MILES and GRIFFIN PALMER RUIDOSO, N.M. — At 2:11 p.m., as two ambulances waited with motors running, 10 horses burst from the starting gate at Ruidoso Downs Race Track 6,900 feet up in New Mexico’s Sacramento Mountains. Nineteen seconds later, under a brilliant blue sky, a national champion jockey named Jacky Martin lay sprawled in the furrowed dirt just past the finish line, paralyzed, his neck broken in three places. On the ground next to him, his frightened horse, leg broken and chest heaving, was minutes away from being euthanized on the track. For finishing fourth on this early September day last year, Jacky Martin got about $60 and possibly a lifetime tethered to a respirator. The next day, it nearly happened again. At virtually the same spot, another horse broke a front leg, pitching his rider headfirst into the ground. The jockey escaped serious injury, but not the 2-year-old horse, Teller All Gone. He was euthanized, and then dumped near an old toilet in a junkyard a short walk from where he had been sold at auction the previous year. In the next 24 hours, two fearful jockeys refused their assigned mounts. The track honored two other riders who had died racing. As doctors fought to save Mr. Martin’s life, a sign went up next to the track tote board: “Hang in there, Jacky. We love you.” On average, 24 horses die each week at racetracks across America.

The obvious choice seemed to be Unbridled’s Song, who had begun his stud career brilliantly, with Breeders’ Cup Distaff winner Unbridled Elaine, Grade 1 winner Songandaprayer, and multiple Grade 2 winner Even the Score in his first crop and Grade 1 winner Buddha in his second. As recently as the middle of last year, however, the investment the breeding industry made in sons of Unbridled’s Song looked like an expensive wager gone very wrong, since Even the Score, the sire of Dullahan and Take the Points, was his only son to have sired a Grade 1 winner.     Online at www.michbar.org/aglaw Transgressing Trainers and Enhanced Equines: Drug Use in Racehorses, Difficulty Assigning Responsibility and the Need for a National Racing Commission By Kjirsten Lee Introduction From Saratoga Race Track in New York State to Santa Anita Park in California, and from Canterbury Downs in Minnesota to Gulfstream Park in Florida, horse racing spans the United States and has always been a part of American culture.1 It is known as “the sport of kings,”2 and millions of dollars change hands every year chasing “1,200-pound investment vehicles running on legs more slender than the average human’s.”3 Tragically, the sport has been tainted by the use of steroids and painkilling drugs, the administration of which masks injury and creates an unfair advantage by allowing horses to race that are not physically up to the challenge.4 Genetically built for speed, over time the Thoroughbred horse has been bred to be faster, with little concern for what might be sacrificed in return. Recently, the American general public has become more aware of the sacrifices breeders make as horses in prestigious races break down on the track.5 In 2006, Americans’ hearts stopped in their chests when Barbaro shattered his leg in the Preakness Stakes, the second jewel of racing’s illustrious Triple Crown.     The Legacy and Traditions of Churchill Downs and the Kentucky Derby The Kentucky Derby The Kentucky Derby has taken place annually in Louis- ville, Kentucky since 1875. It was started by Meriwether Lewis Clark, Jr. at his track he called Churchill Downs, and it has run continuously since that first race. This first jewel of the Triple Crown has produced famous winners, with thirteen of these winners gaining that Triple Crown title. Lewis limited the Derby to only 3-year old horses. The race has evolved and grown over time and has changed since its first running, remaining an important event for more than a century. Friedman* In May 2008, a horse named Big Brown won the Kentucky Derby, narrowly beating a filly named Eight Belles. Just as Eight Belles crossed the finish line, she collapsed and was put to her death in front of millions of viewers as a result of her two broken legs. As the world tried to make sense of the trag- edy, the prominent trainer of Big Brown casually announced that he admin- istered anabolic steroids before the race to enhance Big Brown’s performance and that he would continue to give steroids before every other race for the same reason. Thus, the issue of anabolic steroids in horse rac- ing, which had previously been confined to discussions among those in- volved in the industry, was thrust onto the national spectrum. While the use of anabolic steroids is a relatively new issue, since the death of Eight Belles thirty-two of the thirty-six racing states have passed some regu- lation of the use of anabolic steroids in racing. This Article provides an over- view of those anabolic steroid regulations in the context of the history of regulation in Thoroughbred horse racing. This Article concludes that while the current limitation on the effectiveness of anabolic steroid regulation is a lack of research and accurate laboratory testing, using a pervasive federal law might be the most effective way of ending the use of anabolic steroids in horse racing.
