including both negative health risks resulting from inhaling ESD vapor and broader negative health consequences at the population level. With respect to individual negative biological risks from inhaling vapor, studies have indicated that ESDs cause airway constriction in users and that inhaled and exhaled aerosol contain a number of the same carcinogens found in cigarettes.4 At the population level, ESDs complicate enforcement of existing prohibitions on smoking indoors, diminish those prohibitions’ secondary impact of cessation of tobacco use, and impede progress in social norm change related to smoking.5 These concerning trends are compounded by a lack of accurate data on ESDs due to their short time on the market and the lack of any meaningful quality control or product standards.
